The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above
once the following comments have been addressed: [Each comment is preceded by the applicable reference,
which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14-302(A)(10)] Right offurther division. The development rights (DR) noted on the plat are incorrect.
The total development rights allocated in 1980 to these parcels were: 1 DR for TMP 80-61C (originally
at 3.7 acres) and 2 DR for TMP 80-61B (4.9 acres).
With the current proposal the development rights note should read: "TMP 80-61B is retaining I
development right and may not be further divided. TMP 80-61 C is retaining I development right and
may not be further divided. "
However, if you increase the acreage of Parcel B from TMP 80-61B to a minimum of 2 acres then the
2nd DR originating from the original 1980 TMP boundaries of TMP 80-641B will be preserved but may
only be utilized for a theoretical future division within the 1980 boundary. If this is your client's intent,
revise the boundary lines discussed above to obtain the 2 acre min for parcel B and revise the
development rights note as follows: "TMP 80-61B is retaining 1 development right and may not be
further divided. TMP 80-61C is assigned 2 development rights and may be further divided, when further
divided the development rights must be used within the limits of the 1980 boundary of their parcel of
origin .
2. [14-303(E)] Shared Driveway. Revise the label of the new 30' access easement to `New 30' shared
driveway easement. " Also, label the easement holder(s) on the plat. Also, provide the following note:
"The maintenance of the shared driveway easement shall be by the owners of the lots affected by the
shared driveway easement, not by the Virginia Department of Transportation or the county. "
3. [14-317] Instrument evidencing maintenance of certain improvements. Prior to County approval submit
a maintenance agreement for the easement. Attached is a template provided by the County Attorney's
office. Once drafted please submit it to me for preliminary review prior to my forwarding it to the
County Attorney's office for review/ approval.
4. [14-302(B)(1)] General Information. Provide the date of the last revision.
5. [Recommendation] While outside of the purview of this BLA review, it is recommended that the
applicant assure that the existing drainfield for the addressed structure 2417 remains on TMP 80-61B, as
it is not permitted to be located on any other property than that of the primary structure.
Staff has provided references to the County Code. The Code is kept up-to-date by the County Attorney's office
and may be found at www.albemarle.org/countycode. In accord with the provisions of Section 14-229(B) of
Chapter 14, if the applicant fails to submit a revised plat to address all of the requirements within six (6) months
after the date of this letter, then the application shall be deemed voluntarily withdrawn. Please contact
