STAFF CONTACT(S): Cilimberg, Wade ACTION: X INFORMATION: CONSENT AGENDA: ACTION: INFORMATION: ACHMENTS: Yes BACKGROUND: The applicant, Ms. Leslie Wood, has requested a Home Occupation Class A HOCA (applicant request - Attachment A) modification for the number vehicle trips and to sell retail items for her residence at 5896 Railroad Avenue in Crozet (location map - Attachment B). As this would be wholly located within the primary structure and have no additional employees this does not necessitate a special use permit for a Home Occupation Class B. Home Occupation Class A is typically administered administratively with the condition of no more than seven trips (visits) per week and only allows items that have been hand -made to be sold on site. The applicant plans to conduct massage therapy under this Home Occupation Class A. The applicant would also like to sell items such as skin care products, moisturizers, toners, lotions etc. to clients. Ms. Wood is requesting a modification to allow up to seven clients per day (14 trips per day). Additionally, the applicant has requested to be able to conduct retail sales. DISCUSSION: The applicant is seeking a modification of Section 5.2.2.11A (Attachment C) of the Zoning Ordinance for home occupations, which states, "No traffic shall be generated by such a home occupation in greater volumes than would normally be expected in a residential neighborhood, and any need for parking generate by the conduct of such home occupation shall be met off the street." The applicant is also seeking a modification to Section 5.2.2.1.c (Attachment C) of the Zoning Ordinance which specifies, "there shall 2 be no sales on the premises, other than items hand crafted on the premises, in connection with such home occupation; this does not exclude beauty shops or one -chair barber shops." The lotion and moisturizer Ms. Woods desires to sell are not hand made. Zoning assumes the normal residential traffic to be 10 vehicle trips per day and will allow one additional guest (or client) per day (seven per week), stipulating that these trips should be spread out through the week. No classes/group sessions are allowed without modification. The supplemental regulations governing home occupations do no permit Zoning to administratively increase the number of trips beyond their standard. The Planning Commission has the authority to grant waivers and modifications to the supplemental regulations. Staff has evaluated this request based on the transportation impacts to Railroad Avenue and to the neighborhood. The applicant is requesting up to seven clients per day. This will generate an additional fourteen (14) trips per day. The majority of additional trips will take place when the neighbors will be at work. The potential impact of the increased traffic is similar to certain by -right uses within residences, most particularly a day care serving up to five children (a special use permit is required for a daycare serving 6 or more children). A "by -right" daycare could generate an additional twenty trips (4 trips/child) per day in addition to the vehicle trips normally associated with a home. As previously noted, the applicant's proposed massage therapy business would generate an additional 14 trips per day in addition to those trips normally associated with the home. There will be no traffic associated with the home occupation before 9:00 a.m. and after 5:30 p.m. (trips will be spread out throughout the day), no weekend hours and no medical procedures performed at the home. Railroad Avenue's most current daily traffic count is 1,700. Railroad Avenue is currently experiencing no congestion and staff believes the additional trips associated with the home occupation would not create any traffic related issues. All parking will be able to take place in Ms. Wood's driveway. There will be no on -street parking associated with this home occupation. Ms. Wood is also anticipating up to one delivery to her home per week via UPS or FedEx for product in the operation of her business. The applicant has received support from some residents of Railroad Avenue. (Attachment D) Zoning concluded in their comments (Attachment E) that this business is more suited to a commercial district and suggests that when the next Neighborhood Model ZTA is considered, it may contain some limited commercial uses by special use permit in the R- 6 district. Zoning believes it would be difficult to regulate retail sales (other than products handcrafted on the premises) and that allowing "open retail" would generate even more traffic than just the clients who are coming to the residence for services. Therefore, staff does not recommend the sale of retail items on the premises. SUMMARY AND RECOMMENDATIONS: While staff does not believe the transportation impacts of the services proposed are greater than would normally be expected in a residential neighborhood, staff does not believe the retail sales can be regulated. Therefore, staff can support the modification of Section 5.2.2.1.d regarding traffic, but cannot support modification of Section 5.2.2.1.c regarding retail sales. Also, while the applicant has requested extending hours to 7:00 pm on Tuesdays and Thursdays, staff believes operating hours should end at 5:30 pm (M-F) to avoid other impacts. Staff recommends the approval of HO 2007-26 with the fallowing conditions as verified by Zoning: 1. Clients may only be on the property between the hours of 9:00 a.m, and 5:30 p.m. (Monday -Friday); 2. Appointments shall be scheduled with a minimum of 15 minutes between clients; Only one client shall be on the premises at a time; 4. No more than seven clients per day for five days (Monday -Friday); 5. No appointment may be scheduled on the premises on Saturday or Sunday emergency or otherwise; and 6. Charlottesville, VA 22902-4596 Juan: This is a request for Home Occupancy A with modifications. I was advised to include this cover letter stating the modifications that I want to pursue as well as applicable points pertaining to the modifications. The following are the modifications that I am asking for: 1. 1 would like to see an average of 5-7 clients per day instead of the requisite 5-7 clients per week. 2. 1 would also Iike to be able to do a retail business. The items to follow are specifics of the aforementioned items: 1 The business will start as Massage Therapy and then be turned into a Day Spa offering Massage, Esthetician, and Nail Technician services. 2 Operating hours will be from 9.00 a.m. to 5:30 p.m. and on Tues and Tburs there is the possibility of hours extending to 7:00(equivalent of one extra client but not exceeding the average). 3. There is a separate entrance/exit on the backside of the property and available parking spaces. When it moves to Day Spa status there may be less than 5-7 clients in a day. There will only be two cars on premises at any one time (one leaving and the other arriving), however, my schedule should be such that there is only one car at a time (enough space between appointments that leaving car will already be gone upon others arrival). 4. Retail sales will include products that are used on the client so they may Use them at home & sales will generally come from clients purchasing products when they Ieave (so there really shouldn't be extra "traffic" generated from this endeavor). 5. In the distant future there may be the possibility of an office assistant being required and I would at that time file a Home Occupancy B with Special Use Permit as I have been advised to do per the department permit planners.
