County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to
act on any VSMP permit by issuing a project approval or denial. This project is denied. The
rationale is given in the comments below. The application may be resubmitted for approval if all
of the items below are satisfactorily addressed. The VSMP application content requirements can
be found in County Code section 17-401.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must
contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary.
1. Please provide a signed registration statement (section 1) and signed certification (section 9).
2. Insert an I Ix17 sheet of your pollution prevention plan in section 6.
3. Provide template for inspection logs (section 12).
4. Provide the name of the person holding a certificate of competence who will be in charge of and
responsible for carrying out the land disturbing activity once a contractor is selected. A Land
Disturbance Permit cannot be issued until this information is provided.
B. Pollution Prevention Plan (PPP)
The PPP content requirements can be found in County Code section 17-404.
1. No objections. Be sure to insert into the SWPPP.
C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a
SWMP. This plan is disapproved, and the reasons are provided in the comments below. The
stormwater management plan content requirements can be found in County Code section 17-403.
1. Please combine the Erosion Control Plan and the SWM Plan into one plan set. That plan should
have the WP0201700022 number on it and have the title "VSMP Plan".
2. Nutrient credits must be purchased before plan can be approved. Contact Ana Kilmer before
credits are purchased.
3. Review the area of disturbance. Grading and disturbance appears to go outside the limits at the

Greenbrier Dr. entrance and at the corner of Greenbrier Dr. & Westfield Rd. If disturbance during
construction goes beyond the permitted limits, a stop work order may be issued until a DEQ permit
is issued.
4. Information on Sheet C-405 was cut off. Please review the sheet layout and ensure all information
is legible.
5. Ensure that all critical slopes and existing easements are shown on the plan.
6. Please provide the soil types (including their hydrologic soil groups) on the plan.
7. Provide permanent rip -rap design information for inlet of structure 8B-1 (or provide a paved flume
or other measure to prevent erosion).
8. Provide a map showing the impervious area and managed turf area within the disturbed area used
for the water quality calculations.
9. Provide the state -storage calculations/routings for the SWM pond as well as the emergency
spillway design.
10. Provide a detail for the proposed retaining wall in the SWM pond.
11. Label the easement around the SWM pond, "SWM facility easement". This will need a SWM
maintenance agreement as well as a deed/plat. Contract Ana Kilmer for the SWM agreement.
12. Storm pipe from 5A to 5 is labeled as sanitary. Also, the pipe from 5A to 5 is labeled as 15" in the
detail, but 18" in the profile and the storm pipe calculations have a 113 and 8D1. These appear to
be mis-labeled. Please review and revise.
13. Label the strength class of the proposed storm pipes on the profile. Also, ensure that all utility
crossings are shown.
14. Provide a map showing the drainage to each storm structure.
15. Storm pipe from 8B 1 to 8B must be in a drainage easement since it is carrying offsite water.
16. VDOT approval/permit required for work in the right-of-way.
D. Erosion and Sediment Control Plan (ESCP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP.
This plan is disapproved, and the reasons are provided in the comments below. The erosion control
plan content requirements can be found in County Code section 17-402.
1. Ensure that temporary seeding, permanent seeding and dust control are shown on the erosion
control plan.
2. Provide calculation or drainage area showing that the requirements of section 3.05 of the VESCH
(Virginia Erosion & Sediment Control Handbook) for silt fence are met (no more than one quarter
acre drainage per 100 ft of silt fence).
3. Provide silt fence around the waste disposal area.
4. There are details for diversion dikes, outlet protection and sediment traps on Sheet C-803, but they
are not shown on the erosion control plan. Please remove if they do not apply to this plan.
5. Was the area for SWM-1 intended to be a sediment trap during construction? If so, please provide
the design per the VESCH spec 3.13. If not, please show how structure 5A will be protected from
sediment -laden water leaving the site.
6. Please provide an inlet protection detail.
7. Per the Albemarle County Design Standards Manual, Section 8, please add a note that proposed
slopes steeper than 3:1 must be stabilized with low maintenance (not grass) ground cover. Provide
a schedule for the type of ground cover indicating type, size, number, etc. This shall be noted on
the ESC plans.
8. Please provide a right-of-way diversion (VESCH spec 3.11) for the entrance at Greenbrier Dr.
9. Suggest tree protection on the northeast side of the site. The demolition plan shows some trees
removed and some saved.

The VSMP permit application and all plans may be resubmitted for approval when all comments have
been satisfactorily addressed. For re -submittals please provide 2 copies of the complete permit package
with a completed application form.
Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to
discuss this review.
Process;
After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate
request form and fee to the Department of Community Development. One of the plan reviewers will
prepare estimates and check parcel and easement information based on the approved plans. The County's
Management Analyst will prepare bond agreement forms, which will need to be completed by the owner
and submitted along with cash, certificates or sureties for the amounts specified. The agreements will need
to be approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to
obtain all the correct signatures and forms.
Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded.
The County's Management Analyst or other staff will prepare the forms and check for ownership and
signature information. The completed forms will need to be submitted along with court recording fees.
After bonding and agreements are complete, county staff will need to enter project information in a DEQ
database for state application processing. DEQ will review the application information based on local
VSMP authority approval. At this time, the DEQ portion of the application fees will need to be paid
directly to the state. For fastest processing, this is done electronically with the emails provided on the
application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the
application, they will issue a permit coverage letter. This should be copied to the county.
After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference.
Applicants will need to complete the request for a pre -construction conference form, and pay the remainder
of the application fee. The form identifies the contractor and responsible land disturber, and the fee
remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction
conference will be scheduled with the County inspector. At the pre -construction conference, should
everything proceed satisfactorily, a joint VSMP and grading permit will be issued by the County so that
work may begin.
