Mr. Tucker announced that ghe joint public hearing of
the Board and Planning Commission for ZMA-95-04, The
University of Virginia Real EstaEe Foundation, has been
scheduled for April 9, at 7:00 p.m. Proffers and an
analysis Eo be forwarded to the Board by the middle of
next week.
Mrs. Humphris, Mrs. Thomas and Mr. Martin said they
would attend the Preallocation Hearing in Culpeper, on
Monday, March 25.
Mr. Martin asked the Board go take another look at the
$5000 requesE from Children, Youth and Family Services,
Inc., concerning the Child Care Resource and Referral
Program He feels that tieing this program Eo welfare
reform makes a lot more sense (copy of memo from
Catherine Bodkin attached).
Mrs. Thomas asked that a letter of thanks be sent to
Delegane Earl Dickerson. The House Appropriations
Committee Conferees added $260,000 in conference.

Mrs. Thomas asked about the Steep Slope ordinance. Mr.
Davis said this is a part of the many changes being
processed by the Planning Department. A comprehensive
package of Zoning amendment modifications will be
brought to the Board in the spring.
Mr. Marshall said Mayor Raymon Thacker will be coming
back to the Board asking for a police officer for the
Tow~ of Scottsville, with the possibility of the Town
and County sharing one-half the costs. The officer
would be stationed in the town with duties to cover the
town and surrounding county. The officer would take the
place of the deputy the town is losing.
Mrs. Humphris said she received a phone call from Dick
Keller concerning "under designing" of the intersection
of Avon Street with the Route 20 connector. Mr. Tucker
said he would ask Mr. Cilimberg to call Mr. Keller.
Mr. Perkins congratulated the Parks and Recreation
Department. Beaver Creek Reservoir was named the best
kept dam in the state.

TANDEM SCHOOL
SPECIAL USE PERMIT APPLICATION
ABOUT TANDEM SCHOOL
Tandem School is a private primary/secondary school founded
in Albemarle County in 1970. The School moved to its present
21.77 acre site (Tax Map 91, Parcels 2A/2B)' on Route 20, just
south of PVCC, in 1972. The School currently serves 153 students
in grades 5-12.
The Tandem School was founded upon the principle that
students thrive and learning flourishes when students and
teachers work together, hence the name "Tandem". Tandem School
prides itself on its strong college preparatory program as well
as its commitment to the development of its students' ethical
values and social responsibility. The Tandem School is pursuing
affiliation with the Religious Society of Friends (Quakers) and
the Friends Council on Education. This new affiliation is
intended to reinforce the values of academio rigor, individual
responsibility and community service that havealways been
fundamental to Tandem School.
ABOUT THE BUILDING PROJECT
Tandem School proposes to build a 10,000 square foot
Community Hall building, containing three classrooms, a music
room and a dining room on the ground level, an auditorium with
seating for 250 on the main level, and a faculty workroom/lounge
on the upper level.
The School is presently housed in three buildings, the
original "manor" house, a converted barn/stable, and a new
classroom building constructed in the 1970s. TheSchool currently
is at full enrollment and is overcrowded in its present
facilities. The School does not have adequate space for its
library or its music and drama programs, lacks an auditorium
largeenough to accommodate the whole student and faculty body,
lacks separate dining facilities for the upper and middle school
students and does not have a gymnasium.
The proposed Community Hall building will be built next to
the manor house building. Its main purpose will be to house the
250 seat auditorium on the main level, which will be used for
all-school assemblies, plays and rehearsals by the drama program
and physical education classes in inclement weather. Three
classrooms, a music room and an upper school dining room and
kitchen facilities will be located on the ground level of the
Community Hall building. The new classrooms, music and dining
rooms wil.1 free up space in the manor house and barn/stable
building to expand the library and administrative offices and

1996-97Budget-Increased funds for ChiM Care Resource and Referral
At the Budget Work Session yesterday, thc Board agreed to adding $5,000 to the County
Executive's recommendation for the Child Care Resource and Referral program (CCRR) of
Children, Youth & Family Services. Here is some additional information regarding the agency's
request for increased County funds to support the work of the CCRR staff.
a~ The number of parents and providers making use.of the program is fairly equal for the City and
County residents. This has been true for at least 3 years.
b. The number served by the program has been increasing significantly every year for at least 3
years.
c. In the process of Welfare Reform, the County Department of Social Service staff estimates
there will be a need for 136 new child care openings for infants and preschoolers while parents
work or receive training. The development of child care providers needs to start this year in order
to be ready for the demand beginning July 1997.
In addition to its regular tasks of recruiting training, and registering family day care providers, of
maintaining a data base of day cam centers, preschools/nursery schools and f~mily day care
homes, and of helping parents find suitable child care, CCRR has as a goal this year of developing
these new family day care homes, lTtis recruitment -will be different because the type of care is
likely to be for parents who are scheduled to work swing shifts, evening/night shifts and
weekends.
d. In the budget originally submitted to the County of Albemarle, CYFS assumed $5,000 from the
state ( in the form ora Governor's Innovation Grant) to met the increased recruiting demands
caused by the state's implementation of Welfare Reform locally. We received information 2 weeks
ago indicating that this gram had been discontinued even though only one-third of the original
funds had been awarded statewide.

On March 6, 1996, the BOS approved staff recommended Six Year Primaxy Road priorities. Staff has prepared a
statement for the Chair based on those priorities.
DISCUSSION
Please find attached Albemarle County primary road priorities and a proposed speech that would be delivered at the
pre-allocation hearing in Culpeper, Virginia on Monday, March 25, 1996. The speech does not include every
priority, but it highlights the County's highest priorities in each category. The categories are Standard Projects,
Safety Improvements, Enhancement Projects, and National Highway of System (NHS).

VIRGINIA DEPARTMENT OF TRANSPORTATION 1996 SPRING
PRE-ALLOCATION MEETING FOR THE INTERSTATE, PRIMARY, AND URBAN
SYSTEMS, AND FOR MASS TRANSIT
ALBEMARLE COUNTY PRIORITIES
The following addresses Albemarle County priorities for each allocation of the Intermodal
Transportation Efficiency Act (ISTEA) and each sub-allocation of the Surface Transportation
Program (STP) funds.
Surface Transportation Program (STP~
Standard Projects:
The following projects, listed in priority order, are eligible for STP fm~ds not set aside. They are:
t)
Undertake those Charlottesville Area Transportation Study (CATS) projects eligible for the
primary program in sequence as called for in the February 2, 1992 joint resolution between
the City, County and University and agreed to by VDOT. In addition to Route 29
improvemems a/ready underway, consxruct Meadow Creek Parkway from the Route 250
Bypass to Route 29 North. The Parkway is the County's next highest priority project, and
is of the utmost importance in order to maintain an adequate level of service on Route 29
and to improve the overall roadway system serving the urbanizing area north of the City. The
first phase of this project from the Route 250 Bypass to Rio Road will be funded in the
County's secondary program. The County is now seeking approval ora rev/sed Rio Road
to Route 29N Parkway corridor as an amendinent to CATS with ultimate inclusion in the
Transportation Improvement Program (TIP). The County believes the parkway will meet the
criteria for inclusion in the p~nary system. With the Commonwealth Transportation Board's
decision to eliminate the Route 29 interchanges, the County believes funds should be
redirected to the Parkway and wants to work with VDOT staff to evaluate construction of
subsequent phases as a primary road if this will accelerate the parkway's completion. VDOT
is urged to investigate all possible funding sources to achieve the quickest construction of
this vitally important roadway. Projects in the northern urbanized area not eligible for
primary funds, but listed in CATS, such as the Hydraulic Road/Route 250 Bypass
interchange, should be actively pursued.

The County will be closely following the progress and recommendation of the Route 29
Corridor Study. Improvement to Route 29 north of the South Fork Rivauna River is still
recognized by the County as an important project. We trust VDOT and the consultant will
continue to receive public input regarding the corridor study and would further recommend
that public hearing be held in Albemarle County. We anticipate that local concerns will be
considered and addressed.
3)
Undertake the widening of Route 20 south from 1-64 to the proposed Route 20/742 connector
road that will serve the traffic from the new high school.
4)
Undertake road projects parallel to Route 29 which relieve traffic on Route 29, such as the
Greenbrier Drive/Seminole Square connector.
5)
Widen Route 250 West from Emmet Street to the Route 29/250 Bypass. This section is
covered by a joint design study by the City, County and University of Virginia and was
recognized for improvement in the Lewis Mountain Neighborhood Study. The joint study
should be used as a guide in developing the widening plans. The remaining portions of Rt.
250 West to Yancy Mill (the 1-64/250 interchange) will be under study by VDOT to
determine long term needs for this road. VDOT will also conduct a similar study of Rt. 250
East from State Farm Blvd. to the Fluvarma County line. The County supports and
appreciates this effort.

lmprove Route 240 in Crozet based on results and recommendations of the VDOT corridor
study of Route 240.

Develop design plans for the widening of Fontaine Avenue from Jefferson Park Avenue to
the improvements along the frontage of the University Real Estate Fonndafion development.
Safety Improvements:
Several projects in the County seem to qualify under this 10% set-aside. They are, in priority order:
1)
Construction of pedestrian walkways along various primary routes within the County's
Urban Neighborhoods; in particular, Route 20 south from the City line to the new Route
20/742 connector road, Route 20 north from Route 250 to Wilton Farms Apartments, along
Route 250 East in the Pantops area as an extension to existing sidewalks, along 250 West
from City to Bypass (as part of the overall improvements to this road).
2)
The closing of the remaining Route 29 North crossovers recommended for closure in a
VDOT study adopted by the Board of Supervisors on May 10, 1979 and reaffirmed by the
Board on November 8, 1989.
3)
Improvements to Route 250 West along the business corridor in Ivy (from jnst east of the
intersection of Route 637 to just west of the intersection of Route 678) to address existing
and short-term traffic ckculation problems, including access to developed properties in this
area.
4) Improvements to the Route 240 underpass at the CSX Railroad in Crozet.

Functional plans for Route 20 North and South for alignment improvements.
Functional plans, including am analysis of possible safety improvemems,
for Routes 22 and 231.
Enhancement Projects:
Several projects appear m be eligible for enhancement funds. They are, in priority order:
1) Construction of pedestrian walkways along selected primary road sections.

Beautification of entrance corridors (particularly Route 20, 29 and Route 250) - landscaping,
signage, undergrounding of overhead utilities.
Construction of bikeway facilities as prioritized in the Bicycle Plan for the City of
Charlottesville and Albemarle County (adopted by the Board of Supermsors as an element
of the Comprehensive Plan on July 17, 1991).
Development of portions of the Rivarma River Greenway path system.
Removal of non-conforming billboards.
National Highway System (NHS)
The Charlottesville-Albemarle MPO Policy Board approved the NHS as proposed by VDOT in this
area excluding the Route 29 Bypass. VDOT recommended to FHWA a NHS which included the
existing Route 29 and the Route 29 Bypass. The County's highest priority project in the proposed
NHS is the widening of Route 29 North from the Corporate limits of Charlottesville to Airport Road.
The County desires to continue active participation in Route 29 Corridor studies, including the study
of the Charlottesx?ille to Warrenton segment of the Corridor now underway. The County will monitor
the progress and recommendations of the Route 29 Corridor which is part of the NHS(additional
information is provided under Standard Projects #2).
Congestion Mitigation and Air Quality Improvement Program
This does not apply to Albemarle County. ]5he Couuty is not in an area of non-attainment for ozone
or carbon monoxide.

COUNTY I APPRECIATE THE OPPORTUNITY TO MAKE A FEW BRIEF COMMENTS
ABOUT OUR PRIMARY ROAD NEEDS.
MY COMIvlENTS FOCUS ON THE NATIONAL HIGHWAY SYSTEM AND SURFACE
TRANSPORTATION PROGRAM AND ARE CONSISTENT WITH THE PRIORITIES
SUBMITTED TO YOU LAST YEAR. THEY ARE STILL FOUNDED ON TWO CRITICAL
DECISIONS WHICH WE HAVE ALL REAFFIRMED: FIRST, THE PROJECTS IDENTIFIED
IN THE CHARLOTTESVILLE AREA TRANSPORTATION STUDY (CATS) AND SECOND,
THE MUTUAL AGREEMENT BETWEEN THE CITY OF CHARLOTTESVILLE, UNIVERSITY
OF VIRGINIA, COUNTY OF ALBEMARLE AND COMMONWEALTH TRANSPORTATION
BOARD REGARDING THE PHASING OF THESE AND OTHER ROAD PROJECTS.
ADHERENCE TO THESE TWO DECISIONS IS ABSOLUTELY CRITICAL TO ADDRESSING
THE TRANSPORTATION NEEDS OF OUR COMMUNITY.
SURFACE TRANSPORTATION PROGRAM
THERE ARE SEVERAL IMPROVEMENTS THAT WE OFFER FOR YOUR CONSIDERATION.
THESE ARE MORE DEFiNITIVELY ADDRESSED iN A REPORT WE WILL LEAVE WITH
YOUR STAFF. THEY INCLUDE THE FOLLOWING SURFACE TRANSPORTATION
PROGRAM (STP) PROJECTS:

UNDERTAKING CATS PROJECTS AS OUTLINED IN OUR MUTUAL AGREEMENT,
WITH PARTICULAR EMPHASIS ON THE CONSTRUCTION OF THE MEADOW

IMPROVEMENTS TO ROUTE 29 FROM HYDRAULIC ROAD TO AIRPORT ROAD,

CONSIDERATION OF THE MEADOW CREEK PARKWAY FOR PRIMARY FUNDING
FOR THE PAST FIVE YEARS. WITH THE COMMONWEALTH TRANSPORATION
BOARD'S DECISION TO ELIMINATE THE INTERCHANGES IS FINAL, THE
COUNTY BELIEVES THAT THERE IS AN OPPORTUNITY TO REDIRECT THOSE
FUN-DS FOR THE CONSTRUCTION OF THE MEADOW CREEK PARKWAY.

WHEREAS, the Virginia Department of Game and Inland Fisheries provides funds to assis!

BACKGROUND:.
The Virginia Department of Game and Inland Fisheries has limited funds available in 1996-97 to assist localities in
providing fishing facilities that are accessible to the disabled. The County's ADA Transition Plan incudes the
construction of an accessible fishing pier at Chris Greene Lake. The Department of Parks and Recreation is in the
process of implementing the projects listed in the Transition Plan. The Department submitted an application in 95-
96 that narrowly missed funding. The Department has been encouraged by VDGIF officials to resubmit an
application for this year.
DISCUSSION:
VVhile project plans have not been completed, it is estimated that the project will cost approximately $70,000. The
project will be funded from the existing appropriation for ADA improvements at the County parks. The grant program
will provide successful applicants with reimbursement of $50,000 or 75% of the total project cost, whichever is
lower.
The deadline for applications is Apdl 30, 1996. The application package requires a resolution of support from the
governing body.
RECOMMENDATION:
Staff recommends that the Board of Supervisors adopt the enclosed resolution authorizing the County Executive
to provide the necessary materials and to enter into such agreements as necessary to qualify for a VDGIF grant.

the National Park Service for inclusion in the National Register of Historic Places. I am hopefnl that the Keeper
of the National Register will approve the nomination and include East Belmont on the offi~ml list of the nation's
historic places.
The Virginia Landmarks Register includes "historic landmarks, buildings, structures, districts, objects and
sites which constitute the principal historical, architectural sites which are of local, statewide or national
significance." Bast Belmont r/chly deserves this official recognition as a historic resource of the Commonwealth.
The responsil~flity for preserving Virginia's irreplaceable historic resources rest ultimately with the property
owners and with local officials whose land-use decisions affect those resources. V~qfile registration does not in itself
protect East Belmont, we hope that this formal recognition will foster a grea[er appreciation of its significance and
will provide continuing encouragement to the property owners and m the County to be good stewards of rids

Applicant's Proposal and Justification: To construct a" bridge replacement in Ward's Creek
flood pla'm. The present,bridge is being destroyed by concrete deterioration and age. The
request is for a special use permit to replace the existing structure with an upgraded version that
would present a better hydrological condition and avoid a catastrophic failure o£the existing
sITaClTd~e."
"The present bridge has been used as both resident access and farm use. The replacement
structure would continue to provide the same, only would be constructed in such manner as tO
make hydraulic and safety conditions a priority."
Petition: Arthur A. Watson petitions the Board of Supervisors to issue a special use permit to
allow replacement of an existing stream crossing in the floodplain of Ward's Creek in
accordance with section 30.3.5.2.1(2) of the zoning ordinance. Property, described as Tax Map
28, Parcel 1, consists of about 1,316 acres zoned RA, Rural Areas and is located on the northwest
side of the intersection of Routes 671 and 609 in the White Hall Magisterial District. This site is
not wittfin a designated growth area (Rural Area 1).
Character of the area: This property is an a combination of several smaller tracts. Other
properties in the area are a combination of small lots and relatively large tracts. This property
abuts an Agricultural/Forestal District on the south (Attachment A for location of property;
Attachment B for parcel map).
RECOMMENDATION: Staff has reviewed this request for compliance with the provisions of
30.3 Flopd Hazard Overlay District and 3 t.2.4, t ( criteria for issuance of a special use permit)
and recommends approval with conditions.
STAFF COMMENT
The proposal is to replace an existing culvert structure with a span bridge. The existing structure
contains nine 18-inch diameter concrete culverts ( Attachments C-l, C-2, C-3). The proposed
structure would be a free span structure. Attachment D shows, in elevation, the proposed free
span structare and the existing nine culverts which would he removed. Some minor vertical and
horizontal alignments of the roadway are proposed, however, the proposed bridge would
essentially be in the same location as the existing structure.
The nonconformity provisions of the Flood Hazard Overlay District are more restrictive than the
provisions for nonconformities in general. The provisions of the Counly's flood plain
regulations are dictated in large measure by the provisions of the Federal Register and any
departure to mom liberal provision may jeopardize County eligibility for the flood insurance
program. Federal and County work on the current mapping and regulatory provisions began in
1976 and culminated in 1980 with adoption of current zoning provisions which basically reqarre
any improvements, including replacement of structures, to comply with current provisions
designed to avoid, among other things, constriction in the flood channel to the detrimem of
upstream or downstream properties including both privately owned properties and public areas.
In this case, VDOT has commented that "the proposed stream crossing should not impact the
highway or its right-of-way." The applicant has obtained approvals from the U. S. Army Corps
of Engineers and the.Virginia Department of Environmental Quality.
In an effort to minimize the possibilities of floodplain disturbance, the number of floodplain
crossings should be minimized. While this can be required of the applicant to serve his own
property, the applicant is encouraged to make the proposed crossing available to other property
owners in the area for, at least, emergency access during flooding.
The applicant has been working with the County Engineering Department and has obtained
approvals from the U. S. Army Corps of Engineers and the Virginia Department of
Environmental Quality. Staff has reviewed this request for compliance with the criteria for
issuance of a special use permit (section 31.2.4. l) and is of the opinion that, with further review
by the Department of Engineering and Public Works, the use will not be of substantial detriment
to adjacent properties, the character of the area will not be changed, the use will be in harmony
with the purpose and intent of the Zoning Ordinance and with the uses in the area, and the use
will be consistent with the public health, safety, welfare.
RECOMMENDED ACTION
Staff reconnuends approval of this special use permit petition subject to the following conditions:
Albemarle County Department of Engineering and Public Works (Engineering

Applicant's Proposal: The applicant is proposing to amend SP 95-25'in order to add
approximately two acres to the mobile home park.
Petition: Petition to amend SP 95-25 to add approximately two acres to the Airport Mobile
Home Park. Property, described as Tax Map 32, Parcel 50A, is zoned R-15, Residential and is
located on the east side of Route 606 approximately 0.6 miles south of Route 649 in the Rivauna
Magisterial District. This site is recommended for High Density Residential (10.01-34 dwelling
units per acre) in the Community of Hollymead.
Character of the Area: This site is currently wooded with some cleating having taken place for
roads and utilities. The Charlottesville/Albemarle Airport is located to the west of the site.
RECOMMENDATION: Staff has reviewed this request for compliance with Section 31.2.4.1
ofthe Zoning Ordinance and the previous actions on this property, and recommends approval.
Planning and Zoning History_: In July 1993 the Board of Supervisors approved ZMA 92-14
and SP 93-13 which rezoned this area from RA, Rural Areas to R-15 and issued a special use
permit for a mobile home park. The approval of that special use permit, SP 93-13, expired in
July 1995. The Board of Supervisors in July 1995 approved a new special use permit, SP 95-25,
which reauthorized a mobile home park in the area covered by the original special use permit
with the exception of the two acres currently under review-. /The two acres currently under
review was not under the control of the applicant at the time of the review of SP 95-25.)
Comprehensive Plan: The subject area is shown as High Density Residential (10.01 - 34
dwelling units per acre.) in the Commtmity of Hollymead which is intended to support mobiie
home park development. No change in circumstance has occurred since the original approval of
a special use permit for a mobile home park which results in this request being inconsistent with
the Comprehensive Plan.
STAFF COMMENT:
This special use permxt request will result in an approval which is the same area as covered by
the original 1993 approval. Staff opinion is that approval of this request is consistent with the
original approval and no change in circumstance has occurred.

RECOMMENDED ACTION:
Staff recommends approval of this request subject to the conditions of SP 95-25 with the deletion
of conditions 2, and 10. Condition 2. requires Plarm/ng Commission approval ora final site plan.
A final site plan for the rest of the mobile home park has been previously approved by the
Planning Commission. This area can be added ~o that site plan by amendment and, thus, a final
site plan is unnecessary. Condition 10. established an expiration date for the special use permit.
The Zoning Administrator has determined that this condition has been satisfied and, therefore, is
no longer necessary. The conditions of SP 95-25 are included as Attachment C.

school, a brief description of the school's indications of future plans will be provided.
The Tandem School is in the process of developing a master plan for their facility needs and has
discussed this plan With staff. The planning consultants liave indicated that, upon resolution of
the details in coordinating a new entrance to the school off of the new connector road, that the
plan Will be completed and submitted for review and a school representative has indicated that a
new special use permit Will be applied for at that time. As the applicant's text indicates, the
school hopes to expand tO approximately 280 students ultimately (present enrollment is indicated
to be a maximum of 153 students, with 24 staff persons). The County is obligated to provide
for a new entrance to the Tandem School from the new connector road and the existing entrance
off of Route 20 will be closed when the new entrance is established. The connector road is
expected to be operational by the fall of t 997. Additional parking would be provided for in the
master plan. Issues of septic field and welt adequacy for the increased level of eurollment will
need to be assessed when the plan is submitted. That assessment will include an assessment of
the feasibility of hooking up to the public water and sewer facilities.

ABOUT TANDEM SCHOOL
Tandem School is a private primary/secondary school founded
in Albemarle County in 1970. The School moved to its
21.77 acre site (Tax Map 91, Parcels 2A/2B)' on Route 20, j
south of PVCC, in 1972. The School currently serves 153 student~
in grades 5-12. .~
The Tandem School was founded upon the principle that
students thrive and learning flourishes when students and
teachers work together, hence the name "Tandem". Tandem School
prides itself on its strong college preparatory program_a
. as its commitment to the deve%opment of its students
~ val~e? a~d social responsibility. TheTandem School is pursuing
affiliation with the Religious Society of Friends (Quakers)~and
the Friends Council On Education. This new affiliation is
intended to reinforce the values.of academic rigor, individual
responsibility and community service that have always been
fundamental to Tandem School.
ABOUT THE BUILDING PROJECT
Tandem School proposes to build a 10,000 square foot
'Community Hall building, containing three classrooms, a music
room and a dining room on the ground level, lan auditorium with
seating for 250 on the main level, and a faculty workroom/lounger
on the upper level.
The School is presently housed in three buildings, the
original"manor" house, a converted barn/stable, and a new
large enough to 9c~ommodate t~ewhole student and faculty body,
lacks separate dining facilities for the upper and middle school
students and does not have a gymnasium.
The proposed Community Hall building will be'built next to
manor house building. Its main purpose will be to house the
250 seat auditorium on the main level, which will be used for
all-school assemblies, plays and rehearsals by the'drama program
and physical education classes in inclement weather. Three
classrooms, a music room and an upper school dining room and
kitchen facilities will be located on the ground~level of the
Community Hall building. The new classrooms; musicand dining
rooms wil~ free up space in themanor house and barn/stable
building to expand thelibrary and administrative offices and
will allow room for a separate middle school dining room.
The new Community Hall building is intended to

In conjunction with the preliminary plan submittal and special use permit application
for this site, and if the Commission has granted our Request for Waiver of Requirement
for Connections to Public Utilities, we also request a waiver of the fire protection
requirement in Zoning Ord'mance §32.7.6. As argued in the connection waiver request,
we contend that the public utilities are not "reasonably available:' under the terms of
§32.7,5.1 or §32.7.6.1. Please refer to the connection waiver request for our arguments.

Tandem School Community Hall; Request for Waiver of Requirement for
Connections to Public Utilities
Dear Mr. Lilley:
In conjunction with the preliminary plan submittal and special use permit application
for this site, we request a waiver of the public utility connection requirement in Zoning
Ordinance §32.7.5. We contend that the public utilities are not "reasonably available"
under the terms of §32.7.5.1. We offer the following information in support:
Although the site is within the Service Authority's jurisdictional area. the
nearest public water line is about 1000' distant from the site and the nearest
public 10" sewer line is 2000' distant from the site, according to the Service
Authority. Inspection of the Willow Lake plans reveals that the nearest 8"
public sewer line may be closer, about 1000' distant. Sewer line distance nmy
be greater than indicated as the lines must respect existing topography,
which is variable in this area.
Connection to both water and sewer would be in the Willow Lake
subdivision. Although an easement for extension of the water line exists to
the boundary of Willow Lake, no such easement exists for sewer extension.
Therefore utility connection would require the owner to obtain both
easements across the intervening parcel as well as a sewer easement across
Willow Lake subdivision and potentially some of the lots in Willow Lake.
Both utility extensions would cross the line of work on the proposed Route
20 / Avon Street Connector Road. Since the utilities would most likely be
installed prior to the construction of the connector, coordination would be
required so the connector road construction would not adversely ~mpact
utility service. This represents a delay in the utility design process and
Tandem groundbreaking which we are planning to commence this spring
for fall completion.

Alternative utility connections to other existing utilities such as those on
Avon Street Extended would pose an even greater burden because the
service lines would be longer.
The site is presently serviced by a well and septic fields. Since no increase in
the number of users of these ~acilities is proposed, service is expected to
remain adequate for the site in its proposed configuration. The existing
systems have been in operation for five to 25 years with no indication of
inadequate capacity.
To sum up, we believe the burden of connecting to public facilities is unreasonable at
this time as it would impose significant costs in both money and time on the school so
long as adequate facilities exist on site. The issue of fire protection is addressed
separately, in the "Request for Waiver of Fire Protection Requirements".
