Ruth Wadlington, Co-President, League of Women Voters, referred to a letter from the League and the Rivanna River Basin Roundtable. She urged the Board and City Council to appoint a regional water oversight commission that will be broader in scope than the RWSA's mission. Consensus of Board to include this item on the August 4a agenda for discussion. ASSIGNMENT Meeting was called to Order at 7:05 p.m., by the Chairman. All BOS members present. Clerk: Send letter to Ruth Wadlington and include as item on the August 4th agenda. 5.1 White Oaks (Crozet) '¥Vatch for Children" Sign. ADOPTED the Clerk: Forward original resolution to Juan Wade. attached resolution. 5.2 Appropriation: Virginia Commission of the Arts Grant, $100.00 . (Form#99002). APPROVED. 5.3 Resolution to accept Highlands, Phase 1C, into the State Secondary System of Highways. ADOPTED the attached resolution. 5.4 Year 2000 Legislative Proposals to submit to VACo (deferred from July 7, .1999). APPROVED as recommended by staff. 5.5 Resolution in support of relationship with Provincia of Prato. ADOPTED the attached resolution. 6. SP-99-012. Other Matters not Listed on the Agenda from the Board. · David Benish asked Board members to let staff know what kind of information they want for the September I work session. Board member made the following requests: · Ms. Humphris requested a rendering to show how what the applicant wants could fit on the site. In addition, if staff can do any refinement to the matrix it provided would be helpful. · Ms. Thomas said the telephone conversation with Mr. Jacoby was very interesting. One comment was that Walmart was a leader in reuse of its buildings, and was beginning to build buildings that had separate structures for different parts. They have to figure out how to build these buildings in such a way that they can be reused when they are no longer occupying them. She asked staff to follow UP on this concept. Mr. Perkins asked if Mr. Jacoby could provide drawings of some of his buildings. · Ms. Humphris asked if we could find out from Walmart what they would be willing to offer in the way of sustainability. · Ms. ThOmas said when she thinks of residential on this site, she does not think of it as being on top of the retail. There is a lOcation on the site where it would fit. · Ms. Humphris asked for information about the possibility of reducing the parking ratio. In addition nobody mentioned the beauty of the site and how important it is to give special consideration to the hillside, the old oak trees, and the rock outcroppings. · Mr. Martin said he attended a meeting on the Workforce investment Act, and will make sure Board members get a copy of the information. .... ,1.2. Davis Benish asked Board members to get any questions or issues they want addressed to the Planning staff prior to the September 1 work session. /ewc DATE: TO: FROM: July 8, 1999 Charlottesville City Council Albemarle County Board of Supervisors League of Women Voters of Charlottesville/Albemarle County Rivanna River Basin Roundtable Water Policy and Water Supply Planning The League of Women Voters and the Rivanna River Basin Roundtable advocate sound water policy and full public participation in water decisions that will impact our community far into the future. Regarding the Water Supply Planning process now underway by the Rivanna Water and Sewer Authority (RWSA), we believe that this process is so important that the elected officials of Albemarle County and the City of Charlottesville should be setting basic policy in this matter. Public participation over the past few years in numerous water forums, summits, and committees, in the RWSA process, and at the Water Supply Plan public meeting of April 20, 1999, suggest a high level of informed citizen interest and concern. Therefore, we urge the County, the City and the RWSA, jointly, to initiate a series of meetings to promote public education, dialog and deliberation on this important issue. We believe that there wilI be broad interest in and appreciation for this oppommity for public discourse. We propose the following sessions to be held as soon as scheduling perm/ts, but certainly no later than early September, 1999: 1. An open joint City Council/Board of Supervisors work. session with RWSA presenting their water supply and demand analyses and the potential altemat/ves they have identified to meet their projected future demand. Additionally, service, educational and conservation groups, and other informed parties that represent the broad spectrum of water use and interest in the Basin should be invited to make concise, informed presentations. 2. A second open meeting to be held after a period of time to allow our elected officials to study the information presented and to solicit input from their constituents. This meeting would give the elected officials an oppommity for questions and answers with the RWSA and for a joint discuss/on of water supply and use strategies. 3. A public hearing for further input by the community on water policy and water supply issues. The Water Supply Planning process is proceeding at a del/berate pace. We see no reason that the proposed meetings would interrupt or disrupt the process underway. Conversely, now that the RWSA has identified numerous alternatives for consideration, we feel that this is an ideal time for the public and its representatives to be engaged in the dialog. We ask that you initiate tiffs dialog in an expeditious manner. Since the Water Supply Planning process will continue for an undefined time, we also suggest that you establish a joint City/County and Regional water oversight commission or task force. This would allow the integration of broader water issues with the task of providing an adequate potable water supply for the public service area. We thank you for your attention to these requests, and offer any assistance you would find helpful in organizing the proposed informational meetings and/or identifying important participants. ITEM NUMBER: INFORMATION: INFORMATION: BACKGROUND: The residents of White Oaks subdivision request the Virginia Depadment of Transportation to install a "Watch For Children" sign on Caitlin Drive (Route 1232). This request requires a resolution of support from the Board of Supervisors to the Virginia Department of Transportation. DISCUSSION: On March 3, 1999, the Board of Supervisors endorsed new guidelines for the installation of "Watch for Children" signs. Staff is using these new guidelines to review this request. "Watch for Children" si.qns shall only be considered on secondary roads. The residents have requested the sign to be located on Caitlin Drive (Route 1232) - a secondary road in the Crozet area of the County. This will alert all vehicles to be cautious as they travel on Caitlin Drive. The request must come from a Homeowner's Association where applicable. Please find attached the letter of request from the half of the homeowners in White Oaks subdivision. This subdivision does not have a homeowner's association at this point. It is not fully developed at this time. Staff is confident that this request represents the community's position. There must be child activity attraction nearby for the sign to be considered. White oaks subdivision is located on Caitlin Drive. Caitlin Drive is a cul-de-sac road. The children in the subdivision gather at the end of the cul-de-sac to play. 4. The installation of the si.qn shall not conflict with any existin.q traffic control devices. The proposed location of the sign will not conflict with any existing traffic control devices. As part of its consent agenda, the Board supported staff's recommendation to submit the following items to VACo for inclusion in their legislative proposal: · Request legislation to provide counties with enabling language to operate farmers' markets. · Request enabling legislation to provide for a scenic protection and tourist enhancement overlay district. · Request legislation to preclude VDOT from erecting towers in the fight of way without permission from the locality. Provide high-growth jurisdictions with management tools for coping with residemial development. Such enabling legislation includes 1) the authority to impose school and road impact fees 2) the authority to adopt adequate public facilities ordinances and 3) provide statewide fimding for a Purchase of Development Rights program for localities who establish and locally fund such a program · Request legislation from the state to broaden the revenue sources available to localities such as a local option sales tax, a reduction in the number of sales tax exemptions and a local option income tax. · Increase state revenues to localities for such joint services as jails, juvenile detention facilities, schools, "Five for Five" legislation which would return five percent of the net Virginia individual income taxes collected in each city and county in Virginia to the locality, and in return, each locality would reduce its real estate taxes by five percent. /ewe COUNTY OF ALBEMARLE EXECUTIVE SUMMARY AGENDA TITLE: Year 2000 Legislative Proposals SUBJECT/PROPOSAL/REQUEST: Legislative Proposals to Submit to VACO STAFF CO NTACT(S): Messrs. Tucker, Davis, Blank AGENDA DATE: July 14, 1999 ACTION: ITEM NUMBER: IN FORMATION: CONSENT AGENDA: ACTION: × INFORMATION: ATTACHMENTS: Yes BACKGROUND: As a continuation of our discussion last Wednesday, staff is providing you with some additional information regarding potential VACO legislative submittals. Specifically, the "Five for Five" initiative being considered by VACO and others. This proposal would return 5% of the net Virginia individual income taxes collected in each city and county in Virginia to the locality, and in return, each locality would reduce its real estate taxes by 5%. As you wil see in the attachment from VACO, Albemarle's net new revenue under this proposal would be $2.336 million based on the 1996 income tax collected and the 1998 real property taxes. DISCUSSION: Albemarle County potential VACO legislative submittals: Request legislation to provide Counties with enabling language to operate farmers' markets. There has been local interest in exploring the possibility of operating a farmers' market in Albemarle, but a recent Attorney General opinion ruled that counties do not have the expressed legislative authority to do so. Request enabling legislation to provide for a scenic protection and tourist enhancement overlay district. As the County pursues options to protect the visual quality of land as an aesthetic and economic resource, this legislation would provide localities with a method to ensure full consideration of visual resources and scenic areas when the County or State makes land use decisions in designated areas. Request legislation to preclude VDOT from erecting towers in the right of way without permission from the locality. Currently, VDOT allows cellular companies to erect towers on their right of way with rental fees accruing to the state. VDOT also uses these towers for their own equipment, such as cameras and road monitoring equipment. GROWTH MANAGEMENT: Provide high-growth jurisdictions with management tools for coping with residential development. (See applicant's sketch plan- Attachment A) Petition: Request for special use permit to allow a dining area addition to the existing church in accordance with Section 10.2.2.35 of the Zoning Ordinance which allows for church building and adjunct cemetery. The property, described as Tax Map 99, Parcel 86, contains 2.022 acres, and is located in the Samuel Miller Magisterial District on the west side of Old Lynchburg Road, Route # 631, approximately 0.25 miles north of the intersection &Route # 631 Old Lynchburg Road and Route # 712 Plank Road. The property is zoned PA, Rural Areas. The Comprehensive Plan designates this property as Rural Area. (See tax map - Attachment B). Character of the Area: The site is located in a wooded rural area with scattered dwellings. The site is mostly open, with gravel parking located around the church. The church is set back almost 200 feet from the state road. SUMMARY AND RECOMMENDATIONS: Staff has ~eviewed this request for compliance with Section 31.2.4.1 of the Zoning Ordinance and recommends approval with conditions. Planning and Zoning History.: None. Comprehensive Plan: This site is designated Rural Area. The church is a surveyed historic structure, probably dating from the late 19th century. STAFF COMMENT: Staff has addressed each provision of Section 31.2.4.1 of the Zoning Ordinance pertaining to approval of special use permits: The Board of Supervisors hereby reserves unto itself the right to issue all special use permits permitted hereunder. Special use permits for uses as provided in this ordinance may be issued upon a finding by the Board of Supervisors that such use will not be of substantial detriment to adiacent property, Staff opinion is that the proposed addition will not be of substantial detriment to adjacent property. The property is well-maintained and the use of the church is periodic. Sunday service is held twice monthly. The dining hall addition will not occasion any additional traffic to the site. The existing congregation consists of 50 regular attendees at the Sunday services, with 100-150 persons attending homecomings 3-5 times/year. There are approximately 150 seats in the existing 40 feet by 40 feet sanctuary. A two story addition built in 1987 contains part of the santuary seating and bathrooms upstairs, and a small dining area and kitchen downstairs. The proposed 24 feet by 35 feet dining hall addition will connect to the existing dining area, and is intended to serve the existing congregation. that the character of the district will not be changed thereby, The dining hall addition will not be very visible from the state road, and will not change the character of the district. and that such use will be in harmony with the purpose and intent of this ordinance, Staff has reviewed the purpose and intent of the Zoning Ordinance, relation to the environment, and relation to Comprehensive Plan as Stated in Sections 1.4, 1.5 and 1.6, and has found this apPlication to be in harmony with these sections. with the uses permitted by right in the district, This property and the adjacent properties are zoned RA, Rural Areas. Staff opinion is that the proposed use is in harmony with the uses permitted by right in the district. with additional regulations provided in Section 5.0 of this ordinance, There are no supplementary regulations for churches. and with the public health, safety and general welfare. Virginia Department of Health approval is needed to acc0¥nodate an enlarged kitchen area and two additional toilets on the existing septic system. There are currently two toilets and a small kitchen area located in a 1987 addition to the church. The Virginia Department of Transportation is recommending that the existing gravel entrance be paved with 30 feet width to the right-of-way line, and that the entrance be raised approximately 8-12 inches to enhance sight distance to the north (currently 385 feet). They also note that the left mm sight distance from Route 631 is not sufficient, however, it will require some major grading or relocating of the entrance to meet proper distance (existing 245 feet). (See VDOT letter -Attachment C). The County Engineering Department is recommending that the entrance is adequate for the existing use. They are recommending: (1) that the church meet with the County or VDOT to look at possible ways to improve the existing entrance and sight distance for the existing congregation, and (2) in the event there is an amendment to the special use permit which involves an increase in the size of congregation, then the necessary improvements to bring the entrance up to commercial standards will be required at that time. (See Engineering Department memo - Attachment D). In further discussion with the Engineering Department, it was clarified that the recommended meeting between the church and the County or VDOT is intended as a means to provide additional information to the applicant, and is not intended to make entrance improvements a required condition. Staff opinion is that the proposed addition will add to the convenience of the existing congregation. Although entrance improvements could be required under the special use permit, it is more appropriate, and in keeping with similar approvals, to require such improvements based on an intensification of use. Staff opinion is that if an increase to the congregation is proposed in the future, then the special use permit should be amended, and a site plan required at that time. 2 SUMMARY: Staff opinion is that this request is in compliance with the provisions of Section 31.2.4.1 of the Zoning Ordinance. Staff recommends approval of the special use permit for the rear dining hall with conditions. RECOMMENDED CONDITIONS OF APPROVAL OF SP 99-012: 1. Health Department approval; 2. This special use permit is for an approximately 840 square foot rear dining hall for the existing congregation. Wachovia is proposing to move the ATM to a freestanding kiosk and to accommodate the relocation of the existing angled parking next to the building, allowing bank customers to enter the bank without having to walk across a lane of traffic PETITION: SP 99-019 WACHOVIA - ATM MODIFICATION- Wachovia Bank petitions the Board of Supervisors to issue a special use permit for drive-in windows [Sections 31.2.4 and 25.2.2.4 of the Zoning Ordinance] associated with an existing bank, on 1.831 acres zoned CO, Commercial Office and EC, Entrance Corridor. Property, described as Tax Map 61, Parcel 122 is located east side of Route 29 [Seminole Trail], in front of and adjacent to Fashion Square Mall (Attachments B and C). This site is located in the Rio Magisterial District and recommended for Regional Service Use in Urban Neighborhood 1. SDP 99-004 WACHOVIA BANK AT FASHON SQUARE MINOR AMENDMENT- Applicant also seeks Planning Commission authorization of an internal circulation waiver [Section 4.12.6.2 of the Zoning Ordinance] for angled parking and one way circulation serving access to drive-through windows and an automated teller machine as described above. CHARACTER OF AREA: The property is located on the eastside of Route 29 [Seminole Trail], in front of Fashion Square Mall (Attachment C). The site is adjacent to commercial property zoned HC, Highway Commercial, on all sides. Brown Oldsmobile Honda is located to west. Fashion Square Mall is located to the south and east. Rio Road Superette is located to the north. This site is occupied by a bank building with associated parking area. The bank is currently in operation. The property entrance is directly off of Route 29, near the intersection of Route 631 [Rio Road]. Access is also gained 'from the Fashion Square parking lot. COMPREHENSIVE PLAN: This area is recommended for Regional Service in Neighborhood 1. Banks are a listed use in Regional Service Areas. This proposal is consistent with the Comprehensive Plan. PLANNING AND ZONING HISTORY: SDP 245 Grading Permit: On July 11th, 1972 A letter to approve grading. SDP 80-243 Site Plan: Approved on Jan 3rd, 1980. SDP 82-004 Site Plan Review Waver of Site Plan Review Requirements: On Feb 23~d, 1982 approved for the installation of angled parking and the ATM on the north side of the building. REASON FOR PLANNING COMMISSION RE.VIEW: The drive-in aspect of this proposal requires special use permit approval be the Board of Supervisors. In accord with the Zoning Ordinance, the Commission must also act on the applicant's request for a modification to allow one-way circulation [4.12.6.2] and angled parking [4.12.6.5c]. STAFF COMMENT: The prior bank had Planning Commission approval of a site plan waiver request (SDP 82-004). The plan submitted includes angled parking and one way circulation. This approval was granted before the Board of Supervisors' adoption of the Amended Zoning Ordinance in February of 1989, requiring the Planning Commission authorization for one-way circulation and angled parking. The applicant seeks these necessary approvals with this application. No additional drive-through lanes are proposed. Staff will comment on the special use permit and site plan minor amendment separately. SP 99-019 WACHOVIA - ATM MODIFICATION Recommendation: Staff has reviewed this request for compliance with the provisions of Section 31.2.4.1 of the Zoning Ordinance and recommends approval subject to conditions. Staff Analysis: Staff will address each provision of Section 31.2.4.1 of the Zoning Ordinance. The Board of Supervisors hereby reserves unto itself the right to issue all special use permits permitted hereunder. Special use permits for uses as provided in this ordinance may be issued upon a finding by the Board of Supervisors that such use will not be of substantial detriment to adjacent property, The proposed use will not have a detrimental affect to other by-right uses on adjacent properties. The prior bank's drive-through use existed for a number of years with no detrimental affect to other by-right uses of adjacent properties. that the character of the district will not be changed thereby, The proposed site is located within an intense commercial district. Banks and associated drive- throughs are consistent with other uses in the district. The Proposed site is also subject to Albemarle Cotmty Architectural Review Board [ARB] review. The applicant was required to submit proposed development for ARB review. No major conflicts were identified during the ARB review and approval was granted. and that such use will be in harmony with the purpose and intent of this ordinance, Staff has reviewed this request for compliance of Section 1.4, Section 1.5, and Section 1.6 of the Zoning Ordinance and finds no conflict. with the uses permitted by right in the district, Staff has identified that the proposed drive-through is accessory to a by-right use and is in harmony with other by right uses located in this primarily commercial district. with additional regulations provided in Section 5.0 of this ordinance, Section 5.0 of the Zoning Ordinance provides no additional regulations. and with the public health, safety and general welfare. The Site Review Committee has identified no adverse affect on public health, safety, and general welfare. The Department of Engineering finds no major internal traffic circulation concerns with the proposed development. The increase in impervious surface was not significant enough to be of concern. (Attachment E). The Virginia Department of Transportation [V.D.O.T] has not identified any major traffic concerns (Attachment F). Summary~: Staff has identified the following factors which are favorable to this request: 1. Consistent with the provisions of the Comprehensive Plan; 2. Consistent with Section 32.2.4.1 of the Zoning Ordinance; 3. Consistent with prior use of the facility; 4. The proposed use will not cause substantial detriment to adjacent properties; and, 5. The proposed use will not change the character of the district. Staff has not identified any factors which are unfavorable to this request. Staff finds that the existing use of angled parking and one way access to the ATM island and drive-through windows is an acceptable and expected accessory to a bank. Recommended Action: Staff recommends approval of the ATM and drive-through windows with conditions. Recommended Conditions of Approval: Drive-through windows will be limited to five [5] (Four traditional and one ATM window). SDP 99-004 WACHOVIA BANK MINOR AMENDMENT The Site Review Committee has reviewed this site plan and may grant administrative approval subject to the Planning Commission waivers of Section 4.12.6.2 of the Zoning Ordinance [One- way circulation] and Section 4.12.6.5c of the Zoning Ordinance [Angled parking]. While the angled parking is to be relocated next to the building, the proposed one-way circulation will not change the pattern that currently exist on site. The applicant is requesting a waiver for one-way internal circulation, due to the use of the drive- through windows (Attachment G). Section 4.12.6.2 of the Zoning Ordinance states, "One-way circulation aisles shall not be permitted, except that the commission may approve one-way circulation in such case where the same is necessitated by the peculiar character of the site or of the proposed use such as but not limited to uses involving drive-in windows and automobile laundries". A one-way circulation waiver was not necessary at the time of Planning Commission approval of the site plan in 1980. Since the existing use has ceased, the applicant must obtain a waiver to reestablish use. The Site Review Committee has reviewed the applicant's proposal for installation and maintenance of control devices such as bypass lanes, signage, and pavement markings, and recommends approval of the internal circulation waiver request. The applicant is also requesting continued use of angled parking (Attachment G). Section 4.12.6.5c of the Zoning Ordinance states, "Where practical considerations warrant, the Commission may authorize other angled, curvilinear, and/or parallel parking". An angled parking waiver was not necessary at the time of Planning Commission approval of the site plan in 1980. The Engineering Department has reviewed this proposal and finds no major conflict with the proposed layout of the eight angled parking which now provides handicap access to the walks serving the building. Planning Staff recommends approval of the angled parking waiver request. Recommended Action: Staff has reviewed this request for compliance with the provisions of the Zoning Ordinance and recommends approval of the internal circulation waiver request and the angled parking waiver request, subject to the following conditions: Recommended Conditions of Approval: Applicant is responsible for installation and maintenance of control devices such as by- pass lanes, signage, and pavement makings as indicated on the site plan amendment; and, 2. THOMAS JUNE 1, 1999 JULY 14, 1999 SP 99-20 FREE UNION COUNTRY SCHOOL Applicant's Proposal: Free Union Country School is seeking approval to expand enrollment from the current limit of 60 (55 students, 5 staff), approved under SP 90-82, to 90 (76 students, 14 staff), at the existing location. The school is also asking for an extension of the approval term for the special use permit to five years, to allfow for fundraising and planning prior to construction of new school facilities. Attachment A is a location map; Attachment B is the approved site plan; Attachment C is the applicant's justification; Attachment D is the extension request. Petition: Request to amend an existing special use permit to increase enrollment at a private school in accordance with Section 10.2.2.5 of the Zoning Ordinance which allows for private schools in the RA, Rural Area district. The property, described as Tax Map 29 Parcel 15D, contains approximately 4.76 acres, and is located in the White Hall Magisterial District at 4220 Free Union Road (Route 601), approximately 1/4 mile south of the intersection of Routes 601 and 665 (Buck Mountain Road). The property is zoned RA, Rural Areas. The Comprehensive Plan designates this property as Rural Area in Rural Area 1. Character of the Area: In the past, Free Union was a designated village; prior to that designation, a more intensive development had developed than that generally found throughout the Rural Area. Maupin's Grocery, Free Union Post Office, Shelter Associates, a doctor's office, and a furniture maker are located on Free Union Road to the west of this site, as well as numerous small residential parcels. To the south is Georgetown Farm, a large commercial farming operation that is part of the Moorman's River Agricultural/Forestal (A/F) District. RECOMMENDATION: Staff has reviewed this request for compliance with the provisions of section 31.2.4.1 of the Zoning Ordinance and recommends approval with conditions. Staff also recommends approval of the extension request, with conditions. The Board of Supervisors hereby reserves unto itself the right to issue all special use permits permitted hereunder. Special use permits for uses as provided in this ordinance may be issued upon a f'mdine by the Board of Supervisors that such use will not be of substantial detriment to adjacent property_, Staffhas visited the area and is of the opinion that the impact on surrounding uses will be minimal and, in fact, the amended use may not generate noticeable effects. The increase in enrollment will be confined to the existing site; no new acreage is involved with this request. As previously mentioned, the school has indicated that it intends to construct a new building to accommodate the increase to 90 students/staff. Upon approval of this special use permit, however, an incremental increase in enrollment would probably occur, utilizing the current facilities. School representatives have stated that they feel it would be undesirable to try to accommodate all 90 users without additional construction, and therefore enrollment is not expected to approach 90 until new space is available. that the character of the district will not be changed thereby, This school was originally approved when Free Union was designated as a village. Like the development around it, the school probably represents a more intensive use than those encouraged under the current intent of the Rural Areas district, which is: Preservation of agricultural and forestal lands and activities Water supply protection Limited service delivery, and Conservation of natural, scenic, and historic resources. Acknowledging the fact that the school already exists, staff finds no real detriment to the Rural Area from its expansion. Because the school parcel and curriculum will not change under this special use permit amendment, the character of the district is not expected to change. The activity level on the site will intensify with the increased enrollment, but the operation will remain essentially the same: pre-school (ages 3 and 4) through 5~h grade. Although the school use fully occupies the 4.76 acre property, in staff's opinion it is more desirable to confine such a use to a small parcel than to further infringe upon the uses intended for the Rural Area, such as agricultural and forestal activities. Additionally, as explained below, the proposed school population of 90 is the maximum number of allowable users for the community well. Thus, there is a natural limit to occupancy on site, and with approval of this special use permit, it will have been reached. (see Attachment F, letter from Department of Health, Water Programs) and that such use will be in harmony with the purpose and intent of this ordinance, 3 Staffhas reviewed the purpose and intent of the ordinance as stated in Sections 1.4, 1.5 and 1.6. Staff finds no conflict with these provisions of the ordinance. Staff notes that this request to establish a day care facility forwards the intent of the ordinance as stated in the following Sections: 1.4.3 "To facilitate the creation of a convenient, attractive and harmonious community;" 1.4.4 "To facilitate the provision of adequate police and fire protection, disaster evacuation, civil defense, transportation, water, sewerage, flood protection, schools, forests, playgrounds, recreational facilities, airports and other public requirements;" While this is not a public use, it does serve a public need which some localities provide governmentally. with the uses permitted by right in the district, The school expansion as proposed will not restrict permitted uses on adjacent property. Although there will be an increase in traffic with the expanded enrollment, the road improvements will make right tums into the site safer and thus mitigate at least some of the traffic impact. with additional regulations provided in Section 5.0 of this ordinance, Past approvals have required the school to comply with Section 5.1.06, which sets forth: "No such use shall operate without any required licensure by the Virginia Department of Welfare as a child care center. It shall be the responsibility of the owner/operator to transmit to the zoning administrator a copy of the original license and all renewals thereafter and to notify the zoning administrator of any license expiration, suspension, or revocation within three (3)days of such event. Failure to do so shall be deemed wilful noncompliance with the provisions of this ordinance;" and with the public health, safeW and general welfare. There are no major issues affecting public health and general welfare associated with this application. In fact, it should make a positive contribution to the above-cited criteria. The most significant potential safety issue is related to traffic. Increased enrollment will generate increased traffic, although the parents' regular carpooling arrangements somewhat offset this impact. Presently there are four school carpools operating, each transporting an average of five students. VDOT has also recommended construction ora turn and taper lane, which in staff's opinion is warranted based on the school's location on the curve and the impending intersection to the northwest. The mm and taper lane can be expected to help mitigate the traffic impacts, and the school has indicated that it is willing to comply with the VDOT request. The Trip Generation Manual, published by the Institute of Transportation Engineers, does not address a school category like this one. A day care use can be expected to generate approximately 408 vtpd (vehicle trips per day), 74 vtph (vehicle trips per hour) per peak morning hour, and 74 vtph per peak afternoon hour. A public elementary school is shown as generating 1.02 trips/student/day, for a total of 78 vtpd. A single family detached residence (typical for a parcel of this size in this district) can be expected to generate 10 vtpd. None of these calculations calculation seems accurate for this school, and in fact, at the time of preparation of this report, the school was conducting a count at its entrance. While the traffic generated on-site will be significantly greater than that anticipated with a residence, staff opinion is that it can be adequately accommodated in this area. As previously mentioned, the school's waterworks [well] permit limits use to 90 persons (students and staff combined), and thus the requested enrollment increase also is a firm ceiling for the school's ultimate size. The Thomas Jefferson Health District has indicated by its March 9, 1999 that with modification, the existing septic system can serve up to 90 users. (see Attachment G) SUMMARY: Free Union Country School has operated for 15 years without adverse impacts to surrounding properties or the general public. Its enrollment is naturally limited by the availability of water and septic capacity. It is providing a service to families in the Rural Area who want an alternative to public education. (There is no public elementary school in the vicinity of this site.) Staff finds no adverse noise or visual impacts to the adjacent community, and although limited in ultimate capacity, the site can adequately support this use. RECOMMENDED ACTION: Staff recommends approval of SP 99-20 and the request for extension of the approval period to 5 years, subject to the following conditions: Recommended Conditions of Approval: If licensure is not required by the State Department of Welfare, this approval shall constitute a waiver of Section 5.1.6(a) of the Zoning Ordinance, set forth below: No such use shall operate without any required licensure by the Virginia Department of Welfare as a child care center. By using the same daily water-use estimates on which we defined the school's population early last year, the additional 220 gallons of sewage capacity would appear to allow the school to increase its population by twenty-two (22) individuals at ten (I0) gallons-per-day each. Please understand that this applies to faculty, staff, elementary, students, and half-day (4 hours per day) preschoolers. If Free Union Country Day School ever opts to offer preschool day-care for the entire day. your overall enrollment will be affected and you need to contact the Health Department in such an event. The League of Women Voters has appeared before the Planning Commission to voice environmental concerns about CPA 97-05: Brass, Inc. Those concerns centered around the need to protect the Moore's Creek watershed. We reiterate the importance of run-off control through BMPs and minimization and disconnection of impervious surfaces, as recommended by the Water Resources Manager. Tonight, while we agree with the proposed Comprehensive Plan amendment, we urge you to recall the Sustainability Accords of the Thomas Jefferson Sustainability Council. The League was among the first to 'sign on' to these accords. We refer you to the accord that affirms: "Optimize the use and re-use of developed land. Promote clustering in residential areas and the integration of business, industry, recreation, residential and open space." Further, under the heading, "Land Development," the goal states: "Building is concentrated in Charlottesville and established village centers (also called growth areas) and sustainability is considered in all land use planning decisions." We believe that putting a "big box" retail store on the site is the wrong concept and is an underutilization of the land. The recommendation of the staff for some residential development, with areas of second-story living space above a portion of the retail, could prove to be very marketable as well as accessible to moderate income individuals and families. We also support the recommendations of the Planning Commission for a design incorporating clustered smaller buildings. This development, done with foresight and ingenuity, could go a long way toward meeting the retail shopping needs of residents in southern Albemarle while serving as a village center. This seems to be a logical site for the establishment of a village center, as described in the Sustainability Accords. Unlike a big box retail monolith, such a center would complement. already existing neighborhoods and the well-established village center of Scottsville. This is the time, the place, to decide what is best for the environment, already existing neighborhoods, and the County as a whole.
