From: Paty Saternye- Senior Planner Division: Planning Services Date: April 10, 2017 Rev. 1: April 21, 2017 Subject: SUB -2017-41 Louise Finger -Boundary Line Adjustment The County of Albemarle Planning Division will grant or recommend approval of the Final Plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] [14-302(A)(3)] Existing or platted streets. Specify the width of the prescriptive easement for State Route 668 (Fox Mountain Road). Rev. 1: Comment A,ddressed- 2. [14-302(A)(10)] Right of further division of proposed lots. Address the following comments: The development rights for Tax Map 15 Parcel 22 appear to be incorrect. Please provide any supporting documentation that shows Tax Map 15 Parcel 22 only has one development right. Deed book 2160 page 637 stated "Development rights are not being affected with this survey." Provide the deed book and page numbers for any recorded plats that assign Tax Map 15 Parcel 22's development rights to other parcels. If the deed book is older than deed book 350 provide a PDF or hard copy of the plat in question. Rev. 1: Comment Addressed. • Development rights for Parcel "A". It appears that no development rights will be transferred with Parcel "A". Specify that on the plat. Rev. 1: Comment Addressed. Development rights for Parcel 22A. It appears from Deed book 2160 page 637 that TMP 15-22 has no development rights. If it is correct that no development rights will be transferred with Parcel "A" (mentioned above), and that no development rights were assigned TMP 15-22A with deed book 2160 page 637 (see above), then specify on the plat that Tax Map 15 Parcel 22A has no development rights and may not be further divided. Rev. 1: Comment Addressed. [NEW COMMENT] The 31 -Acre Rule wording in the development rights note is not yet correct. Revise the development rights notes for Parcel "A" and Tax Map 15 Parcel 34 to combine them and to state, "Parcel "A" is not assigned any development rights and may not be further divided. The residue of Tax Map Parcel 34 is retaining five development rights and when further divided it shall not consist of more than thirty-one acres." • [NEW COMMENT] The development rights note for Tax Map 15 Parcel 22A is correct. No change is needed to that note. 3. [?4-302(6)(7)] Reservoir watershed; agricultural -forestal district. The note addressing the reservoir watershed status appears to be incorrect. County GIS shoenrs both parcels as being part of the Water Supply Protection Area. l"evise the note to address this. Rev. 1: Comment Addressed. 4. [14-303(0)] Signature Panels. The Marcel specified in the signature area for Louise A. Finger appears to by incorrect. The parcel should be "22A" and not- "22".
