HomeMy WebLinkAbout1951-11-23 A regular meeting of the Board of County Supervisors of Albemarle County, Virgi~mia, was held at the Office Building of said County on the 23rd day of November, 1951. Present: Messrs. C. Purcell McCue, E. J. Ballard, Henry Chiles, C~ R. Dorrier, Jo W. Williams,~ and W. W. Wood. Absent: None. Officers present: County 'Executive and Commonwealth's Attorney. Minutes of the meeting of October 17, 1951, were read and approved. Proposals were received from the following companies for the bond of the Director of Finance for the four-year term beginning January 1,1952, and upon motion, made by Mr. Wood and seconded by Mr. Bal!ard, were taken under advisement: Allen And Sullivan City Mortgage and Insurance Co. Commerce Realty and Insurance Co. Mr. C. B. Mackreth Minor-Duke Mutual Ins. Agency Mr. D. B. Owen Petition was received from several citizens in the Rivanna District requesting that one-fourtt mile' of road beginning one mile southeast of Barboursviile, Virgir~a at the Orange County line and lead- ing to the top of the mountain, be taken into the Secondary System. This petition was deferred until the regular Road meeting. Petition was received requesting that Avo,n Street be extended with a hard top southwardly across Moore's Creek to connect with the Old Scottsville Road, and that the Old Road from the point of connection southwardly to Route #20 be resurfaced with a hard top. This petition was deferred until next regular Road meeting. Mr. W. W, Shields, Resident Engineer, advised that the Research Department of the University of Virginia Engineering School wants to build a pme-pressed concrete bridge in Albemarle County near enough to the University to be accessable to Engineering students. Mr~ ,Shields advised that Moorets Creek on Route 742 of the foregoing request and the bridge on Garth's Road had been suggested as ideal places for this experiment. Upon motion, made by ~iro Williams and seconded by M~. Ballard, the locatio~ on Garth Road was approved by the Board for the construction of a pre-pressed concrete bri~ke. agreement Mr. E. H. Bain advised the Board that Mm. Marvin E. Weast has signed the ~ for property agreement at Brownsville for a public dump, which ~ reads as follows:~ THIS AGREEMENT made this 16th day of October, 1951, by and between MARVIN E. WEAST and BABIE E. WEAST, his wife, hereinafter called O~.mers and THE BOB~D OF COUNTY SUPERVISORS OF ALBEMARLE COUNTY, VIRGINIA, hereinafter called the County, W I T N E S S E T H: That for and in consideration of the payments hereinafter set forth and of the covenants hereinafter contained, the owners hereby GRJ2~T and CONVEY ~nato the County the right to use as a public dumping ground a certain 23 acre gract of land owned by the said owners situated near Brownsville in Albemarle County, Virginia and being in all respects the seme tract of land which was conveyed to the owners by deed of H. Moore Bowen and others dated January 23, 1946 and recorded in the Clerk's Office for the Circuit Court of Albemarle County, Virginia in D. B. 255, p. 434. Said tract of land is the same tract of land which is designated as Lot i on a plat recorded in said Clerk's Office in D. B. 266, p. 426. This agreement shall remain in full force and effect for a periog of 5 years from the date hereof, provided, however, that it may be terminated at any time by either party upon 90 days written notice to the other party of in- tention to terminate. This agreement is subject to the following covenants: 1. The County will take all responsibility for compliance with health reg~lations and other laws in the maintenance of a public dttmp in accordance herewith. 2. The County will restrict dumping to the gullies within the area herein described at all times and will cover the material dumped therein period- ically as often as practicable. i3. The County will pay to the said owners the sum'of$i20. OO annually so long as this agreement remains in force, payable quarterly beginning November 23, 1951. 4. The County is to have the right to cut brush and trees from the land herein described so as to render the doEping ground safe from unnecessary 5. Residents of the Bounty of Albemarle shall have the right to enter upon the lands hereinabove described for the purpose of dumping trash and other re- refuse, provided, however, ~hat all such residents of Albemarle County shall be re- stricted in en$~ering upon these lands to a route leading directly thereto from the southside of U. S. Highway 250. Weast (SEAL) THE BOPPED OF COUNTY SUPERVISORS OF ALBEMARLE COUNTY, VIRGINIA By: (Si~ned) .C- Purcell McCue Chairman Upon motion, made by Mr. Chiles and seconded by Mr. Williams, the following resolution was unsn imously adopted: BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the State Highway Department be a~d is hereby requested to open a road into the public dump established on the property of Marvin E. Weast near Browns- ville, to locate proper signs on such road, and to cover the material dumped in the area designated periodically as often as practicable at the following rate: (1) Angledozer - 60 HP and Operator, $3.65 per hour. (2) Power Grader - 12' blade, $3.35 per hour. (3)' The moving of equipment to the project to be a charge against same while returning of equipment or moving to another place is not to be charged against the county dump. Mr. Nelson Beck appeared and discussed the Chamber of Commerce plan for group insurance. Mr. Beck was advised that the Board cannot 'act on this matter until after the new Board comes into office on January 1, 1952. Mr. D. A. Robinson, Director of Finance, submitted a Statement of Expenses of the Department of Finance for the month of October, 1951~ one-third of which to be borne by the State. Upon motion duly made and seconded, this Statement was examined, verified, and approved. Mr. D. A. Robinson, Director of Finance, submitted a Statement of Expenses of the Sheriff's Office for the mont~ of October, 1951, two-thirds of which to be borne by the State. Upon motion, duly made and Seconded, this Statement was examined, verified, and approved. Mr. D. A. Robinson, Director of Finance submitted a Statement of Expenses of the Commonwealth Attorney's Office ~8r the month of October, 1951, one-half of which to be borne by the State. Upon motic duly made and seconded, this Statement was examined,~ verified, and approved. Statement of Expenses incurred in the maintenance of prisoners confined in the County Jail during the month of October, 1951, along with a summary Statement~ o~ Prisoner Days, was submitted, Upon motion, duly made and seconded, these statements were examimed, verified and approved. Claim of Dr. Richard T. Ergenbright, in the amount ef $6.00 was presented and upon motion, made by Mr. Dorrier a~d seconded by¥~. Wood, was approved for payment. Request was received from the School Board for $800.00 to be appropriated from the School Fund Surplus for the purchase amd installation ofsta~e curtains, cyclorema, and lights for the Red Hill High School Stage. Upon motion, made by Mr. Ballard and seconded hy Mr. Dorrier, the following resolution was unanimously adopted: BE IT RESOLVED by'the Board of County Supervisors of Albemarle County, Virginia, that $800.00 be and is hereby appropriated from the School ~and Surplus to be used for the pUrchaSe and installation of stage curtains, cyclorema, and lights for the Red Hill High School sta~e. Mr. D. S. Chase, Mr, G. C. Spencer, Mr. Keith Wiley, Mr. J. S. Earrish, Dr. Ross Lillard amd Airport. ~hese citizens ~sked a number of questioms regarding the activities of the airport as well as Bpe~a~$mes, Inc. ant as a Mhole expressed an objection to the airport s location .at Earlysvmlle. Mr. D. B. Marshall advised the group that he knew of no provisions in the law which'would permit a referend on a matter of this type. Mr. James McClammer a~peered before the Board .in order to determine whether or mot he should plant his crops this year in view cf the fact that his land will be taken for the air- port. Mr. McClammer was advised that 'this matter is up to him, but should he decide to plant.crops, the~i Court would allow him to ha~¢est them or pay him for the crop if not harvested before the land is need Claim of J. Upon motion, made by Mr. Williams and seconded by Mr. Wood, Mrs. Batten was allowed $100 each far the pullets and $4.00' for the bantam. Claim of George Garland for fifteen turkeys killed by dogs was presented. Inasmuch as the game warden viewed only one carcass, motion was made by Mr. Williams, seconded by Mr. Ballard, allowimg $2.0£ for the turkey viewed. Clai~of Harry La~ghorme for two lambs and mine sheep killed by dogs Mas presented.- Upon motion, made by Mr. Dorrier and seconded by Mr. Williams, Mr, Langhorne was allowed $20,OOeach for the sheep amd lambs. Claim of William T. Ward for one chicken killed by dogs was presented. Upon motion, made by Mr. Williams and seconded by Mr. Ballard, Mr. Ward was allowed $1.00 far this chicken. ~Iaim ef Charles Arnette for one rabbit killed by dogs was presented. Upon motion, made by ~r. Williams amd seconded by Mr. Baltard, Mr. Arnette was allowed $2.50 for this rabbit. Claims of Lyston D. B. Cady for sixtee~ sheep and sixteen lambs killed by dogs were presented Action on this claim was deferred until after ~onference with the Commonwealth's Attorney. The Board was advised that its offer of $25,000.00 to Dora L, Farish for 344.85 acres of land for the Crozet Sanitary District was rejected and that Mr. and Mrs. Farrish had offered~ the land to the County for $35,000.00. Upon. motion, made by Mr. Chiles and seconded bY Mr. Williams, it was ordered that this offer be formally declined. Mr. W. W.-Finley appeared before the Beard and reques~ted that he ble relieved of the delinquent Personal property taxes on cattle assessed against ~ due to the fact that the fence was destroyed and the cattle had t~ be sold at a loss. Mr. Finley w~s advised that the assessmemt en the cattle was a true and proper one and c,uld-net be exonerated. Reports of the Welfare Dep~rtment for the month ef October, 1951, were presented in accordance with Chapter 371 of the 1950 Acts oF the General ~ssembly. Claim of the University ef Virginia Hospital in the amount of $1,697.38, cae-half of which is due by the County, was presented and approved for payment. Report of the County Executive for the month of October, 195t~ wen presented, approved, amd ordered filed. Commnnicatioa was received from Miss Elise ~. Noel requestimg release from her position as Assistant Home Demomstration Agent, effective December 31, 1951. Upon motion, made by Mr. Williams and seconded by Mr. Dorrier, Miss Noel's resignation was accepted with regret. Communication was received from Miss R. Belle ~Burke, District Home Demonstration Agent, recommending the appointment of Miss Virginia Roller of Halifax County. Upon motiom, made by Mr. Williams and seconded by Mr. Bsllard, Miss Roller's appointment was approved at a salary of $1200.00 from local funds. Report was received from T. Coleman Andrews amd Company on the a_udit of th~ accounts and records of the County for the year ended June 30, 1951, and was ordered filed. Report was received from the Department of Welfare and Institutions en commitments to the Communication was received from the Crippled Ohildren's Hospital in Richmond, Virginia, re- questing a contribution from the County. Upon motion, duly made and seconded, Mr. D. A. Robinson was re- quested to acknowledge receipt of this communication and to inquire as to whether or net any children from Albemarle County have been served by the Hospital. Communicatiom~w~s~reoeived from Mr. Charles K. Woltz expressing his appreciatiom of his ap- pointmemt by the Board to the School Board. Communication from Colgate W. Darden, Jr., addressed to Mr. Alex H. Bell, President of the Treasurers' Association of Virgimia, regarding the practicability of holding a local Government Official' Conference at the University of Virginia was received a~d read. Communication was received from the local Chamber of Commerce advising that the ~ual Meeting would be held at 7:00 P.M. on November 15th. Communication was received advising that the National Municipal League would hold its annual conference on November 26, 27, amd 28, 1951 im Cincinnati, Ohio. Communications were received from the State Chamber of Commerce and ordered filed. Mr. D. A. Robinson presented to the Board the itinerary of the visit of Ryukyuan Government Officials to this Country, a part of the time which was spent in the City of Charlottesville and County of Albemarle. A copy of t~e financial report of Pulaski County was presented and ordered filed. At the request of Mr. D. A. Robinson, Director of Finance, motion, made by ~Ar~. Mr. Williams and seconded by Mr. ~ood, was carried, deferrimg the land sale from December, 1951 until April, 1952. Communication was received from the State Compensation Beard giving notice o2 the annual meet- ing of the Board on November 29 amd advising that all requests for s~laries and expenses of the Depart- ment of Finance, the Sheriff's Ofgice and the Commonwealth Attorney's Office should be in by that date. Upon motion, made by Mr. Ballard and seconded by Mr. Williams, it was ordered that the Salary Committee be authorized to approve salaries requested by the Departme~ Heads em behalf of the Beard and forward se~me to the Compensation Bear~ before the deadline. Mr. D. A. Robinsom called the Beard's attention to the fact that Deputy Sheriff E. H. Davis had requested that he be paid mileage for the use of his personal car. Mr. Robinson also advised that he imtended to have the new oar which was ordered for Mr. Davis equipped with a two-way radio, Upon motion, made by Mr. Williams and seconded by ~r. Wood, it was ordered that a sufficieat amount be appropriated te cover th~ cost of mileage of E. H. Davis while usim~ his personal ear and to cover the eest efa two-way radio for the car mow en order for Mr. Davis.
