The Albemarle County Board of Supervisors, at its meeting on
March 2, 1988, unanimously approved the above-noted petition'
to rezone 5 . 023 acres from LI, 'Light, IndÍ1sDI:ial, to HI,
Heavy Industrial, to allow for a mobile home sales park.
Property, located on the east side of Rt. 2BN north and
adjacent to Bàdge;r POwhatan. Tax Map 32, Parcel 5E.
Rivanna Magistèrial District. This approval is subjEict to
proffer of March 1, i988 (copy attached) amending Statement
No. 1 at the bottom to read: "that such an' easement will
not, in the opinion of the Planning Commi~siion, adversely
affect the marketability or usage of the 'parcel;" and
amending Statement No.3 at the bottom to r,ead: "that this
right-of-way wiil follow the approximate alignment of the
sewer easement as shown on the attached plat."

Virginia Land conditionally proffers a right-of-way easement through that parcel known
as Tax Map 32, Parce1SE, for use by the adjacent property to the north. The conditions
of this proffer are:
1. that such an easement will not adversely affect the marketability or usage of the
parcel;
2. that this right~of-way will be used as a secondary access to the adjacent property,
and that the primary access to the adjacent property will remain at Rt. 29; and,
'3. that this right-of-way will follow the sewer easement as shown on the attached plat.
Virginia Land Trust proffers deletion of certain HI uses for that parcel known as
Tax Map 32, Parcel SE, effectively limiting usage to the following:
1. Mobile home sales.
2. Uses permitted in the HI zone which are permitted by right in the LI zone.
3. Uses permitted in the HI zone which are permitted by special use permit in the
LI zöne, subject to special use permit approval.
