The language hasn't been approved yet by our CA but it should be a good starting point: Section 13.01. Creation of Preservation Area Easement: Association B Declarant hereby imposes a perpetual tree preservation/woodland preservation ea certain areas labeled and designated as "Tree Preservation / Woodland Preservation Open Space Easement" on the Plat ("Preservation Area"). The Preservation undisturbed and trees located within the Preservation Area shall be preserved in { terms set forth herein, The Association shall be responsible for the maintenance of tl upon the terms set forth within this Article XIII. Section 13.02. Tree preservation areas can be on individual lots as long as they are in an easement and you have an instrument recorded for their maintenance. I think you will need to amend your current agreement to include these features. Or include a separate agreement. You will likely still need a BLA with phase 2 to make sure your overall density for the site site stays at or below the approved 1.2125 du/ac.
