Carey, Clerk ~ March 14, 1996 Board Actions of March 13, 1996 (Night Meeting) The following is a list of actions taken by the Board of Supervmors at its regular meeting on March 13, 1996 (Night): Agenda l~em No. I. The meeting was called to order at 7:00 p.m. by the Chair, Mrs. Humphris. Agenda I~em No. 4. Other Matters Not Listed on the Agenda from the Public. Mr. John~Carter from Earlysville was present to discuss a matter of increasing concern, that being the ir~creasing reliance of the Count~ on tax revenues from the real property tax assessment. H~e said the assessment continues to increase each year to the joy of the spenders, but he warned the Board that real property values can go down or become static. Should they do either, the County would have to figure out what to do away with. Although some people think this cannot happen in Albemarle, it can, and the Board cannot stop it, Mr. Carter suggested that the Board move toward a discussion of an income tax for the people of Albemarle County, a tax which would not replace the real property assessment, but one that wo01d make at least one-half of the tax base safe. He understands the Board has been pursuing t~is idea to degree, but he does not think the Board speaks to the people. He thinks the paoplb should participate. He asked that the Board let him "go to bat" with this idea, and if he strikes out, so be it, Mr. C. R, Chisholm, Jaycees, Chairperson for the JAYS Program (Jaycees Against Youth Smoking)~ He said they are running the program from March 30 to April 6 and will be going to local retailers who sell tobacco products and politely inform them of the State laws Printed on recycled paper Robert W. Tucker, Jr~ March 14, 1996 (Page 2) which I~rohibit the sale of tobacco products to youth under the age of 18. They will be direct and forward with them and remind them that this is not a cure-all for the problem of youth smoking, but will remind them that the enforcement of this law does significantly act as a major deterrent to youth smoking. While visiting, they will offer information packets and ask them to sign a petition stating they will adhere to this law and refuse to sell tobacco products to youth under the age of 18, They will also ask if they can place signs in their stores, and offer them assistance in completion of this project. He requested a written enclorsement of the program from the Board, to go along with paperwork from Mayor Toscano, and the local police chiefs, This endorsement will be copied and distributed in the packet. Mrs, Humphris asked staff to draft the appropriate resolution and include it on next week's agenda for adoption. Mr. Charlie Tracta from Woodbrook was present. He said the Rivanna Solid Waste Authority meets at times when most citizens who would like to hear their discussions, cannot attend. He asked the Board to use their influence to have them meet on Monday or Thursday nights, days which do conflict with either this Board's meetings, or the meetings of the Planning Commissi on, Mr, Tucker said the meetings to which Mr. Tracta is referring are not those of the RWSA, but rather the Solid Waste Task Force. The meeting time was chosen by that Committee which is working on a single issue. When they have finalized their report, that Committee will be disbanded, Agenda Item No, 5.1. Odginal Agenda Item No. 5.3. Authorize public hearing for transfer of Jail property. Authorized public hearing to be held on April 3, 1996, to consider the transfer of the County's title to the real and personal property necessary for the operation of the jail to the Jail Authority. Agenda Item No. 6. Public Hearing on the proposed 1996-2002 Six-Year Secondary Road Plan. Also to be discussed is the policy adopted by the Board, effective November 1, 1988, governing the paving of unpaved roads in the County. Mr. Roosevelt Barbour was present to request that Route 674 which runs from Route 673 to Route 614 for 1,6 mile be added to the priority list for paving, Robert W. Angela Tucker said there will be a~ meeting of the U.S. 29 Corridor Development Study Steering and Technical Committees on March 21, 1996, at 10:00 a.m., at the Department of Forestry building on Fontaine Avenue. Mrs. Thomas said she had heard from a constituent about Route 688. It has moved up on the list, and they want to be sure it stays there. Approved the Albemarle County priority for Secondary Road Improvements 1995-96 through 2000-01 as recommended by the Planning Commission on January 16, 1996 (Attachment A); to approve VDOT's Secondary System Construction Program for Albemarle County 1996-97 through 2001-02 (Attachment B); and to reapprove the Unpaved Roads Policy (Attachment C). Agenda Item No. 7. SP-95~22. J. Bruce Barnes, inc. Public Hearing on a request.to rezone approx 19 acs from C-1 to HC, with proffers, located in Crozet on S sd of C&O Railway (current location of J. Approved the following: Designate the Meadow Creek Parkway Corridor from Rio Road to Route 29 North (as depicted on the attached map) in the County's Comprehensive Plan and CATS as a 45 mile per house minor arterial road with intersections at Rio Road and Route 29 North and three additional controlled access points for undeveloped land between Rio Road and the South Fork Rivanna River at Route 643, and for undeveloped land between Route 643 and Route 29 North. Pursue Virginia Department of Transportetion (VDOT) funding for the ultimate construction of the Parkway. Proceed under the VDOT process with consider- ation and analysis of the Sverdrup Study's "B", "G" and "Y" alternatives within this corridor. · Drop from further consideration the Sverdrup Study's "T1" Connector. Reserve for future study the Sverdrup Study's "T4" Connector and "W" Extension of the Parkway until final decision is made on the Comprehensive Plen Growth Area Expansion and The Route 29 North Corridor Development Study. Mr. Bowerman said any alignment that is chosen wil~ effect someone. Agenda Item No. 10. Discussion: Six Year Primary Road Plan. Deferred this item until March 20, 1996, Staff is to prepare the final statement to be made at the Preallocation Hearing in Culpeper on March 25. Agenda Item No. 12. Other Matters not Listed on the Agenda from the BOARD. Mr. Cilimberg said that two members of the Planning Commission will be out of town on April 9, the date which was suggested for the public hearing on the UREF petition. After a short discussion, it was decided to let UREF know that the proffers need to be submitted in time to have them analyzed by staff, and in time to readvertise the petition. Staff will try to ascertain an appropriate date for the hearing. Reconsidered their original motion which denied the request for a donation to Christworks Ministries. The reconsideration passed, as did the motion to adopt the following resolution granting Christworks Ministries an amount of money to pay site plan review fees. Original resolution sent to Zoning Department (copy attached). Mrs. Thomas said that last week during presentation of the Annual Financial Report, she had requested some information from Mr. Breeden concerning the number of new businesses in the County. She has received that information and it shows that last year there were 669 new businesses and this year, so far, there have been 403 new businesses. Mrs. Thomas mentioned the draft "Albemarle County Mountain Protection Plan" which was included with the packet this week. She suggested that the members read the draft and answer the survey questions. Mrs. Thomas noted that the children who appeared at the Board meeting last week about a problem with dead animal carcasses and dumping started a flurry of activity. There has been one neighborhood meeting, and there will be another in the County Office Building on next Monday night at 7:30 p.m. in old Room 12 on starting a neighborhood watch. County staff is also developing a fact sheet to be used to report such problems in the future. Mrs. Humphris said she had received new letters on the Routes 22/231 situation. She asked that staff take these letters into consideration and provide the Board some more information. Mr. Tucker said the Board has already adopted a resolution requesting VDOT to limit the routes to through truck traffic. He does not know what else can be done. Mrs. Robert W. Tucker, Jr. Maroh 14, 1996 (Page 6) Humphris said she does not have a suggestion, but it appears that the citizens are very upset. A letter from Mr. John Moore seems to indicate that Senator Couric did not understand all of the issues, but a letter from Dennis Rooker was very enlightening about what could be done. She does not know if VDO~' would consider it, but Mr. Rooker had not copied the letter to VDOT people, and she believes it should be sent to them. Mr. Martin said he had not had a chance to read all of these letters yet. Agenda Item No. 13. At 9:01 p.m., adjourned to March 18, 1996, at 1:00 p.m., for a work session on the 1996-97 County budget. NOW, THEREFORE, BE IT RESOLVED that Robert W. The Virginia Commission for the Arts has awarded Touring Assistance Grants in the amount of $325 each to Brownsville and Stone Robinson Elementary Schools and $600 to Henley Middle School. DISCUSSION: There are no significant changes recommended to the Six Year Secondary Road Plan. Staff is recommending that a major revision of the Six Year Secondary Plan be undertaken next year after the adoption of the updated Comprehensive Plan and the Charlottesville Area Transportation Study. Attachment B is VDOT's draft Six Year Construction Program based on the County's proposed priorities. The list of County priorities (Attachment A) consists of more projects than can be funded over the six year period. The VDOT Six Year Construction Program includes only those projects which will receive funding over the six year pedod. Pen Park Lane/Rio Road Intersection - The City of Charlottesville is attempting to enter into an agreement with The Wrenson Corporation to purchase and develop the old Meadow Creek Sewage Treatment property into a planned residential development, This would also likely involve the development of adjacent Wreneon property in the County (see Attachment 3). The total development could total 100 or more un(is. The only practical access to this new development that has been identified is via Pen Park Lane. Angela Tucker has advised that traffic from such a deveJopment would greatly increase the need for a left turn lane on R~o Road atPen Park Lane Isee Attachment 4). As an off-site improvement it cannot be required by the County or VDOT and would have to be addressed through the Ciiy's development approval process. The Wrenson representatives have indicated a willingness to purchase the right-of-way and construct the improvement, but are not in a pos'alon to condemn right-of- way should that be necessary. Airport Road - This project between Route 29 and the Charlottesvitle-Aibemarte Airport has been in ~he County's Six Year Plan Priodty List for a number of years. The project is proposed in the upcoming plan to be prioritized as project #7 with an estimated construction completion date of December 2001, DISCUSSION: Pen Park Lane/Rio Road Intersection - The City has requested that this intersection improvement be included in the County's 6 Yr Plan Priority List so that the County might pursue right of way acquisition (t(~ be paid for by the developer) at a future date as necessary for the project's development. Airport Road - Staff and the Airport Authority have had recent discussions with VDOT about the possibitity of exped~ng this project threugh the use of Airport Access Funds. The Authority has requested the Couoty apply for such funds to Support the accelerated construclJon of improvements to Route 649 (see Attachment 5) It appears that the County can apply twice for up to $450,000 per application, the first $300,000 which requires no match and the remaining $150,000 which the County must match dotiarfor dotiar. This would produce a total of $1,200,000 for this project, $900,000 of which is grant dollars. The local match can come from secondary road funds and/or revenue sharing funds. The Plan is based on local priorities adopted by the Board of Supervisors. The Six Year Plan consists of a priority list of projects and a financial implementation plan. Until this year the priority list of projects was subject to reviaw every two years, with the financial plan reviewed and adopted every year, VDOT's policy has now changed to permit an annual review of priorities. Since 1986, the Commission and Board of Supervisors have approved a priority list of road improvemem projects which would cost, in total, in excess of available funds over the six-year planning period, With such a list developed, subsequent financial plans can be prepared and revised in response to available annual ftmds. The Virginia Department of Transportation's Six Year Secondary Road Plan is based on the County's priorities established in this list. Attachment A is the current County priority list which has been updated to include the present status of each project and the most recent cost estimates. The County has used a locally derived criteria-based rating system to prioritized road improvement projects in the County. This system, with some modifications and refinements, has been used since 1988. Attachment C is a listing of the criteria used to prioritize road projects within construction categories. VDOT has submitted an updated Six Year Secondary Road Plan based on the County's current priority list (Attachment B). VDOT is recommending one major change for the board's consideration. VDOT has recommended combining the County-wide Sign, Pipe, and Seed funds (priority #I) with the County-wide Plant Mix funds (priority/13). Staffsupports this proposed change. This change will give VDOT and staff mom flexibility to complete smaller and less complicated projects. (The "Sign, Pipe, Seed" project funds are used for small improvement projects to existing roads which do not require acquisition of rights-of-way such as sight distance, shoulder and drainage improvements. "Plant Mix" project tin,ds are used for upgrading road pavement surfaces, usually fi:om a prime and double seal surface, to the stronger and smoother asphalt plant mix surface). VDOT have also recommended lowering the priority for two unpaved road projects, Routes 711 and 760 in North Garden. Staffsupports the changes recommended by VDOT. Both projects were lowered in priority based public input fi:om the area. The Draft Land Use Plan recommended by the Planning Commission calls for the removal of North Garden as Village Growth A/e~ A primary reason for the previous high ranking of these roads was to support anticipated development within the Village Growth Area. Route 712, another unpaved road in North Garden, will remain at its present priority because traffic volumes and safety issues warrant upgrading the road. VDOT has already initiated efforts with property oWners along Route 712 to obtain necessary right of way for the project. Scope of Review Due to the ongoing update and anticipated adoption of the Comprehensive Plan and Charlottesville Area Transportation Study (CATS), staff is recommending that no major changes be made to the project priorities the Plan this year. The Comprehensive Plan and CATS are not expected to be completed until the summer of 1996. Both documents provide the basis for transportation recommendations for the Six Year Plan. With VDOT's new review process permitting annual reviews of the Six Year Secondary Plan, the opportunity exists to make major changes to the Plan next year based on the recommendations of the Comprehensibe Plan and CATS. Also, there are a number of high priority projects which are scheduled for design and construction over the next three years, including the Meadow Creek Parkway (Mclntire Road to Rio Road), Hydraulic Road widening, Rio Road widening, and the extension of Greenbrier Drive to Rio Road at the Rock Store. These committed projects take the bulk of the available funds for the next three years so the impact of any new projects would not immediately affect the Plan. Therefore, this year's review of the Six Year Secondary Road Priorities will not be a major update. Next year's review will be used to make any major adjustments m the Six Year SeCOndary Plan. Total Funds Available The amount of total funding available to localities for road improvement projects is determined by statewide distribution formula. The County has regularly applied for Revenue Sharing funds since 1988. The total amount potentially available through this program is $500,000 a year, or $3,000,000 for the six year planning period. The Revenue Sharing Program requires a dollar for dollar match by the locality ($500,000 Revenue Sharing funds + $500,000 County match =$1,000,000 maximum/year). Therefore, this program creates the potential of $6,000,000 additional dollars for road improvement projects over the six years of the plan. It should be noted that in the recent past the County has not received the full allocation from the program because total amount requested from all Virginia localities exceeded total funds available in the program. Staff recommends continued participation in the Revenue Sharing Program to the maximum extent feasible. (The VDOT Draft Secondary System Construction Program, Attachment B, assumes full participation in the Revenue Sharing Program). Status of County Priority List Three (3) projects have been either completed or are under construction at'this time. They are: Priority Route Name Project #4, complete 691 Tabor Street Improve Intersection #5, complete 1403 Bet 'kmar Drive New Road #7, under construction 671 Moormans River New Bridge Efforts continue to qualify the Meadow Creek Parkway from Rio Road to Route 29 North for fimding in the Primary Road System. If the Parkway is granted status as a primary road it wiI1 significantly reduce the longer term funding of the Six Year Secondary Plan. It is presently priority #12 and has the highest cost of all the prioritized projects. School/Public Requests Attachment D is the list of hazardous road conditions submitted by the School's Transportation Department. This list was compiled last year with the assistance of the Planning Deparmaent and the local VDOT office. The majority of these projects can be completed with funds from the County wide projects (Priority #I on Attachment A). The more significant projects have been prioritized as spot improvements in the priority list. Staff and VDOT recommend additional funds be allocated to the County-wide projects (priority #1) to expedite the completion of the projects. VDOT's updated Six year Plan (Attachment B) reflects an increase of $200,000 per year from previous Plan allocations for County-wide projects. As noted previously, this would create a highly flexible source of funds to address road improvement needs around the County. The County received four new requests from the public to' be included in the priority list. Copies of public requests are provided in Attachment E (a total ofg). They include Routes 633 (bridge improvement), 702 (unpaved road), 679 (unpaved road), and 743 (sight distance). VDOT is currently in the process of working with Norfolk Southern Railroad to improve to Route 633. The project is currently not in the priority list, but Norfolk Southern will be upgrading the bridge in the near furore. Funding for VDOT's participation will come from the County,wide projects (priority #1). This route is also on the School's Transportation Department hazardous list. Comments on other public requests: Route 743, guardrail installation - Staff recommends that VDOT pursue the potential for interim improvements using County-wide funds. If necessary this project should be included in the Six Year Plan next when major review of project priorities are considered. Route 643 improvements - Improvements to the railroad underpass would be extremely expensive. The road does not serve a significant area for future growth. Unpaved Roads (Routes 633 and 702) - Donation of necessary right of should be pursued. If and when the full dedication needed for improvements are provided by adjacent property owners, these projects will be included in the County Priority List of Road Improvements. Unpaved Road Policy Staffrecommends the Planning Commission and the Board of Supervisors use this opportunity to review the County's policy on unpaved roads. On November 1, 1988, the Board of Supervisors approved the unpaved road policy for the County (Attachment F). The policy places emphasis on road paving projects located within designated Growth Areas; with significant dally traffic counts; and, projects where right-of-way has been completely donated for the projects. The basis for tiffs policy was to establish priority for project funding based on need and not only on fight-of-way availability. However, recent projects originally identified as unpaved road projects have, or would have required acquisition of fight of way to upgrade and pave the road ~Route 682 and Route 610). Undertaking a road paving project which requires acquisition of fight of way by VDOT can be a disincentive to the donation of right of way for other projects. Also, projects requiring fight of way acquisition consume an inordinate amount of additional fimds (for right-of-way acquisition) resulting in delays in completing paving projects where right of way has been donated. Staff supports the existing policy, but feels the Board needs to reaffirm its commitment to the existing priorities and emphasis on requiring full dedication of fight-of-way in advance of any paving project. Staff recommends that the Board of Supervisors reaffirm, by resolution, the existing road paving policy and re-affirm the Board's desire to require full donation/dedication of right of way in order to use nnpaved road run,ds for paving proieets. 4 Planning Commission Action Staffproposes that the Commission recommend approval to the Board of Attachment B (VDOT Draft Secondary System Construction Program) with the combination of the two County-wide projects (priorities #1 and #3) into one project (to be prioritized as #1). In rainy weather, one side of the road is a gutter that is deeper than an automobile wheel while the other side cf the road is bound by a fast flowing creek. Route 702 is probably one o~ the most dangerous roads in Virginia. The Department of Transportation does its best to maintain this road but perio4ic work to keep it open must be expensive and is, at best, a temporary solution which is negated with the first rain after their efforts. Camp Holiday Trails is an award-winning summer retreat for children with serious health-impairments. For some it is the only real holiday they can expect during a difficult year of treatment. These children are frequently transported from the camp to UVA Hospital either for regular treatments or for emergency medications. To insure safer vehicle travel to the adjacent residences, for buses carrying children to CampHoliday Trails, and for passage to the Ragged Mountain Reservoir, may we request your solution to this most hazardous road problem. We feel that the unimproved 0.5 mile portion of this road (our only access to other state roads) is substandard, at times clearly dangerous and needs your immediate attention. 1 am sure there are files in your office which document the difficulties and the frustrations we have experienced in attemoting to improve the safety of this short section of road. We have reported the accidents which have occurred along this short stretch of road and I have enclosed another copy of 24 documented accidents which have occurred there. Thus far the losses have only been economic but surely more serious events lurk We have made VDOT aware of the poor and dangerous conditions existing on SR 679 on numerous occasions spanning several years. Our newly elected representative. Mrs. Sally Thomas, arranged a meeting between herself, Mr. Dan Roosevelt, Mr. Robert Tucker and representatives of the Grassmere Homeowner's Association. We met on September 14, 1994 to walk the unimproved portion of SR 679 so that ali parties could get a better understanding of the issues. After walking the road, and with the agreement of Mrs. Thomas and Mr. Tucker Mr. Roosevelt suggested several changes which would make the road safer and which the residents 'hoped would be accomplished in the immediate future: 1. Grade the road away from a steep embankment on the dght side (heading south) in three critical areas. 2. Installation of a guard rail at the most dangerous points (where there is no shoulder to the road and a steep embankment. This would prevent cars and school buses from sliding over the drop-off in wet or icy conditions. At issue was whether it would be tess expenswe to place a guard rail continuously along the length of road or just at these critical spots. 3. Improve drainage so that water did not wash across the gravel surface; the road surface would then be less prone to being covered by a sheet of ice in freezing weather. Not too long after this meeting Mr. Roosevelt transferred from his position as Resident Engineer- before the changes discussed could be implemented. There was also discussion (but no resolution) of the long term plan for paving the remainder of SR 679. Several years ago we obtained all necessary easements and fulfilled all requirements to have these problems corrected and hard surfacing included in the five year road plan. We have not moved up on the list as funds became available. Our spot on the list remains the same - other projects were moved ahead of us because, we were told. of a "change in county priority. We feel that the longevity of our problems, the attainment of necessary easements, the traffic count, the relatively recent approval of another subdivision access~eg this roa~ plus the dangerous conditions in bad weather warrant reconsideration of this basic issue as well. Additionally, several homeowners have experience difficulty in selling fine homes in our subdivision due. in great part, to the poor road conditions and the tack of action toward ~mprovements. This. in effect, decreases the value of our homes and property at a time when the county tax assessment continues to increase! Residents of this area are angry and our patience is exhausted. There is little question that, after heavy rains, road conditions present a safety hazard. This danger is exaggerated after snow or, worse yet, ice. As a representative of the other residents, I wanted you to know that it is our unanimous feeling that immediate attention to the problems is imperative!. We feel that continued neglect of the road is a sedous liability. We recognize that your have many new situations with which to deal. On Wednesday, March 15, heading west on SR 633, I encountered a school bus coming around a comer in the middle of the road. I was forced to mn up the embankment to avoid being hit. This incident was reported to Mr. David Gentry of the Transportation Dept. on Lambs R~o?d. This further strengthens the arguement for paving the road and bringing it up to proper safety standards. What are our tax dollars, among the highest in the state, doing for us? Over the years, many complaints were made via phone to Mr. Daniel Roosevelt to little or no avail. Since we moved into our house just ~wo years ago, our family has already suffered two serious incidents on the road -- and this does not take into account the close calls and dangerous encounters that are a daily matter. First, let me describe the road for you. It is about four miles in length and proceeds west from route 29 first up and then down Heards Mountain. The first mile or so of the road is not at a steep grade and is paved. It is once you hit the unpaved portion of the road that conditions begin to deteriorate. The road is cut into the side of the mountain and has a large number of hairpin turns and blind curves. Because of the topography, even at night, it is not always possible to detect oncoming traffic. During the day, it is not possible at all. In many places the road is crowned in the middle or slopes off toward the down-mountain side. Even in its best stretches, the road is barely wide enough to encompass two ordinary cars passing each other. In many places, the terrain falls off precipitously at the side of the road -- and there is nothing but a gravelly gull~ between your car and the steep drop off down the mountainside. It is because of this drop off and the gullies on the sides of the road where the shoulders inevitably wash out and the fact that the road is crowned in the middle that cars tend to drive in the middle of the road -- with predictable results when encountering another car around one of the blind curves. Because of the grade and erosion problems, the road is also subject to serious washboarding. It is covered with loose gravel -- which gravitates towards the sides since cars stick to the middle. The driving surface is treacherous and makes braking a very chancy proposition. In the spring of 1994, my husband, driving our big old Lincoln Town Car -- encountered another car coming round a curve. Both cars applied the brakes but skidded on the loose gravel. The result was a collision. The Lincoln suffered very minor damage, but the other car did not fare so well, and I believe the woman driving it may have been injured in the crash as well. The accident was considered "no one's fault." The second incident was far more terrifiying. I was driving toward Route 29 on the road. This time, I was in a much newer vehicle than the Lincoln, an Acura Legend, with new tires and antilock brakes. Because of the collision with the Lincoln, I had taken to driving very, very slowly on the road. I was quite near to the paved portion of the road. A rabbit ran out into the road; the natural reaction, of course, is to hit the brakes. I did hit the brakes, but did not stop. The wheels caught in the washboards and the combination of the washboarding and the loose gravel were disastrous. It all happened in slo%~ motion -- the car sliding toward the edge of the mountain. The road at that point goes along one of the many parts of the route where there is a very precipitous drop-off. I was sure I was going over the edge and found myself hoping that somehow the thin trees would be able to keep my car from plunging off the mountainside. Finally, the wheels caught on the foot-wide strip of grassy verge (which does not exist on many parts of the road) and the tires gripped and the car stopped. The car was sufficiently off the mountain so that I could not drive my way out and a AAA tow truck had to be called to tow the car back onto the road. I must say that wildlife abounds in the area -- and there are many deer and rabbits and squirrels. It goes against your reflexes not to slam on your brakes when you are about to hit an animal. The point is that the poor visibility as to oncoming traffic, hazardous terrain of the road, its narrowness and the perilous drop- off on one side make the ability to stop quickly very important. But it is not always possible to stop quickly given the road conditions -- even if you are travelling very slowly. I am sure that at one time, the road was good enough for the small amount of traffic it had to bear. But times have changed. I cannot remember the last time I traversed the road without encountering another vehicle. Today's society is more mobile and there are also number of new homes going up in the area. There are UPS trucks, oil trucks, logging trucks, schoolbuses, FedEx vehicles, service vehicles, etc. using the road now. I heard from my neighbors, the Stellings, that VDOT has counted the traffic on the road at 57 vehicles per day. I cannot believe this is accurate. It must be at least twice that many. The other day, driving in toward Route 29 at 6:30, I met seven cars on a single trip. I also heard, through the grapevine, that there had been plans to pave the road. at some time in the past, but that landowners along the road had thwarted those plans because they wanted to "preserve the rural character of the neighborhood." Great. So what are we, the citizens who actually have to drive on this very dangerous road -- some kind of rural-dwelling exhibits? I do not believe the lives and well-being of tax paying citizens should be sacrificed to aesthetic whims. We'd like to move into the 20th Century. Look, I wouldn't complain about this road if it were merely inconvenient, if it were just bouncy and dusty. Taylor's Creek Road, which heads down towards Nellysford, is unpaved, bouncy and dusty -- and it's just fine. But Heards Mountain Road is a different story -- it's very danqerous and should be paved as soon as possible before there is a disaster. Thank you for your assistance in this important matter. The Department maintains more than 200+ miles of gravel roads throughout Albemarle County. Funding is limited, therefore, i~rprovemen~ needs must be prioritized. The Department requires that a minimum of fifty vehicles per day travel a section of road in order that the road be eligible for improvement funding. Route 633 currently carries 59 vehicles per day. The County prioritizes the need for gravel road improvemenus by assessing traffic volumes and the right of way available by donation. The Department determines what funding is needed for each improvement project and seus up a budget known as the Secondary Six Year Plan. Residents can support this project by the dedication of all necessary right of way needed for construction. Therefore, it is suggested that interested property owners work with our office to obtain donated right of way. It is not current policy to pay for land needed to improve gravel roads. The cost uo purchase right of way would severely impact the limited funds available for gravel road improvemenss. By copy of this letter, we will advise the County of your concerns so that consideration may be given co including this road on the priority list for gravel road improvements. This list eventually receives fundin§ through the- Secondary Six Year Plan. While this process is not speedy, it is the only way currently available to improve our numerous gravel roads. It is our understanding that this project is already included ia the Albemarle County Six Year Road Plan', however, given other urban roadway projects in the plan, Route 649 improvements are not slated for construction until aRer the year 2001. The Airport Authority has learned that the Virginia Transportation Board has adopted modifications to the Virginia Airpor~ Access Road program. As the result of these changes, VDOT has indicated via the attached letter that $900,000 is available to support this project at this time. We further understand that because ofthis additional aid being made available, Route 649 improvements can be accelerated in the County's Six Year Plan void of deferring or delaying other Couaty priorities. Moreover, £mce the first $300,000 annual Airport Access Road Fund allocation does not require any local matching funds, engineering design work can be implemented asr soon as VDOT funds are designated for this project. The Airport Authority is willing to offer the County and VDOT the services of Delta Airport Consultants, Inc. to design this proje~. The Airport Authority has a five year eontraet with Delta to provide engineering design services through a 1994 public procurement process. DISCUSSION The Six Year lh-imaty Road Plan process differs from the Secondmy Road Plan process in that a specific mount of funds is set aside for secondary road projects in the County, whereas funds for primaW road projects are allocated for each construction district, and all prima~ mad projects proposed within all localities of the district compete for those funds. The Culpeper District includes Albemarle, Culpeper, Fanquier, Ftuvanna, Greene, Louisa, Madison, Orange, and Rappanannock Counties. RECOMMENDATION The staff comments and recommendations for projects are provided in Attachment A. Staff continue to show Meadow Creek Parkway as recommended by the Plmauning Commission subject to decision of the BOS. The staff will draft a presentation which reflects the meats covered in Attachment A, recommendations from the March 6 BOS meeting and the BOS tin01 decision on the Meadow Creek Parkway. l:~s\prinO6.wp 96.041 [ATTACHI~IENT Al VIRGINIA DEPARTMENT OF TRANSPORTATION 1996 SPRING PRE-ALLOCATION MEETING FOR THE INTERSTATE, PRIMARY, AND URBAN SYSTEMS, AND FOR MASS TRANSIT ALBEMARLE CObTVTY PRIORITIES The following addresses Albemarle County priorities for each allocation of the lntermodal Transportation Efficiency Act (ISTEA) and each sub-allocation of the Surface Transportation Program (STP) funds. Surface Transportation Procrram (STP) Standard Pro_leers: The following projects, listed in priority order, are eligible for STP funds not set aside. They are: l) Undertake those Charlottesville Area Transportation Study (CATS) projects eligible for the primary program in sequence as called for in the February 2, 1992 joint resolution between the City, County and University and agreed to by VDOT. In addition to Route 29 improvements already underway, construct Meadow Creek Parkway from the Route 250 Bypass to Rome 29 North. In addition to the Route 29 improvements the Parkway is the County's highest priority project, and is of the utmost importance in order to maintain adequate level of service on Route 29 and to improve the overall roadway system serving the urbanizing area north of the City. The first phase of this project will be fimded in the County's secondary program. The County believes the parkway will meet the criteria for inclusion in the primary system. With the Commonwealth Transportation Board's decision to eliminate the Route 29 interchanges, the County believes funds should be redirected to the Parkway and wants to work with VDOT staffto evaluate construction of subsequent phases as a primary road if this will accelerate the parkway's completion. VDOT is urged to investigate all possible funding sources to achieve the quickest construction of this vitally important roadway. Projects in the northern urbanized area not eligible for primary funds, but listed in CATS, such as the Hydraulic Road/Route 250 Bypass interchange, should be actively pursued. 2) The County will be closely following the progress and recommendation of the Route 29 Corridor Study. Improvement to Route 29 north of the South Fork Rivauna River is still recognized by the County as an important project. We trust VDOT and the consultant will continue to receive public input regarding the corridor study and would further recommend that public hearing be held in Albemarle County. We anticipate that local concerns will be considered and addressed. 3 ) Undertake the widening of Route 20 south from 1-64 to the proposed Route 20/742 connector road that will serve the traffic from the new high school. 4~ Undertake road projects parallel to Route 29 which relieve traffic on Route 29, such as the Greenbrier Drive/Seminole Square connector. 5) Widen Route 250 West from Emmet Street to the Route 29/250 Bypass. This section is covered by a joint design study by the City, County and University of Virginia and was recognized for improvement in the Lewis Mountain Neighborhood Study. The joint study should be used as a guide in developing the widening plans. The remaining portions of Rt. 250 West to Yancy Mill (the 1-64/250 interchange) will be under study by VDOT to determine long term needs for this road. VDOT will also conduct a similar study of Rt. 250 East from State Farm Blvd. to the Finvarma County line. The County supports and appreciates this effort. 6) Improve Route 240in Crozet based on results and recommendations of the VDOT corridor study of Route 240. 7) Develop design plans for the widening of Fontaine Avenue from Jefferson Park Avenue to the improvements along the frontage of the University Real Estate Foundation development. Safety_ Improvements: Several projects in the County seem m qualify under this 10% set-aside. They are, in priority order: l) Construction of sidewalks along various primary routes within the County's Urban Neighborhoods; in particular, Route 20 south from the City line to the new Route 20/742 connector road, Route 20 north from Route 250 to Wilton Fanus Apartments, along Route 250 East in the Pantops area as an extension to existing sidewalks, along 250 West from City to Bypass (as part of the overall improvements to this road). 2~ The closing of the remaining Route 29 North crossovers recommended for closure in a VDOT study adopted by the Board of Supervisors on May 10. 1979 and reaffirmed by the Board onNovember 8, 1989. Improvements to Route 250 West along the business corridor in Ivy (from just east of the intersection of Route 637 to just west of the intersection of Route 678) to address existing and short-term traffic circulation problems, including access to developed properties in this area. 4) Improvements to the Route 240 underpass at the CSX Railroad in Crozet. 5) Functional plans for Route 20 North and South for alignment improvements. 2 6) Functional plans, including an analysis of possible safety improvements, for Routes 22 and 231. Enlxancement Proiects: Several projects appear to be eligible for enhancement funds, they are, in priority order: 1) Construction of sidewalks along selected primary road sections. ~see #1, Safety Improvements above). 2) 3) 4) Beautification of entrance corridors (particularly Route 20, 29 and Route 250) - landscaping, signage, undergrounding of overhead utilities. Construction of bikeway facilities as prioritized in the Bicycle Plan for the City of Charlottesville and Albemarle County (adopted by the Board of Supervisors as an element of the Comprehensive Plan on July 17, 1991). Developmem of portions of the Rivanna River Crreenway path system. Removal of non-conforming billboards. National Highway System (NHS] The Charlottesville-Albemarle MPO Policy Board approved the NItS as proposed by VDOT in this area excluding the Route 29 Bypass. VDOT recommended to FHWA a NHS which included the existing Route 29 and the Route 29 Bypass. The County's highest priority project in the proposed NHS is the widerfing of Route 29 North from the Corporate limits of Charlottesville to Airport Road. The County desires to continue active participation in Route 29 Corridor studies, including the study of the Charlottesville to Warrenton segment of the Corridor now underway. The County will monitor the progress and recommendations of the Route 29 Corridor which is part of the NHS(additional information is provided under Standard Projects #2). Congestion Mitigation and Air Ouality Improvement Program This does not apply to Albemarle County. The County is not in an area of non-attainment for ozone or carbon monoxide. The concems/issnes can be categorized as traffic concerns and environmental concerns. DISCUSSION Traffic The main traffic couccrns revolvad around whether the Meadow Creek Parkway would be a faster alternative than using Route 29 and Rio Road to travel between the same points. Staff's preliminary analysis indicates that while Meadow Creek Parkway as proposed is slightly longer in length (approximatdy 33 miles vs. approximately 3.15 miles), it will be qdiekor to tak~ the Meadow Creek Par~vay due to the eongestiun on Route 29. As an example, tho model indicates during thc PM peak period it would take seven minutes and f'~ffeen seconds to trevel on Route 29 and Rio Road, wh~ it would take four minutes and fort~ nine seconds to travel the Meadow Creek Parkway. Analysis indiea~s that without the Meadow Creek Parkway, the Route 29/Rio Road kip would take eight minutes and fffiy-four seconds. Those times indicate ho;v long it is projeated to take to get from eno point to another in the forecast year 2015. Environmental * Water quality of the Rivanna River- DEQ 303(d) Ust: TheE~~~a~ment~fEnvir~nmenta~QualityCDEQ)~ub~isheda3~3(d)Pri~rityListintheSpring~f~994. The list contained all fivar and stream s~ts in Virginia that do not fully support all beneficial uses (aquatic life, swimming, fish consumption, etc.). The Rivauna River from the ennfluence of the North end South forks down to Milton was on the list based on biological monitoring rests performed by DEQ staff in 1991 near the Route 729 bridge (Milton), The methodobgy used compares the Rivanna to a "reference stream", which is a stream similar to the Rivannain sizg but that is in relatively pristine condition and whose watershed is undeveloped. Therefore, the reference stream represents, in theory, the best possible enuditiun for a river like the Rivanna. The biological "gap" between the Rivanna and the reference stream, as measured by communities of aquatic Lnsests, is used to assess the relative hca/th of the Rivannm The 199 t results that led lo the "moderately impaired" ranking of the Rivanna on the 303(d) list had plenty of insects, but the populations found waren't as diverse as those found in the referonee stream. It is misleading to draw the eenelusion that the Rivanna is devoid of life, dead, or severely impaired. We eon also say that it certainly isn't pristine. There are many land uses, both urban and agricultural, within the watershed that are capable of degrading waier quality, and the geology and soils of the river valley make it patticalarly prone ;o stream bank erosion (which releases large quantifies of sediment into the river). All ofthese faeters eonkibute to sonte measuro of degradation. Given the watershad characteristics, the Rivanna is not likely to ever match the biological health of the reference streava. The DEQ biologist that performs the sampling on the Rivanna reported to the RWSA Watarshad Manager recently that one particular category of insects missing in 1991 was found during subsequent monitoring events. This means that the moderately impaired ranking is relative and eunnet be assumed to be a eonsumt enndition of the Rivauna~ Finally, DEQ reports that several chemical monitoring stations ia the Charlottesville area eonsialentiy indicate that water quality standants are being mm. * Design of the roadway through the flood plain: The alignmeaat of the Meadow Creek Parkway will require it to cross the 100 year storm Floodway and Floodway Ftinge of the South Fork Rivanna River and AC. This project has been recommended by the Charlottesville Albemarle Transportation Study, the Sverdrup Study, the staff of the Virginia Department of Transportation, the Commonwealth Transportation Board., the City of Charlottesville, the University of Virginia and the County of Albemarle. Extensive study, rapid population growth at. the northern terminus and the expanding potential for residential, industrial and commercial growth continue to validate the need for the Meadowcreek Parkway. This is not a bypass designed to move through traffic, but a new collector route designed to serve local traffic. As a result of this meeting a task force of County plannin~ and En~lleering staff/md VDOT staff from Charlot/esv/lle, Culpeper and R/chmond was formed. It was de~ermined that thd task force woukl undeflake the follow/ng: Develop new cost estimates based on a lower design speed and flmctional classification and at-grade intersect/ohs rather than interchanges at U.S. 29 North and Rio Road. 2o Include additiona~ controlled access points to serve futura development along tho alignment and include these access points in a re-mn of the traffic forecasting model, Contact affected l~opexiies along the corridor to determine tho willingness of property owners to cooperate in the right-of-way acquisition and/or eomtmetion of the Parkway. Complete the study in time for presentation of the County's request to VDOT Primaxy Allocation hearing in Spring of 1996.
