Dear Mr. Chege:
Staff has reviewed your initial submittal for the request for a special use permit amendment (SP)
for the addition of a modular classroom structure to an existing church in the Rural Areas zoning
district. We have a few questions and comments which we believe should be resolved before
your proposal goes to public hearing. We would be glad to meet with you to discuss these
issues.
Planning Comments (Rachel Falkenstein)
• Provide the size of the existing sanctuary (number of seats) and list the number of parking
spaces provided in the existing parking area to confirm there is ample parking on site.
• Identify the septic field location on the concept plan to demonstrate compliance with
Health Department comments (see below).
• A building permit and certificate of occupancy will be required for the mobile unit. Staff
recommends you work with the building department to determine the building code
requirements for the structure at this time. For building permit information please contact:

• Though not required by the building code for a non-residential mobile unit, staff strongly
recommends skirting or safety fencing be installed around the base of the unit.
Site Plan reauirement
• A site plan is required for this use; however, you have the option to submit a site plan
exception. If you plan to submit a site plan exception, provide a written request to
address why a full site plan would result in "substantial injustice or hardship" (see
Section 32.3.5). This can be submitted while your SP is under review or you have the
option to waiting to see if the SP is approved. Approval of a site plan or site plan
exception is required prior to the issuance of a certificate of occupancy.
Communitv Meetin
• The applicant is required by ordinance to undertake a community meeting process as
part of the review of the SP amendment. Staff has not been notified that the community
meeting has been scheduled (see attached Community Meeting Guidelines).
• You will be required to notify neighboring properties (staff can work with you to provide
a list of property owners) as well as the Board Member and Planning Commissioner for
your district.
• Please work on scheduling this meeting ASAP and keep staff informed of the community
meeting location and time. Staff will attend the meeting to answer questions, but the
applicant is responsible for facilitating the discussion.

Engineering Comments (Frank Pohl)
• We recommend the applicant provide needed maintenance to the site entrance by
installing additional gravel to provide a level transition from Gilbert Station Road,
provide a stable entrance (non -erosive), and to provide positive drainage away from the
entrance and road. The entrance shall be at least 12-ft wide and tie smoothly into the
roadway surface. Entrance radius should be 20-ft minimum. Additional gravel should
extend at least 20-ft into the site. Refer to VDOT Figure 4-1 for details (attached).

Virginia Department of Health Comments (Josh Kirtley)
The existing Sewage Disposal Construction Permit does not specify the number of church
attendees and the modular classroom does not include plumbing. We have no issues with the
proposal provided:
1. The modular building should retain at least a 10' setback to any septic component
(septic tank, sewer line, drainfield, etc).
2. The Church must use no more than 100 gallons per day in order to stay within the
permitted limits of the septic system.
3. Parking must not occur over the septic system.
4. Daycare is not permitted under this approval.
5. A kitchen should not be placed in the modular unit.
6. 1 recommend that the Church use be limited to basic worship services given the very
small size of the septic field.
7. The applicant should adhere to the Office of Drinking Water guidelines to determine the
need for a public water well on site.

After you have read this letter, please take one of the actions identified on "Action after
Receipt of Comment Letter" which is attached.
Resubmittal
If you choose to resubmit, please use the attached form. There is a $1,075.00 fee for each
additional resubmittal. The resubmittal date schedule is provided for your convenience.
Notification and Advertisement Fees
Prior to scheduling a public hearing with the Planning Commission, payment of the following
fees is needed:
$276.00 Cost for newspaper advertisement
$215.00 Cost for notification of adjoining owners (minimum $215 + actual postage/$1 per
owner after 50 adjoining owners)
$491.00 Total amount due prior to Planning Commission public hearing
Prior to the Board of Supervisor's public hearing, payment of the newspaper advertisement for
the Board hearing is needed:
$276 Additional amount due prior to Board of Supervisors public hearing
$767.00 Total amount for all notifications Fees may be paid in advance. Payment for both the
Planning Commission and Board of Supervisors public hearings may be paid at the same time.
Additional notification fees will not be required unless a deferral takes place and adjoining
owners need to be notified of a new date.

Subject: SP201700002 — African Lighthouse Baptist Temple - Amendment
This special permit is being proposed to begin to address various violations of the codes, including: Building
without permits (the modular addition to the rear); expansion without a special permit amendment (the same
modular addition), and; other structures on the site (a large mobile home structure and another small structure).
The mobile home structure has been removed.
This can be recommended for approval with the following conditions:
1. The proposed improvements shall be in general accord with a sketch plan to be provided by the
applicants. Major items shall include: building location; parking area, lighting and access.
2. The area of assembly shall not be increased with this special use permit.
3. Setbacks shall be: front-75 feet; sides-25 feet, and; rear-35 feet
4. There shall be no day care center or private school on site without approval of a separate special
use permit;
5. VDOT review and approval of access.
6. Compliance with the Virginia State Department of Health.
7. The construction shall commence within one year of approval of the special permit, after obtaining
required building permits and any other approvals needed. Occupancy of the additions shall not
take place until all permits are obtained and construction is completed in compliance with building
codes.
8. All outdoor lighting shall be full cutoff and directed away from adjacent properties and roads.

The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the Special Use Permit request dated February 21, 2017 and offer the
following comment.
Land use
Please see VDOT Road Design Manual appendix F, Access Management Design
Standards for Entrances. Please see page F105, Figure 4-1, private entrance and low
volume commercial entrance detail.

A VDOT Land Use Permit will be required prior to any work within the right-of-way. The
owner/developer must contact the VDOT Charlottesville Residency Land Use Section at (434)

Moderate Volume Commercial Entrance: A commercial entrance along highways with
shoulders with certain site and design criteria reduced. Site requirements are:
Maximum highway vehicles per day: 5,000
Maximum entrance vehicles per day: 200
Maximum entrance percent truck trips of vehicles per day: 10%
PrivateEntrpnce: An entrance that serves up to two private residences and is used for
the exclusive benefit of the occupants or an entrance that allows agricultural operations
to obtain access to fields or an entrance to civil and communication infrastructure
facilities that generate 10 or fewer trips per day such as cell towers, pump stations, and
stormwater management basins.
Private and Low Volume Commercial Entrances
All private and low volume commercial entrances shall be designed in accordance with
the entrance design criteria below and Figure 4-1 to promote safe and efficient movement
of vehicles in the entrance and on state highways.
Low Volume Commercial Entrance Stopping Sight Distance
Adequate stopping sight distance is required for low volume commercial entrances, as
specified in the Stopping Sight Distance Tables 2D-1 and 2D-2.
Private Entrance Sight Distance
The installation of a private entrance cannot be denied on the basis of sight distance.
VDOT will review the property owner's highway frontage and determine a useable
location for the private entrance with the best possible sight distance.
The property owner's preferred location can be denied by the Department if the location
does not have the best possible sight distance and therefore is less safe for users of the
entrance as well as for motorists on the intersecting highway.
The Department may require the property owner to grade slopes, clear brush, remove
trees, and conduct other similar efforts necessary to provide the safest possible means
of ingress and egress that can be reasonably achieved.
Private and Low Volume-CQmmercial Entrance Curb and Gutter
Standard entrance gutter (Std. CG-9D; other options are CG-9A or CG-9B) shall be
used with Std. CG-6 or CG-7 curb and gutter. A special design entrance gutter shall be
submitted for approval when roll top curb is used.

All private and low volume commercial entrances shall be designed and constructed as
noted below and shown in Figure 4-1.
Entrance radius shall be 20' minimum.

Entrance pipe culverts shall be sized to accommodate the run-off expected from a 10-
year frequency storm. Altemate methods for placing pipe culverts under the entrance
(cut/fill details) are presented in the PEA design standard illustration in the VDOT Road
and Bridge Standards, Section 600, available on the VDOT web.*
All private and low volume commercial entrance grades shall start back of the shoulder line. If
drainage is necessary, the ditch line may be moved back to provide 9 inches minimum cover
over pipe.
Entrances shall be at least 12' wide and tied smoothly into the roadway surface.
The entrance surface can be crusher run aggregate (gravel), asphalt, concrete, etc. and shall
extend from the edge of the roadway to the right-of-way line.
Private and Low Volume Commercial Entrance Grades
In the interest of assuring an adequate, convenient, and safe access to public roads,
VDOT recommends the grades along such entrances not exceed 10%.
Modification of an Existing _Private _or Low Volume Commercial Entrance
When an existing street is re -developed and modification of an existing entrance is
required, the entrance surface shall be extended to the right-of-way line or the extent of
disturbance to the existing entrance.

ACTION AFTER RECEIPT OF COMMENT LETTER
Within 30 days of the date of this letter, please do one of the following:
(1) Resubmit in response to review comments
(2) Request indefinite deferral
(3) Request that your Planning Commission public hearing date be set
(4) Withdraw your application
(1) Resubmittal in Response to Review Comments
If you plan to resubmit within 30 days, make sure that the resubmittal is on or before a
resubmittal date as published in the project review schedule. Be sure to include the
resubmittal form on the last page of your comment letter with your submittal.
The application fee which you paid covers staff review of the initial submittal and one
resubmittal. Each subsequent resubmittal requires an additional fee. (See attached Fee
Schedule.)
(2) Request Indefinite Deferral
If you plan to resubmit after 30 days from the date of the comment letter, you need to request
an indefinite deferral. Please provide a written request and state your justification for
requesting the deferral. (Indefinite deferral means that you intend to resubmit/request a
public hearing be set with the Planning Commission after the 30 day period.)
(3) Request Planning Commission Public Hearing Date be Set
At this time, you may schedule a public hearing with the Planning Commission. However, we
do not advise that you go directly to public hearing if staff has identified issues in need of
resolution that can be addressed with a resubmittal.
After outstanding issues have been resolved and/or when you are ready to request a public
hearing, staff will set your public hearing date for the Planning Commission in accordance with
the Planning Commission's published schedule and as mutually agreed by you and the County.
The staff report and recommendation will be based on the latest information provided by you
with your initial submittal or resubmittal. Please remember that all resubmittals must be made
on or before a resubmittal date.

By no later than twenty-one (21) days before the Planning Commission's public hearing, a
newspaper advertisement fee and an adjoining owner notification fee must be paid. (See
attached Fee Schedule) Your comment letter will contain the actual fees you need to pay.
Payment for an additional newspaper advertisement is also required twenty-two (22) days prior
to the Board of Supervisors public hearing. These dates are provided on the attached Legal Ad
Payments for Public Hearings form.
Please be advised that, once a public hearing has been advertised, only one deferral prior to the
Planning Commission's public hearing will be allowed during the life of the application. The
only exception to this rule will be extraordinary circumstances, such as a major change in the
project proposal by the applicant or more issues identified by staff that have not previously
been brought to the applicant's attention. As always, an applicant may request deferral at the
Planning Commission meeting.
(4) Withdraw Your Application
If at any time you wish to withdraw your application, please provide your request in writing.
Failure to Respond
If we have not received a response from you within 30 days, we will contact you again. At that
time, you will be given 10 days to do one of the following: a) request withdrawal of your
application, b) request deferral of your application to a specific Planning Commission date as
mutually agreed to with staff, or c) request indefinite deferral and state your justification for
requesting the deferral. If none of these choices is made within 10 days, staff will schedule
your application for a public hearing based on the information provided with your original
submittal or the latest submittal staff received on a resubmittal date.

Fees may be paid in cash or by check and must be paid at the Community Development Intake
Counter. Make checks payable to the County of Albemarle. Do not send checks directly to the
Review Coordinator.
