F o r t h e purpose of these proffers, the Project is further described in the Code of Development and application plan (the “Plan”) entitled “Rezoning Application Plan Amendment to Block 1 f o r R i v e r s i d e V i l l a g e ” p r e p a r e d M a y 2 1 , 2 0 1 2 b y S h i m p E n g i n e e r i n g P C , a n d l a s t r e v i s e d o n April 10, 2017.This current proffer statement for Block 1 (the “Proffer Statement”) supersedes the proffer statement dated August 20, 2015, for ZMA 201500003 as it pertains to Block 1only. Th e P l a n s u p e r s e d e s , a s t o B l o c k 1 o n l y , t h e p r e v i o u s C o d e o f D e v e l o p m e n t a n d a p p l i c a t i o n p l a n entitled, “Rezoning Application Plan Amendment for Riverside Village”, prepared by Shimp Engineering PC, last updated June 18, 2015, which 2015 Application Plan pertained t o t h e e n t i r e R i v e r s i d e V i l l a g e d e v e l o p m e n t p r o j e c t ( 1 8 . 6 6 a c r e s r e f e r r e d t o a t t h e t i m e a s T a x Map 78 Parcel 58).Pursuant to Section 33 of the Albemarle County Zoning Ordinance (Chapter 18 of the Albemarle County Code), the Owner hereby voluntarily proffers the conditions listed belo w w h i c h s h a l l b e a p p l i e d t o t h e P r o p e r t y i f i t i s r e z o n e d t o t h e z o n i n g d i s t r i c t i d e n t i f i e d a b o v e . These conditions are proffered as a part of the requested rezoning and the Owner acknowledges that the conditions are reasonable. Each signatory below signing on behalf of the O w n e r c o v e n a n t s a n d w a r r a n t s t h a t i t i s a n a u t h o r i z e d s i g n a t o r y o f t h e O w n e r f o r t h i s P r o f f e r Statement.1.Affordable Housing.Within the Project, the Owner shall provide fifteen percent (15%) of the housing units as affordable housing units (“Affordable Housing U n i t s ” ) i n t h e f o r m o f f o r - s a l e a n d / o r f o r - r e n t c o n d o m i n i u m s o r a p a r t m e n t u n i t s . T h e P r o j e c t Affordable Housing Units shall be subject to the requirements as set forth in Section VI of the Code of Development. The Project Affordable Housing Units shall be constructed w i t h i n B l o c k 1 a s s h o w n o n t h e P l a n . A.For-Sale Affordable Units. All purchasers of the for-sale Affordable Housing Units shall be approved by the Albemarle County Housing Office or its designee. T h e f o r - s a l e A f f o r d a b l e H o u s i n g U n i t s w i l l b e d e s i g n e d f o r h o u s e h o l d s w i t h i n c o m e s l e s s t h a n eighty percent (80%) of the area median income such that housing costs consisting of principal, interest, real estate taxes, and homeowners insurance (PITI) do not exceed t h i r t y p e r c e n t ( 3 0 % ) o f t h e g r o s s h o u s e h o l d i n c o m e . T h e O w n e r s h a l l p r o v i d e t h e C o u n t y o r i t s designee a period of ninety (90) days to identify and prequalify an eligible purchaser for the for-sale Affordable Housing Units. The ninety (90) day period shall commence u p o n w r i t t e n n o t i c e f r o m t h e O w n e r t h a t t h e u n i t ( s ) w i l l b e a v a i l a b l e f o r s a l e . T h i s n o t i c e s h a l l not be given more than sixty (60) days prior to receipt of the Certificate of Occupancy for the applicable Affordable Housing Unit; the County or its designee may then hav e t h i r t y ( 3 0 ) d a y s w i t h i n w h i c h t o p r o v i d e a q u a l i f i e d p u r c h a s e r f o r s u c h A f f o r d a b l e H o u s i n g Unit. If the County or its designee does not provide a qualified purchaser during the ninety (90) day period, the Owner shall have the right to sell the unit(s) without any res t r i c t i o n o n s a l e s p r i c e o r i n c o m e o f t h e p u r c h a s e r ( s ) . T h i s p r o f f e r s h a l l a p p l y o n l y t o t h e f i r s t sale of each of the for-sale Affordable Housing Units.B.For-Rent Affordable Units.(1).Rental Rates. The initial net rent for each for-rent Affordable Housing Unit shall not exceed the then-current and applicable maximum net rent rate approved b y t h e A l b e m a r l e C o u n t y H o u s i n g O f f i c e . I n e a c h s u b s e q u e n t c a l e n d a r y e a r , t h e m o n t h l y n e t rent for each for-rent Affordable Housing Unit may be increased up to three percent (3%). For purpose of this proffer statement, the term “net rent” means that the rent doe s n o t i n c l u d e t e n a n t - p a i d u t i l i t i e s . T h e r e q u i r e m e n t t h a t t h e r e n t s f o r s u c h f o r - r e n t A f f o r d a b l e Housing Units may not exceed the maximum rents established in this paragraph 1B shall apply for a period of ten (10) years following the date the certificate of occupancy i s i s s u e d b y t h e C o u n t y f o r e a c h f o r - r e n t A f f o r d a b l e H o u s i n g U n i t , o r u n t i l t h e u n i t s a r e s o l d a s low or moderate cost units qualifying as such under either the Virginia Housing Development Authority, Farmers Home Administration, or Housing and Urban Development, S e c t i o n 8 , w h i c h e v e r c o m e s f i r s t ( t h e “ A f f o r d a b l e T e r m ” ) . (2).Conveyance of Interest. All deeds conveying any interest in the for-rent Affordable Housing Units during the Affordable Term shall contain language recitin g t h a t s u c h u n i t i s s u b j e c t t o t h e t e r m s o f t h i s p a r a g r a p h 1 . I n a d d i t i o n , a l l c o n t r a c t s p e r t a i n i n g to a conveyance of any for-rent Affordable Housing Unit, or any part thereof, during the Affordable Term shall contain a complete and full disclosure of the restrictions and c o n t r o l s e s t a b l i s h e d b y t h i s p a r a g r a p h 1 B . A t l e a s t t h i r t y ( 3 0 ) d a y s p r i o r t o t h e c o n v e y a n c e o f any interest in any for-rent Affordable Housing Unit during the Affordable Term, the then-current owner shall notify the County in writing of the conveyance and provide th e n a m e , a d d r e s s a n d t e l e p h o n e n u m b e r o f t h e p o t e n t i a l g r a n t e e , a n d s t a t e t h a t t h e r e q u i r e m e n t s of this paragraph 1B(2) have been satisfied.(3).Reporting Rental Rates. During the Affordable Term, within thirty (30) days of each rental or lease term for each for-rent Affordable Housing Unit, the the n - c u r r e n t o w n e r s h a l l p r o v i d e t o t h e A l b e m a r l e C o u n t y H o u s i n g O f f i c e a c o p y o f t h e r e n t a l o r lease agreement for each such unit rented that shows the rental rate for such unit and the term of the rental or lease agreement. In addition, during the Affordable Term, the t h e n - c u r r e n t O w n e r s h a l l p r o v i d e t o t h e C o u n t y , i f r e q u e s t e d , a n y r e p o r t s , c o p i e s o f r e n t a l o r lease agreements, or other data pertaining to rental rates as the County may reasonably require.2.Cash Proffers for Residential Units. Subject to the credits for in kind and cash contributions and subject to the credits for by-right units allowed in the previous zoning a s o u t l i n e d i n p r o f f e r # 5 a p p r o v e d w i t h Z M A 2 0 1 5 0 0 0 0 3 , t h e O w n e r s h a l l c o n t r i b u t e c a s h f o r each new residential unit that is not classified as an Affordable Housing Unit for the purposes of addressing the fiscal impacts of development on the County's public facilitie s a n d i n f r a s t r u c t u r e , i . e . , s c h o o l s , p u b l i c s a f e t y , l i b r a r i e s , p a r k s a n d t r a n s p o r t a t i o n . T h e c a s h contributions shall be at the following rate: Seven Thousand Four Hundred Nineteen and 91/100 dollars ($7,419.91) cash for each new multi-family dwelling unit.
