Yes,this plat is ready for County signature.The Zoning Division and County Attorney's office determined that the revised
Note B is sufficient.
That said, I will share that this request generated some significant questions/discussion and I would like to provide the
following information:
1. Although this is a composite plat, we would consider this application to be a "boundary line adjustment" and
therefore also a "subdivision" as those terms are defined in Chapter 14.
2. As a result,the bounds of a combined lot may be considered a proposed lot line. Although the verification of
existing structures under Section 312 has not always been a requirement in the past,the Subdivision Agent may
require it if that information is needed to confirm compliance.
I'm sharing this information because I think that you, Brian and/or Roger would be interested in general, but especially
interested for the purposes of estimating the time/work required for different future proposals.
Please coordinate the signature process with Cameron Langille (ext. 3432) because I will be out of the office until
January 3rd

Thanks for your comments on the Sage Homes plat combining the parcels.
Please find attached a pdf copy of the revised plat.
I have revised the land use note B to state that the 2.17+/- acres may not be further divided according
to the current zoning ordinance.
We have been informed by the County Zoning Administrator that development rights are a zoning
entity and can not be done away with.
This is a Composite Plat combining the parcels not an actual Boundary Line Adjustment.
We are not creating any new boundary lines or creating any setback violations.
We do not perform field work for plats combining existing parcels of record.
Verifying the location of existing structures has not been a requirement in the past for approval of
combining parcels.
Once you have had a chance to review the revised plat, please let me know when it is ready for
owners notarized signatures.

Here are comments for this application:
1. Section 14-302(A)(10) and Section 6.4(B)- The existing parcels 103D and 103G are non-conforming lots with
respect to acreage.Therefore, please revise Note A to read: "After combining these parcels into one parcel,
the 2.17+/-acre parcel will have one development right and may not be further divided."
2. Section 14-312—The boundary of the combined lot is considered a proposed lot line. It looks like the
building at the rear of the lot may not meet the six-foot setback for an accessory structure.Can you please
confirm this structure meets the required setback?

I think you have all of the information you need with regard to the development right question/discussion from the
Legal Meeting yesterday, but I'm forwarding this information just in case you don't.
Right now, we're planning to request that Note B on the revised plat(attached) be further revised to read: "...the 2.17
+/-acre parcel shall have one development right and may not be further divided."
