Johnson; TMP 94-41A Dear Mr. Shepherd: PHONE: 434-977-9666 FACSIMILE: 434-977-0326 We believe the above -referenced tax parcel in Albemarle County has 8 development rights calculated as set forth below. We enclose the fee of $40.00 for the determination of development rights of TMP 94-41A. The last instrument of record for TMP 94-41A prior to December 10, 1980 that includes a plat or metes and bounds description is a Deed dated June 26, 1980 from Elizabeth B. Anderson, as grantor, to Dennis Lee Johnson and Karen S. Johnson, as grantees and recorded in Deed Book 695 Page 598, reserving to Elizabeth B. Anderson a life estate. This Deed transfers 79.149 acres, as described on the plat of William S. Roudabush, Inc. dated June 17, 1980, a copy of which is enclosed. Pursuant to a Deed dated April 10, 1985 and recorded in Deed Book 833 Page 423, Dennis Lee Johnson transferred all of his interest in the property to his wife, Karen S. Johnson, as her sole and separate property. There are no other plats or deeds of record with respect to this parcel. Elizabeth B. Anderson died in 2001, thereby terminating her life estate. The entire 79.149 acres in Albemarle County has not been previously subdivided at any time since December 10, 1980. Therefore, the parcel has 5 division rights of lots of a minimum of 2 acres each. Assuming the minimum lot size, there remains 69.149 acres, into which 3 lots of a minimum of 21 acres each could be divided, or a total of 63 acres.
