A regular meeting of the Board of County Supervisors of Albemarle County, Virginia, was held
at the Office Building of said County on the 17th day of February, 1960.
Present: -Messrs. John We Williams, Edgar N. Garnett, H~ Ashby Harris, George C. Palmer II,
M. Y. Sutherland, Jr. and' Robert Thraves.
Absent: None.
Officers Present: County Executive
The meeting opened with the Lord's Prayer led by Mr. M. M. Pence.
Minutes of the meeting of January 20, 1960 were read and approved.
Mr. George T. Huff appezred regarding Free Union bridge over Mooreman's Ri~ver~ Mr. H. W.
Runkle, Resident Highway Engineer, Sd. vised Mr. Huff that this bridge had been placed in'the Federal Aid
Program but that work would not be begun on same until about 1962.
Mr. Huff also appsarBd regarding road over the C&ORailroad at the~ Woolen Mills and this
matter was referred to Viewers.
Mr. LeghWalker and Mr. Curtis Thacker appeared on behalf of the Monticello Memorial FoundRtio
requesting that road to Monticello he,straightened. Mr. Thacker advised that during the past year 1158
buses visted Monticello and there were 240,000 paid visigors. He also stated that the majority of the
necessary right of way could be given by the Monticello Memorial Foundation. After considerationof
this request~othe following resolution was offered by Mr. Harris, seconded by Mr. Palmer,~and unanimousl
adopted:-
BE IT RESOLVED by the Board of County Supervisors of Albemarle County,
Virginia, that the State Department of Highways be and is hereby requested to
give consideration in its budget for the allocation of sufficient funds to improve
and straighten Route 53 from Route 20 to the entrance of Monticello and thence, if
funds are available, to the foot of Monticello Mountain along the road leading to
Ash Lawn.
Communications were received from the State Department of Highways advising that the following
additions to the Secondary System had been approved effective January l, 1960:~
(1) Forest Hills Subdivision (Rock CreekRoad) From. S.C.L. of Charlottesville
to Intersection Laurel Circle - length 0.03 mile.
(2)Forest Hills Subdivision (Laurel Circle) from Intersection Rock Creek Road
to Dead End - length 0.10 mile.
(3~ Greenbrier Subdivision - ~Banbury Street) from Intersection Route 1403
(Tarleton Drive) 0.05 mile S.W. Intersection Rt. 631 to Intersection Route
1403 (Tarleton Drive) 0.25 Mil S.N. Intersection Rt. 631 - length 0.35 mile.
On motion of Mr. Harris, seconded by Mr. Thraves, and unanimously carried? the following
persons were appointed to service as Viewers for 1960, any three of whom may serve:

Mr. O. R. Randolph was presented and on motion of Mr. Sutherland, seconded by Mr. Garnett, was approved
and the Chairman and Clerk were authorized to sign same on behalf of this~ Board.
Plat as prepared by ~r. O. R. Randolph was presented on Wilder Drive Subdivision~ On motion
of Mr. Garnett, seconded by Mr. Palmer, this plat was approved subject to signing by the City Planning
Commission and the Chairman and Clerk were authorized to sign same on behalf of this Board.
Mr. William P. Moore, Jro, representing seventy-two families in Bellair, appeared regarding
fire hydrants in the Bellair Subdivision. Mr. Moore advised that the fourteen hydrants in Bellair were
installed before the formulation of a County policy and that standard fittings were used w~reas the Cil
and County fire equipment does not use standard fittings. Mr. Moore advised that the cost of renewing
these fittings would be approximately $423.60 and requested that the County participate in one-half of
the cost due tb~the foregoing circumstances~ The County Executive stated that all fitting should be mad
uniform and recommended that the County s~re in one-half of this cost. On motion of ~r. Thraves,
Seconded by Mr. Palmer, the request of Mr. ~oore was approved.
Communication was received from the Albemarle Squadron of the Virginia Wing of Civil Air
~atrol advising that said organization was planning to erect a hangar and operations room at the Univer-
sity of Virginia Airport and would appreciated the Board's consideration of the donation of the ground
observer post buildings which are no longer used in the County. On motion of Mr. Sutherland, seconded
Statements of Expenses of the Department of Finance, the Sheriff's Office, and the Office of
the Commonwealth's Attorney for the month of January, 1960, were presented, and on motion of Mr. Palmer,
seconded by Mro Harris, were examined, verified and approved.
Statement of Expenses incurred in the maintenance of the County Jail was submitted along with
Summary Statement of Prisoner Days for the month of January, 1960. On motion of Mr. Sutherland, seconde
%ryNr. Garnett~ these Statements were examined, verified and approved.
Reports of the Department of Public Welfare for the month of January, 1960, were presented in
accordance with Sections 63-67.1 and 63-67.2 of the Code of Virginia, and on motion were approved.
Claim of the University of Virginia Hospital in the amount of $1,420.00, of which one-half is
reimbursable by the State, was presented and on motion of Mr~ Palmer, seconded by Mr. Garnett, was ap-
proved for payment.
On motion of Mr. Sutherland, seconded by Mr. Harris, rules with regard to second reading were
suspended, and the following resolution unanimously adopted:
BE IT RESODVED by the Board of Supervisors of Albemarle County, Virginia, that the
following appropriations be and the same hereby are made for the month of March,
1960 from the funds and for the functions or purposes indicated:

Mr. Thraves nominated Mr. Hamilton Burnet of Advance Mills to serve on the Equalization Board
for the year 1960. ~[r. Guy Via of Free Union was nominated by Mr. Garn~tt. In voting on the foregoing
nominees Mr. Burnet received three votes and Mr. Via received three. This matter was carried over.
Report of the Coun~ Executive was presented and on motion, duly made and. seconded, was approve
and ordered filed.
Mr. George Palmer, Chairman e£ t~e Land Use Committee, recommended the appropriation of
$500.00 for the emplo~nent of State Plarming permonnel in the preparation of a land use map for AI~-
mar!e County. On motion of ~r. Palmer, seconded by ~r. Garnett, rules with regard to second reading
were suspended and the following resolution ,unanimously adopted:
BE IT RESOLVED by the Board of County Supervisors of Albemart~ County,
Virginia, that $50~.00 be and the same is hereby appropriated for the emp!o~nent
of State Planning ~ersonnel in the preparation of a land use m~p of Albemarle
County.
Report was received from the Mater Shed Committee in which said committee recommended that
initial steps be taken in proceding with the Beaver Creek Dam pro~ect a~ soon as the financial status
will permit. Action on this recommendation was deferred until later this month.
The Chairman called for public hearing on the amended Slot ~achine Ordinance in accordance
with notice of intent to adopt which was published in the D~ily Progress in accordance with law. The
County Executive read all proposed chanEes in this Ordinance, complete copies of which had been mailed
to the Board previously. There being no discussion of this matter by the Public, the ordinance was
as follows

AN ORDINANCE I~IPOSING TAX ON SLOT MACHINES AND
MERCHANTS PLAC. lNG VENDING ~LACH!~ES_ ~ ..
BE IT ORDAINED by the Board of County Supervisors of Albemarle County, Virginia, that on the
17th day of February, 1960, and in pursuance to Sections 58-361, ~58-36!.! and 58~367.2 of the 1950 Code
of Virginia as amended that:
SECTION I.
Any person, firm or corporation having on a road, street or alley, or other public place or
in shops, stores, hotels, boarding houses, depots, public or private rooms, or any other p~lace anywhere
in this County a slot machine of any description into which are dr.opped coins to dispose Of any article
of merchandise or for the purpose of operating musical or other devices that operate on t~e coin-in-the-
slot principle, used for gain, except as a pay telephone, s'hall pay for every such slot machine or
musical or prier device as the case may be, a license tax of $2.50 (two dollars fifty cent's) per year on
machines where the customer pays 15 (one cent) and a license tax of $5.00 (.fi~e(dollars) Oer year on
machines where the c~tomer pays more than 15 (one cent) to operate, except automatic baggage or parcel
machines or receptacles which are used for the storage of baggage, parcels of any character on which
shall be levied a tax of 25¢ (twenty~five cents) per year for each receptacle that is operated on the
coin-in-the-slot principle; except, however, that license of coin-operated laundry machines or devices
shall be as follows:
(1) For each washing machine there is hereby l'evied a county license tax of $2.00 (two
dollars) per year;
(2) For each drying machine there is hereby levied a county license tax of $2.00 (two dollars)
per year;
(3) For each combination machine that does both washing and drying there is hereby levied a
county license tax of $~.00 (four dollars) per year;
(~ For each ironing machine there is hereby levied a county license tax of $2.00 (two dol-
lars) per year~
(5) For each vending machine located on the premises of a s~lf-service laundry and used to
vend soaps or detergents, there is hereby levied a county license ~tax of $2.00 (two do!lars~ per year~
(6) For each coin-operated change machine wherever located in the county, there is hereby
levied a county license tax of $2.00 (two dollars) per year.
Provided, however, that no such person, firm or corporation may keep, maintain, exhibit or
operate any slot machine or any device in which the element of chance enters or which gives out any
slugs or checks or device which may be used to again operate the machine or gives out any prize or any II
other articel than the article of merchandise or music in payment for which the coin was originally
deposited; provided further, that this ordinance shall not apply to slot machines that are used for the
purpose of selling individual sanitary drinking cups, or Uo S. Postage Stamps.
This license is not transferable' and is not to be pro-rated.
Any person violating any provision of this section shall be fined not less than $5.00 (five
dollars) nor more than $50.00 (fifty dollars) for each day and the machine shall be confiscated.
Each license issued shall show the manufacturer's number° If the machine has no number the
license must be posted in a conspicuous place on the machine~
SECTION II.
Every person, firm and corporation engaged in the business of selling goods, wares and mer-
chandise through the use of coin~operated vending machines shall be classified as a retail merchant and
shall pay an annual license tax fo~ the privilege of doing business in the County of $20.00 (twenty
dollars~; provided, however, that if any such person, firm or corporation has more than one definite
place in this County at which goods, wares, or merchandise-are stored, kept or assembled for supplying
such vending machines, the annual license tax hereby imposed shall be $20.00 (twenty dollars~ additior~l
for each such definite place in excess of one. The license tax aforesaid shall not be subject to pro-
ration.
Every person, firm and corporation shall also pay a tax of 20¢ (twenty cents) on every one
hundred dollars of gross sales through such vending machines in eEcess of two thousand dollars in emch
calendar year, or part thereof. Such volume tax shall be assessed and collected by the Director of
Finance of Albemarle County after the first day of January and before the last day of January following
the calendar year in which such business is done, under such rttles and regulations as may be prescribed
by the Director of Finance.
The taxes imposed by this ordinance shall be in lieu of any license tax on the individual
vending machines and this ordinance shall not apply to any vending machine upon which the license tax is
paid under the provisions of Section I of this ordinance.
Every vending machine shall be plainly marked by the owner thereof with the name and address
of such owner.
The term "vending machines", as used in this section, includes only such machines as vend goods
wares and merchandise and give to the Customer on every purchase his money's worth in goods, wares or
merchandise. The term does not include any machine the operation of which is prohibited by law, nor any
machine which has any gambling or amusement feature whatsoever.
Every person, firm or corporation liable to pay the tax hereby imposed shall annually make a
report to the Director of Finance, as directed by him and on fo~m~ ~ ~ ~ ~.~ ~ .... ~ ........

This Ordinance shall be in full force and effect on and after February l?, 1960o
Communication was received from the Department of Agriculture, Division of Animal and Dairy
Industries, advising that Albemarle County would be placed under its testingprogram for brucellosis
as soon as possible after July l, 1960o
Notice was received from the State Corporation Commission concerning public hearing to be
held on February 29, 1959, on application of the Southern Railway Company for authority to discontinue
the agency station at Covesville, dismantle and retire the depot b~Elding and erect in lieu thereof a
standard waiting booth-wareroomo Mr. Sutl~rland advised that he had contacted residents in that area
and found no opposition to said application.
