The Purchasers have asked that the Seller provide a Determination letter from your office confirming the number of Development Rights, as part of the Study Period. We believe that the property has three (3) Development Rights. This is based on the fact that I spent several years attempting to do a By -Right Division of this property. We got as far as the final approval process before the project was abandoned because of prohibitive road construction costs. I believe that we had a Determination done at that time, but I cannot find a record in my files. Regardless, I do not think we would have gotten as far as we did without having the 3 development rights that we assumed to have with this parcel. Please confirm at your earliest convenience, and let me know if you have any questions. I ordered a title search done, which provided plats and instruments dated after 1980 (which are included). However, despite the fact that the title search went back to the 1920s, we were unable to find any recorded plats or metes and bounds descriptions of the subject property prior to 1980.
