was held at the Office Building of said County on the 20th day of December, 1944.

The following copies of orders of the Circuit Co. urt of Albemarle $o~ty were pre-
sented and ordered made a part of the minutes of this meeting:

On this the 20th. day of December, 1954, personally ap-
peared in the Clerk, s Office of the Circuit Court of the County-of
Albemarle, Henry Chiles who was on the Sth day of December 1955, duly
appointed by the Circuit Court. of said County a member of the Board of
County Supervisors, White Hall District, to fill the unexpired term of
office of Dr. L. G. Roberts, deceased, endin~ December ~lst 1~47, and'
t~geSher with the Fidelity and Deposit Company of Maryland, by ~ary G.
Hisle, atty in fact, entered into ~ud acknowledged a bond in the penalt~
of One Thousand ($1,000.00) Dollars, conditioned and payable according
to law, and took and subscribed the oath of office prescribed by law.

Application having been made to the Board o~ County Supervisors of this Oounty
!by Luther ~orris and ~illie Rodgers through their Attorney, ~r. ~. C. ~illiams, to establish
~a public road through the lands of Loula ~. ~h~et$,a distance of approximately one-half mile

~to the property of Willie Hodgers, it is ordered that Messrs, C. ~. Garnett,/~i V. Herold,
IC. C. Duke and P. C. Minor, resident freeholders of this county, any three of wh~m may act,
!e and they are hereby appointed Viewers whose duty it shall be to examine such road and re-
~ort upon the expediency of establishing the same; they shall as soon as practible after ~e-
~eiving this o~der, proceed to make the view, and may e×~ine o~her routes and locations than
~he one proposed, and if of opinion that there is a necessity for establishing a public road
~hey shall locate the same, return a map or diagram thereof, with a report to the Board stating
heir reasons for preferring the locations made, the probable cost of establishing the
~ocations of such road, the convenience and inconvenience that will result as well as to
individuals as to the public, whether the said road will be one o~ such mere private convenience
as to make it proper that it should be opened, established, and kept in order by the person or
~ersons for whose convenience it is desired, whether any yard, garden, orahard will have to be
land so taken, and for the damages of the residue of the ~ract, if any, beyond the peculiar
benefits to be derived in result to such residue from the road to be established; and all
other facts amd circumst~uces in their opinion useful in enabling the Board to determine its
expediency of establishing the road~~_ and they shall file such report with the Clerk of this
Board;
In the event that some of the l~ndowners donor require compensation and they will
execute written consent, giving the right of way in question, the said Viewers shalI obtain
such consent and return it with their report:
Provided, however, that the Chairman of the state.~Highway Commission, sometimes
called the State Highway Commissioner, shall forthwith be notified of' and made a party to
these proceedings, and t~t he shall likewise be notified of the time and place of the meetin
of the Viewers herein designated.
A request was received from the Virginia Reserve ~.li%im , Company 2, for an ap-
propriation of ~200.00 to defray the expenses of the Company was presented.
Upon motion, duly made and seconded, an appropriation of $200.00 or as much thereoJ
as is necesszry was made for expenses of Company No. 2 of Virginia Reserve Militia.
~[r. C. A. $~dner of Fork Union, Virginia, requested that a section of Road'in
Appleberry Mountain of about four miles which was dropped from t~e Secondary System at the
February, 1943, meeting, be ~a~aken into the Secondary System. Upon motion, duly made and
seconded, this matter was referred to Mr. R. C. Ambler, Resident Engineer, for report.

for additional information.
H. A. Haden, Director of Finance, submitted a Statement of expenses of the Depart-
ment of Finance for the month of November~ 195¢, one-third of which to be borne by the State.
Upon motion, duly made and seconded, this Statement was examined, verified and approved.
H. A. Haden, Director of Finance, submitted a Statement of Expenses of the Sheriff~
Office for the month of N~vember 1945, two-thirds of which to be borne by the State. Upon
motion, duly made and seconded, this Statement was examined, verified, and approved.
A Statement of the Cost of Maintenm~ce of Prisoners confined in the County Jail
du~ing the month of November, 1~$4 was submitted. Upon motion, duly made and seconded, this
Statement was examined, verified and ap~proved,
A Summ~ry Statement of Prisoner days served in the County Jail during the month of
November, 1955, was submitted. Upon motion, duly made and seconded this statement was examined,
verified and approved.
A Claim'of Dr. R. T. Ergenbright, Jail Physician, amounting to $6.?~ was approved
for payment.
Claim of the Monticello Hotel~for board of Jury in murder case of Commonwealth Vs.
Lonnie Collier amounting to 20 was approved for payment.
A com~nunication from the Fidelity and CasuiStry. Company of New York inquiring wheth~
or not the Board wished to continue in force Bonds which were issued for H. H. Tapscott, M.
H. Foster, and Hugh ~. Clark as special police. The County Executive was directed to write
the Fidelity and Casualty Company of New'York that we did not care to continue the bonds in
force beyond the term for which they were originally written.
Albert Garland presented a Claim for refund of taxes for the year. 1928 on a tract
of ~4 acres which was paid twice. Once on June 13, 1930 and again on October 9, 1955, amounting
to $17.87 for the year. Upon motion, duly made and seconded, $17.87 was ordered refunded to
Albert Garland..~
The followinE reports were presented and ordered filed:
(a) County Executive.
(b) University 8f Virginia Hospital.
(c) Game Warden.
(d) Board of Equalization.~
A .communication from Mr. W. E. Buford regarding Route No. 626 was presented. Upon
motion,_duly made ~nd seconded, the County Executive was instructed to advise Uro Buford tha~
the matter would be taken up at the regular spring road meeting in
The following resolution way unanimously adopted;
~HEREAS, it has been brought to the attention of this Board
that the private road leading to the residence of Nr.~Henry~cComb
Bush, near Eamtham, this Co~unty was damaged to such an extent by
travel to and from an air spotting station located on Mr. Bush's
property, that it has become n~cessary to resurface the same, and
V{HEREAS, it appears that it is unfair for Er. Bush to bear
the entire cost of this repair work under the circumstances,
NOW, THEREFORE, BE IT BESOLVED, by the Board of County
Supervisors of Albemarle County, that it is the sense of this Board
that the Federal Government should assume 252 of the cost of the re-
pair work required on this road at this time.
Claims against the County Amounting to $176,011.~8 were presented, examined, and
~llowed... a.nd ordered certified to the Director of Finance forspayme~and charged against the
following funds:
