HomeMy WebLinkAboutSP201600025 Action Letter Special Use Permit 2017-04-12 COUNTY OF ALBEMARLE TRANSMITTAL TO THE BOARD OF SUPERVISORS SUMMARY OF PLANNING COMMISSION ACTION AGENDA TITLE: AGENDA DATE: SP201600025 Regents School of Charlottesville April 12, 2017 SUBJECT/PROPOSAL/REQUEST: STAFF CONTACT(S): Amendment to Special Use Permit(SP2014-5) Benish, Perez, and McDermott for School of Special Instruction to omit condition #9(the SP shall expire on Aug 13, 2017). PRESENTER(S): Removing the sunset clause will allow the school Perez more time to find a suitable location to relocate. No increase in enrollment or modifications to the school are requested. BACKGROUND: At its meeting on February 7, 2017,the Planning Commission voted of 5:0:2(Spain, Dotson absent)to recommend approval of SP-2016-00025 with the conditions outlined in the staff report with a modified condition#9 from SP2014-5 as follows: "SP-2014-5 shall expire on August 13, 2021". The Commission's action letter, staff report, and minutes are attached(Attachments A, B, and C). DISCUSSION: The staff report was slightly modified to correct two errors in information, changes can be found on Pages 3&4 in red.These minor changes do not modify staffs recommendation or analysis. To date, available traffic information does not indicate there is a significant traffic issue resulting from the increased enrollment previously approved. However,the assessment is based on one year and 10 months of date(or nearly two full school years). RECOMMENDATIONS: Staff recommends that the Board adopt the attached Resolution (Attachment D)to approve the special use permit, subject to the conditions contained therein. The applicant must now pay the required fee for this application to be further processed for review. The fee required for SP-2016-00025 is$1075.00 Please provide a check to the front office staff in the Department of Community Development for the amount noted above, payable to the "County of Albemarle", by no later than Tuesday November 15t, 2016 If this fee is received after Tuesday November 1st then your application will be processed with the next round of application submittals. Submittal Schedule Also, please provide a copy of this email along with your check as verification that your fee can be accepted. ADDITIONAL FEES REQUIRED BUT NOT DUE AT THIS TIME. Please note that there will be at least one public hearing by the Planning Commission and one public hearing by the Board of Supervisors. Virginia State Code requires that notice for public hearings be made by publishing a legal advertisement in the newspaper and by mailing letters to adjacent property owners.Therefore, at least two fees for public notice are required before a Special Use Permit may be heard by the Board of Supervisors. The total fee for public notice will be provided to you after the final cost is determined and must be paid before the application is heard by a public body. Staff estimates the total cost of legal advertisement and adjacent owner notification to be between $400 and $450 per hearing. This estimate reflects the average cost of public notice fees for Special Use Permit applications, but the cost of certain applications may be higher. If applicable any fees for waiver/special exceptions will be required at the time the additional fees noted above are calculated.The current fee for a special exception is $457.
