Chris & Matt,
Just wanted to follow up with you on Woodlawn, as we'll be submitting the revised Subdivision plat per your
comments but also subsequent to recordation of the Forest& Open Space Easement, which we will be moving
forward with asap(and so we can denote the recorded document on the plat, which addresses `Engineering
Comment no. 1'). Yes, that is what you need to do.
One item I want to clarify, so we're all on the same page, is the intended nature of the SWM Facility
easements. The HOA is responsible to maintain these stormwater management facilities. These easements
merely permit the County access to and the ability to maintain the stormwater management facilities onsite in
the event the HOA fails to do so. This is required by the ordinance to ensure the Health, Safety, and Welfare of
these residences. These easements are addressed in the C&R document and will be `private'. That's fine, leave
them as such in the legal doc as it was already review/approved the County Attorney. They are labeled `private'
on the plat, but our survey note 8 was not edited to exclude these from being public. I spoke to the County
Engineer, he requested you leave note#8 as it is. We will remove the SWM facility reference from note 8 and
will maintain their indication as `private' on the plat. (This pertains to Engineering comment no. 2) Please
remove"private" from the SWM facility easements labeled on sheet 2. Leave note#8 as is. That's all.
Matt—I believe you may have spoken with Chip recently regarding dedication deed for public drainage
easements . . this will be addressed and provided accordingly. Please provide the deed of dedication to me in his
place. I'll send it off to the County Attorney for review. Thanks

signed Deed will then need to go to the County Attorney and the County Executive for signatures and will be returned to

Dear Mr. Perez:
We have reviewed all of your comments and made the necessary revisions. Please find our
responses to the comments below in bold lettering.
1. [14-403, 18-4.6.1, 18-13.3] Minimum Lot Frontage. Lot 2 shall have a minimum of
250 feet of frontage on Woodlands Road. Currently it only has 246.88 feet. Revise.
RESPONSE: Frontage increased; please note that in addition to the 249.92'line
bearing SE, Curve 16 (L=5') is also part of the lot boundary.
2. [14-428] Dedication of Streets. The approved preliminary subdivision plat depicts
the frontage of lot 2 on Woodlands Rd being dedicated to public use; however, the

RESPONSE: Note 2 revised.
4. [4.6.5] Rear Yards. Lot 8 is provided a rear yard; however, this is a corner lot thus
this yard shall be a side. Revise.Also, the rear setback for lot 6 appears to be
incorrectly dimensioned at 25 feet; however, it shall be 35 feet.
RESPONSE: Lot 8 (and Lot 1 as clarified with Chris Perez) now have 2 sides and
2 front setbacks (from SB is 75'along ex. Woodlands).

S. [14-302(B)(5)] Zoning. Provide the zoning of the property.
RESPONSE: Zoning listed in /with note 1. Zoning also noted now on Sheet 2
(bottom center).
6. [14-302(A)(10)] Right of further division. Provide the following note: "Lots 1, and
3-8 are assigned 1 development each and may not be further divided. The residue
of Tax Map/Parcel 44-12W (Lot 2) is retaining 1 development right and may not be
further divided".
RESPONSE:Added- see note 16.
7. [14-303(A)] Statement of consent to division. Changes to the State Code and to the
County of Albemarle Subdivision Ordinance require changes to the consent to
division statement. Please revise the statement to read: "The platting or dedication
of the following described land [insert correct description of the land subdivided] is
with free consent and in accordance with the desire of the undersigned owners,
proprietors and trustees, if any." Revise.
RESPONSE: Consent revised as noted above.
If the applicant would like to continue utilizing the previous ordinance language:
"Any reference to future potential development is to be deemed as theoretical. All
statements affixed to this plat are true and correct to the best of my knowledge and
belief." Please utilize it as a separate note on the plat. Revise.
RESPONSE: Language omitted.
8. [14-302(A)4&5] Drainage Easements. Label all drainage easements as either public

We need to process a refund of$355 for a tier II groundwater study review, which was mistakenly charged
during the preliminary sub plat review (see CV snipp below). This mistake became evident during my review of
the final plat(SUB2017-11) as they need a Tier III ground water study. They plan to submit the reportand
review fee soon but have asked that we merely accept the difference between the two fees. I am not sure if this
is something yall can or will do, or if you want to just process a full refund for the study and accept a check for
the full amount for the new studies review.

I've researched your question. It appears at prelim plat stage of the review I incorrectly required a tier II review fee and
conducted the tier II report ourselves.Then during my review of the final plat it became evident that I had you pay for
the wrong study at the prelim stage of the plat. Because of this the County will issue you a refund of the Tier II study
fee. We still need the Tier III study from you and applicable fee prior to final plat approval.

Forest&Open Space Easement limits disturbance of the area covered, but that these areas are not always'common'
areas, which is the scenario for Woodlawn. In this case,ownership of the easement area will be transferred with the
conveyance of the encumbered lots (Lots 6 and 7). So, currently those lots are in the name of the developer, but will

hypothetically be transferred upon evelopment of the home sites. Is there a preferred way to address this comment in
light of our understanding of the ownership?

I am not sure there is truly a Level A or B. Maybe you are mistakenly referencing Section 17-1003 Sections A
&B as types of studies? Regardless, attached is an example of a tier III study we need. It needs to be a full
study, not a draft. We also need the $548 review fee with the study.

aim for a smooth submittal 2, so I'd like to seek your input relative to setbacks for Lot 8 and Lot 1. You provided
comment no. 4 noting that Lot 8 is a corner lot and therefore should have a side-yard set-back on its east line (versus the
originally implied 35' rear yard SB). Does this apply to the 35'SB we show for Lot 1 as well? I've attached a PDF clip of
the areas with red-lines to help convey the question. Let me know your thoughts.

date by the County Attorney's office. The Code may found on the County Attorney's website which may be found under
"Departments and Services"at Albemarle.org.
In accord with the provisions of Section 14-229(B)of Chapter 14 of the Code if the developer fails to submit a revised final
plat to address all of the requirements within six(6)months after the date of this letter the application shall be deemed to
have been voluntarily withdrawn by the developer.

Does the above ref plat have an approved &bonded road plan?
Does the above ref plat have an approved &bonded WPO plan?
Your only comment on the above referenced plat was "1. The Forest& Open Space Easement will need to be
recorded and the Deed Book information filled in on Note 15 on sheet 1 and on the label on sheet 2. "
The bonding of these two items matters for my approval of the final plat.
Please speak to this aspect of the proposal.

Dear Mr. Perez:
The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced plan as submitted by Timmons Group, dated 26
January 2017, and offers the following comments:
1. Please add a note stating that sight distance easements are dedicated to public use and
shall be kept clear of visual obstructions, including but not limited to fences, structures,
and landscaping.
2. Please revise Note 8 to state that public right-of-ways are to be dedicated to the locality
(Albemarle County) for public use.

A VDOT Land Use Permit will be required prior to any work within the right-of-way. The
owner/developer must contact the Charlottesville Residency Transportation and Land Use
Section at (434) 422-9399 for information pertaining to this process.
