A regular meeting of the Board of County Supervisors of Albemarle County,
Virginia, was held at ?:.30 P.~. on Kay 10, 1972, at the Albemarle County Court
House.
Present: Messrs. Stuart. F. Carwile, GeraldE.' Fisher, J. T. Henley, Jrl,
~illiam C. Thacker, Jr., Gordon L. ~heeler and Lloyd F. '~oO~d, Jr.
Absent: None
Officers present: County Executive and ~County Attorney.
The Chairman called for continuation of hearing, deferre&, from April 26,
1972, on CUP-1 ~O--petition of. Walter Cushman to. install a central well water
supply to Serve Neriwe~her Hills. Subdivision located~on, the southeast side of
Route 678, nust north of Route 2~0 Test, in. the Ivy area.
The County Executive reviewed report made to the Board on April 26, advising
that the Planning Commission recommended approval as submitted for ~2 dwelling
units, subject to additional storage, and conditioned upon pipe material being
the same as that used by the Service ~Authority for possible tie-in t° County
system being serviced.by the Sarvice~ Authority in this area. Mr. Batchelor
further advised that the County ~Attorney and Fred Landes, attorney for~Nr. Cush-
man, had worked out further agreement with regard to water (to be noted on plat),
which was satisfactory to the developer and the County. Nr. Landes read this
~greement which follows:
"The lots sho~n on this subdivision Plat will be supplied with water
from a system o~ned and operated by~Cushman Realty and Building Cor-
poration, the owner and developer. Said owner and developer ~ agrees
~~ on behalf or, itself and its successors or assigns in ownership.~of
"-~-such ~stem,~to dedicate to public use all distribution lines, valves,
c
onnections and water meters owned by it, but excluding the well lot
and all improvements thereon other than distribution lines crossing
~~ it, at such time as it is ur~able to operate SUch system in compliance
~ with any order legally issued by the State Board of Health pursuant
~to Section 62. I, Chapter 4 of the Code of Virginia (19~0 as amended),
~~ including such rights of appeal provided for therein and by the g~neral
~~? laws of Virginia."
Motion was offered by Nr. Thacker, seconded by Mr. ~ood, to approve CUP-I~0
with conditions recommended by the Planning Commission and the additional condi-
tion contained in agreement above, said statement of agreement to be put on the
plat of Meriwether Hills Subdivision before it goes to record. Nr. ~isher offered
amendment to require double row of six ft. evergreens as screen on road side.
~The amendment was not ~ccepted, it being the e~ressed feeling that the Board
j~should let the Planning ~G~m~ie~ decime on any screening needed. Motion carried
by the following recorded vote:
AYES: Messrs. Carwile, Fisher, Henley, Thacker, ~nee~er and ~ood.
NAYS: None.
The County Executive advised that copies of memo from the City Attorney,
regarding operation of ~the Joint Airport by the County and City, had been forwarded

to the Board along with proposed budget.., of the Qpe~a~ion. which~indioated that
revenue would be ~ci.en.~.~o pay ~he sa!ary o2.a~l~il!,timemanager. However,
reorganization as proposed require public, hearing by the. ~wo governing
bodies. It was po.in~ed~.ont_,that.a joint..hearing wasnot necessary~. Nr.
Batchelor advised, wi~h the. CounDy.A~torney concurring,, that advertisement
of this hearing was not necessary. It was ordered that this be an agenda item
oh ~ay 18, 1972.
The Chairman requested, an.executive session..to receive additional infor-
mation on proposed 1972-73 budget, stressing t.~ fact.~that no decisions would
be made. Nr. Fisher stated that he wo. ul&..like.~the budget made.available to
the public no later than Nonday (~ay 1 ~). Lotion was offered, by Nr. Thacker,
to adjourn this meetinE to an. executive session..te receive additional budget
information. Nr. Carwile. stated that executive .session ~was alzo necessary for
discussion of water and sewe~, and accordingly, seconded ~r. Thacker's motion.
