Perez, Senior Planner Division: Planning Date: April 14, 2017 Subject: SUB201700053 Better Living Berkmar - Easement Plat The County of Albemarle Planning Division will grant or recommend approval of the easement plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] 1. [14-302(A)5] Easements. Relabel the easement to read: `New 15' Access Easement is Hereby Dedicated to the County of Albemarle for Public Use". 2. [14-302(A)4&5] Drainage Easements. On the plat label all drainage easements as either public or private. If the drainage easements are to be public, prior to plat approval provide a deed of easement to dedicate this land. County Attorney approval is required prior to final plat approval. 3. [14-303(D)] Acreage of Lots. Provide the total acreage of each lot. 4. [Comment] Too much is happening on this plat along the frontage of Berkmar Drive. It is suggested that you break this area out into a couple additional pages, as too many easement lines overlap making it hard to read/decipher. 5. [14-302(B)(1)] General Information. Provide the date of the last revision. The Code is kept up-to-date by the County Attorney's office and may be found at www.albemarle.org/countycode. In accord with the provisions of Section 14-229(B) of Chapter 14, if the applicant fails to submit a revised plat to address all of the requirements within six (6) months after the date of this letter, then the application shall be deemed voluntarily withdrawn. Review# 1 Dear Mr. Perez: The Department of Transportation, Charlottesville Residency Transportation and Land Use Section has reviewed the Better Living Berkmar- Easement Plat (2), dated March 7, 2017 as submitted by Roger W. Ray & Associate Inc., and offer the following comment. Land use 1. There needs to be a sight distance easement recorded for the "sight distance left" to complement the easement to be recorded on T.M. 45-112B. Though this area is currently within the reserved area along the road a sight distance easement is necessary until the land is claimed for right of way. 2. Please note that trees within the sight distance easements or right-of-way may have to be removed if not pruned in such a way as to avoid becoming sight line obstructions. For sight lines that cut through lots, decks and/or fences may not be able to be built as they may also create sight line obstructions. Please add a note stating that sight distance easements are dedicated to public use and shall be kept clear of visual obstructions. A VDOT Land Use Permit will be required prior to any work within the right-of-way. The owner/developer must contact the VDOT Charlottesville Residency Land Use Section at (434) 422-9399 for information pertaining to this process. Ray & Associate Inc., and rind it be acceptable on condition that the plat must be signed and recorded by appropriate parties prior to approval of the associated site plan. A VDOT Land Use Permit will be required prior to any work within the right-of-way. Seems we are ready for County approval of the plat. Please drop off a minimum of two copies of signed/notarized plats for County approval. Notably, the deeds I have in my office associated with this plat are not signed/notarized by the applicant, but they are signed by Doug Walker. I'll give these to you with the approved final plat. The owners need to sign/notarize these documents prior to recordation of the plat. Once all the deeds are signed by the owners please record these in the clerk's office and send me the recordation recipient of this action. Thanks Christopher P.
