Mr. Perez,
Thank you for the reply, and for the attachment. Mr. Anderson and I have spoken several times when he
initially inquired about the sub-divide. Everyone is on the same sheet of music w/r/t the fees, etc., so we had no
concern there. We (road committee) were just unsure of any county "legal/admin" requirements directly
pertaining to our responsibility. I don't recall any language that addressed the addition of any lots to the North
Pines road maintenance charter, but will be taking another look at the two documents to be sure.

The private street is not being extended nor modified with the proposed subdivision; rather, the proposal adds a
single lot to the existing private street. A revised private street maintenance agreement is not required for the
County to approve the plat; however, if your HOA would like to add the proposed lot to your existing private
street maintenance agreement you may need to amend your existing road maintenance agreement and record a
revised copy in the clerk's office. I say may because it depends on how your original agreement was/is written.
If it specifically calls out 92 lots and does not provide any way to add a new lot based on use of the road, then
yes you should modify it.
Status of the plat: under review, pending a resubmittal by the applicant.

Below is a thread regarding the potential subdivision of an existing parcel in our subdivision (North
Pines). I realize there's a "firehose of info" within the previous emails, but if you could take the time
to read through them, we would appreciate it. The real purpose of the inquiry is expressed in my last
email to Mr. Nelson,
The Bottom Line question is whether we (the road committee) must do anything administratively (i.e.
- file anything with the courts) to incorporate (or add) the newly created lot to the the road
maintenance agreement/charter for the neighborhood, if in fact a new lot is created. We don't have
a position one way or the other on whether the application is approved or denied.

applicant) is required to have the signed plat recorded in the Albemarle County Circuit Court Clerk's Office.
Once the plat is recorded, the Clerk's Office notifies the Albemarle County Assessors Department and they
update the GIS map to show the new parcels.
If the signed plat is not recorded in the Clerk's Office, the plat approval is voided and the GIS remains as it
was—showing no subdivision.

Mr. Nelson,
We (North Pines Road Committee) have a question regarding any administrative procedures or
processes our road committee may need to execute when a new lot is created / divided from an
existing lot.
A resident in the North Pines neighborhood (Rt 29 North behind GE) has listed for sale a parcel
(apparently) divided from his total lot/property. My understanding based on conversations with the
owner approximately a year ago is that he executed all the legal/administrative requirements for the
actual sub-division of his property. However, the County GIS site does not reflect a sub-divide of
the current lot, to date. In any event, a sub-division of the "parent" lot will create an additional lot
which will be subject to the annual road maintenance dues.
The road committee is only responsible for the maintenance (paving and/or repair) of the private
roads, and for snow removal. As such, the committee assesses annual road dues based on
improved and unimproved lots that are serviced by the private roads in our neighborhood. The
legal instruments registered on file at the courthouse that established the road maintenance
committee in 1980 (and amended in 1982) currently indicate ninety-two lots that are subject to the
annual dues.
Will we ( road committee) need to submit an amendment to the base document that established the
road maintenance agreement/committee to add the additional lot number? If not, are there any
other administrative requirements the committee may be required to execute?
Any advice or guidance would be appreciated. It's not a "hair on fire issue" right now, but we don't
want to get behind the curve when/if the lot is sold.

Per conversations with Zoning this note idea being floated is not possible. You need to re-draw the lines around
the building sufficiently.
I offer the following suggestion outside of my area of experience to deal with this issue- you could put this idea
in your contract purchase with the potential buyer that you both will move the lines through a BLA once the
barn has been demolished; this may help yall come back to the table w/the new property owner once the barn is
demolished. Hope this helps.

14-312] Location of existing buildings. Depict and label the existing pool and the outbuildings on the
residue lot. Rev 1. The proposed property line goes through the existing barn. Section 4.11.2(b)
requires these structures to be no closer than six(6)feet to the side property lines.Revise the
proposed property line to address this requirement.Once revised also provide distance measurements
on the plat for each out parcel to the new property line.
Please tell the reviewer the barn is really a shop (the enclosed section) & equipment shed (open section) is a failing
and abandoned building and that we cannot afford to have it demolished until we sell the proposed new lot, which
demolition by us will be in our contract with the buyer to take place ASAP after closing (demolition is about
$6,000). We do have some junk stored in the enclosed section/shop but are sorting that for disposal or for moving
to our home or stable. The concrete slab in the shop section is progressively sagging like a bowl so the doors do not
close completely and the open shed portion roof is bowing, both due to springs undercutting the
structure. Electricity has been cut off for the building. We would rather not redraw the lines to go around this
building which will not exist soon after the property is sold. Several potential buyers have seen the property and
had no problem with the structure being demolished after the sale closing. I have attached photos of the
deteriorating structure with spring sink hole.

I jumped back into this project per your inquiry and spoke to Francis. Section 14-232(B)2 does not allow the
extension of the existing private road by the agent; rather, it would require PC approval be you are extending
the previously approved private road and will not be the sole and direct means of access to a public road. The
comment stands as originally provided.
The modified sketch you provided in the email takes advantage of the guidance provided in the second portion
of my July 15th comments. I believe that is what you need to submit as it allows Lot 60 to maintain 150' of
frontage on Mahonia Drive and you provide the culdesac lot(Lot 60A) a reduced frontage amount on Mahonia
Drive on a cul-de-sac.

The proposed access easement should be relabeled to be a "Shared driveway easement to benefit Lot 60 and Lot
60A". This shared driveway easement does not provide these lots frontage, rather just access to the previously
approved private road. Also a note shall be added to the plat stating that "Maintenance shall be by the owners of
the lots affected by the shared driveway easement (Lot 60 and Lot 60A), not by the Virginia Department of
Transportation or the county."
Also, provide a maintenance agreement for this shared driveway easement as required in section 14-317. The
County Attorney will need to review and approve the document prior to plat approval. Attached is a template
for you all to edit/modify the language as applicable for a shared driveway easement.

Attached is a statement of the road maintenance fees payable for 2016 issued by
the North Pines Road Committee.
The fee for new lot 60A proposed in this subdivision application will be $35 as an
unimproved lot in 2016 and when sold and built on it will be $180. I will pay the
$35 fee after approval of subdivision.
There are no other matters related to this subdivision that are within the purview
of the Committee and there is no other North Pines organization or legal
instrument bearing on this subdivision.
I have contacted the Committee on several occasions and their only concern is that
the new lot 60A be recorded in the North Pines subdivision plan with the County
registrar which wile done upon County approval of this subdivision application.

Annual Report and Notice of Annual Meeting March 01,2016
The annual meeting of the North Pines lot owners will be conducted at the new Hollymead Fire Station off Airport Road at 7:00 PM on
Tuesday,March 22,2016. All lot owners are encouraged to attend. The 3 year term currently held by Roger Ritenour is up for re-election.
Anyone willing to fill Roger's spot please attend the meeting. We would like to thank Roger for his service to the neighborhood.
The overall condition of the roads is good. The continuing plan for road repaving is to build up funds,while we evaluate the roads conditions
to determine when to start the next paving project.
Last year we placed"Snow Plow Route"signs up to aid the contractor in ensuring all roads are plowed. This seems to have helped,but if
your street is ever not plowed please contact us. We are always evaluating the contractors,and if you feel as though you know of a contractor
who could better serve us please come to the meeting with your suggestions. As always,please be respectful to the contractors.
The cul-de-sacs are the most difficult for the drivers to plow. This is especially important when residents with multiple vehicles park
them in the cul-de-sac instead of in their driveways. The best place to park is in/at the end of your driveway if possible. This helps the
drivers identify where the driveways are,which is difficult in the dark and snow.and allows the drivers to push the snow between the
driveways and avoid blocking mail boxes. One thing the contractor requested was that residents please not park in open areas where they can
push the snow.
2015-2016 ASSESSMENTS AND DELINQUENCIES
There are no outstanding assessments. All lot owners are currently paid in full, however several payments were made very late and only after
multiple contacts from the road committee. Please be advised that late fees will be assessed if payments are 30 days late and a lien will be
placed on the property if 90 days late if no contact has been made by the owner to arrange payment. Please do not just ignore the assessment,
contact the road committee at Northpinesroads;cf= rnail.co n if you are having a difficulty. Prompt payment of your assessment is always
greatly appreciated by the road committee. Thank you.
As of January 1,2016 there are 90 improved lots and 2 unimproved lots. For the second year in a row,the officers propose that this years
assessments to remain the same as last year's rate of$180 on improved lots,and $35 on unimproved lots. The plan is to build up a cash
reserve so that when re-paving of the roads is required, a special assessment will not be necessary. Assessment notices will be mailed to lot
owners in April and will be due May 31.2016.
Please note the P.O. Box is now in Ruckersville so make sure you mail your payment to the correct address.
The Road Committee encourages residents and their guests to honor posted speed limits and to avoid parking in areas on roads that may
impede snow removal. Special thanks to those residents who mow the grass and plant flowers each year at the North Pines front entrance.

I am the reviewer of the project and had some questions as to possible impacts of the proposed lot lines with a relatively
recent septic repair permit that was approved. It was unclear to me if the the proposed drainfield area would be
impacted, and if so, to what degree. It is unclear at this time whether or not the repair system has been installed.
I have worked with the owner in the past and have met him at the property. I had meant to wrap this up before the
Holiday, but wasn't able to do so.
I have scheduled some time Monday morning to finish two County reviews (this one and Rivanna Church). I'll follow up
once I'm able to clarify a few things.
