Main Street, Suite M Charlottesville, VA 22902 RE: SDP2017-25 Field School of Charlottesville Phase I - Initial Site Plan; Revision 1 dated 7/7/2017 Dear Mr. Shimp: Pursuant to Section 32.4.2.5 of Chapter 18 of the Code of the County of Albemarle (hereinafter "County Code"), the above referenced initial site plan has been disapproved. This action has been taken because the site plan does not comply with all applicable requirements. Specifically the plan fails to satisfy the following Sections of Chapter 18 of the County Code and Special Use Permit (hereinafter "SP") 2015-24: [SP2015-24, County Code §§ 2.1.1, 10.2.1, 10.2.2, 32.5.2(s) & 36.1(a)] The SP was not phased, the approval of the SP did not allow for the construction of the ball fields prior to the construction of all of the other improvements specified in the SP, and there are improvements that were specified with the SP or would be required with the full buildout of the project specified in the SP that are not being proposed with this initial site plan. Therefore, in order to ensure that the improvements provided with Phase I are sufficient to meet the needs of the proposed uses of Phase I, it is necessary to explicitly specify on the site plan what those uses will be. Without these notes the use would be deemed a separate use and require a SP for swim, golf, tennis or similar athletic facilities (10.2.2.4). Therefore, address the following: • Revise the "Proposed Use" statement to state "Private school ballfield (67 YD x 107 YD) as per SP201500024. For Field School of Charlottesville sporting event use only." • Revise the ITE Trip Generation note to include at the beginning the following sentence: "The ball fields are for Field School of Charlottesville private school sporting events use only, as authorized by Special Use Permit SP201500024". • If non -sporting events are to be held at the site, and/or if the field is to be used by any other group or organization for sporting events, then revise the ITE Trip information to include those uses and/or organizations. Any additional uses or organizations could necessitate the inclusion of the turn lanes in Phase I of the project. 2. [SP2015-24 Condition #5, County Code §§ 32.5.2(k), 32.5.2(s) & 36.1(a)] SP Condition #5 states that "No construction for the use shall begin without written approval of the proposed septic facilities from the Virginia Department of Health." In order to ensure that no Phase I uses or improvements will impact the future drainfield locations, and to allow the Virginia Department of Health to review the proposed drainfield location, the primary and reserve drainfields for Phase II (full buildout) of the project must be shown on the Phase I initial site plan. [SP2015-24 Condition #5, County Code §§ 4.1, 32.5.2(k), 32.5.2(s) & 36.1(a)] SP Condition #5 states that "No construction for the use shall begin without written approval of the proposed septic facilities from the Virginia Department of Health." Neither the approved Special Use Permit nor the County's Zoning Ordinance address or anticipate septic systems other than those served by subsurface drainfields. Therefore, only bathrooms served by a subsurface drainfield will be allowed by the County. Provide a note on the initial site plan that states, "If bathroom facilities are provided they must be serviced by subsurface drainfields." 4. [SP2015-24 Condition #1 (d), SP2015-24 Condition #1 (e), County Code §§ 32.5.2(p) & 36.1(a)] SP Condition #1 states that "Development of the use shall be in general accord with sheet four (4) of the concept plan entitled `Special Use Concept Plan and Exhibits for Field school of Charlottesville'..." and goes on to list five specific major elements shown on the concept plan. Two of those major elements can be incorporated with Phase I and must be incorporated in Phase I in order to ensure that the items specified are preserved and provided. Those two major elements are "d. Preservation and installation of tree buffers as indicated" and "e. Preservation of wooded areas and slopes outside of building and sports field envelopes as indicated". Listing the "Landscaping, Buffer, and Design Notes Per SP 201500024:" on sheet C5 of the 7-7-2017 resubmission of the initial site plan does not specifically state that they will be included with Phase 1. This is even more evident considering that the "Buildings:" portion of the note is not being built until Phase II. No information on Sheet C5 of the resubmission of the initial site plan specifies at which phase each of these SP major elements will be provided. Also, without showing the buffer areas on the initial site plan, clearly delineating their areas and providing all associated notes and labels, it cannot be ensured that they will be preserved and provided as the SP specifies. Therefore, revise Sheet C5 of the initial site plan so that the labels, notes and hatching for all of the required buffer and landscape requirements specified in SP2015-24 are shown to be provided in Phase I or provide a new initial site plan sheet to do so. In accord with the provisions of Section 32.4.2.5(e) of Chapter 18 of the County Code the developer shall submit the corrected or modified plan within fifteen (15) days after the date of the notice of disapproval and the submittal of a reinstatement fee of $86. The date of disapproval is the date of this letter. If a revised plan is received the agent shall act on the corrected or modified plan within forty-five (45) days after it was submitted. If a revised plan is not received within fifteen (15) days a new application and fee shall be required for the submittal of a plan. In accord with Section 32.4.2.6 of Chapter 18 of the Code, this decision may be appealed. Please contact me at your earliest convenience if you have any questions or require additional information.
