BACKGROUND:
The applicant, Mr. George Stevens, has requested approval of a private road to serve a proposed new lot of 26 acres
divided from a parent parcel of approximately 200 acres. The existing private road, known as Middle Mtn Road,
currently serves three properties, one of which has two residences for a total of four existing users. The proposed
new lot creates a fifth user and requires authorization by the Planning Commission under Section 14-234 to allow
a private road. The private road currently runs parallel to Grubbs Branch and approaches to withi feet of the
stream.
DISCUSSION:
As grounds for this request, Mr. Stevens has stated that Grubbs Branch should be protected from erosion and
additional runoff that would result from widening the existing road (beyond the County's private road standards)
and that existing vegetation along the stream should be protected (see Attachment D). Staff has visited the site and
believes that maintaining the private road within its existing road bed and minimizing grading and removal of
vegetation does in fact provide the best means of protecting the stream. Engineering staff met with the applicant
and his contractor on the site to explain what work would be needed to meet the private road standard. Engineering
has determined that, with the exception of improvements to the stream crossing, all needed work has been
satisfactorily completed (see Attachment E). Planning staff will not approve the proposed subdivision plat until the
stream crossing is built or bonded to the satisfaction of the Engineering Department.
RECOMMENDATION:
Staff recommends approval of the request under Section 14-232(A)1(b) of the subdivision ordinance.

Dear Maynard,
I have requested for application for a private road accessing my 26.3548 acre parcel at
Sugar Hollow. I am subdividing this parcel from family property acquired by my
grandfather in the 1930's. My main interest is to preserve the natural beauty and
integrity of this area in Albemarle County.
The subject road which is the original Burnt House Hollow Road runs parallel with
Grubb's Branch, which feeds into the Moorman's River. This road is in close proximity
to the banks of this branch and needs to be protected from erosion and any additional run
off that would occur with further widening of this road. It is important to provide good
visibility, but at the same time preserve trees and important vegetation. We have
followed the recommendations of county engineer Glenn Brooks to improve the road
with minimum impact to the environment. These improvements have been completed to
his specifications.
I feel that the public would not benefit from having this road maintained with tax dollars.
I will have my attorney prepare a proper road maintenance agreement along with the
recent survey of this subject parcel.

RE: Middle Mtn. Road, private road evaluation for additional residence and
subdivision of land
According to our inspection of 30 November 1998, the work necessary on Middle Mtn. Road to bring it
up to County private road standards has been satisfactorily completed, with the exception of
improvements to the stream crossing.
The Stevens have indicated that the County requirements for the stream crossing are somewhat vague;
stating only that the crossing must meet a 10 year storm design (14-512.1). The prices they have
received from the private sector to clarify this design requirement at the crossing into any actual physical
improvements have been very unreasonable. (The engineering cost quotes probably exceed the actual
cost of improvements to the road.)
In an attempt to clarify County requirements, I have performed the computations which are attached.
Please pass this on to the applicant, as they may wish to have the data checked, or have an alternative
computation performed, or just have it for reference.
The existing culverts do not meet the 10 year storm design, as the predicted flow during a 10 year storm
will overtop the road. Adding a 42" or 48" metal pipe (CMP) with its bottom even with the lowest pipe,
and raising the low point of the road about a foot, will improve the crossing to meet County
requirements. However, it should be noted that the existing arrangement of pipes (see attachment) is
susceptible to clogging and washing out. It is recommended that all of the small ductile iron pipes be
removed and replaced by two 48" pipes. (Two 48" pipes and a 36" pipe at the elevation of the lowest
invert, with about a foot of fill added to the road, will meet the County standard.)
It should be noted that the current culvert arrangement meets approximately a 2 year storm
