Stoner Milestone Partners 300 2nd Street NE Charlottesville, VA 22902 RE: ZMA201000018: Crozet Square Dear Frank: Thank you for your submittal of July 18, 2016. Summary of June 28, 2016 Meeting: You, Ann Mallek, Mark Graham, Susan Stimart, Faith McClintic, Doug Walker, David Benish, and I met to discuss issues related to this development, off -site improvements, and on -site improvements. These are our takeaways: • Ann will talk to the downtown businesses about the fact that there will be future intersection improvements that will change the circulation pattern on the Square so that they have a heads -up as Frank proceeds with his project. • Ann, Doug, and Economic Development will get together separately to discuss ultimate ownership, improvements for, and maintenance of the Square. • Doug and Economic Development will put together information for the BOS that will ride separately from and, hopefully in advance of, the ZMA that will lay out potential funding mechanisms for public improvements to spur growth and redevelopment where we want it to take place. (downtown Crozet and Rio/Hydraulic are the two places that first come to mind) • Frank and DCI are working with a consultant on a plan for the downtown plaza. We will point out in our staff report that future ownership of, improvements, to and maintenance responsibilities will need to be worked out ahead of the first site plan or plat that establishes the plaza area. Outstanding Items In addition to these items, I said I would put together a punch list of items you need to change on your plan and proffers, based on our other discussion, as well as provide a potential schedule for getting to the Planning Commission and Board of Supervisors. Information on a potential schedule is provided at the end of this letter. The Proposed Plan In your most recent email concerning the road network, you provided the plan to the right. We discussed the fact that High Street and Library Avenue need to be public streets and that there will need to be some r.o.w. vacation of Oak Street and Ellison Street (not identified on the plan on the right) for your plan to proceed. We recommend that you modify the plan to show Library Ave. and the length of High Street to the primary street connection as public streets and the primary street connection as a public street. The other connecting streets may be public or private. Please note on the plan that the parking lots shown are conceptual only and may change. We recommend that you proffer development of the land with the grid network that appears on the plan, acknowledging that modifications to the alignment of the roads on the plan are allowed with the approval of the Director of Community Development and provided that the street interconnections are made. Street Network As we have previously discussed, development from your properties will accelerate a need for off -site intersection improvements which, at present, you have not offered to make. County staff is willing to recommend that the County fund up to half of the cost of making these intersection improvements when warrants are met. Staff also believes that a warrant analysis should be done with each site plan for development of the property until such time as the warrants are met. We recommend a commitment to a warrant analysis for each site plan until warrants are met and a commitment to fund at least half of the intersection improvements up to $250,000 to deal with the impacts of your development. Regarding the extension of High Street to Tabor Avenue, staff previously spoke with you the need to consider construction of an urban street section from your property to the intersection with Tabor Avenue. After much discussion, though, staff believes that the proffer you provided in the April 4 draft proffers is acceptable. This is because an urban section would require drainage improvements on properties you do not control. A Public Plaza The Crozet Master Plan recommends creation of a Downtown Community Green for which you provided a proffer ("Civic Space"). We recommend that you further define this proffer by indicating that the location(s) for civic space, including a community green, will be decided in consultation with the Crozet Community Advisory Committee or other Crozet community -wide group and approved by the Director of Community Development. Any improvements to, ownership of, and maintenance of this area will rest with the developer until such time that the County is offered and takes ownership of the area or another entity agrees to take on this responsibility. List of Changes for Your Final Submittal for the Planning Commission 1. Revised Plan (your last version) showing Library Ave. and the length of High Street to the primary street connection as public streets and the primary street connection as a public street. The other connecting streets may be public or private (noting that private streets will require a separate modification request if done with a subdivision). Please note on the plan that the parking lots shown are conceptual only and may change. 2. Conceptual plan for stormwater management. 3. Proffers containing information on these items: a. Correct TMP information and description: TMP 056A2-01-00-07100, 056A2-01-00-071BO (portion), and 056A2-01-00-02500 (portion) b. Paragraph 1: Rezone one parcel and portions of two additional parcels totaling 6.2407 acres, more or less, two from Heavy Industry (HI) to Downtown Crozet District (DCD) and one from Commercial (C-1) to Downtown Crozet District (DCD) c. The (Phase 1) Plan shall refer to [name of plan, date of preparation, name of preparer, and last revision date. d. Construction of Public Streets — as indicated on page 1 of the April 4 draft proffers. e. Civic Space -- further define this proffer by indicating that the location(s) for civic space, including a community green, will be decided in consultation with the Crozet Community Advisory Committee or other Crozet community -wide group and approved by the Director of Community Development. Any improvements to, ownership of, and maintenance of this area will rest with the developer until such time that the County is offered and takes ownership of the area or another entity agrees to take on this responsibility. f. Affordable housing proffers (if you still wish to include them) with these changes: g. (Recommended) With each site development plan for new construction, you will provide a warrant analysis to VDOT satisfaction related to the need for timing of intersection improvements to Library Avenue at Crozet Avenue and The Square at Crozet Avenue. h. (Recommended) Proffer to provide up to half of the cost for the intersection improvements required at Library Avenue and Crozet Avenue and The Square and Crozet Avenue up to $250,000. i. (Recommended) Proffer to reserve for dedication on demand r.o.w. of sufficient width to connect a street or streets in Phase 1 of your project to Hilltop Street in Parkside Village through Tax Map Parcel 056A2-01-00-071BO. As you may recall, this property adjacent to the National Register Crozet Historic District. We believe it is very important that new construction be compatible with the vernacular architectural styles in Crozet. Please consider how you could commit to support and enhance the character of the historic district. Action after Receipt of Comment Letter Frank, the next resubmittal date is next Monday which would give you a potential PC date of 9/13/16 and a possible BOS date in November.
