There is also the possibility that it could be considered a deck which is permitted to encroach by up to 4' (giving us a 21' setback). Rebecca, I know this is a super quick turnaround request but we do have a bunch of volunteers that would like to come out saturday to get started on these projects. Do you think you could catch up with Ron this afternoon? I really do feel that a treehouse is much closer aligned with a trail than a primary structure as the purpose of this facility is really just to give kids in wheelchairs the opportunity to see the creek since they can't get down there otherwise. Its sort of an elevated trail that happens to be centered around a tree. However, the exemption does not allow for the cutting down of trees within the buffer. A building permit will be needed for the structure. Frank Frank V. [mailto:lustin@shimp-engineering.com] Sent: Monday, January 30, 2017 9:44 AM To: Frank Pohl <fpohl@albemarle.org> Subject: Quick Stream Buffer Question Hello Frank, A quick, but perhaps unusual question for you: I'm working with the Wildrock day camp up on Blackwells Hollow Road on getting the camp up and running. We have an approved SP/SDP/WPO/etc and are under construction and a question has come up on what are allowable encroachment into the stream buffer may be. We have some volunteers who have offered to construct a wheel chair accessible tree house so that kids with mobility issues can see the stream which runs across the front of the property. The issue we have is that the only tree that we can get to off the accessible path is in the stream buffer and also practically we need to be in the buffer to get a view of the stream. Looking at the WPO ordinance: Sec. 17-603 Types of structures, improvements and activities authorized in a stream buffer. If otherwise authorized by the applicable regulations of the Zoning Ordinance, the following types of structures, control measures and activities shall be allowed in a stream buffer, provided that the requirements of this section are satisfied.• C. Water -dependent facilities and miscellaneous uses. Water - dependent facilities; water wells; passive recreation access, such as pedestrian trails and bicycle paths; historic preservation; archaeological activities; provided that all applicable Federal, State and local permits are obtained. I've attached a sketch of the tree house so you can get the idea. It will basically ramp up and be built around the tree. Seems to me like this would qualify as a passive rec/trail type of use but since its a structure of sorts I thought we should get some clarification. Its pretty much the same thing as a wooden bridge that might cross over a stream it just stops short and provides a viewing platform. I've also attached a sketch of the proposed location. We have a crew of volunteers eagerly waiting to do this, any clarification you could provide would be most appreciated. Thanks! Justin Shimp, P.E. 434-953-6116
