Rachel,
As we discussed earlier,the "buffer" is already turf for much of the back yard.The location of the new dwelling will be
within turf area, 90-ft from the 'stream',which results in an impact of the first 10-ft of buffer. Reduction of the buffer to
50-ft is allowed by Section 17-604.A(ii) if mitigation is provided. Section 17-604A is as follows:
A. "Within the landward 50 horizontal feet. On a lot within the fifty(50) horizontal feet of a stream buffer that
is the most landward (furthest from the stream), if the structures, improvements or activities either: (i)
would be for necessary infrastructure to allow reasonable use of the lot; or(ii) would be on a lot that is
within a water supply protection area where the stream buffer protects an intermittent stream and the lot is
within a development area. In all cases under this subsection, any new building site and sewage disposal
system shall be located outside of the stream buffer."
The Engineering Dept reviews building permit applications for single family homes (only) and the reviewer typically
confirms if there is a buffer disturbance, even if the disturbed area is less than 10,000 sf. Considering the condition of
the buffer/stream and the proposed mitigation (3 trees if I recall correctly), engineering did not object to the permit
application.

Frank,
I have a rezoning for this property going to the PC tonight. One PC member asked exactly how much disturbance to the
stream buffer is occurring. I pulled this WPO to see if I could find out and the application proposes 0.001 acres to be
disturbed but there wasn't a whole lot of other info. Is it fair for me to tell the PC that only .001 acres of disturbance is
allowed?
