at the Office Building of said County on the 21st day of March, 1956.
Present: Messrs. Ho Ashby Harris, Edward L. Smith, M. Y. Sutherland, Jr., Edgard N. Garnett,
Robert Thraves and John N. Williams.
Absent: None.
Officers present: CountYExecutive and Commonwealth's Attorney.
The meeting opened with the Lord's Prayer led byMr. M. N. Pence.
Minutes of the meetings of January 18, January 30, February 9, February 15, February 29 and
March 13, 1956 were read aD~ approved.
Mr. Randolph Perry of the Chamber of Com~Lerce appeared and presented communication from the
Thomas Jefferson Memorial Park Association regarding road from Route 250 to the birth place of Thomas
Jefferson. Mr. Perry advised that the exact location of the birth site had now been determined and
plans were being formulated for the erection of his home and requested a road as described above as a
County project. He further stated that such a road wo~ld honor Jefferson and also-be of considerable
commercial value. Mr. Shields, Resident Highway Engineer, advised that the length of this proposed road
would be approximately .27 of a mile and the cost would be around $10,000.00. He advised also that com-
munications from the State Highway Department had suggested that such a project be handled through
special legislation since acceptance into the Secondary System through regular channels would necessitat
the funds for same being charged to Albemarle County allocations. It was the ~eeling of the Board that
more information should be obtained in regard to this matter and action on same was carried over until
the next regular meeting.
The following Viewers~ Report was presented, and upon motion, made by Mr. Williams and second~
byMr. Sutherland, was accepted in accordance with Section 2039 of the Virginia Code:
We, the undersigned, being Viewers appointed by your Board at its regular meeting
on February 15, 1956 to vie~ the following described section of road and make re-
port to your Board hereby wish to advise that onM arch 8, 1956 we did view the
following section of road and make report on same:
Beginning at a point in Route 621 near Eastham and continuing for 0.4 of a mile
to the east, petitioner - Charles W. Phillips.
We find that this section of road serves approximate three homes but there is no
future development in order to consider as serving the public.

the Virginia Department of Highways Secondary Road System.

by Mr. Sutherland, was accepted in accordance with Section 2039 of the Virginia Code:

report to your Board hereby wish to advise that on March 8, 1956, we di~ view
the following section of road and make report on same:
Beginning at the end of maintenance on Route 610 near Eastham and continuing for
0;35 of a mile to the east, petitioner - Mr. Tim Mahanes.
We find that the p~titioners have graded t~e section of road f~om end of present
maintenance to 0.35 of a mile east. This work was suggested in last years report
and we find satisfactory with the exception of taking out the existing cattle
guards.
~e, therefore, recommend to your Board that the section from the end of present
~tate Maintenance to 0.35 of a mile East be placed in the Virginia Department of
Highways Secondary Road System when said cattle guards are removed.

motion of Mr. Williams, seconded by Mr. Sutherland:

610 near Eastham and continuing for. 0.35 of a mile to the east.
BE IT FURTHER RESOLVED that the State Department of Highways be and is
hereby guaranteed a 30 foot unobstructed right of way along this requested ad-
dition.
The following Viewers' Report was presented, and upon motion made by Mr. Williams and seconde~
by Mr. Sutherland, was accepted in accordance with Section 2039 of the Virginia Code:
We, the undersigned, being Viewers appointed by your Board at its regular meeting
on February 15, 1956, to view the following described section or road and make
report to your Board hereby wish to advise that on March 8, 1956, we did view the
following section of road and make report on same~
Beginning at entrance to Mr. Austin W. Flint's property on Route 746, 0.2 of a
mile east of Route 807, thence crossing wooden bridge and climbing hea~vyggrade,
through woodland, and to Mr. Sam Norris' residence (Dead End) a distance of 0.5
of a mile.
We find that this section of road is in travel shape with some improvement needed
through the woodland, but we cannot feel that there is sufficient public service
to be rendered to Justify it being p~aced in the Secondary Road System.
WE, therefore, do not recommend to your Board that this section be placed in the
Virginia Department of Highways Secondary Road System.

The following Viewers' Report was presented, and upon motion made by Mr. Williams and seconde~
by Mr. Sutherland, was accepted in accordance with Section 2039 of the Virginia Code:
We, the undersigned, being Viewers appointed by your Board at its regular meeting
on February 15, 1956 to view the following described section of road and make re-
pert to your Board hereby wish to advise that oh March 8, 1956 we did view the
following section of road and make report on same:
Beginning at the end of State maintenance on Route 645, in the Gordonsville Area
and continuing to for 0.3 of a mile to Wilden Baptist Church.
We found this section of road to be passable but with a very ~heavy grade and. under
wet conditions would be very slick. This section was studied by viewers in 1953,
but we feel that the conditions have changed with justifies a reconsideration.
We, therefore, recommend to your Board that the section from end of present state
maintenance to the Wilden Baptist Church, a distance of 0.3 of a mile, be placed
in the Virginia Department of Highways Secondary Road System.

motion of Mr. Williams, seconded by Mr. Sutherland:
BE IT RESOLVED by the Board of County SUPervisors of Albemarle County,
Virginia that the State Department of Highways be and is hereby recommended to
take into the Secondary System road beginning at the end of State maintenance
on Route 645 in the Gordonsville area, and continuing for 0.3 of a mile to the
Wilden Baptish Church.
BE IT FURTHER RESOLVED that the State Department of Highways be and is
hereby guaranteed a 30 foot unobstructed right of w~y along this requested ad-

The following Viewers' Report was presented, and upon motion made by Mr. Williams and seconded!

Beginning at the end of state maintenance on Route 6~i near Barboursvil!e and con-
tinuing for one mile South, petitioner - Mr. Hank Hurtt.
We find that this road is an extension of Secendary Road that was placed in the
System some three years ago, and we feel that the expenditure by the State at that
time on maintenance should s~tisfy the petitioner until a later date.
We, therefore, do not recommend to your Board, that the Section from the end of
present State maintenance to one mile South be placed in the Virginia Department
of Highways Secondary Road System.

The following Viewers' Report was presented, and. upon motion made by Mr. Williams and seconded
by Mr. Suther!and, was accepted in accordance with Section 2039 of the Virginia Code:
We, the undersigned, being Viewers appointed by your Board at its regular meeting
on February 15, 1956 to view the following described section of road and make re-
port to your Board hereby wish to advise that on ~arch 8, 1956, we did view the
following section of road and make report on same:
Beginnin~ on Route 640, 400 yds. East of Int. with Route 641, and thence to the
east for 0.5 of a mile, petitioned for by Mr. R. Thraves and others.
This section of road was viewed on February 16, 1955 and our report that date still
stands. After further study we feel that the location on the ridge could be made to
serve these petitioners and be extended at a later date to serve other properties.
Ne repeat that we cannot recommend granting this petition on the location mentioned
in same for a State Secondary Road.

on February 15, 1956 to view the following described section of road and make re-
port to your Board hereby wish to advise that oh ~!arch 8, 1956, we did view the
following section of road and make report on same:
Begimuing at Route 743 between Hydraulic and new airport and extending to the
northwest following private road between the Mi~ Lillian Smith and Thomas Grinnell
properties to creek near the Murray property line, a distance of approximately 0.75
of a mile;
We find that the present road is in unusually good condition, well stabalized
and drained. We note one new residence and are advised that several lots for
building purposes have been sold. By the State's regulation this would place
this section in the Sub-Division class. Ne cannot see sufficient public service
at this time to be rendered by the p~itioned for Section of road to justify it
being placed in the Secondary Road System.
We, therefore, do not recommend the granting of this petition to be placed in the
Virginia Department of Highways Secondary Road System.

We, the undersigned, being Viewers appointed byyour Board at its regular meeting
on February 15, 1956 to view the following described section of road and make re-
port to your Board hereby wish to advise that on M~rch 8, 1956, we did view th~
following section of road and make report on same:
Beginning at the right angle turn on Route 691 and extending to the South to present
road, thence East to the R. L. Snead home, a distance of approximate I mile.
We find in viewing this area that it would seem if the final set up for roads in
this section could develop a through road from Route 240 opposite the cemetary,
passing through this general area and through the Gentry Farm to Route 240 just
S.W. of ~orton's Pie Factory. We are mentioning the above for information to
your Board and thinking the Sub-Dividers should develop their Sub-Divisions with
this idea in mind.
However, as to the petition of John B. Jarman and others, we believe this to be
a sub-division and. recommend to your Board that the petitioned for one mile of
reed would have to be brought up to a State's requirement for Sub-Division before
it could be made part of the State's Secondary System.

Beginning at Intersection with Route 692 at corner of Bruce D. Rennolds' property
and continuing for 0.3 of a mile to the North, petitioner - Forest Graves.
We find that this road is passable but requires widening and some stabalization.
However, we cannot see sufficient public service to be renderedi
We, therefore, do not recommend to your Board, that this section be placed in the
Virginia Department of Highways Secondary Road System.
The following Viewers' Report was presented, and upon motion made by Nr. Williams and seconded
by Mr. Sutherland, was accepted in accordance with Section 2039 of the Virginia Code:
We, the uudersigned, being Viewers appointed by your Board at its regular meeting
on February 15, 1956 to view the following described section of road and make re-
port to your Board hereby wish to advise that on March 8, 1956, we did view the
following section of road and make report on same.
Beginning at Route 737 in Scottsville area near the home of E. W. O'Brien and
ending at Route 726 (No length given).
We met Mr. O'Brien, his som, and Irene Jones at the 737 end of proposed road,
which was not traVeled with car, truck, or e~netractor. No landowners were
present to discuss right of way for proposed road. We advised Mr. O'Brien that
all ~and owners would have to sign a petition at your office guaranteeing a 30
feet right of way on proposed location of same as the old road bed would not be
satisfactory~ We feel that this section needs a road connecting 737 and 726
near this point.
We therefore, cannot recommend to your Board regarding this petitionuntil
right of way and other problems are clarified.

Beginning at Route 6~1 (01d Lynchburg Road) approximate seven miles from city
limits and in an Eastern direction ending 0.6 of a mile at property of C. A.
Lambert, Jr.
We find that this section of road to be practically impassible and feel that the
petitioners should first construct a Road suitable for State maintenance before
they build or improve any property in this area.

Virginia Department of Highways Secondary Road System.

Beginning at Route 982 (Strib!ing Avenue) 0.3 of a mile West of City limits around
Circle and back to Route 782, 0.5 of a mile West of City limits, a 6istance of O.3
of a mile.
We find that this road needs widening, some stabalizing. Howevers we do not feel
thatthere is sufficient public service to be rendered in order to justify our
recommending same to be put in the Secondary System.
We, therefore, do not recommend to your Board that tkis section be placed in the
Virginia Department of Highways Secondary Road System.

by Mr. Sutherland, was accepted in accordance with Section 2039 of the Virginia Code:
We, the undersigned, being Viewers appointed by your Board at its regular meeting
on February 15, 1956 to view the following described section of road and make re-
port to your Board hereby wish to advise that on March 8, 1956, we did view the
following section of road and make report on same:
Beginning at South end of~ state route 803 in Maury Hills and continuing West to
Route 29, a distance of 0.14 of a mile, petitioner - Hamilton L. Wood.
We find this short section of road adjacent to the hard surface section of State
road in Maury Hills and understand that traffic in this section uses this short
section when coming out of Naury Hills area.
We therefore, recommend to your Board that, if an when the petitioners fill low
sections and bring up entire road to State maintenance standard, that this section
of O.l% of a mile be placed in the Virginia Department of Highways Secondary Road
System for State maintenance.
In connection with the foregoing report, the following resolution was unanimously adopted on
motion of Mr. Williams, seconded by Nr. Sutherland:
BE IT RESOLVED by the Board of County Supervisors of Albemarle County,

We, the undersigned, being Viewers appointed by your Board at its regular meeting

port to your Board hereby wish to advise that on March 8, 1956, we did view the
following section of road and make report on same:
Beginning at Corporate limits on ForestHills Avenue and extending through County
section of Forest Hills Avenue, a distance of approximate &O0 feet, petitioner-
Hubert Carver.
We find that this section of road was constructed by the cityunder right of way
agreements and believe it to be properly classed as a Sub-Division Street. We do
not feel that this short section lying by itself should be added to the State
Highway System.
W$, therefore, do not recommend to your Board that this section be placed in the
Virginia Department of Highways Secondary Road System.

The following Viewers' Report was presented, and upon motion made by Mr. Williams and seconded

We, the undersigned, being Viewers appointed by your Board at its regular meeting
on February 15, 1956 to view the following described section of road and make re-
port to your Board hereby wish to advise that on March 8, 1956, we did view the
following section of road and make report on same:
Beginning at Route ll05, O.11 of a mile east of ll03 and continuing North for
O.1 of a mile to llO1, petitioner - C. E. Spencer.
We find that this read is a connection between llO~ (Woolen Mills Road) and llO1
with one house to be served. The improvement of this road would be mostly for the
developments of lots joining same, which we feel would not justify being put in
the Secondary System.
We, therfore, do not recommend to your Board that the section be placed in the
Virginia Department of Highways Secondary Road System.

The following Viewers' Report was presented, and upon motion made by Nr. Williams and seconded
by Nr. Sutherland, was accepted in accordance with Section 2039 of the Virginia Code:
We, the undersigned, being Viewers appointed by your Board at its regular meeting
on February 15, 1956 to view the following described section of road and make re-
port to your Board-hereby wish to advise that on March 8, 1956, we did view the
following section of road and make report on same:
Beginning at Int. with Route 7~8 near State Highway Warming House, and extending
North to V.F.W. Club, a distance of 0.3 of a mile, petitioner - Peyton Taylor.
We find that this section of road is serving some three or four business estab-
lishments, and V.F.W. Club, also State Highway Equipment Parking Area. We believe
that this is properly classified as a Sub-Division and the same should be brought
up to the standard for Sub-Divisions.
We, therefore, do not recommend to your Board that this section be placed in the
Virginia Department of Highways Secondary Road System until brought up to meet Sub-
Division requirements.

The following Viewers' Report was presented, and upon motion made by Mr. Eilliams and seconded

We, the undersigned, being Viewers appointed by yourBoard at its regular'meeting
on February 25, 1956 to view the following described section of road and make re-
port to your Board hereby wish to advise that on March 8, 1956, we did view the
following section of road and make report on same:
Beginning at Route 250 just West of entrances to Charlottesville Stone Quarry and
continuing in an S. E. direction for 0.27 of a mile to the proposed Thomas Jeffer-
son Memorial, petitioner - Me. Hildreth.
We find that this road has been discussed with the Highway Department and they
have estimated the cost of constructing satisfactory road in keeping with a
memorial of this type would cost approximate $10,000. We do not feel that at
this time there is any public service to be rendered.
Wy, therefore, do not recommend to your Board that this section be placed in the
Virginia Department of Highways Secondary Road System.

Petition was received requesting inclusion in the Secondary System of an extension of Monte
Vista Avenue of 550 feet. Mr. Pence was directed to advise the petitioners that when this section of
road is brought up to subdivision standards, this Board will recommend its acceptance, into the Se¢ondar~
System by the State Highway Department.
Communication was received from Mr. D. K. McNish requesting that the road in f~nt of his
house be taken into the Secondary System, said road being an extension of Kenwood Road of approximately
700 feet. it was ordered that this request be filed with Run,edge Subdivision petition.'
Mr. Harry Martin appeared and present~d~p~ition signed by some forty-two persons, requesting
hard surface of Route 6~8 extending from Route 22 to the Chesapeake and Ohio Railroad. Mr. Shields
requested Mr. Martin to come by his office in order that he may go over the Highway Department's master
plan which woLGd show the program shheduled.
The following resolution was received from the Albemarle County Planning Commiss~on.
UBe it resolved, that, the Albemarle County Planning Commission recommends thath~he
Albemarle County.Board of Supervisors close the 20' foot strip porposed as a road
between the properties of Frank B. Haynes, Jr. and Hope W. Gleason, Jr. in Meadow-
brook Heights until such time as it is widened to meet the specifications of the
subidivision regulations for a street."
Mr. Bruce Reynolds, Attorney, appeared representing residents in the area above referred to
and advised that said residents do not wish this narrow strip used as a public road but have no object-!
ion to same being used as an access road by the subdivider. He further requested that the Board declar~
this road as an access road only. ~r. Massie Smith also appeared in this regard representin the
Bellemoore Realty Corporation. After considerable discussion, the following resolution was offered by

Mr. Williams seconded by Mr. Sutherland, and unanimously adopted:
BE IT RESOLVED by the Board of County Supervisors of Albemarle County,
Virginia, tha~ the 20 foot strip of road situated between the properties of
Frank B. Haynes, Jr. and Hope W. Gleason, Jr., located in Meadowbrook Heights,
'!?be ~nd the same is hereby approved as an access road only for use of the sub-
divider and not for use by the public.
Communication was received from Mr. Bluford Hall requesting inclusion in the Secondary System
of road by Mayo chapel connecting the Scottzville Road with the Old Lynchburg Road.

tion was called to the fact that this road had been viewed by viewers and had been turned down because
of the prohibitive cost involved. ~ir. Pence was directed to advise Mr. Hall of the Viewers' report and
of the Board's concurrance in said report and also to advise Mr. Hall that the views for this year have
been completed but that if he so wished, he could make application for viewing next year.
Mr. M. N. Pence, Director of Finance, submitted Statement of Expenses of the Department of
Finance for the month of February, 1956, of which one-third is to be borne by the State. Upon motion,
'duly made and Eeconded, this Statement was examined, verified and approved.
Mr. N. ~i. Pence, Director of Finance, submitted Statement of Expenses of the Sheriff's Office
for the month of February, 1956, of which two-th~ds is to be borne by the State. Upon motion, duly
made and seconded, this Statement was examined, verified and approved.
Attorney's Office for the month of Feb=hary, 1956, of which one-half is to be borne by the State. Upon
motion, duly made and seconded, this Statement was examined, verified ~nd approved°
Statement of Expenses &~c~ed ~ the maintenance of the County Jail for the month of February,
1956, was submitted along with Summary Statement of Prisoner Days. On motion, duly made and seconded,
this Statement was examined, verified and approved.
Reperts of the Department of Public Welfare for the month of February, 1956, were presented
in accordance with Sections 63-67.1 and 63-67°2 of the Codeof Virginia.
Claim of the University of Virginia Hospital in the amount of $3,0~0~00, of which one-half is
reimbursable by the State, for hospitalization of indigent patients, was presented and on motion of Nr.
Smith, seconded by Nr. Thraves, was approved for payment.
Report of the County Executive for the month of February, 1956, was presented, approved and
ordered filed.
An offer of $50.00 was received from Henry B. Goodloe, attorney, on behalf of one of his
clients, for a one acre tract of land owned by the County and located in the Samuel Niller District,
recorded in D.B. 287, page 9. This offer was referred to Nr. No Y. Sutherland for investigation and
report.
An offer of 950.00 was received from Nr° John W. Gibbs for four acres of county owned property
located in the Scottsville District, recorded in DoB. 299, page 55~ This offer was referred to Nr.
H. Ashby Harris for investigation and report.
Nrc N.~N. Pence, Director of Finance, advised the Board that as a result of voiding the 195~
reassessment an error occurred in the assessment of real estate of Cove Creek Industries, Incl and of
E. F. and H. Bo Wieboldt. He further advised that the tax on same was paid by Nr. Wieboldt and was late~
discovered by his attorney who reported the error to his office. Nrc Pence stated that a refund of
9290.53 wo~ld be necessary to correct this error and that with funds in the budget, an appropriation of
$~1.00 would be required. On motion of ~r. Smith, seconded by Nro Garnett, refund of $290.53 was ap-
proved and the following resolution unanimously adopted:
BE IT RESOLVED by the Board of County Supervisors of Albemarle County,
Virginia, that 9~1.00 be and is hereby a~propriated to supplement funds already
budgeted to cover refund of taxes in the amount of $290.53.
Report was received from the Division of Narkets on t~st of weighing and measuring devices in
the County and was ordered filed.
The following resolution was received from the School Board:
"On a motion by Nr. Oglesby, supported by Nr. ~oltz, it was unanimously decided that
the School Boar8 was of the opinion that the building program which was suspended in
Nay, 195~, shouted now be resumed and carried to complet±on as soon as possible, and
that it was the opinion of the School Board that this could be done within the limits
of the present tax structure. This report was made to the Board of County Supervisors

Club and were ordered filed. After considerable discussion of this matter, the following resolution was

Communication was received from the Albemarle Tuberculosis Association regarding payment of
sanatorium board for medically indigent tuberculosis patients and made the following recommendation.
When the General Assembly passed legislation calling for admission of tuberculosis patients to state
hospitals without regard for their ability to pay, most of the local political units refused to re-
appropriate funds for this purpose. The Association, therefore, feels it unfair for the few remaining
locals to assume this responsibility and requested that Albemarle County also withdraw their financial
~upport~ However~ the Association did request that f~nds be set aside in case of any emergency.
Pence advised that funds were in the budget in the event such became necessary.
Application was received from Edward Jo & George $. Shiflett to operate an Automobile Grave-
yard on the property of Edward J. Shiflett located approximately one-half mile beyond Earlysville on
the right-hand side of the Advance Mill Road. This matter was referred to Nr. Thraves for investigatio~
and report.
Notice was received from th~ ~tate Corporation Commission advising of hearing on April 2~,
1956 at lO:O0 A.N. on the petition of The Chesapeake and Ohio Railway Company seeking authority to dis-
continue its agency and telegraph station at Greenwood, and to thereafter maintain the same as a prepay
or non-agency station. This matter was carried over until the regular April meeting in order that any-
one interested might make their wishes in this regard known to this Board.
Nr~ Pence advised the Board that request had been received from Orchard Acres Subdivision for
assurance to F.H.A. that the Board of Supervisors would recommend acceptance of reads in this subdivisio
into the Secondary System. On motion of Mr. ~illiams, seconded by ~r. ~mith, Nro Pence was instructed
to advise by letter that if an when said roads are brought up to subdivision standards, this Board will
recommend their acceptance into the Secondary Road System.
Nr. Pence advised the Board that he had received a request from the Thomas Jefferson Nemorial
Foundation and the Chamber~ Commerce f~r an appropriation from this Board of $10.00 fOr a wreath to be
placed on Jefferson's grave on April l~th. On motion of Mr. Willia~ms, seconded by Nr. Thraves, the
following resolution was unanimously adopted:
BE IT RESOLVED by the BOard of County Supervisors of Albemarle County,
Virginia, that $10.00 be and is hereby appropriated to be used for a wreath to
be placed on the grave of Thomas Jefferson on the date of his birth, April 13tho
~r. Pence advised the Board that Sections 24-207 and 2~-208 of the Virginia Code allow $5.00
round trip, plus mileage, to judges for delivery and custody of books, whereas it has been the policy
in the county over past years to allow a day's pay for each trip and each day served, plus mileage.

On motion of Mr. WilliamE, seconded by Mr. Thraves, the Board want into executive session for
the purpose of discussing matters pertaining to personnel.
Back in session, the resignation of Mr. Samuel S. Clark as Assistant County Executive effect-
ive March 31, 1956, was received. On motion of Mr. Williams, seconded by Mr. Sutherland, Mr. Clark's
resignation was accepted with regret and the Board expressed its appreciation for Mr. Clark's offer to
be of assistance to the office and his successor if needed and also expressed good wishes to Mr. Clark
in his new work. Also on motion of Mr. Williams, seconded by Mr. Sutherland, Mr. Pence was directed to
look for a replacement for this office.
A policy relating to the construction of roads in new subdivisions to conform to standards of
the State Highway Department was presented, and after considerable discussion, this matter was refer~ed
to the Commonwealth's Attorney, the State Resident Engineer and the County Executive for further con-
sideration and report at the next meeting.
