A regular meeting of the Board of County Supervisors was held on October 2¢,
1972~ at '7:'30 P.M, in the Albemarle County Courthouse, Charlottesville, Virginia.
Present: Messrs. Stuart F. Carwile~ Gerald E. Fishery J. T. Henley~ Jr.,
William C. Thacker, Jr., Gordon Lo Wheeler and Lloyd F. Woody Jr.
Absent: None.
Officers present: County Executive and County Attorney.
At ¢:30 P.M. the Chairman called for public hearings on zoning matters as
advertised in the Daily Progress on 0ctober'$ and October 11, 1972:
(1) ZMP-2$6. George Cason. Applicant is requesting the Board of SUpervisors to
rezone 12.0 acres from R-3 Residential to B-1 Business and 8.8 acres from
R-3 Residential to A-1 Agricultural. Property is located at the 1-65 and
Route 631 interchange just south of the city limits of Charlottesville and
is described as County Tax Map 76, Parcels 5~A, 5~L, 5~M, 54-0, 54P and
55 (part thereof). Scottsville Magisterial District.
Mr. Cason was present in support of the ~etition. No one from the public spoke
in 99~osition. Mr. Humphrey gave the following report: "The land use plan as
adopted and presented by the consultant indicates this property to be in an area
designated for medium density (2.~ dwelling units per acre). The consultant did not
recognize the existing zoning (R-3). During the course of the ~mblic hearings the
consultant~ on commenting on why this quadrant was not shown f~r future commericial
user as did to the north~ said that there were numerous small parcels existing which
were individually owned which would preclude~ in his judgment, consolidation ¢ora
compact community commercial center. The general area in which this land lies
meets the criteria for locating community centers, motels~ etc. as spelled out in
the written objectives. He further stated that if the land could be consolidated
into one package then it could be considered appropriate for a planned center,~ Until
that could be accomplished~ the existing acres of land require reasonable protection
from encroachment. It goes without saying~ that the 8.8 acre-tract along Noores
~reek best serves the general welfare, safety and health of the community by being
in the A-1 'zoning category~ however~ the building permits issued for ap~rtments~:
would still be valid under the present ordinance in my opinion; The staff agrees
with the statements of the consultant regardinE the quzlifications of the site.
However~ we do not feel the consolidation is complete enough to afford a compact
center development. There are still several individual pa~cs~s with homes that
require protection. The staff would note that there are several other parcels
which by oversite are not a part of this request~ which are under contract."
M~. Humphrey stated that~he Planning Commission had unanimously recommended approval
of the petition. Mr. Wood offered motion to accept the recommendation of the Planning
Commission on both parcels of land. Motion was seconded by Mr. Carwile and
carried by the following recorded vote:

(2) SP-20~. Richard and Carolyn Brown. Applicants wt~ to place a permanent
mobile home on property located on Route 712 at North Garden~ Virginia.
Property which contains~l.0 acre is zoned A-1 Agricultural and is described
as County Tax Map 99A, Parcel 15. Samuel Miller District.
Mr. HumpSrey stated that there is an emergency mobile home occupied by the applicant
on the property~ valid until December 31, 1972. The Planning Staff :.meeommended
screening along Route 712~ and the Planning Commission recommends approval of
the petition subject to screening which is to be left to the discretion of the
County Planner and Zoning Administrator. Mrs. Brown was present in support
of the petition. No one from the public appeared. Mr. Fisher ~£fered motion
to accept recommendation of the Planning Commission and staff. Motion was seconded
by Mr. Wood and carried by the following recorded vote:
AYES: M~ssrs. Carwile, Fisher, Henley~ Thacker, Wheeler and Wood.
NAYS: None.
(3) SP-210. Michael B. Stewart. Applicant wi~hes~;to place a permanent mobile
hom~,.on property located on Route 727 near Carter's Bridge, Virginia.
Property which contains 10.0 acres is zoned A-1 Agricultural and is
described as County Tax Map 103, Parcel 16 (part thereof). Scottsville
Magisterial District.
Mr. Humphrey stated that the property is a portion of Quandary Farm, recently
subdivided into large tracts. This tract is a pipe-stem shape, largely an open
field~ abutting on Murphy's Run_to the west and having access to Route 727 to
the east. None of the other tracts along this access haVe been developed.
The property is not visible from Route 727. There are no homes visible in the
immediate area, however~ there are several lots being dev~oped along Route 727.
The staff felt a permanent~mbbite home on this property could be considered
incompatible with possible future development of the large tracts in this
that approval be
subdivision. The staff recommended/condition upon health department approval
of a septic tank system. Mr. Stewart was present. No one from the public
appeared in-opposition. Mr. Humphrey stated that the Planning Commission
recommended approval of the permit for a 2-Year period with administrative
approval yearly thereafter and Health Department approval of a septic tank
system and that permit state expiration date. The Supervisors again discussed
the s~division of this land. Mr. ~arwile felt the property had been subdivided
with disregard to the County subdivision ordinance and offered motion to defe~
action on this petition until November 8 at which time all adjoining property
owners have been invited to be present. Motion was seconded by Mr. Thae.ker :.~.

NAYS: None.
Mr. Wheeler stated that November 29 would be set as the date to hear
SP-203 for the City of Charlottesville. This to be advertised for 7:30 P.M.
At 8:05 P.M. the Chairman entertained a motion to adjourn into executive

AYES: Messrs. Carwile, Fisher, Henley, Thacker, Wheeler and Wood.
NAYS: None. The Board reconve~d.
Mr. Rosser Payne, Planning Consultant, gave a resume of the new zoning ordinance
now under consideration. He gave details on items such as: condominium approach~
flood plains, new conservation zone and the difference between modular and mobile
homes. He stated that his attorneys~ Pritchett and Tilman, had reveiwed the
ordinance and have stated that work is legal. Two County attorneys have also
reviewed the work. He also stated that if particular points need to be cleared up,
this can be done without delaying work on the ordinance itself. He reiterated
that a handbook or procedural manual needs to be developed. At the end of the
presentation, Mr. Wheeler stated to members of the Planning Commission, who were
present, that he felt there was quite a lot of work to be done to the ordinance
before it is ready for a public hearing and asked that this be accomplished
as quickly as possible.
Claims against the County amounting to $1,351,782.97 were presented, examined
and allowed and certified to the Director of Finance for payment and charged
against the following funds:

Motion was offered by Mr. Fisher, seconded by Mr. Thacker to adjourn this
meeting until 8:00 PoM. on November 2, 1972~ in the Board R~om of the County
Office Building for a Work session on ZMP-243, Virginia National Bank, Trustee.
Motion carried by-the following recorded vote:
AYES: Messrs. Carwile, Fisher, Henley~ Thacker, Wheeler and Wood.
