This project is denied. The rationale is given in the comments below. The application may be resubmitted for approval if all of the items below are satisfactorily addressed. The VSMP application content requirements can be found in County Code section 17-401. A. Stormwater Pollution Prevention Plan (SWPPP) The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary. 1. Provide a copy of the DEQ coverage letter when obtained Response: A copy of DEQ coverage letter will be provided when obtained. (Rev. 2) Acknowledged. 2. Complete Section 6 — PPP Response: Section 6 has been completed with this submittal. (Rev. 2) Partially addressed; Provide an exhibit sheet. B. Pollution Prevention Plan (PPP) The PPP content requirements can be found in County Code section 17-404. 1. Provide a plan showing pollution activities and prevention practices; Refer to the minimum control and prevention practices list shown in Section 6C. Response: The E&SC plan shows pollution prevention practices listed in Section 6C. (Rev. 2) Addressed. 2. Site stormwater will be discharging to impaired waters with TMDL's. TMDL requirements will have to be met (Ref. 9VAC25-880-70, etc). Response: The SWPPP contains information relative to the TMDL requirements. Nutrient credits will be purchased to satisfy phosphorous reduction. (Rev. 2) Addressed. Nutrient credits must be purchased prior to approval. Contact Ana Kilmer prior to purchasing credits to confirm requirements. Engineering Review Comments Page 2 of 6 C. Stormwater Management Plan (SWMP) VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a SWMP. This plan is disapproved, and the reasons are provided in the comments below. The stormwater management plan content requirements can be found in County Code section 17-403. 1. Show/provide legend. Response: A general legend has been provided on Sheet SW2 and SP2. An E&S control legend has been added to sheets SW4 and SW5. (Rev. 2) Acknowledged. 2. FEMA map and date labeled for FEMA floodplain. Response: The existing 100-yr floodplain — 100yr He = 324.0' per Fema map ... (Rev. 2) Floodplain limits as shown do not appear to match FEMA's revised map (show Floodplain, BITE, Floodway). 3. CFR 60.3(b) requires a permit (the County's Floodplain Development Permit) for all proposed construction and other permits in Zone A (floodplain). Any development activity in the floodplain requires a Floodplain Development Permit. If there is a potential impact, then a special use permit may be required according to the Zoning Ordinance. Response: A county floodplain development permit was provided in last submittal. (Rev. 2) Provide a no -rise certificate indicating no impacts to the BFE. 4. Standard SL-1 Safety Slabs shall be required as part of the drainage design for manholes, junction boxes and drop inlets with heights greater than 12 feet. On structures whose vertical height is 12' or greater and Safety Slabs are not specified, the use of bolt down or lock down covers or grates should be considered. The drainage descriptions should specify how many safety slabs are needed for each structure and the quantity should be noted in the remarks column on the Drainage Summary (Vdot Drainage Manual, 9.4.5.2.2). Response: Safety slabs will be provided with drop inlets of 12 feet or more, see detail SP15. (Rev. 2) Addressed. 5. The following General Note should be included on the General Note Sheet (Vdot Drainage Manual, 9.4.5.2.2): D-18 St'd. SL-1 Safety Slab locations are based on the assumed use of precast structures. If cast -in -place structures are utilized, and the interior chamber dimensions (length and width, or diameter) are less than 4 feet, the safety slabs shall not be installed. Response: The general note has been provided on sheet SP2, SW2 under General Construction notes #10. (Rev. 2) Addressed. 6. Proposed slopes greater than 3:1 to have low maintenance (not grass) ground cover specified on plan (Design Manual, sect. 8A). Response: Proposed slopes greater than 3:1 will have low maintenance ground cover, see note 4 on SP6. (Rev. 2) List approved ground cover mix/plant type. Also, add note to the ESC plan since installation of groundcover is required for permanent stabilization. 7. Proposed storm pipes must not disturb preserved stopes. Response: Per attached email from the County Engineer dated 2/10/2017, the storm pipe installation may disturb preserved slopes by right. (Rev. 2) Partially addressed; Disturbance is allowed only within drainage and sanitary sewer easements, but other areas of steep slopes must not be impacted. Include note: Disturbance to preserved slopes limited to drainage/sanitary sewer easement areas shown on plan. 8. Show drainage easements (public) for where stormwater is coming from existing/offsite (Design Manual, sect. 6). Engineering Review Comments Page 3 of 6 Response: Public drainage easements have been shown where appropriate. (Rev. 2) Addressed. Provide deed and plat for review. 9. Maximum pipe slope of 16% (only applies where drainage is in P11blic areas, otherwise N/A). Response: All storm pipes have been shown with a slope of less than 16%. (Rev. 2) Addressed. 10. Existing critical (25%) slopes are not disturbed, unless a waiver has been granted by the Planning Commission (18-4.1, 14-304). Response: The disturbances of the preserved slopes for public utility purposes are all permitted by right. (Rev. 2) Acknowledged; see comment #7 above. 11. Label retaining walls with maximum heights (walls require building permits according to Building Official policy). Response: Retaining wall types and maximum heights have been provided with this submittal. (Rev. 2) Addressed. 12. Engineering details and computations may be required on site plans where walls will support or potentially conflict with stormwater facilities, travelways, parking, or present a safety concern. This includes where walls are placed too close (a distance equal to the wall height) to property lines, such that they may affect neighboring property. In such cases the following items will be required. Response: The applicant is aware of the concerns a-c below. a. A typical detail. (VDOT standard walls are acceptable) The VDOT RW-3 wall detail has been added to sheet SP14. Contractor may submit equivalent design at time of building permit. b. Specific details as required for unusual or possibly conflicting areas. An example is where utilities are expected to go through walls or footings. As is commonly done, the wall designer will address possibly conflicting areas with the wall design. See retaining wall notes sheet SP5. c. Certified computations to support the design. All soil and bearing assumptions, as well as reinforcement materials and assumed loadings must be included. Certified computations will be provided by others with the retaining wall design to be submitted with the building permit. See retaining wall notes sheet SP5. (Rev. 2) Addressed. 13. Show safety railing for walls over 4' high (building permit may be more strict). Response: A note has been added to sheet SP5, requiring safety railing for walls over 4' high. (Rev. 2) Addressed. 14. Guardrail with VDOT designation shown for retaining walls next to parking or travelways (18- 32.7.2). Response: Guardrail (GR-2) has been provided next to travelways and parking. (Rev. 2) Addressed. 15. Drainage should not run across, though, or backwater in dumpster areas [18-4.12.19]. Response: Spot shots shown on the plan have been provided to show positive drainage away from the dumpster pads. (Rev. 2) Addressed. 16. Show details on stilling basin. Response: A detail for the stilling basin has been provided on SW 11. (Rev. 2) Partially addressed; SW9 — Provide callout for stilling basin detail. 17. Show area of Forest/Open Space to be protected. Response: Forest/Open Space protection is shown on the Landscape Plan. (Rev. 2) Show map of Forest/Open space to be protected. Forest/open space to be shown outside limits of disturbance on E&SC plan and shown as protected (e.g., fencing). If not Engineering Review Comments Page 4 of 6 protected, provide notes/requirements for soil restoration of any disturbed Forest/Open space areas. Areas of undisturbed Forest/Open space shall be protected as such in agreements, deed of dedication of easement, and platted within an easement. 18. Please contact Ana Kilmer for information about nutrient credit purchasing documentation and requirements. Response: The applicant will contact Ana Kilmer to begin the process of nutrient credit purchasing. (Rev. 2) Acknowledged. 19. (Rev. 2) Calculations packet — page numbers should match the index sheet. 20. (Rev. 2) Provide outlet protection calculations for all outlets. 21. (Rev. 2) Include the WPO number on the cover sheet. 22. (Rev. 2) Provide an overall map of the total land disturbance area. I calculated the area to be closer to 5.25 acres. 23. (Rev. 2) Provide an overall drainage area map for the ditches to go along with computations for verification of drainage areas. 24. (Rev. 2) SW8/SP17 — It is difficult to read this drawing, cannot confirm drainage structures match drainage areas (inlet locations, sub -areas, callouts, contours, calc. values, show proposed/existing drainage systems to be impacted). Can't find Str 24. STR 3 and Ditch-2, there is no dividing line between DAs. 25. (Rev. 2) SW4 — Fix label showing as 15" for pipe outfalling from SB. Should be 24"? 26. (Rev. 2) SW4 — Adjust or remove diversion from going through preserved slope area. 27. (Rev. 2) In reference to the note on SW7, callout the ditches on this plan. 28. (Rev. 2) Permissible velocities exceeded for Ditches 1 & 2 for grass channel. Provide design details for all ditches (Ditch 3 not identified on SW8). 29. (Rev. 2) EC-3 lining is not for the long-term, consider lining ditch with something permanent (concrete or riprap). Show that water velocity will not blow out turn in ditch. 30. (Rev. 2) Consider piping for storm lines 5, 9, and 22 to inlet 4. 31. (Rev. 2) Minimize structures in the floodplain by replacing outlet pipe with an adequate channel. 32. (Rev. 2) Provide collection piping for all building downspouts. D. Erosion and Sediment Control Plan (ESCP) Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP. This plan is disapproved, and the reasons are provided in the comments below. The erosion control plan content requirements can be found in County Code section 17-402. 1. Show/provide legend. Response: A legend has been provided on SW4 and SW5. (Rev. 2) Acknowledged. 2. Indicate staging area, any stockpiles, and show dust control symbols (DC); protection required for all stages of construction. Response: A staging area, stockpile area and DC symbols have been shown with this submittal. (Rev. 2) Addressed. 3. Show seeding symbols (TS, PS). Response: A TS and PS symbols have been shown with the E&SC plan. (Rev. 2) Addressed. 4. Include paved wash racks and detail (Ref. Design Manual, Sect. 6). Response: A paved wash rack has been provided with the E&SC plan, see detail SW11. W1 A 7 8. 9. Engineering Review Comments Page 5 of 6 (Rev. 2) Addressed. Show soils map/descriptions; Label property lines. Response: A soils map has been provided on SW3 and a soil report has been provided with the E&S narrative. (Rev. 2) Addressed. All watercourses to be protected and encroachments minimized. Response: All watercourses are protected per the E&S Plan and encroachments have been minimized. (Rev. 2) Addressed. Show typ. section for each temp. channel or diversion, referenced for the plan sheets. Existing ground should be shown at the maximum cross -slope on the plan. Response: Typical section for diversion and note are shown on the detail sheet SW11. (Rev. 2) Addressed. (Rev. 2) Offsite clearing/grading requires approval and temporary easement from adjacent landowner (where shown near Broadway St CE access). Or remove offsite activities. (Rev. 2) There is not an adequate channel along Moores Creek Lane. Provide documentation that stormwater flowing through channel will not overflow onto road (Refer 10. (Rev. 2) Add SF alongside Moores Creek Ln to prevent sediment from washing out onto road. 11. (Rev. 2) Add IP at storm structure 4. 12. (Rev. 2) Tree line on sheets SW4 and SW5 do not match in the location of ST-2. Correct limits of clearing. 14. (Rev. 2) Provide OP for pipes 1, 9, 22, and 5 (if ditches remain). 15. (Rev. 2) Provide SF around lower half of stockpile location. 16. (Rev. 2) Provide SAF/protection around fuel storage areas. The VSMP permit application and all plans may be resubmitted for approval when all comments have been satisfactorily addressed. For re -submittals please provide 2 copies of the complete permit package with a completed application form. Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to discuss this review. Process; After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate request form and fee to the Department of Community Development. One of the plan reviewers will prepare estimates and check parcel and easement information based on the approved plans. The County's Management Analyst will prepare bond agreement forms, which will need to be completed by the owner and submitted along with cash, certificates or sureties for the amounts specified. The agreements will need to be approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to obtain all the correct signatures and forms. Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded. The County's Management Analyst or other staff will prepare the forms and check for ownership and signature information. The completed forms will need to be submitted along with court recording fees. After bonding and agreements are complete, county staff will need to enter project information in a DEQ database for state application processing. DEQ will review the application information based on local VSMP authority approval. At this time, the DEQ portion of the application fees will need to be paid directly to the state. For fastest processing, this is done electronically with the emails provided on the application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the application, they will issue a permit coverage letter. This should be copied to the county. After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference. Applicants will need to complete the request for a pre -construction conference form, and pay the remainder of the application fee. The form identifies the contractor and responsible land disturber, and the fee remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction conference will be scheduled with the County inspector. At the pre -construction conference, should everything proceed satisfactorily, a joint VSMP and grading permit will be issued by the County so that work may begin.
