Dear Mr. Dise;
This is to confirm our telephone conversation of this week. It is my opinion that the above noted
property consists of six separate parcels of record. Each parcel is entitled to five development
rights based on a minimum of two acres per development right. Actual development shall comply
with the zoning and other development regulations in effect at that time.
The basis for this decision is a finding that the County Real Estate Department combined all six
tracts into one tax map/parcel number. Therefore, this administrative practice for the convenience
of our record keeping did not actually combine the tracts or forfeit development rights.
By copy of this letter to Gay Carver in the Real Estate Department, I am informing her that the
parcels can be separated out as described in the deeds. These deeds generally describe the
property as follows:
1) A tract containing 161.9 acres, known as the Maddox Horne Place;
2) A tract of 24 acres, known as a portion of the Wheeler tract;
3) A,tract of 16 acres;
4) A tract of 120 acres, known as the John B. Day tract;
S) A tract of 10 acres; and
6) A tract of 249 acres.

If you are aggrieved by this determination, you have a right to appeal it within thirty (30) days of
the date notice of this determination is given, in accordance with Section 15.1-496.1 of the Code
of Virginia. If you do not file a timely appeal, this determination shall be final and unappealable.
An appeal shall be taken only by filing with the Zoning Administrator and the Board of Zoning
Appeals a notice of appeal which specifies the grounds for the appeal. An appeal application must
be completed and filed along with the fee of $95. The date notice of this determination was given
is specified above.
