At your request, this office has examined our records with respect to the zoning status of the
above -referenced (5) parcels situated in the Rio Square Magisterial District of Albemarle County
Virginia, which property is commonly known as the Branchlands Retirement Village (collectively
the "Property"). WHSB, LLC is purchasing the Property and pursuing a loan from Wachovia
Multifamily Capital, Inc. concurrent with this zoning confirmation request.
1) The Property is zoned Planned Unit Development (PUD), and according to Section
20.3.1 of Chapter 18 of the Albemarle County Code Multiple Family Dwellings are
permitted By Right within this zoning classification.
2) There are no known outstanding zoning violations with respect to the Property and there
are no pending administrative, legislative orjudicial proceedings which would in any
manner adversely affect the status of the current zoning for the Property.
3) The Property is not located within any overlay districts or special assessment districts.
4) Parking on the Property complies with the current zoning classification.

connection with their purchase of the above -referenced real estate (the "Property") and its
financing through Wachovia Multifamily Capital, Inc (the "Lender"). The Lender has requested a
Letter of Zoning Compliance.

of Zoning Compliance.
Please assist us by reviewing your records for the Property and advise us as to the following
