HomeMy WebLinkAboutLOD201700012 Letter of Determination 2017-04-19COUNTY OF ALBEMARLE Department of Community Development 401 McIntire Road, North Wing Charlottesville, Virginia 22902-4596 Phone (434) 296-5832 Fax (434) 972-4126 April 19, 2017 VIRGINIA OIL COMPANY INCORPORATED C/O FRAYSER WHITE, SOUTH CREEK INV 1100 HARRIS STREET CHARLOTTESVILLE VA, 22903 RE: LOD2017-00012 — FOR PARCEL IDs 09400-00-00-03800 and 09400-00-00-03900 A DETERMINATION OF 1) AREA ZONED C-1 COMMERCIAL, 2) THE AMOUNT OF WATER PERMITTED TO BE USED BY RIGHT Mr. White, In association with the review of the application for Initial Site Plan (SDP2017-00009 Boyd Tavern Market) and in accordance with § 31.1 a (1) of Chapter 18 of the Albemarle County Code (the "Zoning Ordinance"), the following determinations are made: 1) The total area of Parcel IDs 09400-00-00-03800 ("Tax Map 94 Parcel 38 or Parcel 38") and 09400-00-00-03900 ("Tax Map 94 Parcel 38 or Parcel 38") that is zoned C-1, Commercial, and 2) The amount of water permitted to be used without the need for a special use permit. Analysis The following is the zoning history of Tax Map 94 Parcels 38 and 39 including the official actions taken by the Albemarle County Board of Supervisors regarding the zoning of Tax Map 94 Parcels 38 and 39. The statements that are bolded and italicized are my comments relevant to the analysis of the amount of acreage zoned C-1, Commercial. The reference to A-1 zoning is what the current Zoning Ordinance describes as RA, Rural Area, and B-1 zoning is C-1, Commercial. Tax Map 94 Parcel 38 8/9/1949 The property owner records a plat of 5.95 acres in Deed Book 305 Page 470 (Attachment A). 2/2/1967 The Commonwealth of Virginia as described in Deed Book 426 Page 381 (Attachment B) takes a total of 3.87 acres of area for Interstate 64. There is no survey of the 3.87 acres, so it is determined by calculation. This leaves the remaining portion of the original 5.95 acres (by calculation) as 2.08 acres. April 19, 2016 LOD201700012 Page 2 of 4 4/30/1970 ZMP-122 — The property owner files an application to rezone 2.08 acres from A-1 to B-1 (Attachment C). The application states the area to be rezoned as 2.08 acres. The application does not include a survey of the 2.08 acres, only an outline of the area from the Virginia Department of Highways plans for the Interstate 64 Interchange at Boyd's Tavern (Now Exit 129) (Attachment D). I believe that staff assumed the 2.08 acres was the remaining portion of the original 5.95 acres after the taking noted above. 6/18/1970 The Board of Supervisors approved the "...application for rezoning 2.08 acres..." (Attachment E). A future survey, dated November 1970, of the assumed location of the 2.08 acres shows the area actually to be 3.566 acres. Tax Map 94 Parcel 39 10/30/1970 ZMP-146 - The property owner files an application to rezone 10.0 acres from A-1 to B-1 (Attachment F). A survey is provided and references two tracts of land 3.566 acres (Parcel 38) and 10.098 acres (Parcel 39). The proposal is to rezone 10.098 acres. The plat provided with the application shows what appears to be the same shaped parcel rezoned with ZMP-122 known as Parcel 38 surveyed as 3.566 acres, and Parcel 39 surveyed as 10.098 acres. This survey identifies the 10 acres subject to the rezoning. This survey is later proposed and approved as a subdivision in February of 1971 (see 2/12/71 subdivision application below). 12/17/1970 The Board of Supervisors only approved rezoning a portion of Parcel 39, described in the minutes as "only .6 acre (said parcel being triangular in shape in plat submitted) at this time." This property is noted on a plat in the file (Attachment G & H). The survey submitted with the application shows not only the original parcels (3.566ac and 10.098ac), but also a reconfiguration into Parcel A (1.178ac) and Parcel B (12.486ac), later proposed and approved as a subdivision in February of 1971 (see below). The "triangular" area of 0.6 acres is rezoned with this application and not the entire 10 acres as requested. Also, the 0.6 acres appears to be an incorrect area, as it appears to be an estimated area and not surveyed and it is not clear how the estimation was made. April 19, 2016 LOD201700012 Page 3 of 4 Tax Map 94 Parcels 38 and 39 02/2/1971 SUB 00019 - The property owner files a subdivision application showing a plat of re -division of TMP 94-38 and 39 into Parcels A (1.178ac) and B (12.486ac) (Attachment 1). Today, Parcel A is Tax Map 94 Parcel 38 and Parcel B is Tax Map 94 Parcel 39. This plat shows Parcel A as 1.178 acres. All of Parcel A is zoned B-1 at this time. Parcel B is 12.486 acres. By estimation, there would be approximately 2.719 acres zoned B-1. Using a scaled survey of Parcels A and B; the area of multiple the geometric shapes is calculated for the "triangular" area as noted in ZMP-146 above. This estimated area is 0.331 acres. Using the surveyed acreage of Parcel A (1.178ac) and subtracting the "triangle" (0.331ac) would leave 0.847 acres (1.178 — 0.331 = 0.847). The 0.847 acres is a portion of what is determined to be the original parcel rezoned with ZMP-122 totaling 3.566 acres, not 2.08 acres as stated at that time. With 0.847 acres, being a part of Parcel A, then 2.719 acres is a part of Parcel B (0.847 + 2.719 = 3.566) Tax Map 94 Parcel 39 04/05/1979 ZMA1979-00011 - The property owner files an application to rezone 10.0 acres from A-1 to B-1 (Attachment J). This land area appears to be incorrect since the applicant did not account for the acreage rezoned with ZMP-146. 06/06/1979 ZMA1979-00011 - According to the approval letter, the Board of Supervisors only rezoned a 0.56 acre portion of Parcel 39 from A-1 to B-1 (Attachment K). The application and approval letter note that the approval is for Parcel 39A and was 10 acres. Parcel 39A was never a parcel of record. The parcel of record was Parcel 39 and was 12.486ac. The proposed rezoning was for the 10 acre portion of Parcel 39. Only 0.56 aces was approved. The portion of Parcel 39 now zoned C-1 is 3.279 acres (2.719 + 0.56 = 3.279) After considering and analyzing the evidence above it is determined that, AREA ZONED C-1 The area zoned C-1 on Parcel 38 is the entire surveyed parcel of 1.178 acres. The survey of Parcel 39 shows the parcel to be 12.486 acres. The area zoned C-1 on Parcel 39 is approximately 3.279 acres. Exact acreage of the area zoned C-1 for Parcel 39 may be established by surveying the area in the field using the approvals granted with the noted rezonings and the previously approved subdivision plat. The Zoning Administrator must review said survey before recording or the County acknowledging any change in the 3.279 acre area. April 19, 2016 LOD201700012 Page 4 of 4 WATER USAGE WITHOUT A SPECIAL USE PERMIT Land area zoned C-1; uses permitted by right not served by public water shall not exceed 400 gallons of water per site acre per day. Based on the previous analysis of relevant land area zoned C-1, uses permitted by right not served by public water shall not exceed: Parcel 38 - 471.20 gallons of water per day, (1.178 acres X400 gallons per site acre per day = 471.20 gallons) Parcel 39 - 1311.60 gallons of water per day, (3.279 acres X 400 gallons per site acre per day = 1311.60 gallons). The amount of water for Parcel 39 is subject to change if the measurements of Parcel 39 contained in this Letter of Determination are found to be inaccurate by a survey conducted by a Licensed Surveyor. Prior to final approval of any proposal for development, the applicant must provide information regarding the proposed development's water usage. The Zoning Administrator in consultation with the County Engineer will decide whether the proposed water consumption is allowed by right or requires a special use permit. Water usage over the noted limits is subject to Board of Supervisors approval of a special use permit. If anyone is aggrieved by this determination, they shall have a right to appeal it within thirty (30) days of this notice, in accordance with Virginia Code § 15.2-2311. If they do not file a timely appeal, this determination shall be final and unappealable. An appeal may be taken only by filing an appeal application with the Zoning Administrator and the Board of Zoning Appeals, in accordance with § 34.3 of the Zoning Ordinance, along with a fee of $240 plus the actual cost of advertising the appeal for public hearing. Applications for Appeal of the Zoning Administrator's Determination are available at the Department of Community Development located at 401 McIntire Road, Charlottesville, Virginia 22902 or online at www.albemarle.orq/cdapps. This form applies to the appeal of a decision of the zoning administrator or any other administrative officer pertaining to the Zoning Ordinance. Regulations pertaining to the filing of an appeal to the Board of Zoning Appeals are located in Chapter 18, Section 34.3 of the Albemarle County Code. Brown and Others to rezone 20.0 acres located on Route 704 5 miles south of Charlottesville from A-1 Agricultural to RS -1 Residential. Mr. Humphrey advised that the staff and the Planning Commission recommended denial of the application. Mr. Brown and other owners were present in support of the application. Mr. Carl Dorman appeared in opposition advising that petition had been submitted to the Planning Commission containing some 38 signatures of residents in the area who were opposed to the zoning change. Mr. Brown advised that some residents in the area supported his request. Motion was offered by Mr. Yancey, seconded by Mr. Wood, to grant the petition as requested. Mr. Gibson stated that where the Planning Commission has unanimously recommended denial on two occasions, their recommendation should receive very serious consideration. The.County Executive stated that growth should be guided to those areas where water and sewer Facilities are planned. He also stated that the Master Plan is near. Mr. 'Wheeler requested roll call vote on Mr. Yancey's Motion, which follows: Ayes - Messrs. Yancey and Wood. Nays - Messrs. Garnett, Gibson, Paulett and Wheeler. Mr. Humphrey advised that the staff and Planning Commission recommended approval. Mr. George Gilmer appeared in support of the application. No one appeared in op- position. Mr. Earl Sowers appeared on behalf of the applicant. No one appeared in opposition. Mr. Humphrey advised that the Planning Commission recommended approval of only .6 acre (said parcel being triangular in shape in plat sub - witted) at this time.On motion by Mr. Gibson, seconded by Mr. "Wood, the recom- mendation of the Planning Commission was accepted. (4) ZMP-148 - Resolution of intent of the Boand of Supervisors to amend the Zoning Map to rezone 220.74 acres from Industrial, Limited M-1 to Research and Technical Manufacturing District R -TM. Property located in northwest quadrant of interchange of Route 637 and I-64, owned by 0. J. Langford and Robert F. Howard; G.E. contract purchaser. Mr. Humphrey advised that the Planning Commission held public hearing in accor- dance with this Board's request and agreed with the resolution of intent to rezone the subject property and amend the ZoAing Map. No one appeared with regard to this matter.
