HomeMy WebLinkAbout1957-03-20 A regular meeting of the Board of County Supervisors of Albemarle County, Virginia, was held at the Office Building of said County on the 20th day of March, 1957. Present: Messrs. John W. Williams, Edgar N. Garnett, H. Ashby Harris, Edward L. Smith, M. Y. Sutherland, Jr., and Robert Thraves. Absent: None. Officers present: County Executive and Commonwealth's Attorney. The meeting opened with the Lord's Prayer led by Mr. M. ~. Pence. Minutes of the meetings of February 20 and March 14, 1957, were read and approved. Mr. W,W. Shields, Resident Highway Engineer, presented to the Board plans on the Route ~8 Federal Aid Project and requested a resolution from this Board giving the Highway Department authority to condemn land where rights-of-way cannot be obtained. On motion of Mr. Sutherland, seconded by Mr. Harris, the following resolution was unanimously adopted: WHEREAS, the Commonwealth of Virginia, through the Department of Highways, has prepared and submitted plans to the Board for the construction or improvement of a section of Route 708 of the State Secondary System, Project 1302-19, in Albemarle County, from 0.341 Mi. W. Int. Rt. 20 (near Carters Bridge) to 4.753 Mi. W. Int. Rt. 20 (near Red Hill), approved February 28, 1957; and WHEREAS, it is the desire of this Board that sai~ road be improved in ac- cordance with said plans. NOW, THEREFORE, BE IT RESOLVED: That this Board hereby approves the plans and requests the Department of Highways to proceed with construction in accordance therewith, and this Board hereby agrees to assist and cooperate in the acquisition of the righ~ of way shown on plans as being required, it being~nderstood that costs for such right of way are to be paid from Secondary funds allocated or to be allocated to Albemarle County. It is further understood and agreed that in the event one or more property owners refuse to execute a deed covering land required .from their properties for right of way purposes that the Commonwealth Of Virginia, Department of Highways, will institute and conclude condemnation proceedings and that all costs are to be paid from Secondary funds allocatedor to be allocated to Albemarle County. Communication was received from Mr. Harry Guest, President of the Bellair' Owner's Assoc., regarding the hazardous condition of the entrance to Bellair from Route 250, West, and requesting some type of light at the entrance to alleviate the situation. Mr. Shields,.Resident Highway Engineer, ad- vised that this matter had been called to his attention and that he had written to the Planning Divisic of the Highway Department requesting a study of this matter and eXpected someone from that Division to meet with him and interested residents within a short'time. Communication was received from Mr. John B. Hemmings, Attorney, on behalf of Bellemoore Real~ Corporation, requesting that roads and streets within the boundaries of SeCtion III, IV and V of RUt- ledge SubdiVision be taken over by the State Department of Highways~as soon as said roads have been found to meet all Department of Highway specifications. On motion of Mr. Harris, seconded by Mr. Garnett, the following resolution was unanimously adopted:' BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that upon completion of roads within the boundaries of Section III, IV, ~nd V of Rutled~e Subdivision in accordance with standards and specifications of the Virginia Department of Highways, said completion being to the point where only o~inany maintenance will be required, and subject to recommendation of the State Resident Engineer, this Board will recommend acceptance of said roads into the Secondary System. Communication was received from the Virginia Department of Highways enclosing tentative allo- cations of interstate and primary construction funds as approved by the Highway Commission and advising of public hearing on same to be held on Friday, Ma~ 3~ 1957, at 9:00 A.M. in Richmond. Mr. Gilbert Campbell and Mr. Randolph Perry of the Chamber of Commerce appeared and presented to the Board a resolution drafted by a committee appointed in Harrisonburg with reSard to the location of the East-West highway from Richmond to the intersection of U.S. Route ll at Staunton. Mr. Campbell requested that this Board approve said resolution or adopt a resolution which the Board may 2eel more suitable and to forward same to Gener~ A~n~ n~ m~ ~ w~ ~ ................. WHEREAS, after caref~tl study over a period of years, the Virginia Highway Departm~ent, collaborating with the Federal Bureau of Roads, determined mpon and designated the interstate highways and their location in Virginia which will be inte- grated into the Interstate Highway and Defense System of the United States, and WHEREAS, U. S. Route 250 from Richmond westward to its intersection at Staunton with U. S. Route ll has been designated as a part of the National System, and WHEREAS, the location of this route in its present corridor is best sUited to meet defense necessities, since it leads from the Hampton Roads area through Rich- mond, Charlottesville ~ndWaynesboro to Sta~uton, along which route are located many important critical defense installations and industries and is indispensable as a line of communication in an emergency, and WHEREAS, this route is ideally located to accomplish the optimum of ob- jectives as provided in the criteria on which the Interstate System was selected by accomodating the maximum of civilian traffic, NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Albemarle County that the Virginia Department of Highways be-urged not to alter the already approved location of the East-West highway from Richmond to the intersection of U.S. Route ll at Staunton, Virginia. Mr. J, J. Edwards appeared with regard to a matter of service of the Virginia Telephone and Telegraph Company and extension of lines into the Mutual's territory. This matter was discussed and the Chairman appointed a committee consisting of Mr. Thraves and Mr. Sutherland to investigate the matter and to obtain the facts from the Virginia Telephone and Telephone Company and report back to the Board at its regular April meeting. Mr. M. M. Pence, Director of Finance, submitted Statement of Expenses of the Department of Finance for the month of February, 1957, of which one-half is to be borne by the State. On motion, duly made and seconded, this Statement was examined, verified and approved. Mr. M. M. Pence, Director of Finance, submitted Statement of Expenses of the Sheriff's Office for the month of February, 1957, of which two-thirds are to be borne by the State. On motion, duly made and seconded, this Statement was examined, verified and approved. Mr. M. M. ~ence, Director of Finance, submitted Statement of Expenses of the Office of the Commonwealth's Attorney for the month of February, of which one-half is to be borne by the State. On motion, duly made and seconded, this Statemen~ was examined, verified and approved. Statement of Expenses incurred in the maintenance of the County Jail for the month of February~ 1957, was presented along with Summary Statement of Prisoner Days. On motion, duly Sade and seconded, these Statements were examined, verified and approved. Reports of the Department of Public Welfare for the month of February, 1957, were presented in accordance with Sections 63-67.1 and 63-67.2 of the Code of Virginia. Claim of the University of Virginia Hospital in the amount of $2648.80 was presented and on motion of Mr. Sutherland, seconded by'Mr. Thraves, was unanimously a~proved for payment. Report of the County Executive for the month of February, 1957, was presented, a~proved and ordered filed. At !0:00 A.M., the time advertised for public hearing on a proposed Subdivision Ordinance, the Clerk read the following notice which was published in the Daily Progress on March 1st and March 8th: "Notice is hereby given that ~t the March meeting of the Board of 6ounty SupervisorE of Albemarle County to be held in the CoUnty Office Building on March 20, 1957, at 9:00 A.M., it is intended to propose for passage an Ordinance setting forth Regulations Governing Subdivisions as authorized by.Section 15~779 to Section 15-~94,3 of the 1950 Code of Virginia as amended. Notice is further given that public hearing on said proposed Ordinance will be held at 10:00 A.M. on the date abovementioned. By Order of the Board of County Supervisors of Albemarle County. (Signed) June T. Moon, Clerk The County Executive then read the proposed Subdivision Ordinance and recommendation was received from the Planning Commission that the same be approved. Numerous citizens from the County appeared and ex- pressed themselves in regard to the Ordinance, both for and against, After the public hearing the matter was taken under advisement and later in the meeting after further discussion, motion was offered by Mr. Harris, seconded by Mr. Smith, and unanimously carried, requesting the County Executive to obtain copies over to the next ~eg'~lar meeting for further consideration. The following budget of the Joint Airport Commission for the fiscal year 1957-58 was received from Mr. G. K. Tebell, Chairman, with the request that same be mpproved in accordance with the Airport Commission Ordinance: RECEIPTS: Rent: Holladay Aviation Total Receipts. DISBURSEMENTS: Lights; Runway Piney Mountain Lamps and Bulbs Insurance Miscellaneous Total Disbursements. $1,200.00 $1,200,00 $ 160.00 l O.OO 280.00 150.00 350.00 4 o.oo $1,200.00 On motion of Mr. Thraves, seconded by Mr, Sutherland, and unanimously carried, the foregoing budget was approved. Communication was received from~the Planning Commission enclosing draft of proposed Sanitation Ordinance and recommending the adoption of same. On motion of Mr~ Harris, seconded by Mro Thraves, and unanimously carried, this matter was taken under advisement. Mr. M. M. Pence, County Executive, advised that some time ago, this Board adopted a resolution charging off Cedar Rust Assessments and that the auditor~ohad questioned the Board's right to take such action in that the assessment was made under Court Order. Mr. Pence further advised that there remained unassessed $3,339.48 and also assessed and uncollected $234.31. He stated that the a~Hitors rendered t~ opinion that the amount assessed would have to be collected but that this Board could appropriate funds to take off the unassessed amount from the books. The Commonwealth's Attorney stated that he felt this procedure to be legal. On motion of Mr. Sutherland, seconded by Mr. Thraves, rules with regard to second readings were suspended and the following resolution u~animously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that $3,339.48 be and is hereby appropriated to erase from the County's books that amount of the Cedar Rust Assessment which has never been assessed. Mr. Pence was also instructed to advise those persons who owe unpaid cedar rust assessments that same should be paid since such assessments are a lien upon the property so assessed. A matter with respect to the disposition of land located on Farish Street for the Children's Home was presented. It was explained that several years ago the County of Albemarle, along with the City of Charlottesville and the Children's Home, had purchased certain real estate for the purpose of erecting a Children's Home. However, since the Children's Home had ceased to function as such, it ap- peared desirable to dispose of the property. After due discussion, and on motion of Mr. Garnett, seconded by Mr. Smith, the County Executive was authorized to join with the City of Charlottesville and the Children's Home Board in disposingof the subject property by sealed bids and subject ~ approval of the Court. Report was received from the Judge's Office Committee to the effect that the office being vacated by Judge Waddell would be of very little use for rental punposes in thatit has no outside entrance and, therefore, should be used jointly by the Sheriff's Office and the Court. On motion of Mr. Thraves, seconded by Mr. Sutherland, and unanimously carried, the.report of the committee was accepted and approved. Mr. M. M. Pence advised that he had obtained an e~timate of $165.00 for necessary repairs to the Jury Room, which estimate included cleaning off old pain~, sizing and painting the walls and ceilings with two coats, repairing cracks, calking windows and applying water proofing to brick on the outside. He further advised that a leak had been found in the roof over the jury room and he had had this leak repaired. Mr. Pence suggested that perhaps it would be more economical to include the foregoing project in the overall painting which would have to be done this year. probably a~o~d ~] ~ v+ ~ ~ ........ Report was received from the Parking Violation Committee advising that due to the fact that a matter which may effect the enforcement of parking violations has"been mentioned to various members of the committee in confidence, it is the opinion of the committee that action be withheld for the tim~ being. On motion of Mr. Garnett, seconded by Mr. Harris, and unanimously carried, report of the Com- mittee was accepted and it was ordered that the Board comply with the wishes of the Committee. Communication was received from Mr. I. To Quinn, Executive Director of the Commission of Gamt and Inland Fisheries, clarifying previous letter to this Board with reSard to request Napier, former Game Warden, for vacation pay. The County Executive was instructed to write Mr. Napier regarding this matter, enclosing copy of letter from Mr. Quinn. On motion of Mr. Smith, seconded by Mr. Thraves, rUles with regard to seco~ readings were suspended and. the following resolution unanimously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle Comuty, Virginia, that $75,153.55 be and is hereby appropriated for operation of schools for the month of April, 1957. ~. M. M. Pence, County Executive, advised that some time ago the City of Charlottesville chaEged its holiday schedule, deleting Armistice Day Znd adding Lee-Jackson Day andWashington~s Birth- day, and s~gested that the County follow 'the same policy. On motion of Mr. Harris, seconded by Nr. Sutherland, the following Holiday Schedule was unanimously adopted: New Year's Day - January 1 Lee-Jackson Day- January 19 Washington~s Birthday - February 22 Jefferson's Birthday ~ April Memorial Day - May 30 Independence Day - July A Labor Day - 1st Monday in September Thanksgiving Day - November Christmas Day - December 25 The County Executive reported on the progress made to date in obtaining land for county dumps and requested authority to proceed with the preparation of specifications, advertising for bids, con- struction of roads, etc. On motion of Mr. Harris, seconded by Mr. gmith, and unanimously carried, the County Executive was authorized to proceed in the foregoing channels in order to put the dumps into operation as s6on as possible. Plats were received on Sections l, 2 and 3 of Arlington Heights So. bd~ision, Section 6 of Rutledge Subdivision, and Sections l, 2 and 3 of Greenbrier Subdivision, as approved by the Planning Commissions of the County of Albemarle and t~e City of Charlottesville, and on motion of Mr. Garnett, seconded by Mr. Smith, and unanimously carried, were approved and the Chairman was authorized to sign same on behalf of the Board. Request was received from the Cushman Realty and Building Corporation that certain roads in Hessian Hills Subdivision be taken into the State Secondary Road System. On motion of Mr. Harris, seconded by Mr. Smith, the following resolution wa~ unanimously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that upon completion of Guilford Lane from Ben~ngton Road to Woodstock Drive and Woodstock Drive from Be~n~ington Road to dead end at temporary cul-de-sac, said roads being in Hessian Hills Subdivision, in accordance with standards and specifications of the Virginia Department of Highways, said completion being to the point where only ordinary maintenance will be required, and subject to recom- mendation of the State Resident Engineer, this Board will recommend acceptance bf the above mentioned roads into the~Secondary System. Present: Messrs. John W. Williams, Edgar N. Garnett, H. Ashby Harris, Edward L. Smith, M. Y. Su~herland, Jr., and Robert Thraves. Absent: None. Officers present: County Executive and Commonwealth's Attorney. The meeting opened withthe Lord's Prayer led by Nr. M. M. Pence. Minutes of the meeting of March 20, 1957, were read and approved. Mr. W. W. Shields appeared and presented prepared resolution with regard to right-of-way guarantee and construction of Route 679 to the West Virginia Pulp and Paper Company, and requested that the Board adopt such resolution and authorize the Chairman to sign copies for the Highway Department on behalf of this Board. In answer to question of the Board, Mr. Shields advised that the estimated con- struction cost was $14,900.00 whereas the original estimate had been in the approximate s~ of $6,000.00. It was the expressed feeling of the Board that if such resolution were adopted it should be conditioned upon report from Mr. Shields before construction was begun on this project and Mr. Shields agreed that he wo~d bring report back to the Board. In v~ew of the foregoing, motion was offered by Mr. Smith, seconded by~r. Garnett, and unanimously carried, approving the resolution .~as presented by Nr. Shields and authorizing the Chairman to sign same on behalf of the Board. Later in the meeting, Mr. Shields appeared and advised that he had found that the Board would be bound by said resolution. Due to the fac~ that the Board felt the cost of this project would be too heavy for ~the ~econdaryBudget to bear, the Foregoing motion was rescidded on motion of Mr. Smith, seconded by ~r. Harris, and unanimously carried, and the County Executive was requested to write the ~¥est Virginia Paper and Pulp Company regarding thi~ matter. Mr. Williams presented check in the amount of $700.00 received from residents in Buckingham Subdivision for their share of black topping roads in said subdivision. Mr. Williams advised that thi~ subdivision was established before the subdivision act went into effect and that the roads are in the State system. Mr. Shields advised that the contribution of the t~nd owners would be approximately one- half of the cost of surfacing and that he felt the Highway Department should do this work since the landowners were bearing part of the cost. The following Viewers' report was presented, and upon motion, made by Mr. Sutherland and seconded by ~r. Garnett, was accepted in accordance with Section 2039 of the Virginia Code: We, the undersigned, being Viewers appointed by your Board at its regular meeting of January 23, 1957, to view the following described section of road and make re- port to your body hereby wish to advise that on March 18, 1957, we did view the following section of road and make report on same. Beginning at Route 7~3 at Grinnell's property and ending at Mr. James B. ~urray's property. (.76 mile) ~e'met petitioners at Mr. Grinnell's place on Route 743 and conferred with them as to their land and needs. ~e then inspected the petitioned for road, finding same graded and drained 16' wide between edge of sbo~J~ ~ .... ~ ....
