The basis for this determination follows. The Albemarle County Real Estate Assessment records indicate Parcel ID 08400-00-00-03000 contains 33.98 acres and zero (0) dwellings, Parcel ID 08400-00-00-030A0 contains 71.06 acres and zero (0) dwellings, Parcel ID 08400-00-00-03200 contains 97.96 acres and zero (0) dwellings and Parcel ID 08400-00-00-03900 contains 88.55 acres and one (1) dwelling. The properties are zoned RA, Rural Areas. The most recent deed for Parcel ID 08400-00-00-03000, recorded prior to December 10, 1980, the date of adoption of the Zoning Ordinance is recorded in Deed Book 673 page 321 dated June 12, 1979. The most recent deed for Parcel ID 08400-00-00-030A0, recorded prior to December 10, 1980, the date of adoption of the Zoning Ordinance is recorded in Deed Book 673 page 321 dated June 12, 1979. The previous deeds show no deviation from the original 76.5 acre accept an addition of .132 acres near Route 691. By taking the 76.5 acres (this is Parcel 32) from the 173.55 acre aggregate on the plat in this deed it is approximated that the remaining portion of the area would be 97.05 acres (This would be Parcel 30, but 30 is made up of 2 parcels of record that this plat does not account for). 98.96 That said the plat recorded with DB 1517 P 265 describes surveyed + portions of Parcels 30 and 32. These development rights are theoretical in nature but do represent the maximum number of lots containing less than twenty one acres allowed to be created by right. If you are aggrieved by this determination, you have a right to appeal it within thirty (30) days of this notice, in accordance with Virginia Code § 15.2-2311. If you do not file a timely appeal, this determination shall be final and unappealable. An appeal may be taken only by filing an appeal application with the Zoning Administrator and the Board of Zoning Appeals, in accordance with Chapter 18, Section 34.3 of the Albemarle County Code, along with a fee of $258 plus the actual cost of advertising the appeal for public hearing.
