HomeMy WebLinkAbout1961-12-21 A regular meeting of the Board of County Supervisors of Albemarle County, Virginia, was held
at the Office Building of said County on the 21st day of December, 1961.
Present: Messrs. John W. Williams, Edgar N. Garnett, H. Ashby Harris, George C. Palmer, II,
M. Y. Sutherland, Jr. and Robert Thraves.
Absent: None.
Officers present: Asst. County Executive and Commonwealth's Attorney.
The meeting opened with the Lord's Prayer led by Mr. Sutherland.
Minutes of the meeting of November 16, 1961, were read and approved.
Report was received from the Virginia Department of Highways on traffic survey of ROute 240 aC
Crozet. Said report indicated the road to be adequate as far as traffic is concerned but showed the
railroad underpass to have insufficient clearance. It was~ recommended that conditions be improved by
construction but ~tated that little could be done by the Department of Highways at this time. This
report was taken under advisement and it was ordered that copies be forwarded to the Route 240 Committee
consisting of Messrs. Blakey, Gillum and Janssen of Crozet.
Report was received from the Virginia Department of Highways giving operational and fiscal
summary for Albemarle County for the fiscal year 1960-61. It was ordered that each member of the Board
be furnished with a copy of this report.
Communication was received from Mr. W. Wright Harrison requesting contribution of $100.00
toward the financing of the program of the "Route 29 Improvement Committee". On motion of Palmer,
seconded by Mr. Thraves, the following resolution was unanimously adopted:
BE IT RESOLVED by the Board of County Supervisors of Albemarle County,
Virginia, that this Board does hereby endorse the program of .the "Route 29 Improve-
ment Committee" which meeks to eventually four lane Route 29 from Warrent~n~south;
and
BE IT FURTHER RESOLVED that this Board contribute the sum of $100.00
toward the financing of this program.
On motion of Mr. Palmer, seconded by Mr. Harris, the following resolution was unanimously
adopted:
BE IT RESOLVED by the Board of County Supervisors of Albemarle County,
Virginia, that effective January 2, 1962, a policeman be stationed at the entrance
to McIntire School both morning and afternoon during the hours when buses are
entering and leaving the school; and
BE IT FURTHER· RESOLVED that if present personnel is not sufficient to
man this post as requested, a special police be employed; and
BE IT FURTHER RESOLVED that copy of this resolution be forwarded to W. S.
Cook, Sheriff, and to Paul H. Cale, Supt. of Schools.
Plat was received on division of land owned by Lucy M. Haden, located on Route 250 West, Part
of Brooksville Manor, as prepared by Mr. T. W. Saunders and approve~ by the County Planning Commission.
On motion of Mr. Palmer, seconded by Mr. Garnett, this plat was approved and the Chairman and Clerk were
authorized to sign same on behalf of this Board.
The following three plats, prepared by Mr. O. R. R~ndolph, were received and approVed subject
to signatures of the County and City Plannint Commlissions, on motion of Mr. Sutherland, seconded by Mr.
Garnett:
(1) Sec. 5 and Sec. 6, Greenbrier Subdivision, redate and change to cor~form with
present ordinance.
(2) Division of land owned by James Murray - 0.35 acre tract fronting on Route 660,
i mile west of Int. with Route 743.

Division of land owned byE. M. Bowers - division of 7.26 acres on Route 250,
west.
Plat was received on division of Lot 9 into Lots 9A& 9B, owned by Allen F. Birckhead,
County Planning Commission. On motion of Mr. Harris, seconded by Mr. Sutherland, this plat was ap-
proved and the Chairman and Clerk were authorized to sign same on behalf of this Board.
Plat was received on Parcel C-lA & C-lB added to Parcel C-2, Parcel C-lC added to C-4, and
Parcel C-lC , a division of Parcel C-l, Carrsbrook Subdivision, as prepared by Mr.. B. Aubrey Huffman
and approved by the County and City Planning Commissions. On motion of Mr. Garnett, seconded by Mr.
Harris, this plat .was approved and the Chairman and Clerk were authorized to sign same on behalf of
this Board.
Plat was received on division of land owned byPercy W. Norvelle on Route 29 South from
Parcel E into Parcels E and F, as prepared by Mr. B. Aubrey Huffman and approved'by the. County Planning
Commission. On motion of Mr. Sutherland, seconded by Mr. Thraves, this plat waz approved and the
Chairman and Clerk were authorized to sign same on behalf of this Board.
Plat was received on Valley Farms SubdiviSion located near Earlysville and owned by Charles
William Hurt, as prepared by Mr. B. Aubrey Huffman and approved by the County Planning Commission. On
motion of Mr. Thraves, seconded by Mr. Sutherl~nd, this plat was approved and the ChairmAn and Clerk
were authorized to sign same on behalf of this Board.
Pla.~twas received on division of one acre tract owned by Clay M. Peyton, located at northeast
corner of Hydraulic Road and Route 29, as prepared by Mr. Amos R. Sweet and approved by the County
Planning Commission. On motionof Mr. Palmer, seconded by Mr. Harris, this plat was approved and the
Chairman and Clerk were authorized to sign same on behalf of this Board.
Mr. William B. Speck, Field Secretary of the League of Virginia Counties, presented to Mr.
John N. Williams a plaque inscribed with resolution adopted by the League at its annual meeting in
Roanoke on November 14, 1961. On motion of Mr. Garnett, seconded by Mr. Palmer, it was orderd that
this inscription be recorded in the minutes of this meeting. Said inscription follows:

JOHN W. WILLIAMS
has served Albemarle County as a public official, from 19A7 to 19A9 as a member of the
County School Board, and in 19A9 was appointed to th~ Board of Supervisors, having
been re-electedto that office in 1951, 1955, and 1959, serving as its Chairman from
1957 to 6 ·
19 l, and serving as a member of the County Board of Public Welfare from 19~9
to Narch, 1961; and
WHEREAS, he has served the League of Virginia Counties in numerous capacities, being
elected as Secretary in 1956 and serving until 195.8, served am Vice-President in 1959,
and as President in 1960; and
WHEREAS, this service has been faithful and devoted despite the many calls upon his
time and'resources; and
WHEREAS, it is proper that such a faithful and devoted servant be recognized, now,
therefore be it
RESOLVED, by the League of Virginia Counties this fourteenth day of November nineteen
humdred and sixty-one that we do hereby commend JOHN W. WILLIANS for his faithful and
devoted service to the People of Albemarle COunty and to the League of Virginia
Counties and to extend to him our best wishes for his continued well-being and
prosperity.
Nr. Palmer, reporting for the trailer assessment committee, stated that under State law,
trailers must be assessed as personal property or real estate and recommended that the present policy
be continued with the deletion of the requirement whereby the person owning the trailer shall also
own the land on which said trailer is situated as a prerequisite to same being assessed as real estate.
On motion, of Mr. Palmer, seconded by Nr. Harris, the following amended resolution from the July 20,
1961, resolution, was Unanimously adopted:
BE IT RESOLVED by the Board of County Supervisors of Albemarle County,
Virginia, that trailers shall be assessed as personal property as a general policy;
the Official Nobile Home ~arke% Report being used for such assessment; however, the
same shall be assessed as real estate when meeting the following requirements:
(1) Al__l parts which make the trailer movable shall be removed~
(2) The trailer shall be attached to a permanent foundation which is
permanently attached to the ground.
(3) A building permit shall be required for the construction of a

the Commonwealth's Attorney for the month of November, 1961, were presented, and on motion of Mr.
Suther!and, seconded by Mr. Harris, Shese Statements were examined, verified and approved.
Statement of Expenses incurred in the maintenance of the County Jail was submitted along with
Summary Statement of Prisoner Days for the month of November, 1961. On motion of Mr. Harris, seconded
by Mr. Palmer, these Statements were examined, verified and approved.
Report on inspection of the County Jail was received from the Department of Welfare and
Institutions and was ordered filed.
Claim of the Jail Physician in the amount of $7.00 for the month of November, 1961, was pre-
sented, and on motion of Mr. Harris, seconded by Mr. Palmer, was approved for payment.
Reports of the Department of Public Welfare for the month of November, 1961, were presented
in accordance with Sections 63-67.1 and 63-67.2 of the Code~.o~ Virginia.
Claim of the University of Virginia Hospital in the amount of $1,257.15 for hospitalization
indigent patients was received, one-half of which is reimbursable by the State. On motion of Mr. Harri~
seconded by Mr. Palmer, this claim was approved for payment.
At the request of this Board, Mr. Richard Middleton, member of the House of Delegates, appear~
with regard to the County's Proposed Legislative Program for 1962. Senator McCue was also invited to
this discussion but did not appear. Mr. Middleton was urged to support the following legislation:
1. That Section 15-26.1, Code of Virginia, be amended to allow counties such as
Albemarle to participate in the water conservation and flood control dams.
Present laws are no longer applicable to the counties originally covered.
2. That counties seeking to meet the needs of their citizens be permitted
taxing powers equal to cities, to the end that counties should be given
authority to assess and levy:
a. Business license tax in lieu~of a merchant's capital tax.
b. Utilities consumer tax.
To prevent unjust taxation of county residents, all local sales taxes
should be prohibited.
~. That the State of Virginia institute a withholding plan for State income
taxes whereby the local officials would collect the tax in a manner similar
to the Federal plan. It is urged, however, that no attempt be made to
change the present method of deduction.
5. That modificati°~'of the current annexation laws should be made tmo permit
a referendum on the proposed annexation of residents in the area affected ~
a basic right of self determination.
That the county express its bitter opposition to the existing practice of
diverting funds from highway use to the Virginia State Police, the Depart-
ment of Agriculture, and the Division of Motor Vehicles.

That permissive legislation be enacted to allow counties to issue vouchers
in lieu of makin~ cash payments to welfare clients.
9. That a study and review be given the present statutes rsgulating work
allowed on Sundays to the end that present ambiguity be clarified.

Thet the present statutes allowing a fee of $0;75 for the first three papers
served by a sheriff and $0.50 for each thereaEter should be raised to $3.00
for each paper served. This is necessary in order that the fees collected
for thi~ service can be brought into line with the cost.
Mr. Jack Kegley, Attorney, appeared and again requested this Board to take action with regard
to his case against the Virginia Telephone and Telegraph Company. This matter was discussed but no
action was taken.
The following report wA~ received from the joint City-County Health Center Committee which
was dated December ~0, 1961:
"Your County-City Committee on a new Health Center met in Richmond on December 19,
1961 with Dr. Mack I. Shanholtz, Health Commissioner, and Mr. Robert D. Ham,
Director, Bureau of Medical and Nursing Facilities Services and discussed fully
with them the proposed new Joint Health Center for this community.
These gentlemen advised us that Hill-Bu~ton funds are available at this time on a
first come, first served basis for health centers. They advised that in order to
be assured of funds from the presen~ appropriation, we shoed make application for
such funds at once. They
and i~ormed us that 10% of the cOst of the building, equipment and architect fees
would be available for the acquisition of a site and that with the a~proval of the
Advisory Hospital Council this 10% woLuld be increased if necessary.
In-view of this information our Committee respectfully recommends thst the County
Executive and the City~anager be instructed on behalf of the County and City,
jointly, to file an application for Hill-Burton funds to cover 55% of the cost of
the construction of a new Health Center in this community based on the following
estimates:
Building $150,000.00
Equipment 31,000.00
Architect fees 9,000.00
Site 30~000.00
Total $220,000.00
We further~recommend that each governing body appropriate the sum of $50,000.00 or
as much thereof as may be necessary to cover the County and City's portion 'of the
costs of this new Health Center and that the Committee be authorized to employee an
architect to prepare the building plans.
Your Committee has not had time to investigate and recommend a site for the Center,
however, this will be done just as soon as is possible and a recommendation will be
made to you at that time."
After discussion of the foregoing, the following resolution was offered by Mr. Thraves, seconded by Mr.
Garnett, and unanimously adopted:
BE IT RESOLVED by the Board of CoUnty Supervisors of Albemarle County,
Virginia, that the recommendations of the Ci~ty-County Committee for a new ~oint
Health Center as stated in their report dated December 20, 1961, be and the same
are hereby approved and that the CoUnty Executive be and he is hereby authorized
on behalf of the Board of County Supervisors to file a joint application along
with the City of Charlottesville for Hill-Burton funds to cover 55% of the cost
of this project, and
BE IT FURTHER RESOLVED that $50,000.00 or as much thereof as may be
necessary be ~nd the same is hereby appropriated as~the County's portion of the
cost of the new Health Center.
Mr. John W. Williams called the Board's ~.ttention to a proposed merger of Catawba and Blue
Ridge Sanatoriums and presented facts and figures he had assembled to substantiate hi~ feeling that the
Blue Ridge SanatOrium should be maintained in its preeent capacity. After considerable discussion of
this matter, the following resolution was offered by Mr. Thraves, seconded by Mr. Palmer, and unanimousl
adopted:
BE IT RESOLVED by the Board of County Supervisors of Albemarle County,
that this Board does hereby express its most definite opposition to the proposal
for removal of the facilities for the care of tubercular patients from Blue Ridge
Sanatorium in Albemarle County, to Catawba Sanatorium.
BEIT FURTHER RESOLVED that if a merger of the facilities of Catawba
and Blue Ridge is necessary, then this merger should be made with the Blue Ridge
Sanatorium in Albemarle County, Virginia, which Sanatorium is centrally located to
the entire State, and adjacent to the facilities of the University of Virginia
Hospital, where at least 95% of all tubercular chest surgery is performed, and
BE IT FURTHER RESOLVED that all members of the General Assembly be urged
to support this resolution and copies of this resOlution be sent to the Governor,
Et. Governor and all members of the General Assembly.
On motion of Mr. Harris, seconded by Mr. Sutherland, rules with regard to second reading were
suspended and the following resolution unanimously adopted:
BE IT RESOLVED by the Board of County Supervisors of Albemarle County,
Virginia, that the following appropriations be and the same hereby are made for
the month of January, 1962, from the funds and for the functions or purposes
indicated:

The proposed Sanitation Ordinance, with amendments of the Board's committee, was presented and
action thereon was carried over until the January meeting.
The Subdivision Ordinance was also deferred until January and it was ordered that the Clerk wri
Request was received from Robert B. and Frances Fo Rogers for refund of real estate tax in the
amouut of $16.56. Mrs. Rogers advised that the 1960 assessment of $30,330 was protested and she was
advised to pay the tax on same and make request to the Equalization Board for a review of the assessment
This was done and the Equalization Board placed a value of $27~500 on her property for the year 1961.
~rs. Roger's request was for a refund of the difference in tax on the two assessmen~ On motion of
Nr. Palmer, seconded by~r. Garnett, this refund was authorized.
On motion of Mr. Garnett, seconded by ~r. Palmer, it was ordered that check #$341, dated
November 16, 1961, payable to Mro & Mrs, George F. Cox, be cancelled. Mr. Cox advised that he was re-
turning this check in the amount of $125.00 which was issued for tuition grant since his child had been
removed from private schools.
Communication was received from the Joint Cooperative Committee of Architects, Engineers and
Contractors, and was ordered filed.
Request was received from Mrs, Eva W.~Maupin for-an additional extension telephone in the
Clerk's Office and on motion of Sutherland, seconded by Mr. Harris, this extension was approved.
Communications were received from the State Compensation Board listing approval of salaries
and expenses as requested for the year 1962 for the Department of Finance, the Sheriff's Office, and the
Office~of the ~ommonwealth's Attorney.
Communication was received from Nro W. O. Holland, Jr. submitting his resignation as Assistant
County Agent, effective December 31, 1961. On motion of ~r. Harris, seconded by Mr. Sutherland,
Holland's resignation was accepted with regret.
Communic~tion was received from the State Corporation Commission giving n~tice of public
hearing at lO:O0 A.M. on January 16, 1962, on proposed truck line route to be operated by Railway Ex-
press Agency between Charlottesville and Newport News, Virginia.
On recommendation of the Chairman, the following resolution was offered by ~r. Thraves,
seConded by Mr. Harris, and unanimously adopted:
BE IT RESOLVED by the Board of County Supervisors of Albemarle county,
Virginia, that Mr. Ray B. Jones be and he is hereby appointed Civil Defense Co-
ordinater of Albemarle County, effective January 10, 1962, at an annual salary of
$4800.00, with increments of $200.00 each year for five years.
On motion of Mr. Harris, seconded by Mr. Sutherland, it was ordere~ that County offices be
closed the day after 'Christmas this year, December 26, 1961.
Claim against the Dog Tax Fund was received from ~rs. A. F. DeMilia for one ewe killed by dogs
on November 2~, 1961. On motion of ~r. Garnett, seconded by ~r. Thraves, this claim was denied due to
the fact that evidenee ~reSented was insufficient to establish the fact that this damage was done by dogs
Claim against the Dog Tax F~u~d was received from Mr. John N. Nays for four ewes killed by dogs
each
on November 18, 1961. On motion of ~r. Palmer, seconded by Mr. Garnett, Nr. Nays was allowed $4.00/for
two ~wes~ 8-10 years o~d and $10.00 each for two ewes 5-6 years old.
Claim against the Dog Tax Fund was receiVed from ~r. C. F. Smithers for one ewe killed by dogs.
On motion of Mr. Palmer, seconded by Nr. Garnett, Mr. Smithers was allowed $15.00 for this ewe.
Claim against the Dog Tax Fund was received from Dr. T. J. Summey for one ewe killed by dogs.
On motion of Nr. Sutherland, seconded by ~r. Palmer, this claim was denied and the Clerk was instructed
to advise Dr. Summey that he should attempt to collect from Mr. Guy, who lives on his place andwhose
killed this ewe, with copy of letter going to Mr. Guy.
Claim against the Dog Tax Fund was received from Mr. James B. Murray for four lambs killed by
dogs on May 2, 1961. On motion by ~r. Palmer, seconded by ~r. Garnett, this claim was denied due to the
fact that 90 days had elaMsed before the claim was presented.
C~aims dated ~arch 2, 1961, Narch 16, 1961 and ~arch 20, 1961, were received f~om J~ Nelson
Brown for a total ten lamb~ killed by dOgs. On motion of Mr. Harris, seconded by Mro Palmer, these

seconded by Nro PAlmer, were approved for the amounts indicated:
September 17, 1961 - 1 ewe, 120 lbs. - $15.00
November 3, 1961 --- 1 buck, 150 lbs. - $15.00
November 3, 1961 --- 4 ewes, 140 lbs. - $15.00 each.
November 3, 196! --- I ram, 150 lbs. - $40.00
