TMP 136-13
Dear Mr. Shepherd:
We believe the above -referenced tax parcel in Albemarle County has 4
development rights calculated as set forth below. We enclose the fee of $40.00 for the
determination of development rights of TMP 136-13.
The last instrument of record for TMP 136-13 prior to December 10, 1980 that
includes a plat or metes and bounds description is a Deed dated August 4, 1977 from
George W. Tapscott, et al., to Charles and Margaret Helwig and recorded in Deed Book
627 Page 521. This Deed transfers 3 separate parcels, including the subject Parcel 1
containing at that time 46.09 acres, as described on the plat of Robert L. Lum dated July
31, 1977, a copy of which is enclosed.
This same 46.09 acre parcel was subdivided in 1986, with the residual parcel of
42.605 acres retaining all of the development rights as set forth on the subdivision plat of
Robert Lum dated March 5, 1986. The 3.485 acre parcel was transferred by Mr. and Mrs.
Helwig to Gary and Brenda Williams pursuant to a Deed dated April 2, 1986 and
recorded in Deed Book 872 Page 723. Mr. and Mrs. Helwig transferred this same 42.605
acre parcel to Robert R. Foster pursuant to a Deed dated May 10, 1989 and recorded in
Deed Book 1048 Page 128. Mr. Foster further subdivided this 42.605 acre parcel and
transferred a 2.002 acre parcel to Jeffrey and Christie Schmick by a Deed dated October
2, 1991 and recorded in Deed Book 1180 Page 449, leaving a residuary parcel of 40.603
acres, which was further reduced by a boundary line adjustment in which another 0.148
acres was transferred by Mr. Foster to Mr. and Mrs. Schmick by Deed dated October 27,
1993 and recorded in Deed Book 1364 Page 65, leaving a parcel of 40.455 acres. By a
Boundary Agreement dated August 26, 1997 and recorded in Deed Book 1637 Page 649,
the subject parcel was determined by survey to have 40.32 acres. By Deed dated August
1, 1997 and recorded in Deed Book 1637 Page 655, Robert Foster transferred this 40.32
acre parcel to James and Joan Norwood. By Deed dated July 2, 2004 and recorded in
Deed Book 2791 Page 139, Mr. and Mrs. Norwood transferred this same 40.32 acre
parcel to applicants, NasrolIah and Kristie Fatehi. There are no other plats or deeds of
record with respect to this parcel.
As of December 10, 1980, the parcel consisted of 46.09 acres. Therefore, at that
time, the parcel had 5 development rights of lots of a minimum of 2 acres each, plus 1
additional development right on the remaining 36.09 acres, for a total of 6 development
rights. Two parcels have been divided and sold from the original parcel, leaving 4
development rights.
