I've researched your question. There is no waiver/modification process for Section 4.16.1 requirements. I spoke with
senior staff and what you need to do is take that remaining acreage need to meet the 16,000 SF(16,000 SF-2,000 SF (tot
lot 1)—2,000 SF(tot lot 2)= 12,000 SF additional area to makeup). Label and depict the limits of this 12,000 SF area on
the final site plan as "12,000 SF Common Area to meet recreational requirements of Section 4.16.1". Below I offer the
sections we are utilizing to reach this conclusion/guidance.
4.16.1 Minimum Area. A minimum of two hundred(200) square feet per unit of recreational area shall be provided in
common area or open space on the site,this requirement not to exceed five (5)percent of the gross site area. The
commission shall consider the appropriateness of such area for the intended purpose,using the following guidelines: 1.
Slope in active recreation areas shall not exceed ten(10)percent. Slope and drainage shall be approved by the county
engineer; 2.The size and shape of each recreation area shall be adequate for the intended use; 3. Groundcover shall
consist of turf grass or contained mulch such as pine bark, shredded tires, or pea gravel;4. Existing wooded or steep areas
may qualify as passive recreation area provided Ori

Chris,
After looking at it we will need to apply for a waiver for the open space requirement. Due to the Virginia Housing
Development Authority we will have to meet the ADA requirements of the trail going up to the 10%open space area
which just will not work. Even worse is that the VHDA requirements also require any recreation areas to be 5%or
less. Do to the constraints of site there is not a possible way to get a large 5%area anywhere. A lot of effort has been
made to fit the 4,000 sf of tot lots, the 2,100 sf recreation center, and the very extensive sidewalk/ramp system down
to the road as well as consideration for connecting the sidewalks to adjacent Sherwood Manor. Unfortunately this site is
not ideal for more open space due to preserved open space areas and existing grades and we have maximized grades
across the entire thing to meet VHDA requirements.
Could you please provide me with what is required to apply for a waiver? Unfortunately we are out of options. I really
do not understand why this did not come up during the Pre-application meeting which I am starting to question the
helpfulness of that. During the pre-application she did comment we needed the tot lots which we added, but nowhere
did she mention the 16,000sf open space meeting 10%slopes.

Chris,
Do you have a status of what we can do for the open space requirement?
As you said you have 4,000 sf required for tot lots but outside of that you just have about 40,000sf of areas that are 10%
or less slope.
1. If you look at the '10%or less areas' PDF then you will see a hatch area showing you these areas. The issue with
these areas is some will have planting bed areas and some are oddly shaped or very linear so I am not sure if
they meet your intended use. This solution will not meet the intent.
2. Another thought was PDF'Rear Lot Area 10%or less'that has a 20,000 sf area in the existing woods and we
could do a trail to it. The issue with this is safety and visibility to the apartments.
I believe this is the option you should pursue.
3. The last thought is PDF'Trail' where we try to cut in a trail through the central open space area. The issue with
this is that it may not end up equaling exactly 12,000 sf(add the tot lots and you have 16,000) and the slopes are
not 10%or less.That's a problem. The trail itself would need to be ADA so less than 5%with less than 2%cross
slope, but the surrounding areas would be 3H:1V. If engineering is ok with it we can incorporate the BMPs into
the Open Space since it will be fescue grass with trees, flat, and very well drained.
Also,did anything change from the SRC meeting or it the letter we have an official comment/approval letter?Yes,
VDOT added a comment and Planning's comment#1 has been rectified. All others were the same,see attached action
letter.
Also, we have examined the culvert going under Old Lynchburg Rd and VDOT does not have any information on this as
far as design. Do you all have any plans or maybe Sherwood Manor plans would have something on this?
I can look in Countyview(records management data base)for you and get w/ Paul Bjornsen our records management
person to pull the plans for you to review in the office.

• Sheet C4: Shift the proposed water main along the entrance road to the edge of the
entrance road. The ACSA should be able to excavate this water main in the future without
impacting the entrance to the site.
• Sheet C4: Building #1 water meter should be a 1" connection and setter.
• Sheet C4: Add notes that all water meters are to be sized by the ACSA.
• Sheet C4: CO2 shall not be located over the proposed water main.
• Sheet C4: Ensure proposed easements extend 10' off all side of proposed fire hydrants
and water meters vaults.
• Sheet C12: The sewer upgrades proposed by 5th Street Place (currently under review)will
address sewer capacity issues for both developments, but will not address the lower

at a lower elevation so the required invert can be achieved.

All,
Nice meeting you today in person.Attached are the sections that were part of the applicants ARB packet. Evidently, the
exact section from your neighborhood were not part of this because the purpose of these sections were to view it from
the Interstate as that is the Entrance Corridor street, and the only street the County can mandate visual impacts for this
type of development.
But as you can tell from the sections the applicant is going down in elevation from the property line rather than up.

I received 10 questions from the adjacent neighborhood late yesterday. I was told to expect some concerned residents at
the SRC meeting today. I would like you to be prepared to respond to questions 6-10(attached and provided below). If
you do not know all the answers to these questions,Kenny may be a great resource. It may be pertinent to ask Frank to
attend the meeting with you as I want to assure we can calm down any neighboring citizens,as this is our 1"official
interaction with the adjacent neighborhood.It's 7:40am and I'm off to visit the site to assure I can honestly respond to the
citizens with a "yes, I have put eyes on the property. "SRC starts at 10am. Thanks for your help.
When does the clearing start? Clearing can start once the Land Disturbance permit is issued.VSMP permit was received
on Jan 20 and we expect to issue comments within the next two weeks. What is the estimated date of completion?This is
a question for the landowner.
Is there going to be blasting or burning?This is another question for the landowner. Separate permits are required for
these activities; however, considering the site proximity to I-64, I don't think burning would be permitted.
What is the plan to control the trash, construction debris and other items that blow around construction sites?Dumpsters
should be covered to contain debris. The County ESC inspector will work with the contractor to control debris.
What about the run-off from the Woodlands and the run-off to the lower part of Sherwood?The VSMP application was
received last week so we haven't been able to review this yet. Are there specific concerns you would like to share?
Who do we contact when things don't go right(construction debris,mudslide,tree falls over, etc.)? Suggest having a
Sherwood representative as a point of contact. County ESC inspector(TBD).

I saw on the SRT Submittals for 12/27/16 that there is a site plan proposed,SDP201600074 Timberland Park Apartments,
adjacent to our County(Revenue Share) sidewalk/pedestrian improvement project along Old Lynchburg Road. Our
project will repave the asphalt path (built by VDOT when they realigned Old Lynchburg Road with the 5th Street
Extension project)and provide pedestrian crossings and signage. I've attached one of my drawing sheets for your
reference. As you review the Timberland Park Apartments site plan I ask that you please consider the following:
• The site plan inaccurately shows the Sherwood Manor Common Area extending to the center of Old Lynchburg
Road. The Sherwood Manor subdivision plat dedicated right-of-way along Old Lynchburg Road prior to its
realignment with the VDOT 5th Street Extension project. Refer to the attached Site Plan Markup and copy of the
Sherwood Manor plat. I believe the dedicated width was 35'from the centerline, but the recorded plat is difficult to
read. I'm certain a more legible copy can be found in CDD's subdivision files or Engineering's archive.
• The County project will rebuild the ADA ramp at Doncaster Lane to bring it up to current standards. Since the offsite
right-of-way exists, please require the developer to extend their curb&gutter and sidewalk to complete the
pedestrian improvements to Doncaster Lane.
As a side note I should mention that I noticed a discrepancy between the Timberland Park parcels existing RW line and
that shown on VDOT's realignment plans. I researched the recorded deeds/plats and the acquisition limits shown on the
1-64 construction plans. The existing RW shown on the Timberland Park parcel appears accurate, so I'll revise my
sidewalk project plans accordingly.
