Other Matters not Listed on the Agenda from the BOARD, Mr. Tucker 'said the Schobl Board would like to meet with the Board to discuss their budget for the next fiscal year. It was agreed that the Board could meeting on February 5, 1996, at 4:00 p.m. Mr, Marshall, said that since the sign was posted for the proposed Southern Connector road his phone has been ringing. The peopl6 in Mill Creek don't want the road. They are afraid their road would be used as cut-through to the University. The developer is also afraid it will hinder his ability to sell lots. If the County cannot afford to build the road, he thinks it should be removed from plans. Mr. Tucker said the staff would look at the proposed road, and make a report at a later date, Mr. Marshall recognized James Miller, who was present for the purpose of obtain- lng an Eagle. The Board of County Supervisors of Albemarle County, Virginia, in regular meeting on the 15th day of January 1997, adopted the following resolution: R E B 0 L U T ~' ON WHEREAS, the street in Forest Lakes Subdivision, Kendalwood (SUB-92-087) described on the attached Additions Form SR-5(A) dated January 15, 1997, fully incorporated herein by reference, is shown on plats recorded in the Clerk's Office of the Circuit Court of Albemarle County, Virginia; and WHEREAS, the Resident Engineer for the Virginia Department of Transpor- tation has advised the Board that the street meets the requirements estab- lished by the Subdivision Street Requirements of the Virginia Department of Transportation. Carey, Cl~rk, CM~ o 0 o ~3 ~ o Im RESOLUTION D~signating the ~onth of February, 1997 am PETFIX HONTH 1997 · FHEI~EAS, dogs and cats give companionship to and share the homes of over 50,000,000 individuals in the United States; and WHEREAS, two unaltered cats and their kittens can produce 420,000 more kittens in seven years and two unaltered dogs and their puppies can produce 67,000 more dogs in six years; and WHEREAS, it is estimated that more than 12,000,000 dogs and cats are euthanized each year in the United States, although many of them are healthy and adoptable, simply because there are not enough homes; and WHEREAS, the Virginia Federation of Humane Societies estimates that there are over 300,000 dogs and cats euthanized in the Commonwealth of Virginia each year; and WHEREAS, the problems of pet overpopulation costs the taxpayers in this country millions of dollars annually through animal control programs trying to cope with the millions of unwanted animals; and WHEREAS, spaying and neutering dogs and cats has been shown to drastically reduce cat and dog overpopulation; and WHEREAS, veterinarians, humane societies, and national and local animal protection organizations worked together to ensure the spaying and neutering of more than 51,000 companios animals during the "Spay Day USA" evenn in February, 1996; and WHEREAS, veterinarians and humane organizations in the Harrisonburg, Charlottesville and Central Virginia areas have joined together to advocate the spaying and neutering of companion animals during "PETFIX MONTH 1997". NOW, THEREFORE, BE IT RESOLVED, that the Board of County Supervisors of the County of Albemarle, Virginia, recognizes the Month of February, 1997 as "PETFIX MONTH 1997" and encourages all citizens to observe this month by either having their dogs or oats spayed or neutered or by sponsoring the spaying or neutering of a companion animal for another. Carey, do hereby certify that the foregoing writing is a true, correct copy of a resolution adopted by the Board of County Supervisors of Albemarle County, Virginia, at a regular meeting held on January 15, 1997. ~r~k, B~oard °~f C°~un/~rvisor s RIVANNA GREENBELT EXTENSION RESOLUTION WHER~S, under the Intermodal Surface Transportation Efficiency Act (ISTEA), certain funds are made available for enhancement projects; and WHEREAS, the project presented is construction of an ADA accessible pedestrian and bicycle path, including the possibility of a pedestrian/bicycle bridge across the Rivanna River, from the terminus of the existing greenbelt trail at Free Bridge to Darden Towe Park, Pen Park and Northeast Park; and WHEREAS, the project is in accordance with the Comprehensive Plans of the County ef Albemarle and the city of Charlottesville, the Albemarle County Open Space and Critical Resources Plan, and the County's Neighborhood Three Plan; and WHER]~I~, the project is deemed meritorious an~ of benefit to the community and State; and WHEREAS, in accordance with Commonwealth Transportation Board construction allocation procedures, it is necessary that a request by resolution be received from the local government in order that the Virginia Department of Transportation program an enhancement project for the construction of an extension of the Rivanna Greenbelt trail. NOW, THEREFORE, BE IT RESOLVED, that the Albemarle Board of County Supervisors requests the Commonwealth Transportation Board to establish a projec= for the construction of the Rivanna Greenbelt Extension with the possibility of a Pedestrian/Bicycle Bridge. BE IT FURTHEE RESOLVED, that Albemarle County has sufficient capital improvemenus funds and agrees to pay one-half of the "local twenty percent match" toward the total cost for planning and design, right-ofmway, and construction of this project, in accordance with guidelines for ISTEA funding. This agreement is contingent upon an equal contribution being made by the City of Charlottesville. It is estimated that each locality's share of the total match will range from $17,100.00 to $50,000.00. AND, FURTHEE RESOLVED, that if Albemarle County subsequently elects to cancel this pro3ect, Albemarle County hereby agrees to reimburse the Virginia Department of Transportation for the total amount of the costs expended by the Department through the date the Department is notified of such cancellation. Request for ISTEA funds for bikelanes, sidewalks and landscaping/scenic beautification. AGENDA DATE: January15,1997 ACTION: CONSENT AGENDA: ACTION: X ITEM NUMBER: INFORMATION: INFORMATION: STAFF CONTACT(S): Tucker, Cilimberg, Wade, Bryan EltioR BACKGROUND: ATTACHMENTS: Yes REVIEWED BY: The Charlottesville-Albemarle Airport is seeking an ISTEA Enhancement Grant to provide sidewalks, bikelanes and landscaping as part of the road improvement project for Airport Road (Route 649). The Airport Road improvement project is identilied as priority ~e (of a total 70 projects) in the County's proposed Pdority ~t of Secondary Rood Improvements. The ISTEA funds would be used to supplement six year secondary road construction funds, revenue sharing funds and Airport Access funds to allow the Airport Road project to meet the County's desire to create an aesthetically pleasing, pedestrian friendly corridor. Airport Road serves not only as the gateway to the County and region for airport users, but also serves as a major spine road within the Hollymead Community. DISCUSSION: It is proposed that ISTEA Enhancement Grant funds be utilized to provide a means to make this corridor more usable for pedestr'rans and bicyclists. Installation of designated bikelanes and sidewalks to enhance Route 649 would also support vehiculsr traffic reduction efforts since these facilities would link residential areas such as Deerwood, Airport Acres, Forest Lakes, and businesses and employment centers such as Crutchtield Corporation, Central Fider~bj Bank, the Airport Industrial Park, the North Fork Research park, and the Charlottesville-Albemarle Airport. Bikelanes and sidewalks, funded through an ISTEA Enhancement Grant, would offer employees and customers living in the surrounding residential areas an alternative to automobile transportation to these businesses. It would also link this area to planned sidewalks and b'[kelanes in the Hollymead Community. This ISTEA Grant would also be used to provide for landscaping to enhance the aesthetic quality of this corridor. The total cost for the bikelanes, sidewalks, landscaping, and scenic beautification is $1,000,000, of which ~200.000 would be Albemarle County's local match. November 18, 1996 Court Square Maintenance Work Albemarle County's Court Square building is in need of maintenance work which includes interior and exterior painting and replacement of two cannon carriages. It is estimated that the maintenance work will cost $84,200.00 with the largest share going to painting the exterior. An appropriate source of landing for this maintenance work is the monies set apart from tax and deed purchases and other services conducted at the Court Square building. The balance in the Court House Maintenance account is as follows: Circuit Court $9,207.34, General District Court $124,968.20, and Juvenile Court $1,311.39. I understand that the Board of Supervisors must approve appropriation of funds. The condition of the building and the cannons warrant this action. Below, for your consideration and hopefully the Board of Supervisors', is a detailed description of the work needed. Exterior painting: The exterior woodwork on the Court Square building is in need of painting. Due to the age of the building, most of the pealing paint contains lead. Lead based paint (LBP) regulations require the County to follow s~rict guidelines while doing this sort of work. There are two painting contractors in this area certified to remove the LBP and conduct the necessary clearance test once completed. Because of the isolation procedures and special testing requirements, it will be less costly to do the work at once as opposed to one-third of the building at a time, which was the original plan. The original estimate for painting une-third of the building was $4,200.00 (see attached purchase order), but had to be canceled due to the new LBP regulations. I'am proposing that the entire exterior woodwork be done now for approximately $50,000.00 Isee attached quote). The exterior painting is predicted to last five-eight years and will be competitively bid if the Board decides to do this work. Interior painting: Since the last major renovation of the Court House fifteen years ago, very little interior painting has been done. I propose we allocate $15,000.00 and do part of the work in the Circuit Court. This amount of money will not do all that is needed, but the Staff Services operating budget could absorb the balance over a few years. MEMORANDUM Court Square Maintenance Work November 18, 1996 Page Two Cannon Restoration: In front of the Court House is a monument with'two cannons, one on each side, which were unveiled on MaY 9, 1909. The cannons (12 Pounder, Field Gun, Model 1857, the Napoleon) are in need of new carriages. The carriages are basically made of wood and include all the parts except the cannon tube itself. Because the wood parts are exposed to the elements 365 days a year, the life expectancy of a cannon carriage is five years. The cannons are an ongoing maintenance item, last rebuilt about five years ago. The wheels have deteriorated to the point that they are unsafe and need to be replaced. The cost to rebuild the carriages in wood is about ~7,200.00. However, instead of replacing the wood carriages every five years, I recommend that the carriages be constructed of aluminum, which will never need replacing. The national parks have gone to aluminum since rebuilding with wood every five years is costly. The cost of the aluminum carriages is $9,600.00 each for a total of $19,200.00 (see attached flier). The Court Square building and cannons are located inthe heart of historic Charlottesville. It is important that the County maintain its facilities and monuments so the history that has become such anintegral part of Charlottesville canbe honored and preserved. The historic atmosphere is the reason so many people live in and visit Albemarle County and the City of Charlottesville. Performing the maintenance work will help preserve the Court Square building, monuments, and correct some safety issues. Your consideration of this request is appreciated. This project was sited in the 1986 Urban Drainage Study and funded through the Capital improvement Project. In order to evaluate the problem and long term solution, the Albemarle County Department of Engineering had to do a specific analysis of the existing channel. The recommended best long term solution is to provide additional detention at a regional location upstream in combination with upgrading the channel. The channel upgrade alone will not provide a long term solution. The County currently has several working regional basins including Smithfield Basin, Berkmar Basin Kegler Basin, and Agnor-Hurt Basin. There are several owned basins that are not upgraded as yet including: Four Seasons Basin and Peyton Basin. These is one basin planned that has been postponed pending the decision on the extension of Greenbier Drive which is called Bimam Basin. These regional facilities were either programmed due to the 1986 Urban Drainage Study or resulted from an upstream project. There are two basins pending acquisition: Branchlands Basin.and Rio Hills Basin which is addressed in this request. With respect to channel upgrades, the Berkley Channel (CIP) project was completed several years ago and there have been other minor projects. To proceed with this endeavor, we need authorization to proceed in acquiring the Rio Hills Shopping Center Basin for this purpose. At the time the shopping center was developed, it was oversized without formalizing what the future use would involve, tt is our intention to either have the basin dedicated to public use or have the physical area deeded to the County. The physical improvements will be limited to an area within the existing stormwater detention basin. There may be some possibility of incorporating private contributions for the capital expenditure necessary for this project in order to take advantage of the regional use. Specifically, proposed upstream development could meet their detention requirements offsite rather than onsite. An agreement with the developer may be considered for this purpose. We anticipate that the funds necessary to provide the improvements have been appropriated. Once the basin is designated for regional use, the design can go forward. Cheryl has recently resigned and Mr. Camblos is requesting that we confmue a portion of this supplement in the amount of $3,321 for the new Assistant Attomey that he has selected to replace Ms. Hig~ins. This reduction in supplement will basically save the County $3,679 on an annual basis. Staff supports Mr. Camblos' request and I am requesting your approval to maintain a salary supplement of $3,321 for this position in order that it may be filled on February 1, 1997. The Comprehensive Plan and CATS (Charlottesville Area TranspoAatien Study) are used as a basis for development in the County. As development occurs, segments of planned roads are either constructed by the developer or right-of-way is resewed for the futura construction of a road. It has been a concern at the time subdivisions are approved that those affected were cugffLzant of the planned mad alignment when they decide to buy a home in proximity to such a project. Often, the property owner is not well informed and becomes upset that the mad connection project should not go forward due tothe effect on their property. Ensuring that Realtors and developers dudng their marketing activities are providing this information to potential buyers is not possible. Examples of specific occasions where planned roads met opposition at the §me the alignment went to public hearing would be Timberwood Parkway, where the developer was required to reserve the right-of- way and the mad design provided that no homes fronted on Timberwood Parkway. Subsequently, the connection to Meadow Creek Parkway was met with public opposition because many property owners were unaware. In that case, a sign would have precluded this from happening. To make the public aware of future projects, other communities have been installing signs at the location of the proposed project and this practice has been successful. Seeing such a sign will prompt interested citizens to call and inquire aboutthe proposed mad. At thatfime, they may review the information that is available in the Community Development Department and decide howthis does or does not affect their decision to purchase property. The first of these signs has been installed at the point where the Southern Parkway extension to Fifth Street may some day be constructed. Attached is a printout of the sign design. There are other locations that are appropriate for the same format (i.e., Western Ridge atthe point where it isintended to link into ;'he 240/250 connector road, and Cory Farm where a segment of the 240/250 connector is routed through.). Mr. Juandiego Wade, transportalion planner, has fielded many calls since the itrst sign was installed. If anything, this will prompt the' public to visit the County Planning Department to review the planned transpodation network in specific neighborhoods. The applicant proposes to park two wacks and wve 16 foot trailers at this residence. A third truck and a 16-foot trailer will be parked on the job site during the week. This third truck will be parked at the applicant's residence when there is no job. A more detailed description and justification for the use are included in Attachment A. Petition,: To establish a Class B - Home Occupation on 4.6 acres zoned RA, Rural Areas. The property, described as Tax Map 80-Parcel 74C, is located off Goochs Mill Lane - Route 842 in the Rivanna Magisterial District. This area is not in a designated Development Area (Rural Area 2). (Attachment B & C). Character of the Area: This property is developed with a single family dwelling and a shed. Access to the property is directly off Goochs Mill Lane - Route 842. Route 842 is an unpaved road (.3 mile in length) serving ten homes with 95 average daily Irips. This road is not scheduled for improveme_n.t in the County's Six Year Secondary Road Plan. The immediate area can be described as raral residential in character. RECOMMENDATION: Staff has reviewed the special use permit for compliance with provisions of Section 5.2 of the Zoning Ordinance and recommends denial. Plannine and Zoning History: In 1990 the applicant was granted a Home Occupation Class A for a janitorial and lawn care business. Comprehensive Plan: This area is located in the Rural Areas as designated in the Comprehensive Plan. This location is not identified in the Open Space as requiring particular attention. STAFF COMMENTS: Staff will address each provision of Section 31.2.2~ of the Zoning ordinance. The Board of Supervisors hereby reserves unto itself the right to issue all special use permits permitted hereunder. Special use permits for uses as provided in this ordinance may be issued upon a finding by the Board of Supervisors that such use will not be of substantial detriment to ad_iaeent property_. The possible impacts of this use on abutt'mg properties will be an increase in traffic, potential increase in noise and other impacts related to equipment/supply storage, and change in visual character. The applicant has indicated that only one of his employees will come to his home. The remaining employees will meecr at the work site. The applicant has also indicated that there will be no storage of oil, gasoline, fertil/zer, or other chemicals on site, and that all major mechanical work Page 1 of 4 other than routine maintenance of vehicles will be performed by an outside mechanic at their shops (Attachment D). The applicant will need to start the equipment at home to determine that it is in satisfactory running condition. Regarding traffic, staff is concerned that this use will increase traffic along an unpaved road and that additional traffic will be of a more commercial character (trucks with trailers). The adjacent property (Tax Map 80, Parcel 74 C) has a Home Occupation - Class A for a-VCR/TV repair business. The property was denied a Home Occupation - Class B to move a portion of his business to an existing garage. One of the main reasons for denial by the Board of Supervisors was the potential of increased traffic from customers on this unpaved mad (Route 842). While this proposed use would not likely generate as much traffic as the VCR/TV repair, it would generate additional traffic of a commemial character,and potentially create cordlicts with residential traffic (assuming one additional employee and two additional tracks leaving and returning only once daily, a total of six (6) additional trips would be generated per day). In the review of development proposals effort should be made to treat lands which are similarly situated and environmentally similar in like manner. Therefore, there should be some distinguishable difference between this proposal and the previous VCR/TV repair proposal on the adjacent property. While the Virginia Department of Transportation comments that this request "should not be a major impact to the infrastructure of the roadway"(Attaehment I), this road is not scheduled for improvements in the County's Six Year Secondary Plan. Regarding issues of eqmpmeut/supply storage, noise, and change of visual character of the area, the applicant has indicated that there will be no storage of gas, oil, fertilizer and the like (and that would be a recommended condition for approval). While the applicant may attempt this in good faith, staff opinion is that it would be difficult for such an operation to exist on site without some storage of gas, oil and fertilizer/seed at some point in time, particularly if "routine" maintenance is going to be conducted on site. Also, noise generated with loading/unloading of trailers and routine equipment maintenance may impact nearby properties. The applicant has taken steps to reduce the noise and view from adjacent properties by insulating the shed and planting ~vhite pine trees. Also, access to the shed takes place from the back, facing away from the road. Opponents of this special use permit have signed a petition (Attachment E). Proponents have also signed a petition in favor of this special permit (Attachment In summary, the area along Route 842 has more of a rural residential character, with smaller lot rural residential development. The proposed use, which in effect functions much like a contractor's storage yard, may not be compatible with the character of this area. that the character of the district will not be chanued thereby. The site is located in the Rural Areas. No significant changes in the character of the larger district are anticipated. that such use will be in harmony with purpose and intent of this ordinance, Page 2 of 4 Staffhas reviewed the purpose and intent of the Ordinance as stated in Section 1:4, 1.5~ and 1.6. and does not believe this use meets the intent. Specifically, Section 1.5, Relationship to the Environment, states that the ordinance shall be designed m treat lands similarly situated and environmentally similar in a like manner. While this section speaks specifically to the"design" of this ordinance, the application of the ordinance should also meet this standard. Approval of this request may not be consistent with a previous action by the Board of Supervisors regarding a Home Occupation, Class B request on an adjacent property (see previous comments). Also, as stated earlier, staff opinion is that this request does not meet the intent of Section 1.4~3 "to facilitate the creation of a convenient, attractive, and harmonious community," as appliedto the immediate community along Ronte 842. with-the uses permitted by right on any adjacent property This request will not affect uses permitted by right on any adjacent property. The use is not anticipated to negatively affect agricultural/forestry use in the area. with additional reeulations ~rovided in Section 5.0 of this Ordinance. Section 5.2 contains regulations for Home Occupations (Attachment G). Staff has reviewed this request for compliance with these regulations. The Zoning Department has also provided comments (Attachment I-1). The applicant intends to store equipment for the business in an existing shed. This building measures 1,800 square feet, exceeding the 1,500 square feet maximum permitted in 5.2 section of the Zoning Ordinance for a Home Occupation. The Commission may grant a modification permitting additional area to be used. and with the public health, safety, and general welfare. Refer to earlier comments regarding traffic. Staff has identified the following factors which are favorable to this request: 1. All major mechanical work on vehicles will be done off-site; 2. No storage of hazardous material. Staffhas identified the following negative factors to this request: 1. Noise associated with starting of equipment during routine maintenance. Generation of additional traffic and type of traffic ( i.e., tracks with trailers as opposed to strictly residential traffic on an unpaved road). Page3 of 4 3. We are a small landscape maintenance company. At our current size, which is less than 5 employees, we can not afford to pumhase or lease warehouse space in the county of Albemarle. We also do not foresee our selves getting any bigger in the near future Therefore we would like to continue to operate out of our home. With operating out of our home we will limit the employees that come to our home to myself, my son, and one employee. We currently do 90% grass cutting/hedge trimming, 10% snow removal, and less than 1% fertilizer applications. Since we do such little fertilization, we now propose to contract our fertilization out, thus requiring no storage or mixing of chemicals on our parr. The hours of operation for us is dependent upon the season. During the summer we will start no earlier than 7 am and have no noise no latter than 9:30 PM. In the evenings we will load up the equipment for the next days work, this would intern reduce the noise level. In the Fall and Winter the hours are 7:30 am to 8 PM. For a noise reduction we have planted white pine trees,and a privacy fence along the property line closest to the building. Inside the shed we have insulated to reduce the noise level. All major mechanical work such as other than routine maintenance of vehicles is performed by an outside mechanic at their shops. Al1 used oils fi-om lawn mowers are turned in for recycling. There is and will never be any storage of gasoline other than what is used for that days operation. We currently buy all our fuel for the day in the morning at different local gas stations. This will greatly minimize the possibility of an accident. Equipment that will be stored her~vill be 2 Toro from mount mowers, 1 Kubota front mount mower, 3 walkbehinfl mowers, push mowers, weedeaters, edgers, blowers, and other various small hand tools. We will have 2 trucks, and 2 small 16t ~ _ailers parked at our residence. The third truck and 16fr trailer will be parked on the job ~its during the week. Some weekends the truck and 16 fr. trailer will be parked at the shed. The shed has been built to conform to the residential settings. With the front looking like a horse barn and all access from the back of the shed. All equipment will be parked in the shed with all trucks being parked behind the shed. Our road goes from the shed to our preexisting driveway as to not interrupt the residential setting. Upon receipt of a request to establish a home occupation, Class B, the zoning administrator shall refer the same to the Virginia Department of Highways and Transportation for approval of entrance facilities and the zoning administrator shall determine the adequacy of existing parking for such use. SP-96-40 Angus Arrington - We understand that Mr. Arrington has built a structure to store his equipment that is 1800 sq. ft. This is larger than allowed under Section 5.2 and thus needs a modification from the PC. The structure was built under a Farm Building permit which is exempt from the bui Iding code and may need some modification to allow this type of use. To correct the situation Mr. Arrington needs to amend his building permit indicating the appropriate use. At that point a building inspector will look at the building and inform Mr. Arrington if any modifications are needed. If Mr. Arrington has any noisy equipment such as a chipper that he will be using at this location, it would help enforcement if a condition of approval included the hours of operation and compliance with the noise ordinance. The applicant is requesting that the previous special use permit be amended to allow for the construction of additional bays to handle an increase in demand. PETITION: The proposal is to amend the current special use permit for an automotive repair garage at this location (SP 94-31) to allow expansion of the number of repair garage bays. Property, described as Tax Map 95, Parcel 12B1, is located on the north side of Route 250 east. just west of the Fluvarma County Line in the Rivarma Magisterial District. The property is zoned PA, Rural Areas and is nat within a designated Development Area (Rural Area 2), CHARACTER OF THE AREA: ~l~ais site is developed with a building which is now used as garage and which was formerly used for White's Bakery and Store. A fence is located on the eastern boundary of the site and one house is located directly opposite this site on the south side of Route 250. RECOMMENDATION: Staff has reviewed this request for compliance with the provisions of Section 31.2.4.1 of the Zoning Ordinance and the previous special use permit for this site and recommends approval. PLANNING AND ZONING HISTORY: A special use permit (SP 94-31) for a public garage was issued on January 11, 1995. Previously the site had been used as for White's Bakery and Store and previously as a garage based on visual observation of the site and information provided to staff. COMPREHENSIVE PLAN: This site is located in a Rural Area. The Comprehensive Plan discourages uses not related to bona fide agriculture or forestry. STAFF COMMENT: The previous staff report for this proposal is attached. Staffreview has been limited to the impact which may be caused by the expansion of the use. Staff will address each provisiou of Section 31.2.4.1 of the Zoning Ordinance. The Board of Supervisors hereby reserves unto itsel£the right to issue all special use permits permitted hereunder. Special use permits for uses as provided in this ordinance Pa~e 1 of 4 may be issued upon a finding by the Board of Supervisors that such use will not be of substantial detriment to ad_iacent proper[v. The design planner has determined that the nature of the revisions does not necessitate ARB review. Based on this information staff opinion is that no change in the character of the district will occur. and that such use will be in harmany with the pum~ ose and intent of this ordinance, Staff analyzed the relationship of this use to the purpose and intent of the ordinance in the prior special use permk review. No conflict with the purpose and intent of the ordinance was identified in the prior review and staff can identify no changes which would change the previm~s fmding. with the uses permitted by right in the district, Approval of this request will not affect permitted uses on adjacent property. with additional re_mtlations ~ovided in Section 5.0 of this ordinance, No additional regulations are found in Section 5.0 and with the public health, safety_ and general welfare. Approval of this request will not adversely affect the public health, safety or general welfare. Staff has identified only one site plan issue to address with this special use permit. The proposed amendment would add two bay doors to the garage. The requirements of the Zoning Ordinance require a 4 bay garage with 2 employees to have 12 parking spaces. Only 9 parking spaces are available at this site and opportunity to add additional spaces is extremely limited. Based on staff observation a maximum of 2 additional spaces could be located on site and this is doubtful, it is more likely that sufficient area for only one additional space exists. Therefore, the applicant's request to have 4 bays cannot be approved without a variance. [Planning Staff neither encourages nor discourages an application for a variance and provides reference ho the possibility of a variance for information only.] Sufficient parking does exist on site for a three bay facility. [Based on conversations with the applicant one of the bays will be devoted to state inspections only.] Therefore, if this request is approved it must be limited m one additional bay for a total of three bays. SUMMARY: Staff has identified the following factor which is favorable to this request: Approval of this request allows for expansion of a successfnl:business within an existing structure alleviating the need to construct a new building elsewhere; Staff has identified the following factor which is unfavorable to this request: Approval of this request would permit a public'garage in the rural areas larger than any previously approved. Staff has reviewed prior special use permits for public garages in the Rural Areas approved since the adoption of the Zoning Ordinance and is unable to find any request which specifically permitted employees. Few applications included conditions which limited the number of employees. [The application under review did not limit employees.] All approvals for public garages limit vehicles on-site awaiting repair to 4 or fewer vehicles. The limit on vehicles awaiting repair and size of building have served to limit the number of employees. Staff notes that home occupations, class B, permit up m two employees. Staffopinion is that in general a maximum of two employees associated with a public garage is generally consistent with other activities permitted in the Rural Areas. Staffdoes not typically support non-agricultural/forestal commercial uses in the Rural Areas. This site iS unusual in that it has a history of commercial activity greater than normally found in the Rural Areas. Residential or agricultural use of this site is extremely unlikely due to the nature of the existing development. The applicant has demonstrated a demand for service in this portion of the County. Staff encourages the adaptive use of existing structure where possible to reduce the need for new construction. This request makes maximum use of the existing s~ucture, and physical improvements to the site. The expansion of the amount of activity permitted on site will not result in a s~gnificanfly greater impact to surrounding properties or the entrance corridor. Based on the demonstration of need for service in this area and the existing character of development on this site staff is able to support this request and recommends approval subject to the following conditions: RECOMMENDED CONDITIONS OF APPROVAL: The public garage use shall be limited to the repairing and equipping of vehicles. Character of the Area: This site is developed with a building which was previously used for White's Bakery and Store. Based on a visit to the site and looking at the building, it appears that the site was a garage at one point and that gas pumps existed. Staff can find no records to support this visual observation. A solid wood fence is located on the east side of the property on or near the county line. One house is directly opposite this site on the south side of Route 250 is visible. SUMMARY AND RECOMMENDATIONS: Staff has reviewed this request for compliance with the provisions of Section 31.2.4.1 of the Zoning Ordinance and recommends approval. Planning and Zoning History_: None available. Comprehensive Plan: This site is located in a Rural Area. The Comprehensive plan discourages uses not related to bona fide agriculture of forestry. STAFF COMMENT: In the past, staff has recommended that public garage uses are generally more appropriate to designated growth areas of the Comprehensive Plan than to random location in the Rural Areas. In past reports for public garages, staff has stated that commercial use of the property be evaluated in terms of appropriateness to the Rural Areas. That is to say, a determination should I ATTACHMENT E J be made as to Whether or not this garage would provide service to the area otherwise nor conveniently available. This property is situated about six miles east of the Urban Area of the Comprehensive Plan and 3.3 miles east of theVillage of Rivanna. The neares! garage in Albemarle County to this site is located approximately 2.5 miles to the west. A garage is located 1.7 miles to the east in Fluvarma County. Other than this distance analysis, planning staffhas no method of determining if this area is adequately served. Staff offers the following guidance to aid the Planning Commission and Board of Supervisors in determining if this area is adequately served: The closest garage in Albemarle County identified by staff is approximately 2.5 miles to the west. (A garage is located 1.7 miles to the east in Fluvanna County). Route 250 has 5,800 vehicle trips per day based on 1992 information. Some of this traffic is generated by development in Fluvanna including Lake Monticello. 3. Tourist traffic is in the area since Route 250 is an Entrance Corridor. Staff notes that this site is developed with an existing block building previously used as a store and, based on the physical layout of the building, was apparently used as a garage with gas pumps. Staffhas viewed this as a significant factor in favor of this request. Staff will address each provision of Section 31.2.4~ 1 of the Zoning Ordinance. The Board of Supervisors hereby reserves unto itself the right to issue all special use permits permitted hereunder. Special use permits for uses as provided in this ordinance may be issued upon a findine bv the Board of Supervisors that such use will not be of substantial detriment to adjacent property, Staff notes that the proposed activity involves no major construction, only renovation to an existing commercial building. This use is a change in use and does not represent the introduction of a commercial use in an area where no commercial activity previously existed. The proposed public garage should not result in traffic of greater volume than thal generated by the previous store. In an attempt to make such uses unobtrusive in rural locations, staffhas in the past recommended conditions that limit operations to mechanical repair and service. Spray-painting, body work, gasoline sales and sale/rental of vehicles should be prohibited. Hours of operation should be limited. The applicant does not propose any uses typically restricted. The hours of operation are normal business hours during the work week an limited on Saturday. Any activity on-site should have minimal effect on adjacent properties as they are vacant or sufficiently setback from the garage, Noise is a potential nuisance factor. The recommended conditions limit repmr work to the interior of the building. This use will have to comply with all ordinance 2 ATTACHMENT E I requiremems. Staff opinion is that due to the location of the garage in relation to existing structures and with conditions that noise should not be an impact. Staff opinion is that this use will not be of substantial detriment to adjacent property due to the character of the site and conditions for approval of the use. that the character of the district will not be change thereby, This parcel is non-conforming due to the size, 0.676 acres. The nature of the building on site does not allow for easy conversion to a dwelling unit. The existing building has limited potential as an agricultural building due to the size of the parcel. Based on tbese factors the site has limited potential for by-right uses. Staff has viewed this change in use as readaptive use of an existing structure. No major new construction will be required to accommodate this use. Existing parking is adequate, therefore no site ptanis required. This site is located in the EC district. The ARB has commented on this request authorizing the Design Planner to approve the building permit application with landscaping and a fence. Staff has not included landscaping or fence as conditions as this change in use does not require a site plan and conditions limit the activity visible from 250 to a level comparable with the previous store. Based on the limited changes proposed (construction of garage doors) no impact on the character of the district is anticipated. and that such use will be in harmony with the puroose and intent of this ordinance, This site is located inthe Rural Areas District. The intent of this district does not support this type of use but is instead supportive of agricultural and forestal uses. A public garage is permitted as a use by special use in recognition of the need to provide limited services. This is reflective of the intent of the zoning ordinance as stated in Section 1.4.3 "to facilitate the creation ora convenient, attractive, and harmonious community". This request would provide convenient garage services to the eastern portion of the County. The Board should determine if this area is adequately served by existing facilities or if this use provides for a convenient community. Staff does note that this use will provide a convenient service on an Entrance Corridor. with the uses permitted by right in the district. Approval of this request will not affect permitted uses on adjacent property. with additional regulations provided in Section 5.0 of this ordinance. No additional regulations are found in Section 5.0. and with the public health, safety and eeneral welfare. The property iscurrently served by two entrances and a loop driveway. Minor work, extension of the island, is needed to obtain a standard commercial entrance. The entrance design provides for good on-site circulation. Conditions are included toinsure adequate disposal of waste. Staff opinion is that the public health, safety and welfare will not be negatively impacted by the garage. SUMMARY: Staffhas identified the following factors which are favorable to this request: l. No significant construction or alteration to the existing structure or site will occur. (Minor work at the entrance and construction Of bay doors will occur). 2. Use will provide service on an Entrance Corridor. 3. No development exists in the area that would be adversely affected by this use. 4. The site has limited potential for by-right uses in the Rural Areas district. Staffhas identified the following factors which are unfavorable to this request: Due to the location of the existing building, activities associated with the use will be visible from adjacent properties and the state road; 2. This type of use is not consistent with the agricultural/forestal intent of the Rural Area District. The applicant is aware of proper methods of disposal for waste material and has already contacted individuals to arrange for disposal of these materials. Staffis unable to provide commems to determine if the area is adequately served as no standards for such a determination exist. I understand that .~Hall (the Buddy in Buddy's Auto Repair) ~would like his Special Use Permit changed to allow him to add more repair garage bays~ i am the person who lives closest to Mr. Hall's garage (my 911 address is 5058 Richmond Road3. I rant a house from Dave Warren, whose property surrounds the location of Mr. Hall's garage. As such, I am the person in the n(~ghborhood who is most effected by the daily operations of Mr. Hall's business. I am utterty against any changes in Mr. Hall's Special Use Permit that would allow him to expand his business at the present time. My reasons for this are s'anple. First, Mr. Hall does not follow the guidelines of his Spex~al Use Permit as they stand now, despite the fact that the Special Use Permit is a legally binding agreement that Mr. Hall has made with the people who live in the n(~ghborhood and the Country Planning Commission. A bit of review: Mr. Hall almost did not get pem~ssion to open his business. Initially, t believe, his request was turned down, or was going robe, until he smoothed matters over with Dave Warren, my landio~d. As things stand now, Buddy's Special Use Permit allows him to be open for business from 8 am to 5:30 pm Monday through Friday, and from 8 am (I believe) until 12:30 pm on Saturdays. Sundays he is to be closed. He was to have no more than four cars waiting overnight on his lot at any time. At no time was he to do body work. Early last fall (1995), I spoke by phone to the part of the planning commission that enforces these guidelines (or whatever office enforces them} The man I spoke with told me that everyone was to be gone about forty-five minutes after the gm'age closed--by 6:15, and no later than 6:30. As the enclosed list shows, Mr. Hall does not follow the agreement he Sighed. Second, after living near Mr. Hall's business almost smce it opened (I moved to my present house on July 15, 1995), I strongly believe that any amendment to the Special Use Permit will not solve any problems mused by Mr. Hall's Permit violations. From what Mr. Hall has told me, his plans are to enlarge one garage bay to permit him to work on trucks that he presently works on outside, and to pour a flat section on cemem that would allow him to do State Inspections. This would not lessen the amount of cars or trucks coming to the garage, but possibly increase it The same problems and violations would still occur. Should Mr. Hall wish to add more bays, this would only increase the noise in the neighborhood during the day, which is in no way desirable (I do much of my work at home, during the day). Allowing Mt. Hall to work on more cars would not eliminate any violations such as staying too late or having too many cars on the lot. Nor would it lessen the number of cars dropped off after 8 pm, often with much shouting and engine-revving, to be repaired the next day. From what I've seen, it would increase the probabilty that more violations would occur; it certainly would not lower the number of them. Following is a list of violations that have occured since August, 1995. Ithas been unavoidable for me not to have noticed these, since they involve something immediatly seen when I pull in to my driveway or because the noise involved has interrupted whatever I was doing. [ should point out that this list is incomplete: during my time here, I've been gone for roughly two to three months at various times, and often do not return home unlil after 7 pm. Therefore, it cannot be taken as a complete list of violations that have occured_ Often I do not know what Mr. Hall was doing when he stayed late, only that he stayed far beyond the time I was told by the enforcement people that anyone should be there. Ali days are weekdays unless noted. August 29 or 30, 1995--Mr. Hall leaves garage at 7 pm, but comes back at 9:30. Do not know when he leaves. Aug. 31--a car is picked up after repairs at 7:30 pm. Sept. 8--a maroon Mercades is on a jack, being worked on in the parking lot by Mr. Hall, at 7:10 p... Sept 26--A dump track is picked up after rePmrs at 7 am. The garage doors are open, an engine is running as a car is being worked on. Nov. 1--Mr. Hall stays until at least 7:20. Do no know when he leaves. Nov. 12--Mr. Hall at gm'age at 10:30 on a Sunday morning. Nov. 18--Mr. Hall at garage until 8:30 pm on a Sunday. Nov. 24--a Saturday. 8 pm: garage doors down, but Mr. Hall is inside working, and I can hear clearly from time to time the sound of bolt remover(drill?) ~uch as is used on tires. Nov. 25--a Saturday: four cars in parking lot, lights on in the office, people there at 8 pm. At 9:20 somebody else drives up, goes m. Nov. 27--7:30 pm. garage doors open, work going on inside. 8 cars on lot. Nov. 28--7 am. Mr. Hall there. ^ few minutes later a tow truck pulls uN, delivering a red Blazer-type vehicle for repairs. Jan. 20--A Saturday: 5 cars in the lot at 1:45 pm. Mr. Halt there, working on garage door. At 7:30 pm, no one there, 6 cars on 16t. Jan 21--Mr. Hall, others there until 9 pm. Jan. 22--Mr. Hall closing up at 8:05 pm, moving big mobile unit rePmr truck. Jan. 28--A Sunday: 1:15 pm people drop truck off for repairs. 2:45-3:30 pm: Mr, Hill here to pick up trailor for back of truck. 4 pm: people drop car off for rePmr. Feb. 8--Mr. Hall leave 7:50 pm, Feb. 12--cleaning up, parking mobile repair truck at 9:15 pm, Feb. 18--A Sunday: wrecker drops off van. 8 cars on lot. By 5:30 pm one car has been picked up and is gone. 5:45: a wrecker brings a blue bronco-type vehicle for repairs. Feb. 19--8 cars on lot. Feb. 20--7 cars on lot. Feb. 22--still working at 6 pm (can hear drills). Mr. Hall leaves 8:15 pm. Feb. 23--a person who doesn't work at garage strips a car in the back lot-~a lot of banging with hammers. This is body work, which is prohibited in Mr. Hall's Permit. Mar. 3--A Saturday. Mr. Hall and one other person here until at least 3:30 pm, when I go in to town. Mar. 5--put up cars at 7:30 pm. Mr. Hall leaves at 7:50 pm. Mar. 7--Mr. Hall leaves at 8 pm. At 9:30 pm a wrecker brings a truck in for repairs. 7 cars on the lot. Mar.~--Mr. Hall leaves 7:50 pm. 8 cars on lot. Mar. 9--A Saturday. 7 cars on lot. One has been picked up and is gone. Mar. 11--7 cars on lot. On Tuesday, March 12, Dave Warren, my landlord, talked to Mr. Hall about these recurring problems. On Thursday, March 14, I talked to Mr. Hail. Mr. Hail said that he sometimes stayed late cleaning his tools and doing paperwork but was usually gone by 6:30 or so. We make our peaee--I don't mind if he stays till around 7 pm as long as there's no noise. Mar 15--Mr. Hall working on a white car in parking lot until 7 pm. Mar. 16--A Saturday. After someone broke into a car, Mr. Hall and his family begin building a fence around lot where he keeps cars over mght. Work starts at 12:45 pm and is still clattering on when I leave at 3:30 pm. Mar 17--A Sunday: work on fence from 10 am until 3:30 pm. Mar 22--A track dumps gravel in fenced-in area at 7:30 am. April 15--Mr. Hall leaves at 7:20 pm. May 14--Mr. Hall working on lawn at garage at 6:20 pm. Leaves 7:30 pm. June 10-- 7:35 pm: a crew of lawn mowers hangs out in parking lot after Mr. Hall has left. Aug i--engine running in garage at 8:25 pm.- Mr. Hall inside working; a plastic pipe lets exhaust out the closed garage door. Aug. 13--6:20: orange pickup of Mr. Hall's assistant still there. 6:45: Mr. Hall anda white Neon show up. Mr. Hall leaves at 7:15. Assistant at 8:10. Aug 20--Mr. Hall leave after 7 pm. Aug. 21--engine running in garage, lights on, 11 pm. Call Mr. Hall's wife to make sure it not a break-in, as Mr, Hall had told me to call if I saw anything odd going on. Nov 1-7:25 pm: car picked up after repmrs. 8 pm: blazer-type vehicle in. 8:25: Mr. Hall gone, but female assistant, blazer driver talk in parking lot with the blazer's engine running until 8:45 pm. Nov. 9--A Saturday: 10:50 am. Car dropped off for repairs, making total of 5 on lot. Nov 10--two more cars dropped off, one at 8:45 pm. 7 cars on lot. Nov. 11--7 cars on lot. Nov. 16--A Saturday: 2:40 pm. Mr. Hail working on car, garage doors closed, exhaust fed through plastic tube out the doors. Nov. 26--9 pm in, pick up drives in, people take away a car left for repairs--they have to get in the garage to do this--pickup parked behind garage, people leave. Again, this is not a complete list of even the things I've noticed. Often if there is 6 or fewer cars on the lot, t don't bother to note it, though that is fifty percent more than is supposed to be left over night. I realize that many of these problems may be only marginally violations--however, I consider people dropping off cars after hours and picking up cars after hours to be doing business. At any rate, that activity is a disruption and goes on when no one is supposed to be on the lot. I do not feel that the problem with too many cars on the lot will be corrected by allowing Mr, Hall more garage bays. Mr. Halt knows exactly how many cars he may have on the lot and, while unexpected things do happen once in while, the frequency with which there are fifty to one hunded percent more cars on the lot over mght than there should be indicates tlmt Mr. Hall seems to think it doesn't matters how many cars are there. It should be emphasized as well that Mr. Hall knows when he's breaking his Permit. Before his business opened, my landlord talked with the Planning Commission about the nUmber of cars to be left on the lot, and the person Dave talked to said that all Mr. Hall had to do was to build a fence or park his cars behind one to hide them. A fence was there when I moved in, and Mr, Hall has consistently parked cars behind it--to prevent burglaries, yes, but to prevent them being seen period. Often when Mr. Hall stays late, he moves his pickup from the parking lot to behind the garage, where it cannot be seen from the road. The drop of frequence ~n my notations of Mr. Hall's staying and working late indicates two things. First, my class schedule is arranged such that I don't get home before 7 pm on Monday, Tuesday, and Thursday. On Wednesdays, I usasally go to Washington. DC. This means that I am home before 7 pm only on Fridays--in other words, only about 4/iifi/k'iflays a month. And still I find Mr. Hall here late (as on Nov. 1). The percentage of times he's here late when I'm here to see him, and the general frequency of his staying late before now suggests he's here late at least once a week, maybe more if he's busy. However, being busy is no excuse. Mr. Hall stays late whenever he wants to. Also, it's hard to tell from simply reading a list, but evei~me someone drops off a car or picks one up after hours, or Mr. Hall stays late, this causes a disruption in my work (I teach, so I work--grade papers, read, plan, think, as well as do my own writing--in the evening as well as in the day). At any time, this is undesirable; other times, it is more worrying. I have called Mr. Halt at home when I thought his garage might be being broking into; I have called 911 once this fall when I saw people feeling under a parked car and generally acting suspicious, as if they were trying to break in or steal the car, when they were only picking it up after it had been repmred. When I called Mr. Hall after calling 911, he said he knew they were coming--business after hours as usualy, but I had no wa5 of knowning people weren't stealing a car 50 feet from my house. A final consideration: while allowing Mr. Hall to expand his business will probably not imporve his observance of his Special Use Permit, whatever form it ends up ra, it will certainly raise the level of noise in this residential area, where I work at home often during the day and another neighbor works at night, so sleeps during the day. The construction noise will be intense, however long it lasts. And then if inspections are done. Mr. Hall has already told me that of course he will have to blow the car or track's horn to make sure it works. Enough horns are blown around here already, as passing trucks or cars give their loud salute as they pass Mr. Hall's. Needless to say, these people do not live in the immediate area, and would not blow their horns if not for Mr. Hall' s business being here. We don't need any more horns going off. I admit that Mr, Hall has done his buisness quietly for the most part. There is no extra noise from his garage--nobody blaring a radio, no excessive shouting, revving of engines, peeling out, etc. He seems to care about his work and the physical appearance of his garage--it is usually neat, dean, and attractive. I am appreciative of this, though really they are only minimal expectations. Mr. Halt also has said that when he stays late is it often "charity" work, working on a car of a handicapped person or some such. I haven't noticed that the people leaving late were in any way handicapped; at any rate, "charity" wok doesn't seem a good reason to consistently ignore your Special Use Permit that you agreed to in order to open your business in the first place. On the other hand, 65 or so noted violations of his Permit in roughly a year (I was gone two months of the timed of rather slack obsevation is far too many, and indicates on Mr. Hall's part a disregard for the conditions of the Permit rather than a continual series of unexpected happenings or charity work. And disregard of the Permit is a disregard of the law, a disregard of the agreement Mr. Hall made with the County Planning Commission and the residents of this area (including me, since I rye here), and a lack of regard for the people who live in the area. I ask that until Mr. HalI runs his business for at least one year without violating his Special Use Permit as it now stands no more than 25 times [that's roughly once every two weeks), he not be pemitted to change his Permit to expand his business--and expand the problems it causes. Mark Cunniugham To~ Members of the Albemarle County Planning Commission and Board of Supervisors I would like to respond to the letter you received from Ms~k Cunning~b. am concerning my husband's request to amend the special use permit for his business Buddy's Mobile Automotive Repair. The majority of the new requests were made to allow him to ope~ame his present business demand more efficiently. Many of his customers have requested that he be able to perform state insv~ctions. Although he is licensed, he is unable to perform them withoum having a level concrete surface that extends from one bay of the garage to the parking lot that would allow the inspection of a longer vehicle such as a truck or bus. This condition is part of the state law concerning inspections. Haising the front ga~ge doors would allow him to bring the larger vehicles he c~rrently repairs into the shop. The height of the doors now ~llows the entrance of only the cab of some vehicles. Installing another garage bay would allow him to repair vehicles more quickly. Some jobs requi~e that a vehicle be torn do~n for several days thereby tying up one bay for that period of time. Additional bay space would offer more interior p~rkin~ and accomodate people who d~op by without an appointment requesting a quick look at or repaLr of their vehicles. The requests h~ve not been made specifically with the intent of bringing in more customers ~lthough we realize there is potential for that. Business is quite sufficient most of the time as Zt is. Mr. Cunni~ham'$ letter is full of assumptions. Some statements are true and others a~e nom. Buddy does not purposely stay ~fter business hours to defy one of the conditions of his special use permit. He is the one who requested his business hours so he is well aware of them., He does occasionally s~y late to finish up a job as a Favor for someone who needs theLv vehicle repaired as soon as possible. At times, customers may stop in withou~ an appointment for a quick repad~ or to have Buddy accompany them ce a test drive of a new ca~. He ummally accomodatea them again as a favor and to please his customers. AFter hours, Buddy usually moves his truck to the side or rean of the building because he doesn't want people to see that he is there and stop. He is not trying to hide anything from ~uyone. As for the n~m~rous mention of the number of cars on the lot, the conditions of his current special use permit state that there are to be no more than ~ vehicles p~rked outside awaitir~ repair and not ~ ca~s waiting o-~-ernight on the lot M~. Cunningnam states. The increase in the number of cars ~s usually the result of cars that i~ve ~lready been re,aired and ~e waiting for their owners to pick them up. At times, people do not have the money to pay for their repairs, so the vehicle stmys there until they can pay. Most people do not have the luxu~ of picking up their vehicles dttring business hOUrS as they work and can't get there ontil the evening, N~ more th~n 4 jobs are scheduled per d~y but eme-~gencles do arise o~%en. Occamlonally, our own vehicles a~e on the lot overni$~t. During business hours, there may be 5 vehicles there. ~ll belonging to our family or th~ secretly. We have stopped by in the evening to find ca~s parked the~re and we have no knowledge of who they belong to. Me think they may belong to people visiting r~ighbors. ~e have no control over when vehicles b~eak dowu and have ~o be towed in and are usually not mw~e of them ttutil the next business day. '~e installed a 6 foot high fence last spring after 2 vehicles were broken in to. We are not_-trying to hide an~hi~. ~affic into the lot is something ~e can't control. The number of vehicles must certainly be lower than when the propez-ty was used as a stoz~. Vehicles pudl into the lot to turn around or stop briefly for reasons we are unaware of. People smop to ask di~ectior~s, use the phone or res~noom. Family ~nd friends occasionally stop to say hello. People stop requesting assistance when developing ca~ trouble while traveling. Albemarle Co~uty Police use the lot to set up rada~ and numerous V~ trucks turn around on the p~o~rty. Evidently, peop~ stop in the lot in the evening to talk. ~ don't know of any way that can be stopped. There are numez~oum reasons our family or the secretaz~ a~e on the iroopermy after hottrs. Extensive bookkeeping must be done and recom~is must be main+~ined. Fu~n~ings ~nd equi~ent need to be cleaned. The floors need to be swept and scrubbed. The bathroom has to h~ cleaned and the trash emptied, Tools need to be cleaned, test~cl, and put away. Salesmen visit in the evening at times. We purchase supplies, deliver and put them away. Maintenance and upkeep on the outside of the propez~y muss be completed as well including mowing, weeding, cleaning the ps.king lot and the building, planting flowers and shz~bs, and general repairs. We have had compliments from neighbors and customers concerning the cleanliness of the interior and exterior of the property. Lastly. I believe Mr. Cunningh~m'e letter is a personal attack on my family's business. To ou~ knowledge, there have been no other complaints, including the neighbor across Rt. 250 with direct vinibility who sleeps d~rinE the day. Buddy is a hard worker who is trying to support his family. The business h~s grown to the extent it has purely by wo~d of mouth. Buddy takes the time to talk with his customers. He generously allows customers much leniency When paying thei~ bills and does for free when the situation warranmm. If any of the conditions of the special permit have been violated, it certainly has not been with any malicious intenm. Ne is simply trying to be a good businessman. Petition: To grant a Special Use_Permit for an expansion of the private school facilities in the R-I, Residential zoning district [Section 13.2.2.5 of the Zoning Ordinance], as required by the current Special Use Permit (SP 96~25). Property, described as Tax Map 91, Parcels 2A and 2B, comprises approximately 21.8 acres, is located on Tandem Lane, accessed from Route 20 South approximately 1 mile south of 1-64 in the Scottsville Magisterial District. This property is within Urban Area Neighborhood 4 and is designated for public/semi-public use. A location map and a general campus layout showing the proposed building location is included as Attachment A. The applicant's justification for this request is included as Attachmem B. Character of the Area: The site is largely wooded and unnoticeable from public roads. The area around this property contains a variety of uses, including an elementary school, industrial facilities, and residential developments including Mill Creek and Willow Lake apartments. The new County High School (Monticello High School) is being constructed just north of the subject property, and the new Avon Street/Route 20 Connector Road being built to serve the new high school will provide a new entrance for the subject property. RECOMMENDATION: Staff has reviewed this request for compliance with the prowsions of Section 31.2.4.1 of the Zoning Ordinance and reconnnends approval with conditions. STAFF COMMENT: The school has been in place since 1972 and the additional facility is represented to be necessary to support the present enrollment, though it is also expected to serve an increased enrollment in the future. Regarding the criteria for issuance of a special use permit, staff opinion is that: The use will not be of substantial detriment to adjacent property; The usc will remain the same as has been in place since 1972. Given the physical characteristics of the property, with substantial wooded area around the campus buildings, the new facility should hardly be noticeable to adjacent properties. The school does not have outdoor activities involving lighting or noise at night. the character of the district will not be changed; Again, the use will remain the same as has been in place since 1972 and the new facility is not expected to detrimentally affect the character of the residential district in this area. the use will be in harmony with the purpose and intent of the Zoning Ordinance and with the uses in the area; The private school use should complement the existing residential uses and those expected ia the area as a result of the present zoning and the Comprehe~ive Plan Land Use designation for much of the surrouudiag area, which calls for higher density residential uses. Other schools in the area include Cale Elementary School and Piedmont Virgihia Community College, with the new high school expected to be in oper~ion just north of the Tandem School by the fall of 1998. the use will be consistent with public health and welfare. There is nothing unusually hazardous or objectionable about the proposed use. The Virginia Department of Transportation (VDOT) has indicated that the existing entrance onto Route 20 does not meet current standards for sight distance and turn lanes, but notes that, since the new Avon Street/Route 20 Connector Road being built to serve the new high school will provide a new entrance for the Tandem School property, the existing entrance does not need to be upgraded. Additional parking will be provided to serve the new ~acility as requi~ed for site plan approval. Though not a problem with the proposed use per se, sewer/septic issues are a concern. The gymnasium is planned to be served by public water and sewer since the existing drainfield which serves Tandem's other facilities is already loaded to its capacity. The applicant has indicated that they would like to have the gynmasium in service for the beginning of the fall '97 semester, but the water and sewer lines'being extended to the Tandem property with the Monticello High School project are not likely to be available before the end of 1997, and possibly not before mid- 1998. Temporary pump and haul is a possible option that the applicant may pursue, which would require Board of Supervisors approval and may be prohibitively expensive. Adequate waste disposal facilities would need to be indicated prior to final site plan approval and would be required to be ia place before a Certificate of Occupancy for the building could be issued anyway, but the issues related to timing are considered worth noting, and a condition of hooking onto public water and sewer to serve the proposed facility is recommended. Since this issue also relates to future expansion of the school, a brief description of the school's indications of future plans will be provided. During consideration of the last two Special Use Permit applications (SP 96-06 and SP 96-25) the applicants indicated they would come in with a master plan when the new counector road access was settled, but have not done so yet. They have indicated previously that, most likely, all theix facilities would eventually be served by public water and sewer. With the SP 96-06 application, the applicant indicated that the school hopes to expand to approximately 280 students ultimately (present enrollment/staffing is limited to 200 by SP 96-25). Connection of all facilities to public water and sewer should be addressed at that point. The County will provide for the existing entrance to the Tandem School to be accessed from the new connector road and the existing entrance offof Route 20 will no longer be available to Tandem when the new entrance is established. The connector road is expected to be in use by November 1997. Additional parking would be provided for in the master plan. The preliminary site plan has been submitted and reviewed by the Site Review Committee and is deemed approvable for basic feasibility ia the proposed location. For purposes of tyhig down the 2 proposed development as to size and location, a condition of facility expansion in general accordance with the preliminary site plan is proposed. SUMMARY: The proposed facility and use is not expected to have any detrimental affect on the surrounding area; however, since there are issues related to the future expansion of the school that would need further review and since the applicant has expressed an understanding of this, staff believes that maintaining limitations on the enrollment for the school are appropriate. RECOMMENDED ACTION: Staff recommends approval of this special use permit request, with the following conditions: The new facility (gymnasium/field house) will be located approximately as shown on the attached preliminary site plan (Attachment A). The school moved to its present 21.77 acre site (Tax Map 91, Parcels 2A/2B) on Route 20, just south of PVCC, in 1972. The school currently serves approximately 160 students in grades 5-12. Tandem Friends School was founded upon the principle that students thrive and learning flourishes when students and teachers work together, hence the name "Tandem". Tandem Friends School prides itself on its strong preparatory program as well as its commitment to the development of its students' ethical values and social responsibility. The school has recently affiliated with the Religious Society of Friends (Quakers) and the Friends Council on Education. This affiliation is intended to reinforce the values of academic rigor, individual responsibility and corcanunity service that always have been fundamental to the school. Previous Special Use Permit Requests The Tandem Friends School property is currently zoned Residential R-1 and is recommended for Institutional Use under the Albemarle County Comprehensive Land Use Plan. Section 13.2.2 of the Albemarle County Zoning Ordinance provides that a private school may be operated in an R-1 zone by Special Use Permit. Since the Tandem School was in operation at its present site prior to the December 10. 1980 adoption date of the Zoning Ordinance, no SUP had been required or applied for by the school until January 29, 1996 at which time the school applied for a special use permit (SP 96-06) for the construction of a 10,000 square foot Community Hall Building. On March 12. 1996, the Albemarle County Planning Commission recommended approval of SP 96-06 to the Board of Supervisors with three conditions, and on March 20, 1996 the Board of Supervisors approved SP 96-06 allowing expansion of the Tandem School facilities with the following conditions. 1. The Community Hall will be located in general accordance with the site layout as submitted. 2. Total school enrollment and on-site staffing shall be limited to 177 persons. 3. Additional buildings or increase in enrollment/staffing must be authorized by a new special use permit. In May 1996, Tandem School filed a petition to amend SP 96-06 to increase the allowance of total school enrollment and on-site staffing from 177 persons to 200 persons. This amendment (SP 96-25) was subsequently approved by the Board of Supervisors on August 14, 1996. About the. Field House Proiect IATTACHIVlENT BJ Tandem Friends School proposes to build a Field House of approximatelv 15,000 sqttare teet. In addition to a regulation indoor basketball court (which will accom/no'date other court [i Page 21 games such as volleyball, badminton), it is envisioned that this facility will also house a fitness . center with padded floors, conditioning equipment, locker rooms with showers, storage rooms and office space. In conjunction with the construction of the Field House, other improvements may include irrigation and drainage systems for the field hockey and soccer fields, a running track and additional walkways, parking and landscaping. As illustrated on the attached sketch plan, the proposed Field House building will be built immediately adjacent to and west of the field hockey field, on the site of what are now dilapidated tennis courts. Some portion of the building will likely be Varo level in order to efficiently accommodate locker rooms, offices and other non-basketball court spaces. Existing parking and walkways will be realigned in more orderly fashion to' define more dearly the pedestrian and vehicular zones. The Field House Building is intended to meet present school needs and those in the foreseeable future. Justification for Current SUP Amendment The current school use is permitted as a non-conforming continuing use pursuant to Section 6.1 of the Zoning Ordinance. However, in order to construct another building on the property, a special use permit is necessary pursuant to Section 2.1.1 of the Ordinance and as a condition of SP 96-O6. In order to fulfill Tandem Friends School's comrmtment to top quality education for its students, it must continually enhance its physical plant. The addition of a field house, with its attendant facilities as described above, is essential to meet the needs of the school's growing physical education program and extracurricular athletic activities. As noted in previous special use permit applications, the Tandem Friends School site is an ideal one for the location of a school. The property is large enough to accommodate the construction of future buildings, such as the field house. It is convenient to major transportation corridors, 1-64 and Route 20. The proposed Rivanna Gmenbeit/Greenway Extension will be up to 11,000' long and will connect Northeast Park, Pen Park and Darden Towe Park with the City's ex~dng Rivanna Greenbelt (See Attachment A). ApproximatelyS,300'feetofthisgreenwayprojectwill be located within the County. The County portion of the Greenway will begin at a poinl just west of the intersection of Route 250 East and Elks [:)rive and extend north, parallel to Elks Drive and the Rivanna River for approximately 2,700'. There are three points along this portion of the greenway, totaling approximately 380', where the trail due to topography, will be located close enough to Elks Drive to require physical separation from the roadway. This separation will be achieved by providing curb and guttering along these three areas. The greenway will then extend as much as 2,600' further into Darden Towe Park, where a pedestrian/bicycle bridge that would span the Rivanna River and make a connection to Pen Park is being considered The construction of the County's portion of the greenway trail, including that portion along Elks Drive, will occur completely on property which is part of Darden Towe Park. Therefore, no easements or right-of-way will need to be obtained. In the City, the project will include handicapped access and steps at Free Bridge and the construction of a trail along Meadow Creek to Northeast Park. The construction of the handicapped access ramp and steps at Free Bridge will allow a direct connection of the City's existing 1.32 mile Rivanna Greenbelt system to this project. If a pedestrian/bicycle bridge is not built, the City's trail will continue north along the western side of the Rivanna river and connect to Pen Park and the Meadowcreek trail system. The greenway trail in the City and County will be 10' wide and consist of a granular stone surface. This surface was selected to allow ADA accessibility and accommodate a wide variety of uses such as road and mountain bikes, stroiters, wheelchairs and joggers. The construction of this greenway project will be funded primarily through an ISTEA Grant. DISCUSSION: The construction of a 13 mile Rivanna River Greenway project has been recommended for development in the Comorehensive Plan for Albemarle County and the Albemarle County Onen Soace and Critical Resources Plan. Also, this portion of the greenway and the pedestrian/bicycle bridge was recommended for development in the Neiahborhood Three Plan. The purpose of this greenway ;s to: 1) protect the natural character of the Rivanna River Corridor while allowing the citizen's and visitors to the area the opportuni[7 to enjoy the river's beauty; 2) provide pedestrian linkages as well as an alternate transportation system to the City and County parks and other actiV~ centers; 3) provide for passive recreation (hiking, jogging, fishing, picnicking, bicycling, etc·); and 4) provide for educational opportunities along the Rivaona River. ISTEA Grants ars based on 20% matching funds from the applicant. The estimated cost of the total project cost ranges from $171,000 if only the trails ara constructed to $500,000 if a pedestrian/bicycle bridge is constructed. Therefore the 20% match can range from $34,200 to $100,000. Staff estimates the cost of constructing the County's portion of the greenwayt~ailwill be approximately $90,000. Annual operational cost of maintenance for the portion of the Greenway located on Darden Towe Park property will be shared by the County (60%) and the City (40%). The City has experienced a yearly maintenance cost of $511.00 per 1,000 linear feet for the existing Rivanna Greenbelt. From time to time there may also be flood damage that will require additional capital cost. The City Council reviewed a similar resolution to the one attached on January 7, 1997: however, the Council did 3ot act on the msolu~on and instead requested that the City staff provide more information on the viability of the pedestrian/bicycle bridge component of the project. The City Council is expected to decide on this matter at its January 20, 1997 meeting. Grant applica~ons must be submitted to VDOT by January 31, 1997. Since there is no other Board meeting scheduled for January, an action on this project will be needed at the January 15,1997 meeting, prior to City Council action. RECOMMENDATION: if constructed, this project will compliment the existing Rivanna River Greenbelt in the City, provide a major segment of the County's overaJlRivanna R'Ner Greenway project, provide pedestrian/bicycle connections to major parks, and provide an excellent facili[y to the ladle number of joggers, walkers and bicyclists of the area.
