A MEETING OF THE BOARD OF COUNTY SUPERVISORS OF ALBEMARLE COUNTY, ADdOURNED FROM 00TOBER 21,
1965, WAS HELD AT ~=00 P.M. ON THIS DATE WITH THE FOLLOWING MEMBERS PRESENT: MESSRS. EDGAR
N. GARNETT, GARRETT ~o KIRKSEY~ GEORGE C. PALMER, II, F. E. PAULETT AND ROBERT THRAVES.
ABSENT: MR. R. A. YANOEY.
OFFICERS PEESENT= COUNTY EXECUTIVE AND COMMONWEALTHIS ATTORNEY.
MR. THRAVES RECOMMENDED THAT THE BOARD INSTRUCT THE COMMONWEALTHIS ATTORNEY TO TAKE
SUCH ACTION AT LAW AGAINST ALL CORPORATIONS OR INDIVIDUALS AS NECESSARY TO PREVENT THE
FURTHER. POLLUTION OF OUR STREAMS AND WATER SUPPLY IN ALBEMARLE COUNTY AND TO ENTER SUITS
FOR DAMAGES WHICH HAVE BEEN DONE TO LIVE STOCK~ WILD LIFE AND RIPARIAN LAND OWNERS. CON-
SIDERABLE DISCUSSION WAS GIVEN THIS MATTER AND THE COMMONWEALTH1S ATTORNEY ADVISED THAT
WATER POLLUTION IS THE PRIMARY RESPONSIBILITY OF THE STATE WATER CONTROL BOARD. THE ~K)UNTY
EXECUTIVE SUGGESTED THAT THE COMMONWEALTHI8 ATTORNEY BE INVITED TO SIT tN MEETINGS WHICH ARE
NOW BEING CONDUCTED IN THIS REGARD AND THIS SUGGESTED WAS GIVEN APPROVAL OF THE BOARD. HOW-
EVER, THE COMMONWEALTHIS ATTORNEY WAS REQUESTED TO LOOK INTO THE GREENWOOD SITUATION AND TO
REPORT HIS FINDINGS TO THE BOARD AT THE REGULAR NOVEMBER MEETING.
iN ACCORDANCE WITH NOTICE PUBLISHED IN THE ~ILY PROGRESS ON OCTOBER ~ AND NOVEMBER
1~ 196~, THE CHAIRMAN CALLED FOR PUBLIC HEARING ON AN ORDINANOE PROHIBITING HUNTING WITHIN
FIFTY FEET OF HIGHWAY8 IN ALBEMARLE ~,OUNTY. THE COUNTY EXECUTIVE READ THE ORDINANCE AS
PROPOSED~ AFTER WHICH THE SAME WAS OFFERED FOR ADOPTION BY MR. PAULETT AND SECONDED BY ~.
~IRKSEY. A NUMBER OF PERSONS APPEARED BEFORE THE ~OARD INCLUDING ~Ro RAY ~IDD WHO STATED
THAT HE FELT THE PROBLEM LIES WITH THE ENFORCEMENT OF LAWS ALREADY ON THE BOOKS. ~Ro FARLEY
COX~ MR. FLOYD OOHNSON~ MR. BILL ~ADDELL (APPEARING BOTH PERSONALLY AND ON BEHALF OF THE
~SAAK ~ALTON LEAGUE), MR. 0. R. RANDOLPH AND OTHERS APPEARED 'IN SUPPORT OF THE PROPOSED
ORDINANCE. MR. dOE BtBCKHEAD STATED THAT HE WAS NOT AGAINST THE ORDINANCE BUT COULD NOT
SEE WHAT IT WOULD ACCOMPLISH AND SUGGESTED THE BANNING OF ALL HUNTING IN SOUTHERN ALBEMARLE.
AFTER THE PUBLIC DtSCUSSION~ MR. PAULETT~$ MOTION WAS UNANIMOUSLY ADOPTED~ THE FOLLOWING
ORDINANCE BEING ADOPTED ON AN EMERGENCY BASIS IN ORDER THAT iT MAY BECOME EFFECTIVE ON THE
FIRST DAY OF HUNTING SEASON:
AN ORDINANCE PROHIBITING HUNTING WITHIN FIFTY (50) FEET OF ANY
STATE SECONDARY OR PR I MARY H I GHWAY W l TH 1N ALBEMARLE COUNTY:
AND PRESCRIBING PENALTIES FOR VIOLATION THEREOF,
BE IT ORDAINED BY THE ~OARD OF COUNTY SUPERVISORS OF ALBEMARLE COUNTY~ THAT=
IT SHALL BE UNLAWFUL FOR ANY PERSON TO BE ENGAGED IN THE HUNTING OR
ATTEMPTING TO HUNT WITH~A FIREARM OF ANY GAME BIRD OR GAME ANIMAL WITHIN
FIFTY (~0) FEET OF ANY PRIMARY OR SECONDARY HIGHWAY IN ALBEMARLE COUNTY.
ANY PERSON OR PERSONS VIOLATING THE PROVISIONS OF THIS ORDINANCE
SHALL BE GUILTY OF A MISDEMEANOR AND UPON CONVICTION THEREOF SHALL BE
~PUNISHED ACCORDINGLY.

BE IT FURTHER ORDAINED THAT THE COUNTY COURT OF ALBEMARLE COUNTY BE
FURNISHED WITH A CERTIFIED COPY OF THIS ORDINANCE, AND THAT COMPLAINTS FOR
THE OFFENSES HEREIN ABOVE SET FORTH BE PROSECUTED UNDER THE TERMS FOR THIS
ORDINANCE~ AND .THAT ALL FINES IMPOSED UNDER THIS ORDINANCE SHALL BE COLLECTED
AND PAID TO THE CREDIT OF THE GENERAL REVENUE FUND OF THIS 0OUNTYo
