HomeMy WebLinkAbout1961-09-21 A regular meeting of the Board of County Supervisors of Albemarle County, Virginia, was held
at the Office Building of said County on the 21st day of September, 1961.
Present: Messrs. Edgar N. Garnett, H. Ashby Harris, George C. Palmer, II, M. Y. Sutherland,
Jr. and Robert Thraves.
Absent: Mr. John Wo Williams.
Officers present: County Executive and Commonwealth's Attorney.
The meeting opened with the Lord's Prayer led by Mr. M. M. Pence.
Minutes of the meetings of August 31, 1961 and September 14, 1961, were read and approved.
Mr. H. A. Haden appeared and requested the a~option of a resolution by this Board supporting
the Community Chest Campaign. ~On motion of Mr. Palmer, seconded by Mr. Harris, the following resolution
was unanimously adopted:
BE IT HEREBY RESOLVED that the Board of Supervisors of Albemarle County
endorses the Charlottesville and Albemarle Community Chest, and recommends its
support to the people of Albemarle County.
The Chest fosters and supports voluntary agencies providing services to
our people beyond those properly available through government, working with us in
our common task of meeting the needs of our community and enhancing its total wel-
fare. The spirit of voluntary ~spo~sibilityofor community benefits is consistent-
with the long tradition of this County and the finest American tradition, s~ud
merits support.
Success in this endeavor is important to the reputation of our County.
Moreover, combination of the fund-raising efforts of many worthy and locally signi-
ficant causes under one heading is not only a practical advantage to the community,
but a commendable evidence of widespread local cooperation and civic responsibility.
We further recommend support of the Chest drive to all County employees,
and their consideration of the fair-share rate of contribution being adopted within
business ~nd industry for the current fund-raising campaign.
Plat was received on division of land owned by R. L. Payne and located on U.S. Rout~ 29, North
as prepared by Mr. Amos R. Sweet and approved by the County Planning Commission. It was noted that this
approval carried a provision that right-of,way would have to be widened if further land in this tract
were subdivided. On motion of Mr. Palmer, seconded by Mr. Harris, this plat was approved and the Chair-
man and Clerk were authorized to sign same o~ behalf of this Board.
Plat was received on division of land owned by James Crenshaw and located on Route 250, East,
as prepared by Mr. O. R. Randolph and approved by the County and City Planning Commissions. On motion
of Mr. Thraves, seconded by Mr. Palmer, this plat was approved and the Chairman and Clerk were authorize~
to sign same on behalf of this Board.
Pl~t was received on Parcel "B", Auburn Hill, as prepared by Mr. William S. Roudabush and
approved by the County andCityPlanning Commissions. On motion of Mr. Thraves, seconded by Nr. Palmer,
this plat was approved and the Chairman and Clerk were authorized to sign same on behalf of this Board.
Plat was received on Addition Two, Azalea Gardens, as prepared byMr. William S. RoUdabush an~
approved by the County and City Planning Commissions. On motion of Mr. Thraves, seconded by Mr. Palmer,
this plat was approved and the Chairman and Clerk were authorized to sign same on behalf of this Board.
Plat was received on Section Seven, Forest Hills, as prepared by Mr. William S. Roudabush and ii
approved by the Oounty and City Planning Commissions. On motion of Mr. Thraves, seconded by Mr. Palmer,!
this plat was approved and the Chairman and Clerk were authorized to sign same on behalf of this Board.
Statements of Expenses of the Department of Finance, the Sheriff's Office, and the Office of
the Commonwealth's Attorney for the month of August, 1961, were presented, and on motion of Mr. Garnett,
seconded by Mr. Palmer, these Statements were examined, verified and approved.
Statement of Expenses incurred in the maintenance of the County Jail was submitted along with
Summary Statement of Prisoner Days for the month of Augast, 1961. On motion of Mr. Palmer, seconded by
Mr. Garnett, these Statements were examined, verified and approved.
Claim of the Jail Physician in the amount of $27.00 was presented for the month of August,
1961, and on motion of Mr. Thraves, seconded by Mr. Garnett, was approved for payment.
Reports of the Department of Public Weifare for the month of August, 1961, were presented in
accordance with Sections 63-67.1 and 63-67.2 of the Code of Virginia.
Claim was received from the University of Virginia Hospital in the amount of $1,503.65, for
the hospitalization of indigent patients, one-half of which is reimbursable by the State~ On motion of
Mr. Palmer, seconded by Mr. Garnett, this claim was approved for payment.
Report of the County Executive for the month of August, 1961, was presented, approved, and
ordered filed.
On motion of Mr. Harris, seconded by Mr. Thraves, rules with regard to second reading were
suspended and the following resolution unanimously adopted:
BE.IT RESOLVED by the Board of Supervisors of Albemarle County, Virginia,
that the following appropriations be and the same hereby are made for the month of
October, 1961, from the funds and for the functions or purposes indicated:

Mr. Palmer, reporting for committee appointed at the last regular meeting, recommended the
appointment of Mr. L. A. Lacy to replace Mr. Goode Love on the Airport Commission. On motion of Mr.
Harris, seconded by Mr. Garnett, Mr. Lacy's appointment was approved.
Mr. Garnett, reporting for the committee appointed with regard to proposed zoning for Albe-
marle County, presented the following resolution adopted by his committee at a meeting held on September
20, 1961:
"BE IT RESOLVED by the Executive Committee of the Planning Commission, in session
with a Committee of the Board of Supervisors, that this Commission suggest to the
Board that the study regards land use underway by the Department of Conservation
and Economic Development be pursued to a successful conclusion, and that qualified
assistance be provided proper County Departments in order that fully developed Land
Use Regulations may also be formulated for further consideration."

Report of the S.P.C.A. for the months of June and July were received, discussed, and ordered
The matter of capital outlay was discussed and on motion of Mr. Palmer, seconded byMr.
Garnett, it was ordered that the Finance Committee make a study on the County's long range capital out-
lay program and report back to this Board as soon as possible.
Mr. Garnett advised that residents near the Knobloch property at Crozet had attempted to have
the owner cleqn this vacant land and had offered to clean same because of an existing fire hazard but had
met with complete opPosition by the landowner. After discussion of the matter, and on motion of Mr.
Garnett, seconded by Mr. Palmer, it was ordered that the Fire Marshall be requested to evalUate the fire
hazard existing in this instance.
The Board went into executive session to discuss payment to Robert Nusselman for his services
in connection with annexation.
Back in open session the following resolution was offered and unanimously adopted:
~EREAS, it is the Board's understanding from its conversation with ~r.
Robert Musselman that our agreement in January, 1961, was to hire Mr. ~usselman
as financial advisor for a maximum of $6,000.00 and later, when it became apparent
that the County's case and the intervenors' case became identical, we hired Mr.
Musselman to work with ~r. Downing Smith on the annexation agreement and for this
service we are agreeing to pay $6,000.00.
NOW, THEREFORE, BE IT RESOLVED that rules with regard to second reading be ~o~*
suspended and $12,800.00 be and is hereby appropriated for fees and costs, less i~,~-
$3,000.00 retainer fee previously paid, a net appropriation of $9,800.00. ~ ~* .~
Claims against the County amounting to $350,629.23 were presented, examined, and allowed and
certified to the Director of Finance for payment and charged against the following funds:
