I know that in the letter I sent to you, I said you might need to ask for a deferral. Unfortunately, that information was incorrect. I've been doing background work on the deferrals that have already been granted, trying to make sure that I know what timelines apply right now. Because you are on your last deferral, there will need to be a PC action by December 19, 2017. Resubmitting will stop the clock; but there are some provisos below. I need to correct your assertion that Ross Stevens' property does not need to be part of the rezoning. The extension of Library Avenue contains property you don't own and is not publicly owned. The zoning relies on that road and requires that the property underneath be part of the rezoning. In addition, the property north of that road is shown as part of the rezoning plan. I know you don't want to talk to Ross Stevens about his property yet, but it needs to be done and the sooner the better. You also need to talk with the church about the r.o.w. needed across the northern part of their property. We really cannot process this application further without all owners of property, for which elements of the plan are shown, participating in the request. Also, while I believe there is a strong possibility that the County might upgrade the Square, the same cannot be said for the plaza. I don't know when the Board might make its decisions on which projects to fund with the NIFI and I don't know if the BOS would agree to fund the plaza. All of this is to say that we don't recommend you base your decision to resubmit on the County's future actions. If you want to wait until October 30 to resubmit, that would be fine. It is the resubmittal deadline for the Dec. 19 PC meeting. This plan is consistent with the MRA designs and the VDOT requirements that have been expressed in our meetings with them (most notably the roundabouts). Let me know if you think it's adequate for a zoning resubmittal. As you've noted, Ross Steven's property is impacted by the extension of Library Avenue but I don't believe his property needs to be rezoned. I thought it was already DCD. My assumption is that Ross will work with us on the ROW since it's about an even exchange of land in phase 1A and he gets frontage on the Library Ave extension. I have not pursued this with him recently because, until we figure out how to fund the plaza and the upgrade of the Square, we don't have a project. If the County can help with those 2 challenges, then we'll want to move as quickly as possible with the phase 1 rezoning and siteplan. We should have a financing evaluation from Municap next week that I plan to submit to the County for review and consideration. This is the email I thought I sent but just found in my Drafts folder! The best next step would be for you to submit to us what you believe to be the final road layout plan and what you are currently willing to proffer. We don't need to schedule anything for the PC, but if we can all agree on the design plan and know what your level of commitment to improvements is, all will go more smoothly when you are ready to take it to the PC. When we last left off, Ross Stevens' property was being included in the design plan, but he had not agreed to the rezoning. That piece is huge for us. Also, we need to see the road layout plan that all 3 groups: you, VDOT, and the County agree to, since this is what seems to mess us up with every submittal. If you could provide this on Monday, June 51h as a resubmittal, you will not need to ask for a deferral. The only thing holding up our rezoning application at this point is a funding strategy for the plaza. I don't want secure the rezoning, only to find out we don't have funding strategy for the plaza and be subject to a higher tax assessment but no viable development plan. I received a draft TIF plan from Municap earlier this week and expect to submit it to the County in the next week or two. If it looks workable at your end, we would want to fast track the rezoning and phase 1 siteplan. In the interim, I'll need your advice. If it's possible to secure the rezoning without a tax increase, we'd be comfortable reactivating the current application and heading back to the Planning Commission as soon as possible. If not, let me know what type of deferral you'd recommend. We need for you to do something with Crozet Square — resubmit, ask for a deferral, or withdraw the application. If you want to resubmit — please tell us when to expect it. It should be within the next 30 days. If you want to defer, please provide us a date by which you will resubmit or ask for an indefinite deferral. The indefinite deferral will only last 1 year.
