The meeting opened with the Lord's Prayer led by Mr. M. Y. Sutherland.
Minutes ~of the meeting of October 19, 1960, were read and approved.
Communication was received from the Virginia Department of Highways advising that Agnese St.
in Woodhayven Subdivision had been accepted into the Secondary System .effective October l, 1960.
Communication was received from Mr. H. H. Harris, State Highway Commissioner, with regard to
action by this Board at its last meeting concerning secondary funds for construction of road between
Route 250 and the birthplace of Thomas Jefferson. Mr. Harris stated that a search of his files showed
no evidence that said road would be financed from any special fm~ds and further, that the road was ac-
cepted into the Secondary System as a result of the Board's resolution of May 16, 1956. The Chairman
advised that Mr. William S. Hildreth was advised by General Anderson in a conversation that special
funds would be used for this project and requested the County Executive to obtain letter from Mr.
Hildreth to this effect and forward same with letter to Mr. Harris.
Plat was received on Section One of Cedar Hills Subdivision oWned by M. H. MeJv~urdo, as pre-
pared by Mr. Amos R. Sweet, the same having been previously approved by the County and City Planning
Commissions. On motion of Mr. Thraves, seconded by Mr. Harris, this plat was approved and the Chairman
and Clerk were authorized to sign same on behalf of this Board.
Application was received from the Virginia Land Company to operate water system in NOrt.hfie!ds
Subdivision, enclosing permit from the State to operate same. The County Executive advised that this
system had not been .completed. On motion of Mr. Palmer, seconded by Mr. Sutherland, this system was
given tentative approval pending further study.
Judge Stuart Head appeared in response to letter received from this Board with regard te
hunting. He stated that any problems with regard to illegal hunting should be brought to his CoU~t
through the Commonwealth's Attorney. Letter was also received from the Department of State Police ad-
vising that that department would do everything possible to alleviate the problem of parking along the
roads in Albemarle County during hunting season.
Mr. H. Ashby Harris introduced Mr. Chester Baker and recommended ~';his appointment as extra
deputy during the hunting season, which recommendation was seconded by Mr. Palmer, it being ordered
that the Sheriff be advised of this recommendation.
Mr. Wright Harrison and a group of citizens from the Crozet area appeared and requested aid
in obtaining a new fire Truck for the Crozet Fire Company. Mr. Harrison s~ted that approximately
$7,500.00 had been raised by the Fire Company and that approximately $9,500.00 additional funds.were
needed. He further stated that his group would like the County to contribute on a matching basis.
The Chairman explained to the group present the background in obtaining equipment and personnel for the
Central Fire District. After a lengthy discussion of this matter, the following resolution was offered
by Mr. Palmer, seconded by Mr. Garnett, and unanimously approved:
BE IT RESOLVED by the Board of County Supervisors of Albemarle County,
Virginia, that $9,500.00 be and the same is hereby loaned to the Crozet Fire
Company toward the purchase of a fire truck, said loan to be non-interest bearing
and to be repaid from receipts of the Fire Company at the rate of $500.00 per year.
BE IT FURTHER RESOLVED that the Chairman appoint a committee to study
the fire protection problem of the County as a whole.

Statements of Expenses of the Department~of Finance,~the Sheriff's Office and the Office of
the Commonwealth's Attorney for the month of October, 1960, were presented, and on motion of Mr.
Sutherland, seconded by Mr. Palmer, were examined, verified, and approved.
Statement of Expenses incurred in the maintenance of the County Jail was submitted along with
Summary Statement of Prisoner Days for the month of October, 1960. On motion of Mr. Garnett, seconded
by Mr. Thraves, these Statements were examined, verified and approved.
Reports of the Department of Public Welfare for the month 'of October, 1960, were presented in
accordance with Sections 63-67.1 and 63-67.2 of the Code of-Virginia.
Claim of the University of Virginia Hospital in the amount of $331.50, of which one-half is
reimbursable by the State,was presented and on motion of Mr. Palmer, seconded by Mr. Garnett, was ap-
proved for payment. "
Report of the County Executive for the month of October, 1960, was presented, appr0~ed and
ordered filed.
On motion of Mr. Harris, seconded by Mr. Sutherland, rules with regard to second reading were
suspended and the following resolution unanimously adopted:

On motion of Mr. Palmer, seconded by Mr. Harris, the Director of Finance was authorized, to
defer the sale to the' Commonwealth of 1958 delinquent lands until April, 1961.
Claim against the Dog Tax Fund was received from Dr. A. F. Demilia fOr' one ewe lamb and one
lamb (sex undetermined) killed by dogs. On motion of Mr. Harris, seconded by Mr. Garnett, Dr. Demilia
was allowed $17.00 for each of these lambs.
Claim against the Dog Tax Fund was received from Mr. Lester Seal for one pig killed by dogs.
On motion of Mr. Harris, seconded ~ by Mr. Garne%t, Mr. Seal was allowed $16.00 for this pig.
Claim against the Dog Tax Fund was received from Mr. Guy Via for three sheep and one lamb
killed by dogs. On motion of Mr. Palmer, seconded by Mr. Harris, Mr. Via was a¥1owed $15.00 for each
of the sheep and $10.00 for the lamb.
Communication waw received from Mrs. Lucy L. Bleecker, President of the S.P.C.A., advising
that the S.P.C.A. wished to present to the County of Albemarle a dart gun to be ~sed by the dog warden
instead of a regular gun in capturing "hard to catch" dogs~ On motion of Mr. Palmer, seconded bY Mr.
Thraves, the CoUnty Executive was directed to acknowledge Mrs. Bleecker's letter with thanks.
On motion of Mr. Palmer, seconded by Mr. Garnett, the following resolution- was adopted by the
following recorded vote: Ayes: MessrS. Garnett, Harris, Palmer, Sutherland and Th~aves. Noes: Nons.

BE IT RESOLVED by the Board of County Supervisors of Albemarle County,
Virginia, that this Board's representatives on the Planning Commission be-and are
hereby directed to go forward on the land use development 'program as rapidly~as
possible.
Mr. Robert Musselman and Mr. William Aaron, attorneys representing the Continental Baking
Company in annexation, appeared with regard to their hearing on an appeal to be held next week and asked
if it would be this Board's wish to have the County's attorneys present at said hearing. They were
advised that the County had made no decision with regard to an appeal, and further that they would be
advised of this Board's action in this regard.
The Sheriff's Committee reported that in accordance with wishes of the Board, they had con-
ferred with the Sheriff regarding the employment of an additional deputy in his office. They advised
that due to the volume of papers now required to be served by that office, plus they'amount of time
each deputy was required to be in Court, was causing a back-log of work in that office.~ They advised
that in accordance with previous authority, they in turn had authorized the Sheriff to employ an ad-
fulltime
ditional/deputy. The Board was informed that ~Ir. Walter Ross Crebbs had been employed at a salary of
$300.00 per month. .They stated that Mr. Crebbs had previous police ~xperience and had attended F.B.I.
School. The Committee recommended that the Board request the Compensation Board to participate in the
BE IT RESOLVED by the Board of County Supervisors of Albemarle County,
Virginia, that the State Compensation Board be and is hereby requested to parti-
cipat-e in the salary and' expenses of Walter Ross Crebbs, additional Deputy Sheriff
employed by the Sheriff of Albemarle County, effective November l, 1960, at an
annual salary of $3,600,00.
The Chairman called for public hearing as per the following notice which was published in
the BaLly Progress on October 21 and October 28, 1960:
"Notice is hereby given that at a regular meeting of the Board of County Super-
visors of Albemarle County, Virginia, to be held on November 16, 1960, it is
tended to adopt an ordinance to provide for the employment of a County Dog Warden
and fixing the amount of dog license, and public hearing on same has been set
for lO:00 A.M. on said date.

The County Executive read the proposed Ordinance. No one from the public appeared to be
heard en same. After discUSsion by the Board, said Ordinance was adopted as follwws and was ordered

AN ORDINANCE TO PROVIDE FOR THE REGULATION OF DOGS IN THE COUNTY
OF ALBEMARLEA. VIRGINIA, AND PRESCRIBING PENALTIES FOR ITS VIOLATION.
BE IT ORDAINED by the Board of County SuperVisors of Albemarle County, Virginia, as follows,
to-wit:
Section 1. Authority for Don Warden. - In accordance with Sections 29-184.2 and 15-8 of the
1950 Code of Virginia, there is hereby created the position ef Dog Warden and provisions made for the
licensing and regulation of dogs in this County. The duties of the DogTi~arden shall be those provided
for in Sections 29-184.2 and such other duties as may be provided for by the Board of Supervisors.
Section 2.~ Definitions Generally. - For the purpose of this ordinance, and unless otherwise
required hy the context:
(a) "Livestock" includes cattle, sheep, goats, swine, and enclosed domesticated rabbits or
hares.
(b) ,P~r~' includes all domestic fowl and game birds, raised in captivity.
(c) "Own" and "~M~er" includes any person having a right of property in a dog; any person
who keeps er harbors a dog or .has it in his care, or who acts as its cUStodian; and any person who
permits a dog to remain on or about any premises occupied by him.
(d) "Kennel" means an enclosure wherein dogs are kept and from which they cannot escape.
(~) ,~og Wardem~ means any dog warden appointed under this ordinance and in accordance with
Sections 29-184.2 of the 1950 Code.
(f) "Other Officer" includes all other persons employed or elected by the people of Virginia
or by any municipality, county or incorporated town thereof whose duty it is to preserve the peace, to
make arrest, or to enforce the law.
(g) "Birector~of Finance" includes the Director of Finance of this county or other officer
desig~nated by law to collect taxes in this county.
~e~ti0n ~3. Amount~of License. - It shall be unlawful for any person to own a dog four months
eider over in this co~uuty unless.such dog is licensed, as required by the provisions of this ordinance~
Dog licenses shallot mn by the calendar, namely, from January 1 to December 31, inclusive, and the
license tax shall~be payable at the office of the Director of Finance and shall be as follows:
Male. - For a male dog., 2~_~.
Unsexed Female. - For an unsexed (successfully spayed) f~male dog, $2.00.
Female. - For a female dog, $~,00.
Kennel, fortwenty .dogs. - For a kennel ~f twenty dogs, ~.
Kennel, for fi£ty dogs. -For. a kennel of fifty dogs, $50.00.

Section %. When License Tax Pa.ya~le. - The license tax on dogs shall be due and payable as
(a) On or before January 1 and not later, than January 31 of each year, the owner of any dog
four months old or older shall pay a license tax as prescribed in thel~preceding section.
(b) If a dog shall become four months of age or if a..dog over four months of ~age unlicensed
by this county shall come into the possession of any person in this county between January 1 and October
31 of any year, a license tax for the current calendar year shall be ~paid forthwith by the owner..
(c) I~ a dog shall become four months of age or if a dog over four months of age unlicensed
by this county shall come into the possession of any person in this county between November 1 and
December 31 of any year, the license tax for the succeeding calendar year shall be paid forthwith by the
owner a~d such license shall protect the dog from the date of payment of-the license tax,.
Section ~, Payment of License Tax Subsequent to Summons, - Payment of the license tax subse-
quant to a summons to appear before the judge, of the county court or other court for failure to do so
within the time required shall not operate to relieve such owner from the penalties provided.
Section 6., The Effect of a Dog not Weakening Collar as Evidence. - Any dog not wearing a collar
bearing a license tag of the proper calendar year shall prima facie be deemed to be unlicensed, and in
any proceedings under this ordinance the burden of proof of the fact that the ~og has been licensed,
or is otherwise not reqUired to bear a tag at the time, shall be on the owner of the dog. (See Se~0tion
Section 7. How 'to Obtain License. - Any resident of this county may obtain a dog license by
making oral or written application to the Director of Finance, accompanied by the amount of the license
tax. The Director of Finance shall have authority to license only dogs of resident owners or custodians
who reside within the boundary limits of this county and may reqUire information to this effect of any
applicant. Upon receip~ of proper application, the DirectOr of Finance shall issue a license receipt
for the amount on which he shall record the name and address of the owner or Custodian, the date of
payment, the year for which issued, the serial number of the tax, whether male, unsexed female, female
or kennel, and deliver the metal $icense tags or plates herein provided for.
S. ection 8. _What Dog Licenses Shall Consist...0f.. - A dog license shall consist of a license
receipt and a metal tag in the style and design adopted by the Virginia Commission of Game and Inland
Fisheries. The tag shall be stamped or otherwise permanently marked to show the sex of the dog, the
calendar year for which issued and bear a serial number. The license tag for a kennel shall show the
number of dogs authorized to be kept under such license and have attached thereto a metal identification
plate for each of such dogs, numbered to correspond with the serial number of the'license tag.
Section 9, D_uplicate License Tags. - If the dog license shall become lost, destroyed, or
stolen, the owner or custodian shall at. once apply to the Director of Finance who issued the same for a
duplicate license tag, presenting the original license receipt. Upon affidavit of the owner or
custodian before the Director of Finance that the original license tag has been lost,.l?destroyed, or
stolen, he shall issue a duplicate license tag which the owner ore,custodian shall immediately affix te
the collar of the dog. The Director of Finance shall endorse the number of the duplicate and the date
issued on the face of the original license receipt. The fee for a duplicate tag sha!l~ be twenty~five
cents ·
S.ection .1.0. Displaying Receipts; Dogs to Tags_. m Dog license receipts shall be carefully
preserved by the licensees and exhibited p~omptly on request for inspection by any dog warden or other
officer. Dog license tags shall be securely fastened to a substantial collar by 'the owner or custodian
and worn by such dog, and it shall be unlawful for the owner to permit any licensed, dog .four months, old
or over to run or roam at large at any time without a license tag, except that when engaged in lawful
hunting, in the open season and accompanied by the owner or custodian, the collar and tag may be
temporarily removed.
Section .!1. Regulating K. ennel Dogs. - The owner of a kennel shall securely fasten the license
tag to the kennel enclosure in full view and keep one of the identification plates provided therewith
a~tached to the collar of each dog authorized to be .kept enclosed in the kennel. Any identification
plates not so 1~ use must be kept by the owner or custodian and promptly shown to any dog warden or
other officer upon request. A kennel dog shall not be permitted to stray beyond the ~imits of the
enclosure but this shall not prohibit removing dogs therefrom temporarily while under the control of the
owner or custodian for the purpose of exercising, hunting, Breeding, trial, or show. A kennel shall
not be operated in such manner as to defraud the county of the license tax applying to dogs which cannot
be legally covered thereunder or to in any manner violate other provisions of this ordinance.
Section 12. Licensed Dogs Deemed Personal Property. - All dogs in this county which are
licensed, and all dogs under four months of age, whether licensed or not, shall be deemed personal
property and may be the subject of larceny and malicious or unlawful trespass, and the owners thereof
may maintain any action for the killing of any such dogs, or injury thereto, or unlaWful detentionS'er
use thereof as in the case of other personal property, It shall be unlawful for any person except the
owner or his authorized agent to administer poison 'to any such dog or to expose poison Where it may be
taken by any such dog, or to injure, disfigure, disable, or kill any dog except as otherwise provided
in this ordinance. The owner of any dog which is injured or killed contrary to th~ provisions of this
ordinance by any person shall be entitled to recover the value thereof or the damage done thereto in an
appropriate action at law from such person. A dog warden or other officer finding a stolen dog, or a
dog held or detained contrary to law, shall have authority to seize and~ hold such dog pending action
before the county or other court. If no such action is instituted within five days the dog warden or
other officer shall deliver the dog to its owner. The presence of a dog on the premises of a person
other than its legal owner shall raise no presumption of theft against the owner of such premises, but
it shall be his duty to notify the dog warden and the dog warden shall take such dog in charge and
notify its legal owner to remove him. The legal owner of the dog shall pay a reasonable charge for the
keep of such dog while in the possession of the dog warden.
Sectio~ ~3, Dogs E~!l~.g or Injuri~g She. ep or 0the.r Livestock or poUl_tr~Y. - It shall be the
duty of any dog warden who may find a dog in the act of killing, injuring, worrying, or chasing sheep,
or killing or injuring other livestock, to kil~l such dog' forthwith whether such dog' bears a~-mtag or not,
or any person finding a dog committing any of the depredations mentioned in this secion, shall have the
right to kill such dog on sight. The Board of Supervisors, the co,~uty court, or any other court shall-
'have the power to order the dog warden or other officer to kill any dog known to be a confirmed poultry
killer, and any dog killing fowls for the third time shall be considered a confirmed poultry killer.
Any dog warden or other person who has reason to believe that any dog is killing livestock or committin
any of the depredations mentioned in this section, shall apply to a justice of the peace of the county,
who shall issue a warrant requiring the owner or custodian, if known, to appear before the judge of the
county court at the time and place named therein, at which time evidence shall be heard, and if it shall
appear that such dog is a livestock killer, or has committed any of the depredations mentioned in this
section, the dog shall be ordered killed immediately, which the dog warden, or other officer designated
by the judge of the county court to act, shall do. Any person killing a dog under the provisions of
this Section shall immediately notify the Dog Warden of such action.
Section. 14 - Killing Unlice~. - It shall be the duty of the dog warden to kill' any
dog of unknown o,~nership found rm~uing at large on which license had net been paid; provided, that the
dog warden may deliver such dog to the custodial organization under County contract in this county
who will pay the required license fee on such dog, with the understanding that should the legal owner
thereafter claim the dog and prove his ownership, he may recover such dog by paying to the custodial
organization to whom it was delivered by the dog warden, the amount of the license fee paid by him and
a reasonable charge for the keep of the dog while in his possession. Any. person,dog warden, or other
officer killing a dog under this chapter shall burn or bury the same.
Section _1_~_, Disnosal .qf Dead Dozs_. - The owner~of any dog which has died from disease or
.... ,___--.-~ ..... +~ ~ ~,,~ +.~ ~ame. If he fails to do so, the judge of~ the county
court, after notice to such owner, shaltorder such dead dog to be cremated.or buried by such person as
he may designate and shall require the owner to pay the person so designated not exceeding the sum of
$2.50, free from all encumberances in favor of such owner. If the owner of any dead dog is hot known,
such person shall be entitled to recover thesumfrom the dog fund.
~t~on 1'6. Other Unlawful Aqts. - The following shall be deemed unlawful and enforced by
proceedings before a judge of the county court in like manner and with like right ~£ appeal as if such
violations were misdemeanors. Any person violating the provisions of this section shall be fined not
more than $100.00 or imprisoned for not more than thirty days in the county jail, or both. (Note: If
desired, lesser penalties may be prescribed for any or all of the provisions of this section.)
(1) D_iseased DeE. - For the owner of any dog with a contagious or infectious disease to
permit such dog to stray from his premises, if such disease is known to the owner.
(2) Eemale Dog in Season. - For the owner of any female dog in semson to fail to keep such
female dog confined beyond reach of any male dog at large.
(3) ~.mqving Collar and Tag. - For any person, except the owner or custodian, to remove a
legally acquired license tag from a dog.
(4) Concealing a DoE. - For any person to conceal or harbor ~any dog on which the license tax
has not been paid, or to conceal a mad dog to keep the same from being killed.
(5) False Statemen$ - For any person t° make a false statement in order to secure a dog
license to which he is not entitled.
Section 1~,' 'Penalty for Violation of the .Do~. O~din~nce. - Any violation of this ordinance
shall be punishable by a fine of not more than $100.00 and shall be enforced by proceedingsbefore a
judge of the county court in like manner and with like right of appeal as if such violations were
misdemeanors.
All fines collected from any person for violating any provision of this ordinance, upon con-
vietion thereof, shall be credited to the general fund of the County and deposited by the Director of
Finance in_the same manner as that prescribed for other county monies.
Section 18. Separability of Provisions. - It is the intention of the Board of Supervisors
that each separate provision of this ordinance shall be deemed independent of all other provisions
herein, and it is further the intention of the Board of Supervisors that if any provision of this
ordinance be ~declared ~nvalid, all other provisions thereof remain valid and enforceable.
THE EFFECTIVE! DATE OF THIS ORDINANCE SHALL BE DECEMBER l, 1960.
On motion of Mr. Garmett, seconded by Mr. Palmer, the following resolution was unanimously
adopted:
WHEREAS, God in His infinite wisdomhas seen fit to call into His
heavenly home Joseph Temple Henley, and
WHEREAS, in the passing of Joseph Temple Henley from this earth,
Albemarle County has suffered the grievous loss of a dear friend and
associate whose life was truly dedicated to the Christian service of his
fellowman, and
WHEREAS, Joseph Temple Henley exemplified his worldly work as a
faithful public servant, serving as a member of the School Board of this
County from 1944 to the time of his passing, and as Chairman of such Board
since 1946, and to whose conscientious effort goes untold credit for the
attainments of e~r Public School System,
NOW, THEREFORE, BE IT RESOLVEDthat the sympathy of the members of
this Board be extended to the family of Joseph Temple Henley, that a ~opy of
this resolution be forwarded to his family, and that such resolution be
spread upon the minutes of this meeting.
After consideration of matters on the r&gular docket, in the Board Room, the Board convened
to the site of a proposed dam in the Crozet Sanitary District. This meeting was held in cenjunctiom
with several members of the Croze~ Water Committee and was for the purpose of inspecting on the ground
the feasibility ef the construction of a 4.4 acre lake.
Considerable discussion was given to the matter with members of the Orozet Water Committee
participating. It appeared to all of those present as if the ~matter of the proposed dam should be
undertaken to provide an additional reservoir of water to suDply the residents of the Crozet Sanitary
District.
After due study, and on motion by Mr. Sutherland, seconded by Mr. Palmer, the County Executiv,
was authorized to proceed to advertise for bids in accordance with the p~aus and specifications which
had previously been submitted to the Board.
Claims against the County amounting to $343,749.62 were presented, examined, and allowed and
certified to the Director of Finance for payment and charged against t~e following funds:
