Dear Ms. Cain:
You have asked for a letter that provides an analysis of the zoning and other information
regarding the referenced property. This letter is based on a review of our records and an
inspection of the site.
1. The property is zoned. PUD, Planned Unit Development.
2. The property is in the EC, Entrance Corridor Overlay District and Airport
Protection Overlay District.
This is a Planned Unit Development approved under Special Use Permit 446 on
September 1975.
4. On December 18, 1985 the Board of Supervisors approved a Special Use Permit
85-75 to allow a motel limited to 160 rooms and restaurant limited to 50 person
seating capacity. Variance 86-06 was approved April 9, 1986 to allow relief of
the required parking space from 187 to 172 provided. Variance 86-12 was
approved on July 9, 1986 to increase the allowable square footage of a directional
sign from 4 square feet to 100 square feet. A copy of the variances and special
use permit are enclosed.

Dear Sir:
The Albemarle County Board of Supervisors, at its meeting on
December 18, 1985, unanimously approved the above mentioned
Petition. The approval is subject to the following conditions:
1. Motel limited to 160 rooms and restaurant limited to 50
person seating capacity;
2. Compliance with conditions of ZMA-80-26 and SP-80-63 with
the agreement that a bond is to be posted in the amount
determined by the County Engineer for construction of
Section 3 of the Branchlands collector road prior to site
plan approval; construction plans for Section 3 of the
Branchlands collector road must be submitted to the County
Engineer, and reviewed by the County Engineer and Virginia
Department of Highways & Transportation to the extent
necessary to accurately establish an accurate bond prior to
site plan approval; and
3. The access road to the site, stormwater detention
provisions, and utility plans for servicing the site, and
their interrelation to the overall plans for the PUD, shall
all be considered as part of the site plan review and
approval.

4.12.6.6.2 of the Albemarle County Zoning Ordinance

Dear Sir:
This letter is to inform you that on July 8, 1986, during
the regular meeting of the Albemarle County Board of Zoning.
Appeals, your application for VA-86-12 was approved.
This variance approval allows relief from Section 3.0 of
the Albemarle County Zoning Ordinance to increase the allowable
square footage of directional sign from four (4) square feet
to one hundred (1.00) square feet, a variance of ninety-six (96)
square feet with the condition that no other signs will be lo-
cated at the entrance.

5. The directional sign height of 25' is legally nonconforming with the current sign
ordinance which allows a maximum height of 12' for a freestanding sign...
6. This project was built under a site development plan 1986- 021 approved on June
6, 1987. The landscaping plan for this site was approved on December 17, 1987.
A copy of the approved site and landscaping plan where mailed to the applicant
on January 19, 2005.
7. A review of our records does not show any unresolved zoning or building code
violations and /or complaints.
8. The property was inspected for zoning compliance on January 20, 2005. One
discrepancy between the approved landscaping plan and the actual site was
identified. The required plantings/trees that are shown on the landscape plan have
been removed adjacent to the building and around the boundary of the parcel to
the northeast and southeast of the site.
This violation can be abated by either replacing the landscaping or bonding the
required landscaping for site compliance. No other violations were identified.
9. The property was granted a certificate of occupancy on January 18, 1989. It is the
policy of this department to purge building permit files after three years. Copies
of certificates of occupancy are maintained on microfilm. Therefore, we have not
retained any paper copies of certificates of occupancy associated with this project.
You may obtain a copy of a certificate of occupancy for an additional fee of
$25.00. The absence of a certificate of occupancy for the project will not give
rise to any enforcement action. A certificate of occupancy will only be required
to the extent of any construction activity in the fixture.
