RE: LZC-201700010 - Parcel IDs 056A2-01-00-06200, 05600-00-00-057CO (the
"Rezoned Property") and 05600-00-057DO (the "By Right Property") (the By Right Property,
together with the Rezoned Property, the "Property")
Dear Ms. McGetrick:
As requested, we have examined our records with respect to the above referenced real
Property lying in Albemarle County, Virginia (the "County"), currently owned by the Route 240
Holdings, LLC, a Virginia limited liability company (the "Owner"). We are pleased to advise you
that:
• The Property is currently zoned Residential (R-6). (See Chapter 18, Section 16 of the
Albemarle County Code).
The Rezoned Property is zoned Residential, R-6 per ZMA2016-00005 (the "Rezoning"),
approved February 8, 2017, and subject to proffers dated January 3, 2017. This
Rezoning includes other parcels not owned by the Owner. The approved proffers
include an application plan that states a maximum number of dwelling units not to
exceed 180 dwelling units. This plan shows all of the parcels included in the Rezoning
with a portion of those parcels being the Rezoned Property.
• The By Right Property is currently zoned Residential, R-6 and is not subject to any
proffers. The zoning permits a density of six (6) dwelling units per acre. The By Right
Property is approximately 12.61 acres, thus would be permitted up to 75 dwelling units.
The Property's maximum of 255 dwelling units must reviewed for compliance with
Subdivision, Zoning, and Water Protection Ordinance requirements. An application for a
portion of the development has been submitted for review by Albemarle County. Since
the review is ongoing, this letter cannot state that the development of 255 dwelling units
may be approved without the necessity of obtaining any variance, special exception or
other authorization or approval. No special use permit is needed to develop the 255
dwelling units.
• The Owner intends to develop the Property per approved plans and permitted uses
within the Property's Residential, R-6 zoning. The ability of the Owner to develop the
Property is limited only by applicable use regulations, site plan regulations, the
aforementioned approved proffers and water protection ordinance regulations.

• The Property is not subject to a special exception, special use permit or variance
application.
• This office has no record of any open violations, exceptions, variances or nonconforming
uses on the Property.
