SECTION II.
Every person, firm and corporation engaged in the business of selling goods~ wares and mer-
chandise through the use of coin operated vending machines shall be classified as a retail merchant and
shall pay an armual license tax fo~ the privilege of doing business in this County of twenty dollars~
provided~ however, that if any such person~ firm or corporation has more than one definite p~ace in this
County at which goods, wares, or merchandise are stored, kept or assembled for supplying such vending
machines, the annual license tax hereby imposed shall be twenty dollars additional for each such definit~
place in excess of one. The license tax aforesaid shall not be subject to proration~
Everyperson, firm and corporation shall also pay a tax of twenty cents on every one hundred
dollars of gross sales through such vending machines in excess of two thousand dollars in each calendar
year~ or part thereof. Such volume tax shall be assessed and collected by the Director of Finance of
Albemarle Cotu~ty after the first day of January and before the last day of January following the calen~
dar year in which such business is done, under such rules and regulations as may be prescribed by the
Director of Finance.
The taxes imposed by this ordinance shall be in lieu of any license tax on the individual vend
ing machines and this ordinance shall not apply to any vending machine ~oon which the license tax is pai~
· under the provisions of Section I of this ordinance.
Every vending machine shall be plainly marked by the owner therof with the name and address
of such owner.
The term'"vending machins"~ as used in this section, includes only such machines as vend goods
wares and ~erchandise and give to the customer on every~purchase his money's worth in goods, wares or
merchandise~ The term does not include any machine the operation of which is prohibited by law~ nor
any machine which has any gambling or amusement feature whatsoever.
Every person, firm or corporation liable to apy the tax hereby imposed shall anually make a
report to the Director of Finance, as directed by him and on forms supplied by him~ on all sales in the
County through such vending machines.
This Ordinance shall be in f~l force and effect on and after Narch l, 1959.
Claim against the Dog Tax Fund was received from Mrs. J. L. Branham for nine hens killed by
dogs. On motion of Mr. Sutherland~ seconded by Mr. Harris, Ers. Branhamwas allowed $1.50 for each of
these hens.
Claim against the Dog Tax Fund was received from Mr. S. N. Harris for five geese killed by
dogs. On motion of Nr. Sutherland, seconded by Mr. Thraves, Nr. Harris was allowed $2.00 for each of
these geese.
Claim against the Dog Ta~ Fund was received from ~r. James C. Andrews for one pig killed by
dogs. On motion of Mr. Harris, seconded by Mr. Sutherland~ ~r. Andrews was allowed $10.00 for this pig.
Mr. Edgar Garnett advised that certain people appeared in the audience earlier during the day
with regard to the improvement of Route 667. He stated that due to the number of people present, they
were unable to remain until such time as they could present their request to the Board and that he was sc
presenting ~heir request. He advised that although Route 667 was in the Secondary System, the residents
along said road desired certain improvements, including surface, in order to shorten the distance to
Charlottesville. On motion by Nr. Garnett, seconded by ~r. Smith, this matter was referred to the
Resident Engineer of Highway~.
Claims against the County amounting to $22%,8A%.82 were presented~ examined and allowed2 and
certified to the Director of Finance for payment and charged against the following funds:

A regular meeting of the Board of County Supervisors of Albemarle County, Virginia, was held
at the Office Building of said County on the 18th day of March, 1959.
Present: Messrs. ~John W, Williams, Edgar N. Garnett, H. Ashby Harris, Edward L. Smith, M. Y.
SUthe~land, Jr., and Robert Thraves.
~bsent: None.
Officers present: County E~ecutive.
The mee%ing opened with the Lord's Prayer led by Mr. M. M. Pence.
Minutes of the meeting of February 18, 1959, were read and approved.
The Director of Finance submitted Statements of Expenses for the Department of Finance, the
Sheriff's Office and the Office of the Commonwealth's Attorney for the month of February, 1959. On
motion of Mr. Smith, seconded by Mr. Garnett, these Statements were. examined, verified and approved.
Statemen~ of Expenses incurred in the maintenance of the County Jail for the month of February
1959, was submitted along with S,,m~ary Statement of~ Prisoner Days. On motiono£Nr. Sutherland, seconded
byMr. Thraves, these Statements were examined, verified and approved.
Claim of the Jail Physician in the amount of $3.00 was presented, and on motion of Mr. Harris
seconded byMr. Garnett, was approved for payment.
Reports of the Depar+~ment of Public Welfare for the month of February, 1959, were presented a~
approved in accordance with Sections 63-67.1 and 63-67.2 ofthe Code of Virginia.
Claim of the University of Virginia Hospital in the amo~ut of $1,757.00, of Which one-half is
reimbursable by the State, was presented and on motion of Mr. Gar~ett, seconded by Mr. Smith, was ap-
proved for payment.
Budget of the Department of Public Welfare for the year ending June 30, 1960, in the total
snm of $231,698.00 was presented and on motion of Mr~ Thraves, seconded by Mr. ~rris, this budget was
approved and-the Chairman and Clerk were authorized to execute same on behalf of this Board.
Report of the County Executive for the month of February, 1959, was presented and on motion
of Mr. Sutherland, seconded byMr. Thraves, was approved and ordered filed.
On motion of Mr. Harris, seconded by Mr. Garnett, rules with regard to second readings were
suspended; and the following resolution unanimously adopted:
BE IT RESOLVED by the Board of County Supervisors of Albemarle County,
Virginia, that $94,627.40 be and the same is hereby appropriated for operating
expenses of the School Board. for the month of April., 1959.
An offer of $65.00 was received from Mr. R. B. Godwin for a tract of land located in the
Scottsville Magisterial District, containing 3.84 acres and owned by this County. On motion of Mr.
Sutherland, seconded by Mr. Thraves, this offer was referred to Mr. Harris and Mr. Pence or M~. Simms
for investigation ~nd report to this Boardl
Request was received from the Crozet Fire Company for an additional street light at Crozet to
be located on Pole No. A~30 opposite the entrance to K. W. Start property on State Route 240. The
Communication further stated that the Crozet Fire Company wo~ld assume the responsibility for payment
of $18.00 per year on said light. On 'motion of Mr. Garnett, seconded by Mr. Smith, the County Executive
was authorized to instruct the Virginia Electric and Power Company to proceed with the installation of
the light as requested.
Notice was received of public hearing before the State Corporation Commission at 10:00 A.M.
on April 7, 1959, on the p~tition of The Chesapeake and Ohio Railway Company seeking authority to dis-
continue its agency station at Cobham, Virginia, and also petition of the Railway Express Agency for
authority to discontinue the express agency at Cobham, Virginia. Mr. Henry Sadler appeared on behalf
of several persons in the Cobham area regarding this matter. He stated that although they wished to
have the station remai~ he doubted that the case would be strong enough to oppose the petitioned for
action. Mr. Sadler stated he would contact those most effected and if in their opinion, someone should
appear at the hearing, he would so advise Mr. Thraves of the Rivanna District.
An agreement on certain electric line to the airport and beyond as prepared by the Virginia
Electric and Power Company, and previously approved by the City Council, was presented~ After dis-
cushion of this matter, the following resolution was offered by Mr. Harris, seconded by Mr. Sutherland,
and uns~uimously adopted:
BE IT RESOLVED, that the Chairman and the Clerk of the Board of County
Supervisors of Albemarle County be and they are hereby authorized to execute a
certain agreement of easement to bear date as of March 9, 1959, conveying to the
Virginia Electric and Power Company, a corporation organized and e×isting under
the laws of the State of Virginia, a right of way across the propert~ of the
County of Albemarle, as shown by plat bearing No. CH-2737, exhibited to the Board.
of County Supervisors of Albemarle County, same to be signed by the Chairman on
behalf of the Board of County Supervisors of Albemarle County and attested and
seal affixed by the Clerk.
Pursuant to Sections 15-282(2) and 15'300 of the Code of Virginia, the County Executive pre-
sented to the Board the proposed budget for the year 1959-60. On motion of Mr~. Harris, seconded by Mr.
Garnett, it was ordered that a synopsis of the proposed 1959-60 budget be advertised in the Daily
Progress in accordance with law and April 22, 1959, at lO:00 A.M. in the County Office Building was set
as the time and place for the public hearing on same.
Claim against the Dog Tax Fund was received from Mr. E. R. Sutherland for seven ewe~~ and one
lamb killed by dogs. On motion of Mr. Sutherland, seconded by Mr. Thraves, Mr. Sutherland was alloWed
$22.00 for each of these ewes smd $10.00 for the lamb.
Claim against the Dog Tax Fund was received from Mr. David Ludwig for twelve pullets and one
rooster killed by dogs. On motion, this claim was carried over for consultation with the Commonwealth's
Attorney due to the fact that Mr. Ludwig's dog was involved .in the claim along with another dog.
Claim of Mr. J. F. Page against the dog Tax Fund for one ewe killed by dogs was received. On
motion of Mr. Sutherland, seconded by Mr. Garnett, Mr. Page was allowed $25.00 for this ewe.
C~aim against the Dog Tax Fund was received from Mrs. George Wilson for three hens and one
guinnea killed by dogs. On motion Of Mr. Sutherland, seconded by Mr. Smith, M~s. Wilson was allowed
$1.50 for each of the hens and $0.50 for the guinnea.
Claim against the Dog Tax Fund was received from Mr. J. Prescott Carter for one ewe killed by

calf killed by dogs. On motion of Mr. Thraves, seconded by Mr. Sutherland, Mrs. Walton was allowed
$10.00 for the pig and $25.00 for the calf.
Claim against the Dog T~x Fund was received from Mr. R. L. Heath for one lamb .killed by dogs.
On motion of Mr. Sutherland, seconded by Mr. Gar~uett, Mr. Heath was allowed $15.00 for this lamb.
Claim against the Dog Tax Fund was received from Mr. Charles W. Byars for one goat killed by
dogs. On motion of Mr. ~Sutherland, seconded by Mr. C~rnett, Mr. Byars was allowed $3.00 for this goat.
Claim against the Dog Tax Fund was received from Mr. J. G. Douglas for six ducks killed by
dogs. On motion of Mr. Thraves, seconded by Mr. Sutherland, Mr. Douglas was allowed $1.50 for each of
these ducks'.
The Committee composed of Messrs. Garnett, Sutherland, and Thraves, appointed to obtain data
regards the proposed construction of a dam on Beaver Creek, on State Route 680, reported on their pro-
gress to date. They advised that permission had been obtained from all landowners involved but two for
purposes of making a preliminary survey, and it appeared as if .the owners of these two tracts might be
somewhat reluctant to agree to a survey. On motion, duly made and seconded, it was unanimously RESOLVED
that the committee proceed by authorized means to obtain the necessary information and to report its
findings to the Board at the earliest possible ~ime.
Mr. H. W. Runkle, Resident Engineer, reported that there was no money available for improve-
ments to secondary roads and that he has a number of approved requests on file for inclusion in the
secondary system. Mr. Pence reported on a meeting of administrators of urban counties with certain
representatives of the Highways Department regarding this matter. After considerable discussion, Er.
Williams suggested, that a resolution be forwarded to the Governor, members of the General Assembly, the
HighwayJDepartment and to all Boards of Supervisors, requesting that a loan to the Highway Department
be made from the General Fund until the increase in gas tax is realized or some other formula is devised
for highway funds. On motion of Mr. Thraves, seconded by Mr. Sutherland, the following resolution was
unanimously adopted:
BE IT RESOLVED that the Board of County Supervisors of Albemarle County, Virginia,
does vigorously oppose the depletion of secondary road funds for the vitally important
rural roads of the State of Virginia, and does hereby urgently request the Governor of
Virginia, the General Assembly of Virginia, and the Virginia Department of Highways to
save and improve our system of farm-to-market roads, and to emphasize the importance of
good rural roads for the necewsary convenience of all residents; as a means for pro-
viding and maintaining services necessary for the health, protection~and general welfare
of residents and property; and to promote and maintain overall economic conditions of
the State.
They are further requested to effect all economies possible and to seek such
other formulas as are necessary to provide ~sufficient funds to assure serving the
citizens of our counties and townS. A!so, to emphasize the necessity for continued
future efforts to expand, improve and adequately maintain an efficient system of secon-
dary roads.
BE IT FURTHERRESOLVED that attested copies of this resolution be sent to th~
Governor of Virginia, to Albemarle County's representatives~in~t-he General Assembly, to
the Virginia State Highway Commissioner, and to each Board of Supervisors in the State.
Petetion was received from a number of residents requesting inclusion in the Secondary System
of Ap~et~se Road, from U. S.~Route 29 to Stadium Road, a distance of ~2 of a mile. It was pointed out tl
this road was developed prior to the adoption of subdivision regulations. On motion by Mr. Sutherland,
seconded by Mr. Thraves, the following resolution was unanimously adopted:
BE IT RESOLVED by the Board of County Supervisors of Albemarle C~unty, Virginia,
that the Virginia Department of Highways be and is hereby requested to accept~into the

Secondary System of Highways Appletree Road, beginning at U. S. Route 29, South,
and ending at Stadium Road, a distance of .2 mile.
BE IT FURTHER RESOLVED that the Virginia Department of Highways be and
is hereby guaranteed a 40 foot unobstructed right of way along this requested ad-
dition, the same having been dedicated in 1936 and recorded that year in Deed
Book 234, page 142 in the office of the Clerk of the Circuit Court.
Nrj Marsh appeared and requested that the old road by the rock church at~ Rio be abandoned.
Marsh advised that this old road was abandoned in 1919 when a portion of the r~ad was relocated and had
never been used nor did it revert to the owners. On motion of Mr. Garnett,. seconded by Mr. Harris, this
matter was re~erred to the Commonwealth's Attorney for investigation and report.
A group of citizens, heade~ by Dr. DeMilia, appeared requesting improvements to Route 667i
This group was advised that because of insufficient funds, improvement at this time was impossible.

do hereby waive notice and special service thereof, of a meeting to be heldJ~at 7:30 P.M. on
the eighth day of April, 1959, in the County Office Building, Charlottesville, Virginia, for
the purpose of considering the following:
(1) Airport Administration B~lding.
(2) Comm~ication relating to Real Estate Taxes.
