which matches the acreage and property boundary for TMP 136-9 shown on the proposed boundary
line adjustment. Please amend the property label on Sheet 2 to state this as the most recent plat of
record.

Rev. 1 Comment not fully addressed. The combination of parcels 136-9 and 136-9H did not
automatically remove the 50' access easement, and as such should still be shown on this plat.
However, the easement may be vacated by adding a note and label to the drawings stating that the
easement will be vacated as part of this plat. The easement boundaries and deed book/page number
should still be shown, just with the note included.

Hi Tim,
I have reviewed the attachments and those are the ones that meet all of the comments. Please have the owners sign a
copy, and submit to the County for signatures.
It is possible that the GIS attributes were updated since you initially submitted the application. The parcel data can
change based on when the real estate division forwards boundary line adjustments or other land divisions to our GIS
Division. Sometimes there is a lag between when those changes are recorded with the Clerk and then make their way
back to the County GIS data. I have only seen it happen on one other plat in my short time here with the County though.
To be honest, I looked at the notes twice before I even caught that new deed book and page number on this one.

Tim,
Good news — I spoke with one of my colleagues who signs plats on behalf of the County. Going back to the first version
of the plat you submitted, Note 2 on Sheet 2 covers the easement, regardless of whether it still exists or not. Therefore,
you don't need to show the easement boundary and deed book and page number on this plat. You can ignore the
easement comment and submit the revised plat with property owner signatures that addresses the other comments.

Right now I have one of my colleagues looking further into the easement to see if there are any instances where an
access easement would be terminated through the combination of two parcels. If we cannot get a definitive answer, I
will bring the question to the weekly legal meeting with the County Attorney. Those occur on Thursday afternoons, so it
might be a few days before I can offer any more insight into this question.

Cameron,
I put the name and address of the owner on page 2 but can move it to the cover page. As far as the 50' easement I will
need you to verify with the county attorney that the easement still exists after the previous adjustment. I have been told
by an attorney that in this type of situation the easement is terminated when the two parcels were merged. I am not
trying to be picky but I do not want to show an easement that may no longer exist. I am fine showing it the way I have it
with my reference to note 3. Let me know what you find out.
Also, I looked at the notes section for parcel 9 and 9F on the GIS and I did not see a reference to DB 4758-504, let me
know if you see it.

I have looked over the plats and I have two comments that are still not addressed (comment #1 and #3) and I added
some information regarding extinguishing the 50' access easement (comment #2). My replies for the second review are
included below in bold and underlined font. Please let me know if you have any questions. If the property owners wish
to extinguish the easement, please follow my comment and send me over a PDF before you re -submit for County
Signatures.

Sorry I missed your call earlier today. I have provided some responses below to help answer your questions.
• Comment 2 — Was there an vacation plat approved for the termination of the easement? The last record I can
find is that the easement was created and recorded in DB 4030, pp. 639-645 and shown thereafter in DB 4758,
pp. 504-512. 1 couldn't find any notes from the most recent plat that dealt with the combination of 9H and 9
that says the easement was to be vacated/terminated. If you can provide me with verification that the easement
was vacated, then it doesn't need to be shown.
• Comment 4 — I attached a PDF of the deed book and pages with the plat I mentioned in the comment. If you
check the "Notes" section in our GIS parcel data, it will show any plats that have been done on the property. The
Owner Information section will show the last purchaser with the deed book and page number, but it might not
show newer plats dealing with things like easements, boundary line adjustments, etc. that didn't involve a
transfer of ownership of the property.
• Comment 6 — I attached a JPEG image of the standard signature block for the County. If you can amend the
signature block currently shown so it matches the wording of that one, this will address the comment.

THIS DEED OF GIFT, made this 18`b day of April, 2016, by and between
JAMES RIVER FARM, LLC, a Virginia limited liability company, hereinafter referred
to as Grantor, and SCUFFLETOWN LLC, a Virginia limited liability company,
hereinafter referred to as Grantee, whose address is 1145 James River Road, Scottsville,
Virginia 24590 provides:
WITNESSETH:
That pursuant to Section 58.1-811(D) of the Code of Virginia, 1950, as amended,
Grantor does hereby GIVE, GRANT, and CONVEY with GENERAL WARRANTY and
ENGLISH COVENANTS OF TITLE unto the Grantee, the following described property,
in the County of Albemarle, Virginia, to -wit:
ALL that certain parcel of land situated in the Scottsville Magisterial District of
Albemarle County, Virginia, containing 1.637 acres, more or less, designated as
"Area X" on a plat dated October 28, 2015, by P. Timothy Stanley, Jr of Stanley
Land Surveys, PLC, entitled "Plat Showing Boundary Adjustment Survey of Tax
Map 136 Parcels 9, 9H, and 9E, The Scuffletown LLC & James River Farm LLC
Properties" attached hereto, made a part hereof, and recorded herewith,
(hereinafter the "Plat"); BEING a portion of the same property conveyed to James
River Farm LLC, a Virginia limited liability company, by Deed of Gift from
Stewart Vernon Tapscott, and Maxwell Travis Critzer and Angela R. Critzer,
husband and wife, dated June 11, 2009, and recorded February 25, 2010, in the
Clerk's Office of the Circuit Court of Albemarle County, Virginia, in Deed Book
3854, page 23. The Grantor James River LLC is conveying Area X to be added to
and made a part of the land currently known as Tax Map 136 Parcel 9.

Pursuant to the Plat, SCUFFLETOWN LLC joins in this Deed to acknowledge
and accept the boundary line adjustment whereby the portion of TM 136-9E, shown on
the Plat as "Area X" is added to and made a part of the parcel shown on the Plat as TM
136-9.
Furthermore, pursuant to the Plat, SCUFFLETOWN LLC also joins in this Deed
to acknowledge and accept the boundary line adjustment whereby the parcel containing
6.472 acres, more or less, shown on the Plat as "TM 136-9H", is added to and made a
part of the parcel shown on the Plat as "TM 136-9".
The total area of the new Tax Map 136 Parcel 9 with Area X and Tax Map 136
