Attached is the action letter for the above ref project.Additionally, attached is an email from Zoning clarifying the gym
addition time frame for validity. Please see that the school receives the Zoning email clarification to assure they are
brought into the loop on the findings on that issue post SRC.

I just wanted to report the conclusion of my discussion and findings with legal about the time limit on commencing a
special use to validate a special use permit. In the case of Tandem Friends gym and middle school there is no limit on
when they have to commence, because no such limit was made a condition of the SP by the BOS.
Both of these SPs were approved after the 2012 changes to the SP regulations that now require a limit to be made a
condition of the SP. Without a limit as a condition, a SP does not expire. As you know, prior to the changes SPs needed
to commence within 24 months of BOS approval.

SDP2016-73 Tandem Friends Middle School Expansion — Initial Site Plan
At SRC today the applicant and members of the private school's board wanted to discuss the validity of
SP2013-19 (for the gym addition which was approved on 7-9-14), as I suggested they include the proposed gym
expansion on the above ref initial site plan currently being reviewed. After some discussion they do not plan to
include it in this site plan for the middle school be they do not have a design for the gym addition yet. They said
they don't plan on dealing with the design or site planning for that improvement for 5 years or so. Thus the
Question is, when must the improvements approved by SP2013-19 commence? I pulled the SP file and
reviewed the approval letter, which does not list a timeframe that these improvements must commence by. From
my work on SPs, I recall the standard is 24 months but wonder if maybe it was omitted be it was a private
school, in an effort to give them time to gain additional funding etc. The staff report does not speak to this. I am
looking for Zoning to make a determination as to when the gym must commence b4 the SP expires so I can
respond to the applicant.
The second part of this question, which may affect how you answer that question has to do with SP2015-21
Tandem Friends School — middle school expansion that was approved on 1-6-2016. The approved concept
plan for this SP depicts and provides notes for the improvements from SP2013-19. Because the school has a site
plan in our office for the specific improvements approved under SP2015-21 by commencing this work does that
then mean they have also begun the work which was originally approved w/ SP2013-19? Notably the approval
letter for SP2015-21 does not have a timeframe for the project to commence by either.
On a side note the above referenced SRC item must have an action taken on it by Feb Z unless the applicant
requests a deferral. Answers to the above items may have an effect on how the applicant decides to proceed
with the SRC item.
I'll bring the SP files downstairs for you to review and the SRC site plan currently under review. If you want to
