Gentlemen and Ladies:
Please let me take this opportunity, on behalf of my partner, Suzanne Jessup Brooks,and the
principals of The Blake at Charlottesville,to thank you for entertaining our request for
clarification about the landscape plan for Oakleigh at your meeting on May 15,2017.
Please be advised that it is our intent to fully implement the landscape plan shown on our
pending site plan, including all plantings along the West Rio Road edge of our project. We are
aware that one or more utility companies have both underground lines and overhead lines
along that part of West Rio Road.We have met at the site on numerous occasions with all such
companies and they are preparing a plan to move poles that are in the way of the Oakleigh
project as well as determine how they will prefer to route future service to our project and to
other customers in the vicinity.At no time during the whole process of our original site plan
approval or in any of our recent discussions have we been informed by any of the utilities that
our landscape plan isn't harmonious with their service lines.Therefore,we will plant according
to the plan as submitted.
If in the future, one or more utilities damage or destroy the plantings we install in order to
service their lines we will be responsible for repairing the damage or replacing the plant
material to the extent no recovery is available from the responsible utility.
If,for some unforeseen reason, we are prevented by the utility companies from planting per
the pending plan before planting is complete, we warrant that we will prepare a new plan
acceptable to the utility companies and submit it to the ARB for review and approval.
I hope this captures the intent of our instructions in providing this letter.

Are the brick samples being done on full size bricks or sample boards from the manufacturer that are just the
"slices"? If they're thin we can glue them to my board that we're putting together. I could send it to Steve if he
could glue them on.
If full size brick, we can affix a digital image to our board and take the sample separate for the ARB to have.
Stucco colors are below:
Benjamin Moore-Alaskan Husky #1479 for the field (main) color. Trim bands (and the hardi trim on the
building) are Sea Pearl #961.
We have these ready and on the board.

Steve- Allen Thomas with Shade and Wise will be contacting you to deliver two sample panels of the brick that
we will install to be used along with the mortar rub finish. Can you submit one and keep the second panel for
me to pick up on my next trip. Also can you show him physical samples of the stucco finish color as well as the
paint for the Hardi exterior. If you don't have samples please get him the manufacturer names and color
numbers.

Allen- we need to select a type S mortar that matches the color range of the paint and stucco finish. I'm sure it
will need to be white cement based, but maybe we can find something in a light portland base that will suffice.
Michael- can you forward an image file to Steve that best depicts the mortar rub technique and copy me. If it
needs to be one of the images that I've circulated let me know if I can help.
If there's anything else EBM or QSL can do to facilitate the submittal process please let us know...thanks guys

Hey Margaret,
Using the ARB's preliminary review action letter, I wrote out some short updates in red pen regarding Oakleigh. I placed
a copy on your desk.
Last night, the Board approved just Scenario A and agreed to reduce the number of saved trees from 13 to 11. I'll have
to double-check the minutes for exactly which trees were "de-proffered" but I think it's#3 and #4A.
I'm also attaching the exhibit that was discussed regarding their back-up emergency access (the path that goes through
the trees). The applicants assured the Board that a connection through the back of the site to Charlottesville Health and
Rehab is their first priority and this is strictly a back-up plan.
I'm not sure when we'll know what connection they're choosing for the site plan review, but I know the back-up plan
would have ARB implications (the new dumpster location, etc.).
I'll plan to keep you in the loop on new information as it becomes available. I'm aware the applicants are meeting with
Engineering this afternoon to discuss grading according to the previously approved WPO plan.

Dear Margaret:
This may be a bit unorthodox but we are trying to shrink our review time so our buyer can begin
construction on the assisted living facility as soon as possible. In this application, we are
submitting to the ARB prior to submitting our Major Site Plan Amendment. We hope this can be
one way to shrink the project schedule and get as much input as possible.
As you recall, on September 19, 2016 we attended and received comments in an Advisory
Review meeting. The project is set to go before the Board of Supervisors on February 8th. The
plan going before them reflects the comments made at the Advisory meeting. We expect to then
submit our Major Site Plan Amendment no later than February 21st. Below serves to fulfill the
written description of the proposal and explains how the project has evolved.
Oakleigh is a project that received ARB approval back in May 2010. The project was rezoned to
Neighborhood Model and consisted primary of residential units with two commercial buildings
along W. Rio Road. Since then, the project's direction has changed due to many factors, least of
which was the economy. Recently, the owner's were approached by a new buyer that allowed
Oakleigh to be resurrected. The new proposal currently before the Albemarle County Board of
Supervisors is a rezoning from NMD to NMD that allows for an assisted living use.
Our project continues to respect parts of the previously"approved" plan but now allows more
flexibility with the new permitted uses. Along W. Rio Road there has been no change to the two
commercial buildings that were previously reviewed and approved by the ARB. The project still
maintains interconnection to Berkmar Crossing and supports many of the other neighborhood
model principles outlined in our rezoning application. The project also has preserved several of
the mature trees on-site. Additionally, we still offer some residential units but have significantly
reduced the number of units available.
Behind the two commercial buildings is where the development plan has changed. We have
added another smaller commercial building (Building C) located behind Building B; and have
added an assisted living facility (Building D) towards the back of the property. As a result to
fulfilling a need in Albemarle County by adding both assisted living and memory care units we
have had to remove more trees than previously proposed in our original approval. However,
several of the most significant trees continue to be preserved which certainly help break up the
development and buffer the assisted living facility from the Entrance Corridor.
Given the fact that the assisted living facility's program requires the building to be one continuous
and uniform finish floor elevation, we have had to propose more retaining walls. Most of the walls
are relatively small but as we proceed to the rear portion they do get taller. Fortunately, 95% of
those rear walls won't be seen from W. Rio Road.

With regards to the comments made at our Advisory Review we feel the project has addressed
many of these remarks. We have revised the Code of Development standards to allow more
flexibility; we have clarified which trees we are preserving; reconfigured the parking to lessen the
impacts to the trees being preserved; are continuing to work with the utility companies to ensure
both can coexist along W. Rio Road as before; and trying to maintain some compatibility in the
building materials with all the buildings. Furthermore, in this submission we will show through site
sections how Building D's massing is compatible, and should be a non-concern issue to the ARB,
as it relates to the site and buildings in front of it.
As for Building C, the design mimics the two commercial buildings along Rio but on a smaller
scale. We feel that is appropriate and is consistent with that particular use. With that said, the
approved samples should also be sufficient for to approve of Building C at this point.
To summarize, we are seeking direction and final approval from the ARB, not only on the site, but
on the assisted living facility (Building D) associated with the project. We also want to determine if
they feel the need to review the six residential townhomes; and if Building C given their locations,
as well as that the two commercial buildings (along with the Garden Spot) screen them from the
Entrance Corridor.
Hopefully with the submitted plans, illustrations, videos and material samples you will agree. We
also hope when we have the opportunity to go before the ARB we can receive enough direction
from them that they will be comfortable leaving the final details to your supervision. We
appreciate your time and effort in reviewing our plans and respectfully request your

The Albemarle County Architectural Review Board, at its meeting on September 19, 2016, completed a
preliminary review of the above-noted request. The Board took the following actions.
Regarding the Zoning Map Amendment, the Board by a vote of 5:0, forwarded the following
recommendation to the Planning Commission:
The ARB has no objection to the amendment to the proposed rezoning, with the following conditions:
1. The Code of Development should be revised to eliminate standards that are either covered by EC
guidelines, are more limiting than the EC guidelines, or are vague. i",

Regarding the site plan, the ARB offers the following comments for future site plan submittals:
When architectural and site plans are submitted for review with the site plan submittal, address the
following issues:
1. The design of buildings in the development should exhibit compatibility in form, character and
materials.
2. Show how the form and massing of Building D result in an appropriate, compatible appearance
along the Entrance Corridor.
3. Provide site sections to clarify the visibility and relative proportions of the various buildings.
4. Provide assurance that the utility easement and the planting along the EC frontage can coexist.
5. Ensure that retaining wall location and construction method allows for required planting at the
perimeter of parking lots/travelways and at the base of the walls. Maximum height for retaining
walls that are visible from the Entrance Corridor is 6'. Taller walls must be terraced and planted.
