During the time of our final site plan application and approval the adjacent parcel 45-112 was under rezoning from R6 to HC. The rezoning was successful and from R6 to HC. There is a screening requirement between C1 and Residential districts but there is there are no screening requirements between C1 Commercial (our site) and HC Highway Commercial (45- 112). The new zoning allows the owner to remove the screening requirements from the Landscape Plan. The owner also wishes to use saved existing trees to fulfill the requirement of 32.7.9.6 which requires that "an area of at least five (5) percent of the paved parking and vehicular circulation area shall be landscaped with trees or shrubs. Neither the areas of street trees and shrubs required by sections 32.7.9.5(d) and (e) nor shrubs planted between a parking area and a building on the site shall be counted toward the minimum area landscaped area for a parking area." The owner has preserved a 14" caliper American Planetree Sycamore and a 10" caliper Leyland Cypress that are adjacent to the parking lot area and together offer enough canopy to meet the required 5% canopy for parking areas. The owner has also saved other trees not necessary for any code requirements for aesthetics. The eleven 11 Wintergreen Barberry bushes have also been removed from the landscape plan as they are not a requirement of the Albemarle County Code.
